ORAL COMMUNICATIONS: None REGULAR AGENDA ITEMS MINUTES: ON MOTION BY FINLEY AND SECOND BY PARKINSON THE MINUTES OF AUGUST 26, 1975 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None CONDITIONAL USE PERMIT NO. 75-12 Applicant: Harry D. Aggers III This is a request to permit.the construction and operation of a swim and tennis club located at the southeast corner of Ernest Avenue and Goldenwest Street. John Cope addressed the Commission and related the concerns expressed by the Planning Commission at its August 19, 1975 meeting which consisted of adequate parking, lighting and location of swimming pool. He noted that the revised plans had been sub- mitted to reflect relocation of the swimming pool and clubhouse away from the intersection of Goldenwest Street and Ernest Street, and provision for additional parking spaces. Chairman Slates opened the public hearing. Mr. Terry Aggers, representing the Huntington Tennis Club, Inc., addressed the Commission, stating that he felt the revised plan was a considerable improvement over previous plans submitted. Mr. Hall Seely, an attorney representing John Thomas, addressed the Commission. He had previously spoken to the Commission expressing opposition to the development'in that area. In his discussion he questioned parking adequacy, possible noise, and traffic as well as impact on future development. The public hearing was closed. The Commission discussed the conditions of approval, particularly street dedication requirements, special events which might occur, and the need for a review in two years. ON MOTION BY KERINS AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 75-12 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: 1. The proposed use is compatible to surrounding uses presently existing, and will be compatible with the long term uses result- ing from implementation of the Land Use Element for the area. 2. The proposed plan is in substantial conformance with applicable provisions of the Huntington Beach Ordinance Code. 3. The proposed recreational facility will be both compatible and complementary to the recreational and open space character of the general area. . 4. Private recreational facilities are unclassified uses and may be allowed in any district. The proposed industrially zoned property does provide a compatible location for the use with surrounding properties. CONDITIONS OF APPROVAL: 1. The revised conceptual plot plan received September 8, 1975 shall be the approved layout. In its approval action the Planning Commission considered the following issues relating to the conceptual plan: Traffic circulation and drives Parking layout Lot area, width, and depth Type of use and its relation to property and improvements in the immediate vicinity. The conceptual plan is reviewed as a basic request for entitle- ment of the use applied for in'relation to the vicinity in which it is proposed. The conceptual plan should not be construed as a precise plan reflecting conformance to all ordinance code requirements. n 1 -2- 9/16/75 - PC Minutes: H.B. Soil Reports as required by the Department of Building and Community Development and the Department of Public Works shall be submitted to such departments prior to the issuance of building permits. 3. Prior to final inspection for the use, a landscape plan depicting plant type, size, location, plan for irrigation, and method of screening for the parking area shall be submitted to the Planning Department for approval. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. No structure other than those shown on the approved plot plan shall be constructed. 6. On -site lighting for the tennis courts shall be subject to approval by the Department of Building and Community Develop- ment. Said lighting shall be reviewed for effects on traffic safety, and possible Public Utilities Commission restrictions on outdoor lighting facilities. There shall be no night lighting of the tennis courts past 11:00 P.M. 7. Use of the cocktail lounge facilities shall be -restricted to members of the tennis club. 8. Goldenwest Street and Stewart Street shall be dedicated and fully improved as required by the Department of Public Works. 9. Ernest Avenue shall provide for a full street section for the length of the site frontage on this street. The south half shall be fully improved and the north half shall provide for an additional travel lane. The design of the improvements shall be as approved by the Department of Public Works. 10. Prior to final inspection, a six (6) foot high by six (6) inch wide solid masonry wall shall be constructed on the south property line. 11. The existing overhead utility lines on Ernest Avenue shall be placed underground. 12. The developer shall participate in the local drainage assess- ment district. 