Applicant: Vince Moorhouse
To permit an enlargement of a residence with a non -conforming side
yard setback pursuant to Section 9719 of the Huntington Beach
Ordinance Code, located at the northeast corner of Palm Avenue and
Thirteenth Street, in an R2, Medium Density Residential District.
Applicant has submitted a request for reconsideration of the pre-
viously imposed conditions of approval for this project.

Secretary Palin reported that the square footage for the addition
to the dwelling has been calculated and is less than one-third of
the original structure; additions of this size are specifically
exempted from the requirement for street dedication by the Ordin-
ance Code.

ON MOTION BY PALIN AND SECOND BY CROSBY, THE CONDITIONS OF
APPROVAL FOR USE PERMIT NO. 75-48 WERE. AMENDED BY THE. DELETION
OF CONDITION A-2, BY THE FOLLOWING VOTE:
A. 2. (DELETED) "In accordance with the City's standards and
requirements, an additional ten (10) feet of,dedication
on Palm Avenue shall be required if building permits
are issued prior to the pending amendment to the Master
Plan of Streets and Highways (which will redesignate
Palm Avenue from an 80-foot secondary to a 60-foot
local street); however, if applicant elects to wait un-
til City Council has adopted the Master Plan amendment
to apply for building permits, the additional ten (10)
feet of dedication will no longer be required."

CONDITIONAL EXCEPTION NO. 75-17 (In conjunction w/A.R. 75-72)
Applicant: William A. Anderson
To allow: 1) construction of an industrial building with zero
side yards on both interior sides in lieu of Section 9513.1(b)(3),
which requires a thirty (30) foot side yard that is opposite a
zero side yard; 2) a reduction in the off-street parking re-
quirement from 24 to 20 spaces in lieu of Section 9793.2(b); and
3) a waiver of the landscape buffer area requirement of Section
9514.5, which requires such planter area when an industrial use
abuts property zoned for community facilities; located on the
south side of Research'Lane at the intersection of Producer Lane,
in a 100-M1-A-15,000 Restricted Manufacturing District.
The Chairman informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act,
1970.
William G. Anderson was present at the meeting.
The Chairman opened the public hearing.
Mr. Anderson addressed the Board, stating his reasons for request-
ing the Conditional Exception, citing the size and shape of the
property itself as justification.
The Chairman closed the public hearing.
Jim"Palin pointed out areas which should be revised on the plot
plan if the exception is approved: revision to reflect the de-

letion of parking spaces, indication of the landscaping along
the front of the property, depiction of the landscaping to be
provided on the High School site to offset the deletion of the
landscape buffer and placement of the landscaping in conjunc-
tion with the zero setback at that location, and indication of
placement of the columns of the two-story portion of the build-
ing.
ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 75-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The size and shape of the property present a hardship, as
this property is the only 100 foot wide lot within the in-
dustrial subdivision having less than 100 feet of frontage
and located upon a knuckle, which presents access problems.
2. The property to the east and west of the subject site have
been approved for construction; the property to the west
being constructed having a 44 foot setback from the west prop-
erty line of subject property, the property to the east being
approved for a condominium development having a zero side
yard setback on the east property line of subject property.
3. The view of the property as seen from the street has afforded
a visual effect in compliance with the purpose of the zero
side yard setback provision.
4. Marina High School has submitted a letter requestinq that
the building be designed and located as proposed, in order to
afford a future site for a logo identifying the Marina High
athletic field.
5. The nature of the use is such that there is not a need for
the full 24 parking spaces.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received Septem-
ber 16, 1975, shall be the approved layout, subject to
the modifications described herein:
a. Landscaping to be shown on abutting property;
b. Landscaping to be shown on the frontage;

c. Column placement for the parking to be shown;
d. Proper dimensions for the 20 allowed parking spaces
shall be shown.
A plan delineating said modifications shall be submitted
to the Secretary of the Board. If such plan complies
with the modifications outlined by the Board, said plan
shall be approved and made a permanent part of the ad-
ministrative file.
In its approval action, the Board of Zoning Adjustments consid-
ered the follwoing issuues relating to the conceptual plan:
• Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary
of -the Board:
Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equip-
ment and shall delineate the type of material proposed
to screen said equipment.
3. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to
the Department of Building and Community Development and
shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm
systems, and any other required fire protection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and
devices shall be submitted to the Fire Department and
shall be subject to approval by the Departments of Fire
and Public [corks.
5. All applicable fees shall be paid prior to issuance of
building permits.

ance Code, located on the south side of Research Lane at the
intersection of Producer Lane, in a 100-M1-At-15,000 Restricted
Manufacturing District. (Revised Plan)
The Chairman informed the Board that this project is covered by
EIR No. 73-16, approved by the City Council on March 18, 1974.
William G. Anderson was present at the meeting.
The Board reviewed and discussed the revised plan.

