Lindborg To permit the construction of a four-story commercial office build- ing, pursuant to Section 9451 of the Huntington Beach Ordinance Code; located at the southeast corner of Second Street and Olive Avenue in a C3, General Business District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-37 on May 27, 1975 by the Environmental Review Board. Mr. Rex Hoover was present to represent the applicant. He requested a continuance of this matter for two weeks until July 23, 1975. Sterling Buck & Associates To permit the construction of a 58-unit apartment building, pur- suant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code; located at the north end of Keelson Lane, west of Elm Street, in an R3, Medium -High Density Residential District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-27 by the Environmental Review Board on May 6, 1975. The Chairman presented a request from the applicant to have this matter withdrawn. ON MOTION BY CROSBY AND SECOND BY SPENCER, USE PERMIT NO. 75-38 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 75-37 (Continued from July 2, 1975) Applicant: Leonard 0. Lindborg To permit the construction of a 17-unit apartment building pursu- ant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code; located on the west side of Holly Street approximately 235 feet south of Garfield Avenue, in an R3, Medium -High Density Residential District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-46 by the Environmental Review Board on July 8, 1975. The Chairman opened the Public Hearing. Mr. Rex Hoover was present on behalf of the applicant. He submitted a revised plan showing the building setback an additional four feet from the previous plan. There being no other parties present to speak for or against the pro- posal, the Chairman closed the Public Hearing. ON MOTION BY CROSBY AND SECOND BY SPENCER, USE PERMIT NO. 75-37 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOW- ING VOTE: BZA 7-9-75 Page 2 Minutes, Huntington Beach Board of Zoning Adjustments July 9, ,1975 Page 3 A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan and elevations received July 9, 1975 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. 3. In accordance with the City's Master Plan of Streets and Highways, an additional five feet of right-of-way on the alley shall be dedicated. 4. Soils and compaction reports shall be submitted by a cer- tified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm sys- tems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. All development fees shall be paid. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Holly Street and the alley shall be improved to the center- line of such right-of-way. Said improvement shall include BZA 7-9-75 Page 3 Minutes, Huntington Beach Board of Zoning Adjustments July 9, 1975 Page 4 curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air condi- tioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respec- tively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. An engineering geologist shall be engaged to submit a re- port indicating the ground surface acceleration from earth movement for the project property. 5. All structures proposed for construction within this sub- division shall be constructed in compliance with the g-factors as indicated by the geologist's report. 6. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City for review. 7.- The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 75-03 Applicant: Mahaffey Brothers To permit a tentative parcel map to create a two -parcel subdivi- sion, pursuant to Section 9920 of the Huntington Beach Ordinance Code; located between Delaware Avenue and England Street approxi- mately 435 feet south of Yorktown Avenue, in an R2, Medium Density Residential District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-47 by the Environmental Review Board on July 1, 1975. Mr. Mahaffey was present. The Board discussed with him their con- cern about the possibility of cars backing onto Delaware Street from the subject property. Items of dedication on England Street and the recording of a final parcel map were discussed. ON MOTION BY CROSBY AND SECOND BY SPENCER, NEGATIVE DECLARATION NO. 75-47 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY SPENCER, TENTATIVE PARCEL MAP NO. 75-03 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: A. TO BB COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on June 12, 1975 shall be the approved layout. A parcel map shall be filed with the Department of Public Works and approved by that Department, and recorded with the Orange County Recorder (prior to final inspection). 3. A copy of the recorded parcel map shall be submitted to the Planning Department. 4. Thirty feet of England Street shall be dedicated to City standards at the time said parcels are developed. 5. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed (if such systems exist within 200 feet of said parcels). 6. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are devel- oped (if such systems exist within 200 feet of said parcels). 7. All utilities shall be installed underground at the time said parcels are developed. 8. All applicable City Ordinances shall be complied with. Also, to permit a three foot reduction of the required ten foot ground clearance per Section 9763.3(b) of the Huntington Beach Ordinance Code; located on the west side of Gothard Street, approximately 100 feet north of Edinger Avenue, in a C4, Highway Commercial Dis- trict. The Chairman informed the Board that this application is a Categori- cal Exemption, Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. Lee was present. He submitted a request to have the Conditional Exception No. 75-25 withdrawn. ON MOTION BY COPE AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 75-25 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 75-26 Applicant: Marc Spitz To permit an additional 8 square feet of sign area to an existing freestanding pole sign, in lieu of Section 9764.3.1.1 of the Huntington Beach Ordinance Code; located at the north side of Atlanta Avenue approximately 200 feet east of Brookhurst Street, in a C2, Community Business District. The Chairman informed the Board that this application is a Categori- cal Exemption Class III, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing. Mr. Marc Spitz was present. He explained to the Board that from a business standpoint it was important to have some identification concerning his location and his service as a podiatrist. He felt the present sign on the property did not fulfill his needs. The Board explained to the applicant the fact that the present sign was previously approved to the property owner's satisfaction and unless some demonstrable hardship was proven, it would be inequit- able to approve this request. Board Member Spencer suggested the applicant discuss his problem with the property owner. There being no other parties present to speak for or against the proposal, the Chairman closed the Public Hearing. ON MOTION BY COPE AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 75-26 WAS DENIED ON THE FOLLOWING BASES, BY THE FOLLOWING VOTE: 1. The proposed additional square footage on the existing free- standing pole sign, if granted, would constitute a grant of special privilege. 2. The proposed request is not predicated upon any unusual circum- stances or a sufficient hardship. Johnson To permit the relocation of an existing overhead electrical service, pursuant to Section 9730.9(a) of the Huntington Beach Ordinance Code; located at 6381 Fallingwater, Huntington Beach. The Chairman informed the Board that this application is a Categ- orical Exemption, Class I, California Environmental Quality Act, 1970. The Board discussed the plan submitted by the applicant and found it to be in proper order. ON MOTION BY COPE AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-98 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received July 7, 1975 shall be the approved layout. 2. The applicant shall install a service panel to facilitate con- version to underground utilities at a future date, pursuant to Section 9730.11 of the Huntington Beach Ordinance Code. FINDINGS OF THE BOARD: The Board has considered all guidelines for approval of overhead utilities and all criteria have been satisfied pursuant to Section 9730.10 of the Huntington Beach Ordinance Code. The Board briefly discussed the requested special event and felt it was necessary to request additional information from the appli- cant. The Board reviewed the subject request and discussed the Con- ditions of Approval. ON MOTION BY SPENCER AND SECOND BY CROSBY, SPECIAL EVENT NO. 75-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: 1. The plot plan received July 9, 1975 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be re- quired prior to the event. 4. A certificate of insurance form shall be filled in the Fin- ance Department five (5) days prior to the event. AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE SIGNS Applicant: Shorecrest AMC/Jeep To permit one pole sign 8-feet by 23 feet 4 inches, one wall sign 4 feet by 41 feet, and one wall sign 2 feet by 9 feet 3 inches; located at 15751 Beach Boulevard. The Board reviewed the proposal for the three signs. Discussion ensued concerning the sizes and justification for them. ON MOTION BY SPENCER AND SECOND BY CROSBY, THE ABOVE -NOTED SIGN REQUEST WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: 1. The sign plan received July 9, 1975 shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code.
