Burke To permit the construction of four industrial buildings pursuant to Section 9511 of the Huntington Beach Ordinance Code, located at the southwest corner of McFadden Avenue and Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. In conjunction with: USE PERMIT NO. 75-52 Applicant: W. B. Burke To permit trucking and loading facilities to face a public street pursuant to Section 9518 of the Huntington Beach Ordinance Code, located at the southwest corner of Graham Street and McFadden Avenue in a 100-M1-A-20,000, Restricted Manufacturing District. Secretary Palin informed the Board that the applicant has requested a continuance of these two applications. Board of Zoning Adjustments Wednesday, October 8, 1975 Page 2 REGULAR AGENDA ITEMS: USE PERMIT NO. 75-51 Applicant: Richard Sharp To permit a two (2) car carport for a single-family residence pur- suant to Section 9106 of the Huntington Beach Ordinance Code, located on the north side of McFadden Avenue approximately 140 feet west of Cambay Lane in an R1, Low Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Richard Sharp was present at the meeting. The Chairman reopened the public hearing. Mr. Sharp addressed the Board, outlining his attempts to comply with the requirements, including enlarging the window in the family room, closing off the sliding glass door into the carport, and installing a fire resistant wall. The applicant also indicated that he under- stands the interpretation of the Building Department to be that "finishing" the inside walls could be accomplished by painting only. There being no other persons to speak for or against the request, the Chairman closed the public hearing. Board discussion ensued, centering on how the code defines "finish- ing" of the inside of a carport and the effective date of adoption of regulations governing construction of this nature. ON MOTION BY CROSBY AND SECOND BY PALIN, USE PERMIT NO. 75-51 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL! A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received September 10, 1975, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Lot area; Lot width and lot depth; Type of use and its relation to property and improvem,_!nt_s in the immediate vicinity; Past administrative action regarding this property. 2. AYES: Palin, Crosby NOES: Lipps ABSENT: None USE PERMIT NO. 75-50 Applicant: Richard Bukowski To permit the construction of a 6,000 square foot office building pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard approximately 80-100 feet south of Talbert Avenue in a C4, Highway Commercial District. The Chairman informed the Board that Exemption Declaration No. 73-60 had been granted by the Environmental Review Board for this request on May 15, 1973. Richard Bukowski was present at the meeting. The Chairman opened the public hearing. There being no one present to speak for or against the project, the public hearing was closed. The Board discussed the project with the applicant, pointing out to him that the expiration of his previous permit requires that his plans now conform to all requirements which have subsequently been enacted. Discussed specifically were the width of allowed curb cuts on Beach Boulevard, width and quantity of landscaping to be provided, and minimum turning radius now required. Andy Vanderlaan cautioned the applicant against allowing parking in front of the building, thereby blocking off entry for emergency vehicles. ON MOTION BY CROSBY AND SECOND BY LIPPS, USE PERMIT NO. 75-50 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan and elevations received September 10, 1975, shall be the approved layout, subject to the modifi- cations described herein: a. A six-foot (61) landscaping strip shall be provided along the front property line. b. A 27-foot turning radius shall be provided. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifi- cations on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval by that Department. -4- BZA 10/8/75 1 Minutes: H.B. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and dev- ices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assess- ment district. 6. The developer shall participate in the Orange County Sani- tation District No. 3 Sewer Annex District. 7. