Ludwick To permit the construction of a six -unit apartment building, pursuant to Section 9162.3.1 of the Huntington Beach Ordinance Code, on property located on the west side of Ash Street, approximately 385 feet south of Cypress Avenue, in an R2, Medium Density Residential District. The Chairman informed the Board that this application was granted Negative Declaration No. 75-15 by the Environmental Review Board on July 22, 1975. The Chairman opened the public hearing. The Board discussed the recommendation of the Planning Department concerning the first condition of approval which involves the revised conceptual plan received August 12, 1975. There being no one present to speak on this matter, the Chairman closed the public hearing. ON MOTION BY PALIN AND SECOND BY CROSBY* USE PERMIT NO. 75-8 WAS APPROVED WITH THE FOLLOWING CONDITION, BY THE FOLLOWING VOTE: -1- BZA 8/27/75 Minutes: H.B. Board of Zoning Adjustments Wednesday, August 27, 1975 Page 2 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: The revised conceptual plot plan, received August 12, 1975, shall be the approved layout if the Huntington Beach Ordinance Code is amended to reduce the amount of open space required, or if the applicant is successful in having a conditional exception application granted; or, the plot plan received August 1, 1975 shall be the revised approved layout should the Huntington Beach Ordinance Code not be amended to reduce the amount of required open space and the applicant not be successful in pursuing the August 12, 1975 plot plan approval. All prior conditions of approval are to remain in effect. AYES: Palin, Crosby, Lipps NOES: None ABSENT: None USE PERMIT NO. 75-43 Applicant: Pacific Southwest Realty Company To permit the construction of four (4) drive -up teller windows, pursuant to Section 9472 of the Huntington Beach Ordinance Code, on property located on the west side of Brookhurst Street, approximately 150 feet south of Adams Avenue, in a C4, Highway Commercial District. The Chairman noted that this application is a categorical exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the Public Hearing at approximately 1:25 P.M. Since there were no parties present to spe-: i-_r- or against the proposed construction, the Chairman tabled this item. About 3:00 P.M. Mr. R. Wayne Smith, the applicant's representative, and Mr. David Robinson, reLresenting the owner of the shopping center, arrived at which time this item was reopened. The lease is in the process of being reviewed by the landlord and negotiations are underway. The possibility of the applicant buying, rather than leasing, the subject property was discussed and the applicant was informed by the Board that application would have to be made to the Board again in such event. There being no one who wished to speak for or against the proposal, the Chairman closed the public hearing. The Board noted that this plan would require a reduction in parking. ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 75-43 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 6, 1975 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works for that area north of the proposed facility as shown on the approved plan. B. GENERAL CONDITIONS: 1. A copy of the executed lease shall be filed with the City prior to issuance of building permit. FINDINGS: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. To permit a 600 square foot addition to an existing shopping center; pursuant to Section 9472 of the Huntington Beach Ordinance Code, on property located at the southwest corner of Goldenwest Street and Warner Avenue, in a C4,,Highway Commercial District. The Chairman remarked that this application is a categorical ex- emption, Class III, California Environmental Quality Act, 1970. The public hearing was opened by the Chairman. Mr. James Albright was present on behalf of the applicant. He stated that the sporting goods store is in need of additional store space and that is the reason for the planned addition which is to be constructed on the rear of the present building. There being no parties present to speak for or against the proposed addition, the Chairman closed the public hearing. The Board reviewed the plan and discussed the proposed Conditions of Approval. ON MOTION BY LIPPS AND SECOND BY PALIN, USE PERMIT NO. 75-44 WAS AP- PROVED WITH THE FOLLOWING CONDITIONS, BY TH" TCI-LOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plct plan and elevations, received August 7, 1975, shall be the approved layout. The Chairman commented that this application is a categorical exemption, Class V, California Environmental Quality Act, 1970. There was no one present in connection with this application. After discussion by the Board, the following motion was made: ON MOTION BY PALIN AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 75-33 WAS CONTINUED TO SEPTEMBER 3, 1975 IN ORDER FOR THE APPLICANT TO BE PRESENT, BY THE FOLLOWING VOTE: AYES: Palin, Crosby, Lipps NOES: None ABSENT: None CONDITIONAL EXCEPTION NO. 75-34 Applicant: David E. Monlon To permit an 8-foot encroachment into the required 25-foot corner cut-off in lieu of Section 9103.4.1 of the Huntington Beach Ordinance Code, on property located at the southwest corner of Aladdin Drive and Wetherly Lane, in an Rl, Low Density Residential District. The Chairman reported that this application is a categorical exemption, class III, California Environmental Quality Act, 1970. Also present was Rosemary Smith of 4085 Aladdin Drive, spokesman for the Wetherly Bay Property Owners Association. The Chairman announced and read a letter in opposition to the application from Arthur W. Knox. Mr. Monlon explained that he had previously submitted his plans to the Wetherly Bay Property Owners Association and acquiesced to their recommended changes before submitting this application. Mrs. Smith explained the actions of the Association in connection with Mr. Monlon's proposed change and the fact that the Association's Board of Directors, as well as the members, found no fault with the pro- posed plan. They felt it was unnecessary for a resident, who does not live in the'area governed by the Association, to comment on their actions. Mr. Monlon vehemently expressed his feeling that a board should have some flexibility in applying the code. There were no other