CONDITIONAL EXCEPTION NO. 75-33
Applicant: Gene Engel
To permit a three and one-half foot encroachment into the required
five-foot side yard, in lieu of Section 9103.2.1 of the Huntington
Beach Ordinance Code, located at the southwest corner of Meander
Lane and Rath Circle, in an Rl, Low Density Residential District.
Gene Engel, the applicant, was present.
The Chairman informm!d the Board that this project is a Categorical
Exemption, Class V, California'Environmental Quality Act, 1970.
The Chairman opened the public hearing.
Mr. Engel addressed the Board stating reasons of beautification
of his property, preservation of privacy, and protection from
burglary as his purposes in constructing the patio encroachment.
There being no other persons present to speak for or against the
conditional exception', the public hearing was closed.
The Board reviewed the request with the applicant, taking into con-
sideration the configuration of the lot, the setbacks to the patio
structure, and the general layout of the tract in which the project
is located. It was noted that there are other lots within the
subdivision having the same model house on rectangular lots which
would not be permitted to construct this type of structure.

Applicant: Mola Development Company
To permit the construction of a five (5) unit apartment building
pursuant to Section 9162.3.1 of the Huntington Beach Ordinance
Code, located at the northeast corner of Alabama Street and Venice
Avenue in an R2, Medium Density Residential District.
The Chairman informed the Board that Negative Declaration No. 75-62
has been granted for this project by the Environmental Review Board
on August 19, 1975.
ON MOTION BY LIPPS AND SECOND BY PALIN, THE BOARD ADOPTED NEGATIVE
DECLARATION NO. 75-62 WITH THE RECOMMENDATIONS OF THE ENVIRONMENTAL
REVIEW BOARD, BY THE FOLLOWING VOTE:

Vincent C. Moretti and Bob Ringstrom were present to represent the
application.
The Chairman reopened the public hearing. There being no persons
present to speak for or against the project, the public hearing was
closed.
Board discussion ensued, including required street dedication and the
possibility of reciprocal drives. The applicants were informed that
reciprocal drives would necessitate filing a Tentative Parcel Map for
the project.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received July 29,
1975, shall be the approved layout, subject to the modifi-
cation:
a. Onsite parking shall be shown on the plot plan.
A plan delineating said modification shall be submitted
to the Secretary of the Board. If such plan complies
with the modification outlined by the Board, said plan
shall be approved and made a permanent part of the
administrative file.
In its approval action, the Board of Zoning Adjustments consid-
ered the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements
in the immediate vicinity;
Past administrative action regarding this property.
2. The following plan shall be submitted to the Secretary
of the Board:
Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public
Works.
3. In accordance with the City's requirements, an additional
two and one-half (2-1/2) feet of right-of-way on the alley
shall be dedicated, and a twenty (20) foot turning radius
shall be dedicated at the street intersection.
4. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to
the Department of Building and Community Development and
shall be subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the Hunt-
ington Beach Fire Code. Plans for such systems and devices
shall be submitted to the Fire Department and shall be subject
to approval by the'Departments of Fire and Public Works.

6. The developer shall participate in the local drainage assess-
ment district.
7. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. The,alley, Alabama Street and Venice Avenue shall be im-
proved to the centerline of such rights -of -way. Said improve-
ment shall include curbs, gutters, sidewalks, paving, street
trees, street lights, street signs, street drainage, and
sewer and water main extensions, in full compliance with the
,City of Huntington,Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. If the developer, proposes. to provide _,air conditioning, , the
insulation in ceilings and exterior walls, shall be a minimum
of R-19 and R-ll,'respectively. if no air conditioning is to
be provided the in_,sulation tin ceilings and exterior walls
shall be a minimum of'R-13 and R-7, respectively.
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed of
at an offsite facility equipped to handle them.
3. Natural gas and 220V electrical shall be stubbed in at the
locations of`.clothes; dryers, and natural gas shall be stubbed
in at the locations of cooking facilities, water heaters,
and central heating units.
4. An engineering geologist shall be engaged to submit,a re-
port indicating the'ground surface acceleration from earth
movement for the project property.
5. All structures proposed for'construction within this sub-
division shall be constructed in compliance with the
g-factors as indicated by,the geologist's report.
6. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for
review.