ADMINISTRATIVE REVIEW NO. 75-72 WAS APPROVED WITH THE FOLLOWING

The Chairman informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act,
1970.
Jim Palin.informed the Board that this request had been improp-
erly completed and advertised and could not be heard by the
Board until such time as it includes a request for the deletion
of open space which would result from the encroachment proposed.
The applicant indicated that he was uncertain at this time
whether or not he would pursue the request.
ON MOTION BY CROSBY AND SECOND BY PALIN CONDITIONAL EXCEPTION

Applicant: Sunset Aquatic Yacht Club (by W.I. Kennedy)
To permit the establishment of a yacht club pursuant to Section
9692 of the Huntington Beach Ordinance Code, located on the north
side of Warner Avenue approximately 2000 feet west of Algonquin,
in an ROS, Recreational Open Space, District.
The Chairman informed the Board that this request is a Categori-
cal Exemption, Class I, California Environmental Quality Act, 1970.
W.I. Kennedy was present at the meeting.
The Chairman opened the public hearing.
Mr. Kennedy addressed the Board, describing the purpose of the
club, hours of operation and number of people expected to use the
building, and the parking provisions on site.
There being no other persons to speak for or against the proposal,
the Chairman closed the public hearing.
Board discussion ensued. The Board took into consideration the
expansions of uses which have taken place at the site of the beach
club since its original approval and questioned whether or not
approval of this request would further degrade the parking ratio.
Mr. Kennedy said that the yacht club's use of parking facilities
would be minimal and that their lease was a "test lease" to expire
on May 31, 1976. He requested that a qualified approval be con-
sidered to expire with the term of the lease, when further review
could be undertaken.

The Chairman informed the Board that -this project is a Categori-

The Chairman opened the public hearing.
Mr. Sharp addressed the Board, explaining the circumstance in
which he finds himself: an already constructed carport which
does not meet the code. He reported that he had made arrange-
ments to have 50 percent of the sides covered and to provide
additional storage, hoping to come up to City requirements.
There being no other persons to speak for or against the pro-
posed project, the Chairman closed the public hearing.
The Secretary noted that no request has been made for deviation
from the Ordinance Code. The Board reviewed for the applicant
some of the requirements of the code for a structure of this
kind; e.g., complete finishing of the enclosed portion of the
carport, proper roof angle, compatibility of material to the
dwelling structure, etc. It was the consensus of the Board that
the applicant should meet with Building Department staff to
determine what would be needed to bring the structure up to code.
ON MOTION BY CROSBY AND SECOND BY PALIN, AND WITH THE CONCUR-
RENCE OF THE APPLICANT, USE PERMIT NO. 75-51 WAS CONTINUED TO
OCTOBER 8, 1975, TO PERMIT APPLICANT TO MEET WITH STAFF, BY THE
FOLLOWING VOTE:

mately 180 feet south of Banning Avenue, in -a C4, Highway Commer-
cial District.
The Chairman informed the Board that this request is a Categori-
cal Exemption, Class I, California Environmental Quality Act,
1970.

paste-up, with heavy printing jobs being done elsewhere. Ile
noted further that the block wall at the rear of the property
would serve to mitigate what noise would result from the opera-
tion.

the proposed project, the public hearing was closed.

uses and the normal working hours of the shop.
ON MOTION BY SPENCER AND SECOND BY CROSBY, USE PERMIT NO. 75-53
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE

FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in

Applicant: Jaren R. Waller ,
To permit a special event sale and outside display of merchan-
dise, pursuant to Section 9432.3(a,b) of the Huntington Beach
Ordinance Code, located at the northeast corner of Adams Avenue
and Brookhurst Street, in a C2 District.
Jaren Waller, District Representative for Phillipps Petroleum,
was present at the meeting.
The Board discussed with the applicant the time period proposed
for this operation (October and November, 1975) and the size and
location of the bin on which the tire sale is to be advertised.
The bin has dimensions of 20' x 8' x 7', and the proposed loca-
tions have been depicted on the submitted plot plan. The
Board reviewed these locations in light of exposure of the sign
to passing traffic and as each would affect sight visibility and
internal circulation onsite.
ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW
NO. 75-136 WAS APPROVED FOR THE TIME PERIOD INDICATED BY APPLI-

ated on the west side of Container Lane, 200 feet south of
McFadden Avenue, in a 100-M1-A-20,000 Restricted Manufacturing
District.
This project is covered by EIR No. 73-16, approved by the City
Council on March 18, 1974.
Donald Simons was present to represent the application.
The Board reviewed the request and discussed the suggested condi-
tions of approval.

NO. 75-11 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
