BOARD MEMBERS: Jim Palin Bruce Crosby Walt Lipps REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 75-34 Applicant: David E. Monlon To permit an eight -foot encroachment into the required 25-foot corner cutoff, in lieu of Section 9103.4.1 of the Huntington Beach Ordinance Code, located at the southwest corner of Aladdin Drive and Wetherly Lane, in an R1, Low Density Residential Dist- rict. The Chairman informed the Board that this application is a cat- egorical exemption, Class V, California Environmental Quality Act, 1970. David Monlon was present at the meeting. The Chairman reopened the public hearing. Jim Palin informed the Board that this request had been continued from August 27, 1975, to permit the applicant an opportunity to investigate alternatives to the plan as originally submitted. The applicant addressed the Board, noting that he has revised his plans and the proposed projection will now be approximately two feet, with that section of the wall serving as a planter. This plan will retain the architectural continuity of the original wall and still project only about three running feet into the required setback. There being no other persons present to speak for or against the pro- posed project, the Chairman closed the public hearing. Board discussion of the revised plans ensued, including the allow- able height of the proposed wall, its relation to the existing sidewalk, and other similar structures within the subdivision. Board of Zoning Adjustments Wednesday, September 10, 1975 Page 2 ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 75-34 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan received September 10, 1975, shall be the approved layout, having a maximum of five feet (5') along a line parallel with the projection of the wall on the off side of the sidewalk. 2. The planter shall be a maximum of forty-two (42) inches in height. FINDINGS OF THE BOARD: 1. The wall as proposed will afford security and privacy for the front entry of the unit. 2. The wall as proposed is similar to other structures within the same subdivision; therefore, the granting of this re- quest constitutes granting parity. 3. It is necessary to have the maximum six (6) foot height projecting into the 25' x 25' cutoff, to afford placement of a gate perpendicular to the walk. AYES: Patin, Crosby, Lipps NOES: None ABSENT: None USE PERMIT NO. 75-39 Applicant: Fredrick Culmann To permit the construction of a seven -unit apartment building, pur- suant to Section 9162.3.1 of the Huntington Beach Ordinance Code, located on the west side of Huntington Avenue, approximately 75 feet north of 17th Street, in an R2-0-CD, Medium Density Residen- tial District. Mr. Culmann was present to represent the application. The Chairman informed the Board that Negative Declaration No. 74-147 was granted for this project by the Environmental Review Board on April 29, 1975. The Chairman opened the public hearing. The applicant addressed the Board, stating that he had been unaware of the proposed drainage assessment district for the area in which the project is located. There being no other persons present to speak for or against the proposed project, the Chairman closed the public hearing. The Board discussed with the applicant the problems of drainage in the entire area, and the further impaction of neighboring properties which could be expected to result from construction on this particular property. The discussion also touched upon the time of recording of the map showing the boundaries of the assessment district and the recommendations from the Environ- mental Review Board. ON MOTION BY PALIN AND SECOND BY LIPPS, AND WITH THE CONCURRENCE OF THE APPLICANT, USE PERMIT NO. 75-39 WAS CONTINUED TO SEPTEMBER 17, 1975, TO PERMIT CITY STAFF TO FORMULATE A POLICY DEALING WITH GRANTING OF PERMITS IN THE PROPOSED ASSESSMENT DISTRICT NO. 73-02, BY THE FOLLOWING VOTE: AYES: Palin, Crosby, Lipps NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 75-113 Applicant: W. Sterling Buck & Associates To permit the construction of a nine (9) unit apartment building pursuant to Section 9231.6 of the Huntington Beach Ordinance Code, located on the east side of Sixth Street approximately 125 feet south of Olive Avenue, in an R4, High Density Residential District. The Chairman informed the Board that Negative Declaration No. 75-63 was granted for this project by the Environmental Review Board on August 19, 1975. John Cowles was present to represent the applicant. The Board reviewed the proposed plot plan and discussed the height clearance for the subterranean garage structure, the required turning radius, and the timing for the necessary alley dedication. The applicant was reminded that the property lies in Fire Zone No. 1. ON MOTION BY CROSBY AND SECOND BY PALIN, THE BOARD ADOPTED NEGA- TIVE DECLARATION NO. 75-63 AND THE RECOMMENDATIONS OF THE ENVIRON- MENTAL REVIEW BOARD, BY THE FOLLOWING VOTE: AYES: Palin, Crosby, Lipps NOES: None ABSENT: None BZA 9-10-75 Page 3 Minutes: H.B. Board of Zoning Adjustments Wednesday, September 10, 1975 Page 4 ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 75-113 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received Aug- ust 29, 1975, shall be the approved layout. In its approval action, the Board of Zoning Adjustments consid- ered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout, Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. In accordance with the City's standards, an additional two and one-half feet (2-1/2') of right-of-way on the alley shall be dedicated. 3. Soil and compaction reports shall be submitted by a cer- tified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and det- ection devices or systems shall comply with the specifi- cations of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Depart- ments of'Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. 6. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Sixth Street and the alley shall be improved to the cen- terline of such right-of-way. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air con- ditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be dis- posed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 5. All structures proposed for construction within this sub- division shall be constructed in compliance with the g-factors as indicated by the geologist's report. 6. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City for review. AYES: Palin, Crosby, Lipps NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 75-130 Applicant: Assistance League of Huntington Beach To permit the establishment of a philanthropic project pursuant to Section 9453 of the Huntington Beach Ordinance Code, located on the west side of Main Street, approximately 50 feet south of Olive Avenue, in a C3, General Business District. The Chairman informed the Board that this project is a Categori- cal Exemption, Class I, California Environmental Quality Act, 1970. Mrs. Ethel Berdelman was present to represent the application. Walt Lipps informed the Board that there has been a preliminary check on the building, and that a comprehensive check will be BZA 9-10-75 Page 5 Minutes: H.B. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-130 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received September 3, 1975, shall be the approved layout. ABSENT: None MTSCF.T.T,ANF.nTTS AGENDA ITEMS REVISED LANDSCAPE PLAN FOR TRACT NO: 8039 Applicant: Huntington Harbour Corporation The Board discussed the revised plans, which provide for mound- ing of the landscaped areas and some different plant species. These changes have been made because of problems with the soil conditions, making survival of some of the original species dif- ficult. The plan has been checked with Public Works, and the mounding as shown will not disturb proper drainage on the property. Walt Lipps reported that the signs as requested would be less than the square footage permitted by code. The Board discussed the location of the signs and the hours during which they would be illuminated. ON MOTION BY CROSBY AND SECOND BY LIPPS, SIGN REQUEST NO. 6569 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received September 9, 1975, shall be the ap- proved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. AYES: Palin, Crosby, Lipps NOES: None ABSENT: None Sign Request No. 6570 Applicant: Graziadio Development Company To permit a 17' x 6' I.D. sign, located on the perimeter wall of Tract 8687, at the southeast corner of Chapel Lane and Ellis Avenue, Huntington Beach. The Board discussed the proposed sign plan in light of its com- pliance with the conditions imposed on Tentative Tract 8687 at the time of its approval by the Planning Commission.