CONDITIONAL EXCEPTION NO. 75-32 (In Conjunction with UP 75-42)
Applicant: Mola Development Company
To permit all required visitor parking to be located on -street in
lieu of Section 9320.10(d) of the Huntington Beach Ordinance Code,
located at the northeast corner of Alabama Street and Venice
Avenue in an R2, Medium Density Residential District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Board, 1970.
Vincent G. Moretti and Bob Ringstrom were present to represent the
application.
The Chairman reopened the public hearing. There being no persons
present to speak for or against the proposed project, the public
hearing was closed.
Board discussion ensued. The applicants indicated that it is
possible to get the required landscaping and open space onsite
and still provide the onsite parking, but they hoped to increase
the open space even further by moving the guest parking to the
offsite location.
ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION
NO. 75-32 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. Applicant has failed to show sufficient hardship to justify
granting of the exception.
2. Approval of this Conditional Fxception would establish an
undesirable precedent for projects of a like nature.

Applicant: Business Properties
To permit a sign height of 3016" in lieu of the required 2510"
(Section 9764.3.2) and ground clearance of 5'0" in lieu of the
required 10'0" (Section 9763.3(b), located at the southwest
corner of Bolsa Avenue and Goldenwest Street in a C2, Community
Business District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
Charles Ball was present to represent the application.

The Chairman opened the public hearing.
Mr. Ball addressed the Board, indicating that experience has shown
that the previously allowed sign area has proven inadequate to pro-
vide identity & visibility for the shops located within the center.
There being no other persons -to speak for or against the project,
the public hearing was closed.
The ensuing Board discussion included sight distances, possibility
of rearranging the panels on the existing sign, the sign area per-
mitted by code for this location, and the problem the center has of
operating under one sign code directly across the street from a
different jurisdiction operating under a differing sign code.
Mr. Palin noted that justification of the exception upon economic
grounds would require a comprehensive 'report on the leasing program
of the center from its inception, with economic facts and figures
submitted by the tenants themselves.
ON MOTION BY PALIN.AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO.
75-35 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE:
REASONS FOR DENIAL:
1. Applicant has failed to show sufficient hardship to justify
granting of this exception.
2. The subject sign could be redesigned and still fall witl;in the
intent of the City in its original approval of the two (2)
freestanding signs previously allowed for the center.
3. The present street frontage will not accommodate the necessary
sign area and reader boards for the identification of uses as pro-
posed by the applicant in this request.

The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Act, 1970.

Applicant Bruce Burton was present at the meeting.
The Board discussed with the applicant the elimination of the
front drive, landscaping required, drainage easements, im-
provement of abutting right-of-way, and the masonry wall ex-
isting at the front property line of subject property.
ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINISTRATIVE REVIEW
NO. 75-123 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE
FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received
August 21, 1975, shall be the approved layout, subject
to the modification described herein:
a. Deletion of the overhead doors in the front of the
structure.
A plan delineating said modification shall be submitted
to the Secretary of the Board. If such modification plan
complies with the modification outlined by the Board, said
plan shall be approved and made a permanent part of the
administrative file.
In its approval action, the Board of Zoning Adjustment- considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;

Lot width and lot depth;

6. The developer shall participate in the Orange County Sanita-
tion District No. 3 Sewer Annex District.
7. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Crabb Lane shall be improved to the center line of such right-
of-way. Said improvement shall include curbs, gutters, side-
walks, paving, street trees, street lights, street signs, and
sewer and water main extensions, in full compliance with the
City of Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. Drainage facility in the northerly section of the property
shall be reconstructed to connect with the existing 60-inch
facility to the north of the property.
2. The existing wall along the front property line shall be re-
moved.

and Delaware Street, in an R2-PD-10, Medium Density Residential
District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Thomas Tupman was present to represent the application.

Mr. Tupman submitted a plot plan to the Board for this project; the
change on this plan is an alteration in sidewalk location with land-
scaping area up against the wall. Also discussed was the varying
height,of the wall, necessitated by the change in slope. The
applicant was cautioned that what the Board may allow on Memphis
Avenue for this model complex will not necessarily hold true for
the construction on Delaware Street.
Don Moore emphasized the importance of installing the fire
hydrants before any further construction proceeds.
ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO.
75-124 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

Jim Palin pointed out that the submitted plan is three spaces
short on parking requirements and approximately 400 square feet
short of landscaping. Bruce Crosby also noted that the parkway
width should be changed from 5 feet to 6 feet, and that there is
a 2-foot public utility easement on the front of the property
that is not shown on the plan.
The Board al$o discussed the use as proposed (warehousing)
and the uses allowed by the district (i.e., light manufacturing),
and the applicant was informed that the Board would have no
guarantee that the other side of the building would not eventually
be put to the allowed use. If the applicant desired to figure
his parking and landscaping on the basis of the warehousing use,
it would be necessary to file a Tentative Parcel Map to eradicate
the lot line between the two sides of the building.
