The Chairman noted that this application was continued from the August 13 meeting. The Chairman informed the Board that this application was granted Negative Declaration No. 75-57 by the Environmental Review Board on August 5, 1975. No one was present to speak on the application. It was noted that, according to the plot plan, although the three spaces for parking on the alley side have been reduced to two spaces, the application still exceeds the minimum requirements for the pro- posed use. The Board further discussed the fact that this project exceeds the recreational and open space requirements for the down- town area. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 13, 1975 shall be the approved layout. In its approval action, the Board of Zoning Adjustments con- sidered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. In accordance with the City's Master Plan of*Streets and Highways, two and one-half feet of right-of-way on the alley plus a twenty foot radius at the corner shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be sub- mitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. The developer shall participate in the local drainage assessment district. 7. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: Olive Street, 19th Street and the alley shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air condition- ing is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 5. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 6. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. To permit the construction of an approximate 15,000 square foot office building, pursuant to Section 9471.4 of the Huntington Beach Ordinance Code, located at the northwest corner of Glencoe Street and Beach Boulevard, in a C4, Highway Commercial District. The Chairman reminded the Board that this matter had been con- tinued from August 13, 1975. He further informed the Board that this application was granted Negative Declaration No. 75758 by the Environmental Review Board on August 12, 1975.., Mr. Steve Hawkins and Mr. Randy Blanchard were present on behalf of the applicant. The Board reviewed the April 15 plot plan and agreed that it complied with the city's code. The landscaping plan was discussed. It was emphasized that a foot of landscaping must be installed for each foot of building encroachment. ON MOTION BY CROSBY AND SECOND BY PALIN, NEGATIVE DECLARATION NO. 75-58 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: CROSBY, PALIN, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 75-106 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: A. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 75-32 Applicant: Mola Development Company To permit all required visitor parking to be located on -street in lieu of Section 9320.10(d) of the Huntington Beach Ordinance Code, on property located at the northeast corner of Alabama Street and Venice Avenue, in an R2, Medium Density Residential District. He further stated that Conditional Exception No. 75-32 was a categorical exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Milton Morrow, an adjacent property owner, was present as an interested spectator, as his property is adjacent to the applicant's along the rear. There being no other parties present to speak for or against the proposed construction in the applications, the Chairman closed the public hearing. ON MOTION BY CROSBY AND SECOND BY PALIN, NEGATIVE DECLARATION NO. 75-62 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY LIPPS AND SECOND BY CROSBY, USE PERMIT NO. 75-42 AND CONDITIONAL EXCEPTION NO. 75-32 WERE CONTINUED UNTIL SEPTEMBER 3, 1975 IN ORDER TO CONTACT THE DEVELOPER, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 75-119 Applicant: Robert Chavez To permit the establishment of a temporary parking lot, pursuant to Section 9730.29 of the Huntington Beach Ordinance Code, on property located on the north side of Pacific Coast Highway at Huntington Avenue, in an R5, Professional -Office District. The Chairman informed the Board that this application is a categorical exemption, Class I, California Environmental Quality Act, 1970. The Chairman noted that Mr. Chavez had verbally agreed at an earlier date to have this matter withdrawn. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 75-119 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES• PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE BZA 8-20-75 Page 7 Minutes: Huntington Beach Board of Zoning Adjustments August 20, 1975 Page 8 TENTATIVE PARCEL MAP NO. 75-9 Applicant: John Irwin To permit a three -lot subdivision, pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, on property located at the southeast corner of Garfield Avenue and Magnolia Street, in a C2, Community Business District. The Chairman said that this application was granted Negative Declaration No. 75-44 by the Environmental Review Board on June 17, 1975. Mr. Irwin was present at the meeting. He stated that they are not ready to develop the larger parcel at this time. The Board explained the necessity of dedications on Magnolia and Garfield being made to the City either prior to, or concurrently with, the recording of the parcel map. The applicant stated he did not see any problem with making dedications now on the three parcels. The applicant inquired about the city's requirements to place a temporary facility on Parcel 2 which is anticipated as a bank- ing facility. The Chairman explained that the city's code does not have any requirements as to a temporary facility, but that the requirements for a permanent structure would apply. ON MOTION BY CROSBY AND SECOND BY PALIN, NEGATIVE DECLARATION NO. 75-44 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY PALIN, TENTATIVE PARCEL MAP NO. 75-9 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on August 12, 1975 shall be the approved layout. 