13. Special uses of the complex, which are open to the general public, shall require approval.of a special event permit by the Board of Zoning Adjustments to insure sufficient off-street parking for the events. 15. Standard_ • Conditional Use Permit INo.`'75-10 is'a'request to'permit the establish- ment of an automobile dismantling yard on an existing developed industrial•site, which was previously used as a contractor's and plumber's storage yard located at the southeast corner of Talbert and Gothard.',The proposed use .includes a screened outdoor storage area, warehouse for storage of parts, office area, and off-street parking facilities,. Planning Commission Tuesday, September 16, 1975 Page 5 Mr. Cope further stated that the applicant will be in the business of providing spare parts for the customers and does not anticipate keeping the stripped automobiles on the premises after obtaining the parts. The public hearing was opened. John Cope stated that a letter of opposition had been received from Jerry Jones and was on file in the Planning Department. Chairman Slates directed the Commission to discuss Conditional Exception No. 75-36 first since approval or denial would be necessary before action could be taken on the Conditional Use Permit. Mr. Frank •Standard addressed the Commission and stated that he would be willing to comply with their requests concerning improve- ments to the property, and stated that the staff report set forth the proposed use in an accurate manner. The public hearing was closed. Commissioner Kerins felt that the use constituted a hardship for the owner of the residence adjacent to the proposed site. He suggested that Mr. Standard seek another use for the site. Chairman Slates felt that since there would be no stacking and the use would be concealed by the eight foot wall, it would be as good a use as the City will get on that site. Commissioner Shea concurred with Chairman Slates. Commissioner Finley stated that it was unfortunate that the ordinance is written in such a way that a proximity to a nonconforming use would prevent the proposed use. Further discussion ensued. ON MOTION BY KERINS AND SECOND BY BOYLE CONDITIONAL EXCEPTION NO. 75-36 WAS DENIED FOR THE FOLLOWING REAS014S BY THE FOLLOWING VOTE: 1. No hardship is shown on the applicant's property. 2. The applicant may Develop any other industrial use on his property other than a dismantling yard due to proximity to a residential use. Planning Commission Tuesday, September 16, 1975 Page 6 CONDITIONAL USE PERMIT NO. 75-13 Applicant: Wahlquist, West, Lawrence, Inc. Conditional Use Permit No. 75-13 is a request to allow construction of facilities to be used as a religious educational training center located at 15761 Goldenwest Street. The existing buildings, which have been used for similar uses in the past, are proposed to be removed. The proposed site plan indicates an expansion of the exist- ing use. John Cope addressed the Commission and indicated that a letter of protest had been received from George Snyder, President of Golden West Homeowners Association. The public hearing was opened. Mr. Reed Lawrence, an architect representing the applicant, addressed the Commission and spoke in -behalf of the proposed use. He presented architectural renderings of the proposed plans for review by the Commission. Mr. Norman Rich, Advisor to LDS students, addressed the Commission. He read a letter which had been prepared by Dr. Dudley Boyce, President of Golden West College, which was addressed to the Chairman of the Planning Commission. The letter related Dr. Boyce's support of the proposed use and is filed in the Planning Department. Mr. Nielsen, of the Church of Latter Day Saints, addressed the Commission and stated that the use would consist of different groups of 18 to 26 year old students during the day and early evening. The building will be carpeted throughout which will eliminate some noise. He further stated that there will be no dancing. Mr. David Whittaker, representing the applicant, stated that he was director of the Institute and had received one complaint from a resident of the tract to the north, concerning the barn which is not being used at the present time. He stated that there are locks on both the inside and outside of this structure in order to prevent any recurrence of past problems. Ms. L. Korba addressed the Commission and complained about the noise and traffic problems. She referred to a petition that was presented to the Mayor in June requesting that the development be R1 on this parcel. She stated that -during the summer the property had been used by motorcyclists with a great deal of noise resulting. Mr. Manlus, a resident in the area, complained