Mayor Gibbs called the Special Meeting of the City Council of the City of Huntington
Beach to order at 5:30 P.M.
ROLL CALL

CALL FOR SPECIAL MEETING
The Clerk read the call for Special Meeting which had been received and consented
to by a majority of the City Council prior to 5:30 P.M., on Sunday, September 21,
1975, for the purpose of considering personnel matters involving administration of
the City in Executive Session.

Mayor Gibbs called the adjourned regular meeting of the City Council of the City of
Huntington Beach to order at 7:00 P.M.
ROLL CALL
Present: Wieder, Coen, Matney, Shipley, Duke, Gibbs

RES.NO 4135 - ADOPTED - COMMUNITY GARDENS AGREEMENT
The Clerk presented Resolution No. 4135 for a reading by title - "A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING COMMUNITY GARDEN AGREEMENT AND
AUTHORIZING DIRECTOR OF RECREATION AND PARKS TO EXECUTE PERMIT AGREEMENTS FOR CITIZEN
PARTICIPATION IN COMMUNITY GARDEN PROGRAM."
Following a reading by title of Resolution No. 4135, a motion was made by Councilman
Coen to waive further reading of same. The motion was passed by the following vote:
AYES: Wieder, Coen, Matney, Shipley, Duke, Gibbs
NOES: None
ABSENT: Bartlett
Councilwoman Wieder commended all the persons responsible for the implementation of
the community garden project. .
On motion by Wied.,r, Council adoptedResolution No. 4135 by the following roll call
vote:
AYES: Wieder, Matney, Shipley, Duke, Gibbs
NOES: Coen

H B FIREMEN'S ASSOCIATION - ARBITRATOR'S AWARD APPROVED
A motion was.ssiade by Councilman Matney to approve the Arbitrator's Award and direct
the City Negotiating Staff to meet with the Fire Association representatives and
prepare a final memorandum of understanding incorporating all necessary and required
language, and also reflecting the arbitration award; upon completion, the memorandum
of understanding shall be presented'to the `City Council for adoption_ at which time
the agreement shall be implemented according to the „terms thereof.
Councilman Coen requested and was granted permission to abstain from voting on the
matter as he was, not present during the negotiation meeting.
The motion was passed by the following vote:
AYES: Wieder, Matney, Shipley, Duke, Gibbs
NOES: None

CAC TERMINATION NOTICE -- COUNTY EMERGENCY SERVICES REQUESTED
M.C. Darrel Cohoon, City Chief Animal Control Officer, informed Council that they
had bean provided with a communication from the City Administrator's office dated
September 22, 1975 regarding the status of the animal control services contract
1X1iw(,i-,11 UILr city and California Animal Control. He presented the alternative measures
which could be taken by the City to provide animal control services to the community.
Such alternatives would include County service, City forces or joint powers agreement
or a contract service.
Discussion was held by Council and staff. Mr. William Amsbary, Deputy City Attorney,
reported on the provisions of the City's contract with California Animal Control.
Discussion was held by Council.
A motion was made by Councilwoman Wieder that the City of Huntington Beach move as
quickly as possible to seek emergency services from the Orange County Board of Super-
visors in that they direct the Orange County Health Department to provide immediate
emergency services and that we proceed to consult with them regarding a possible
joint venture for animal control in the city which might be housed in our own facility,
and which might be subject to local control, and further, t#aat Califoxnia Animal Control
be given a 60 day notice of termination based on violations of its contract; and that the
city, for the time being, pay no money to California Animal Control in order to mitigate
the loss to the City caused by breach of contract until a settlement schedule is
mutally worked out between the City and California Animal Control.
Councilman Shipley requested that Supervisors Schmit and Riley be additionally informed
to enable them to work toward expediting the matter.
The motion was passed by the following vote:
AYES: Wieder, Coen, Matney, Shipley, Duke, Gibbs

On motion by Matney, Council directed the City's Chief Animal Control Officer to
direct that California Animal Control stop forthwith the collection of license fees
and that the collecting function commence immediately by the Chief Animal Control
officer. The motion was passed by the following vote;
AYES: Wieder, Coen, Matney, Shipley, Duke, Gibbs
NOES: None
ABSENT: Bartlett
ANIMAL ASSISTANCE LEAGUE COMMENDED
Councilwoman Wieder commended the Animal Assistance League for their aid in the
operating and administration of the Animal Shelter during the -past few weeks.
RESOLUTION NO. 4136 - ADOPTED -- RE2UEST FOR TEMPORARY EMERGENCY ANIMAL CONTROL SERVICES
The City Attorney recommended that Council adopt a resolution requesting the Board ,
of Supervisors to provide temporary emergency animal control services, and that
authorization be given to the City Attorney to incorporate the wording'in said res-
olution to reflect the intent of Council.

A motion was made by Councilman Matney to direct the Clerk to read Resolution No.
4130 by title; waive further reading and adopt same - "A RESOLUTION OF THE CITY
COUNCIL Or THE CITY OF HUNTINGTON BEACH REQUESTING THE ORANGE COUNTY BOARD OF SUPER-
VISORS TO PROVIDE TEMPORARY, EMERGENCY ANIMAL CONTROL SERVICES. The motion was
passod by the following roll call vote:
AYES: Wieder, Coen, Matney, Shipley, Duke, Gibbs
NOES: None
ABSENT: Bartlett Y

COMMUNICATION REFERRED TO CITY ATTORNEY
A motion was made by Councilman Matney to refer a letter written by a Council person
to the City Attorney's Office for a legal opinion. The motion was passed by the
following vote:
AYES: Wieder, Coen, Matney, Shipley, Duke, Gibbs
NOES: None -

Mayor Gibbs called an Executive Session of the Council for the purpose of discussing
pending personnel and/or litigation matters.

The Mayor called a recess of the Council at 8:35 P.M.

The meeting was reconvened at 9:30 P.M., with Councilwoman Wieder recorded absent.