parties present who wished to speak on this subject, so the Chairman closed the public hearing. The Board discussed other individual cases in this area who had made similar changes and who were able to meet'the requirements of the code. ON MOTION BY PALIN AND SECOND BY CROSBY', CONDITIONAL EXCEPTION NO. 75-34 WAS CONTINUED UNTIL SEPTEMBER 10, 1975 WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: Palin, Crosby,'Lipps NOES: None ABSENT: None TENTATIVE PARCEL MAP NO. 75-10 Applicant: Wilfred Schryer To permit a two -lot subdivision, pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, on property located at the north- west corner of Springfield Street and Pine Street, in an Rl, Low Density Residential District. The Chairman apprised the Board that this application was granted Negative Declaration No. 75-65 by the Environmental Review Board on August 26, 1975. Ron Winterbtrn was present on behalf of the applicant. The Board discussed proposed conditions of approval with Mr. Winterburn. The Chairman noted that this application was granted Negative Declaration No. 75-64 by the Environmental Review Board on August 26, 1975. Mr. Ron Winter burn was at the meeting to represent the applicant. The Board reviewed the plan and discussed the conditions of approval being prclosed. ON MOTION BY CROSBY AND SECOND BY LIPPS, NEGATIVE DECLARATION NO. 75-64 WAS ADOPTED, AND TENTATIVE PARCEL MAP NO. 75-7 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on August 8, 1975 shall be the approved layout. 2. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City ordinances. 8. The property shall participate in the local drainage as- sessment district at the time'said parcels are developed. 9. A copy of the recorded parcel map shall be filed with the Planning Department. B. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a mini- mum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of'R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wirf, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and na.t`,al gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth move- ment for the project property. 5. All structures proposed for construction within this sub- division shall be constructed in compliance with the g- factors as indicated by the geologist's report. 6. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City for review. Board of Zoning Adjustments Wednesday, August 27, 1975 Page 9 ADMINISTRATIVE REVIEW NO. 75-122 Applicant: Simon and Harriet Goban To permit an addition to an existing dwelling, pursuant to Section 9231.6 of the Huntington Beach Ordinance Code, located at the southeast corner of 13th Street and Olive Avenue, in an R4, High Density Residential District. The Chairman mentioned that this application is a categorical exemption, Class III, California Environmental Quality Act, 1970. Ms. Harriet Goban was present at this meeting. The Board reviewed the plan and noted that, rather than a 500 square foot addition, it is only a 260 square foot addition. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-122 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan, received August 14, 1975, with the modifications thereon, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to n-cpprty and improvements in the immediate vicinity; Past administrative action regarding this property. 2. All applicable fees shall be paid prior to issuance of building permits. 3. Bloome To permit the construction of approximately 9,500 sq. ft. of retail shopping center, pursuant to Section 9472 of the Huntington Beach Ordinance Code, on property located on -the west side of Beach Boulevard, approximately 110 feet north of Ellis Avenue, in a C4, Highway Commercial District, at 18455 Beach Boulevard. IN CONJUNCTION WITH: TENTATIVE PARCEL MAP NO. 75-04 Applicant: Valley Consultants, Inc. To permit a tentative parcel map to create a two -parcel subdivision, pursuant to Section 9920 of:the Huntington Beach Ordinance Code, on property located on the west side of Beach Boulevard, approximately 150 feet north of Main Street; in a C4, Highway Commercial Business District. The Chairman noted that both of these applications are covered by Negative Declaration No. 75-51 which was granted by the ERB on August 19, 1975. The Chairman opened the public hearing. Mr. Jerry Jeeves, the Manager of the Denny's restaurant at Main Street and Ellis Avenue; Mr. James Turner, who is an adjacent property owner; and Mr. Ron Winterburn representing the applicant, were present. The Board discussed the easement for the storm drain going over the property. It was noted that there will be only one driveway on Beach for this site. Denny's Restaurant has abou- narking spaces in the right-of-way to the front of their building, reported Mr. Jeeves. lie said that he hoped further discussions with Mr. Mark C. Bloome could be held regarding a possible reciprocal parking agreement. Mr. Winterb urn reported that"a retaining wall will be constructed along the northerly and westerly sides of the site, but not on the southerly side. The public hearing was closed. The Board indicated that the storm drain should be reflected on the plan, as well as the 20 feet to be used for reciprocal ingress and egress. The Chairman noted that this is a categorical Exemption, class III, California Environmental Quality Act, 1970. He further noted it was continued from March 19, 1975. The Board reviewed the proposed plan and discussed the required improvements, as well as the dedications for right-of-way. ON MOTION BY LIPPS AND SECOND BY PALIN, ADMINISTRATIVE REVIEW NO. 75-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: -13- BZA 8/27/75 Minutes: H.B. Board of Zoning Adjustments Wednesday, August 27, 1975 Page 14 A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan received August 21, 1975 and the elevations received August 26, 1975 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity Past administrative action regarding this property. 2. In accordance with the City's Master Plan of Streets and Highways, an additional two and one-half feet of right-of- way on the alley shall be dedicated. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be'submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Eighteenth Street and the alley shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements.