about the noise and traffic problems. Mr. Noble Waite stated that he lived a block away from the site and was in favor of the use. He referred to the 7000 members who were in favor of the use. -6- 9/16/75 - PC Minutes: H.B. Planning Commission Tuesday, September 16, 1975 Page 7 Mr. Elmer Phibb, a resident of the neighborhood, addressed the Commission and stated that the noise emanating from the school was minimal compared to the street noise and noises from adjacent swimming pools. He was in favor of the use. Mr. Don Skaggs, representing the Garden Grove Church, spoke in favor of the project, indicating that students who are now attending the Cypress facility will soon be in the Golden West district. Chairman Slates closed the public hearing. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY FINLEY CONDITIONAL USE PERMIT NO. 75-13 WAS CONTINUED WITH CONCURRENCE OF APPLICANT TO OCTOBER 7, 1975 TO ENABLE THE STAFF TIME TO FORMULATE SUGGESTED CONDITIONS AND FINDINGS FOR APPROVAL BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None Commissioner Kerins stated that parking adjacent to residential might be discussed. Commissioner Boyle felt the use of parking lot facilities should be limited. Commissioner Shea felt that a right hand turn should be worked out with Department of Public Works. Commissioner Slates felt the entrance off Goldenwest should be widened and no left turn permitted and also staff should seek meaningful landscape buffering between the designated parking and the houses on the west. Commissioner Finley felt that after a specified period the use should be examined to determine any impacts on surrounding ues which might occur. Commissioner Bazil would like to see the driveway widened and no left turn permitted with pedestrian traffic discouraged rather than encouraged. Commissioner Parkinson concurred with all the recommendations. Chairman Slates called a 5 minute recess at 9:30 P.M. ZONE CASE NO. 75-08 Applicant: Harbour Pacific, Ltd. Zone Change No. 75-08 is being requested in order to provide the appropriate zoning for eventual implementation of Tourist Commercial -Residential land uses. The subject property consists of approximately 24 acres of land situated on the south side of Edinger Avenue, 1200 feet west of Trinidad Lane and continuing to the terminus of Edinger Avenue. Approximately 9 acres are being requested for commercial (C2) zoning and the remainder is_to be designated as a medium density (R2) residential area. The Chairman opened the public hearing and -noted that Mr. Bill Duncan, representing the applicant, was present for any questions which might be raised. ON MOTION BY BAZIL AND SECOND BY SHEA ZONE CASE NO. 75-08 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. State Planning Law mandates that zoning shall be consistent with the City's General Plan. 2. The adopted General Plan designation on the subject property is Retail Commercial and Medium Density Residential; therefore, the requested change in zoning is in conformance with the General Plan. 3. Because of the subject site's location, orientation, and physical characteristics, the requested zoning will provide for compatible land uses with the surrounding areas. AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None Chairman Slates turned the chair over to Vice Chairman Finley for the next application. TENTATIVE TRACT NO. 8971 Applicant: Foxx Development Corporation Tentative Tract Map 8971 filed on July 9, 1975, is a request to subdivide approximately 4.02 acres of land into a 14 lot multi -family subdivision for triplex and fourplex units. The subject property is located at the southwest corner of Yorktown Avenue and Delaware Street. Mr. Jim Palin stated that there was no information to add to that contained in the staff report. He noted that a map was on display for viewing and showed an aerial slide of the property. There was a discussion on the trees and it was noted that some trees were not worth saving and further that any trees which would be removed would be replaced with 30" box trees. Further discussion ensued. A MOTION WAS MADE'BY BOYLE AND SECONDED BY SHEA TO APPROVE TENTATIVE TRACT NO. 8971 WITH.CONDITIONS AND FINDINGS AS OUTLINED BY THE STAFF. A discussion ensued on cul-de-saving or creating a knuckle on "A" Street for future street alignment along the southerly property line. Bill Hartge stated that it would give an opportunity at a later date to extend south or swing west to tie into Huntington Street. COMMISSIONER BOYLE WITHDREW HIS MOTION. A MOTION WAS MADE BY SHEA AND SECONDED BY KERINS TO APPROVE TENTATIVE TRACT 8971 WITH THE CONDITION THAT THE ALLEY BE REDESIGNED AND "A" STREET BE CUL-DE-SACED. Commission discussion ensued. COMMISSIONER SHEA WITHDREW HER MOTION. Further discussion ensued. Jim Foxx addressed the Commission and requested reconsideration of their decision for the reason that he could meet the condition of approval effecting the installation of a cul-de-sac. A MOTION WAS MADE BY PARKINSON AND SECONDED BY BAZIL TO RECONSIDER THE DECISION TO CONTINUE TENTATIVE TRACT NO. 8971. The property shall be subject to the local drainage assessment district requirements and fees. 8. All vehicular access rights along Yorktown Avenue and Delaware Street shall be dedicated to the City of Huntington Beach, except at street intersections. 