2.. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Magnolia Street and Garfield Avenue shall be dedicated to City standards. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. AYES: CROSBY, PALIN, LIPPS NOES: NONE ABSENT: NONE MISCELLANEOUS: CONDITIONAL EXCEPTION NO. 75-25 Applicant: Lee Electric Sign Company To permit the location of a free-standing sign within five feet of an interior property line, in lieu of the required 20 feet, per Section 9763.3(a) of the Huntington Beach Ordinance Code. Also, to permit a three-foot reduction of the required ten -foot ground clearance, per Section 9763.3(b) of the Huntington Beach Ordinance Code. The Secretary of the Board stated that Mr. James R. Mahoney was present and has requested permission to address the Board on his application (CE No. 75-25) for possible reconsideration. He stated that there was additional information which had not been presented to the Board at the prior meeting and which may have an effect on the request. Mr. Mahoney stated that the view corridor from Edinger had been reduced by a prior encroachment on Bob's Big.Boy, the south driveway had been relocated at the re- quest of the Board at the time of original approval, the shopping BZA 8-20-75 Page 9 Minutes: Huntington Beach Board of Zoning Adjustments August 20, 1975 Page 10 Conditional Exception No. 75-25 center in question could not afford a reduction of one parking space for location of the sign at the center of their frontage along Gothard Street, and that the leasing program was extremely slow and there was a need for identification from Edinger Avenue. Board discussion followed. ON MOTION BY PALIN AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 75-25 WILL BE RECONSIDERED AT THIS MEETING AT THE REQUEST OF THE APPLICANT. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Additional discussion followed, in which the Board reviewed the prior encroachment, location of driveways, ownership of parcels within the shopping complex, criteria for approval of identifica- tion sign, and prior action by the City on approval of all phases of this shopping center. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 75-25 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. Sign shall not be located any closer than eight (8) feet to the south property line. 2. The front leading edge of the sign shall not project beyond a line created by a southerly projection of the screening wall. 3. No additional free-standing identification and/or adver- tising signs will be allowed for this complex on Gothard. FINDINGS OF THE BOARD: 1. The sign will not adversely affect other signs located in the vicinity as the Board had previously conditioned at the time of granting a conditional exception of Nurseryland that no additional signs would be allowed for that use and Bob's Big Boy has no free-standing sign on'Gothard. 2. The sign theme, design and character is in keeping with the architecture of the center and will not be•detrimental to other properties located in the vicinity. The sign as con- ditioned will not obstruct pedestrian or vehicular visibility at either the driveway entrance into the center in question, nor Bob's Big Boy. In its review the Board considered the criteria for free- standing identification signs, pursuant to Section 9761.9.3, which requires that signs be located within landscaped areas and to do so on this property along the frontage at the required setback from the side property lines would require the elimination of one additional parking space. 4. The Board also considered the encroachment allowed on Bob's Big Boy and the view corridors of visibility from the inter- section of Gothard and Edinger and felt that the prior encroachment allowed has reduced that view corridor considerably. 5. The driveway location on the property was mandated by the City by a subsequent revision and the landscaping areas at such intersection were approved by the City for relocation to the southerly property line. 6. The land in question upon which Handyman, Bob's, Nurseryland, and the shopping center in question is under one ownership and the City has previously conditioned on prior conditions for division of land reciprocal ingress and egress for a total integrated shopping center. 7. The applicant indicated that their leasing program is extremely slow, which indicates an urgent need for the sign, pursuant to Section 9763.4.4 of the Huntington Beach Ordinance Code. Ludwick The Board discussed the fact that it has been determined that the developer's plan is deficient in the required open space, pursuant to Article 931 of the Huntington Beach Ordinance Code. Also, it was the consensus that the developer might wish to file a second application, which would be for a conditional exception, in con- nection with this layout.