9. All utilities shall be installed underground. 10. Drainage for the subdivision shall be approved by the Depart- ment of Public Works prior to recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the proposed project. 11. A decorative masonry wall shall be constructed to City specifications along Yorktown Avenue. Said wall shall be six (6) inches wide and six (6) feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Planning Department. The structural design shall be approved by the Department of Public Works and shall be included as a part of the street improvement plan. The intent of this condition is to improve the street scene along Yorktown Avenue. 12. Landscape planter area shall be provided along Yorktown Avenue as shown on the approved tentative map. Such planter shall conform to the plans and specifications on file with the Department of Public Works and the requirements of the Planning Commission. 13. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 14. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 15. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 16. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth move- ment for the project property. -11- 9/16/75 - PC Minutes: H.B. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. 19. The structures on subject propertyk;whether attached or•detached, shall be constructed,in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of-the.property., 20. In addition to;.the,s,treet,trees required by the City of Huntington Beach Subdivision Ordinance for arterial -highways and reduced local streets, one additional minimum 30 inch box tree shall be planted on each lot. The subdivider may substitute at a ratio of one for one of -this ,30 inch- box •requirement with the existing trees, subject to the:relocation�review,�and planting -in compliance with standard plans and specifications on file with the City. Jim Palin addressed the Commission and stated that he -had nothing further to add to the staff report. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY PARKINSON TENTATIVE TRACT NO. 9015 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. Tentative Tract Map 9015 received and dated August 20, 1975 shall be the approved layout. 2. All applicable conditions of approval imposed on Tentative Tract No. 8011 shall be complied with. 3. Each phase to be constructed.shall be.provided with reciprocal covenants, conditions and restrictions and a reciprocal manage- ment agreement -shall be established that will cause a merging -12- 9/16/75 - PC Minutes: H.B. The end result shall be ne homeowners association with common areas common to all, and one management for the entire project. AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None MISCELLANEOUS: Appointment of Planning Commission members to serve on committee regarding landscape requirements for oil operation sites. Commissioners Boyle and Shea were appointed to serve on this com- mittee. It was noted that the first meeting will be Tuesday, September 23, 1975 at 3:00 P.M. Sign Code update John Cope advised the Commission that he would try to have a copy of amended sign code by September,30 and would hope to have more detailed explanation as to how provisions affect the concern of the Commission. Current Planning Work Priorities Dave Eadie informed the Commission that the current planning priorities were Townlot, Equine Standards, Large Lot Ordinance, and Specific Plan Huntington Center. He inquired if the Commission concurred as a whole with staff's recommendations. It was the consensus of the Commission that the staff's approach regarding work program priorities is acceptable. Council Action Secretary Harlow discussed Council action of September 15, noting that the Precise Plan of Street Alignment of Keelson-and•Elm had been approved. He further stated that Old Town Drainage District had been set for public hearing on October 6, 1975. Plot Plan Amendment for Classic Homes (Tot Lot Location) Secretary Harlow advised the Commission that this will be heard by the Board of Zoning Adjustments at their September 17, 1975 meeting in the event any Commissioners wished to attend.