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Beach Boulevard shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The location and width of the driveway shall be subject to the approval of the Traffic Engineer of the City of Hunting- ton Beach. AYES: Palin, Crosby, Lipps NOES: None ABSENT: None USE PERMIT NO. 75-54 Applicant: Cowgill, Kelly, & Smull To permit the construction of a 2400 sq. ft. storage unit to be used by the tenants of the existing shopping center, pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the east side of Brookhurst Street, approximately 270 feet north of Adams Avenue in a C4, Highway Commercial District. Negative Decl'aration No. 75-46 was granted by the Environmental Review Board for this request on October 7, 1975. The Chairman opened the public hearing. There being no one present to speak on the proposed project, the public hearing was closed. Mr. Cowgill was present at the meeting. -5- BZA 10/8/75 Minutes: H.B. Board of Zoning Adjustments Wednesday, October 8, 1975 Page 6 Board discussion of the request ensued, including nature of materials to be stored; turning radius and width of access aisles; openings in the north wall of the center; and how space in the building would be assigned. Walt Lipps expressed the opinion that this was in effect a mini -ware- house, and questioned whether it is an allowed use for the area. Even if conditioned to confine use to tenants of the center and re- strict types of storage, it was his feeling that further exploration should take place. Andy Vanderlaan agreed, citing the need to explore proper access for emergency vehicles. He also indicated some of the conditions the Fire Department would require; namely, one -hour rating for each cubicle wall, overhead sprinklering system, 30-foot drives, restrictions on storage, availability of master keys, etc. ON MOTION BY LIPPS AND SECOND BY CROSBY, USE PERMIT NO. 75-54 WAS CON- TINUED TO THE REGULAR MEETING OF OCTOBER 15, 1975, WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: Palin, Crosby, Lipps NOES: None ABSENT: None ADMINISTRATIVE REVIEW NO. 75-139 Applicant: W. Sterling Buck & Associates To permit the construction of a three -unit apartment building pursuant to S. 9231.6 of the Huntington Beach Ordinance Code, located on the southeast corner of Olive Avenue and 20th Street in an R4, High Density Residential District. The Chairman informed the Board that this request is a categorical exemption, Class III, California Environmental Quality Act, 1970. John Cowles was present to represent the applicant. The Board reviewed the plot -plan for the project, and discussed the conditions of approval. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 75-139 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. In accordance with the City`s standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley and an additional 20 foot radius at the inter- section shall be dedicated. 4. Board of Zoning Adjustments Wednesday, October 8, 1975 Page 8 TENTATIVE PARCEL MAP MO. 75-12 Applicant: Pacific Southwest Realty To permit a lot line adjustment between Parcels 1 and 2 of a prior division of land by adding 35 feet to Parcel No. 2, pursuant to the City's Subdivision Ordinance, located on the west side of Brookhurst Street approximately 160 feet south of Adams Avenue in a C4, Highway Commercial District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. R. Wayne Smith was present to represent the applicant. Jim Palin informed the Board that the suggested conditions of approval had been submitted to the applicant. The Board discussed those con- ditions and reviewed the submitted parcel map. ON MOTION BY CROSBY AND SECOND BY PALIN, TENTATIVE PARCEL MAP NO. 75-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on September 30, 1975, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works and recorded with the Orange County Recorder. 3. Compliance with all applicable City Ordinances. 4. A copy of the recorded parcel map shall be filed with the Planning Department. AYES: Palin, Crosby, Lipps NOES: None ABSENT: None MISCELLANEOUS: ADMINISTRATIVE REVIEW NO. 75-11 (REVISED PLAN) Applicant: Andy Lacono To permit revision to plan for a 5,328 square foot, one-story commercial retail building, pursuant to S. 9430.2 of the Huntington Beach Ordinance Code, located at the north side of Warner Avenue, approximately 110 feet west of Bolsa Chica, in a C2, Community Business District. Board of Zoning Adjustments Wednesday, October 8, 1975 Page 9 Jim Palin noted that when the revised plan was first before the Board it was under the assumption that it was only a revision to facilitate a change in landscaping dimension. However, applicant has now submitted a letter requesting that the Board review a totally revised plan, one which now reflects a maximum floor area of 5,328 square feet for a one-story facility and revision of the parking layout and the landscaping dimension on the front property line. Mr. Palin specifically stated that the Board's review today will be on the plan submitted on September 30, 1975, for Job No. 4331, dated March 26, 1975_ He also noted that the Board's review has disclosed certain discrepancies in the plan, such as front parking stalls pro- jecting beyond the landscaping screening and dimensions of the parking stalls adjacent to the building. Compliance with the code in regard to parking space dimensions will reduce the 28 spaces as shown on the plan to 27; however, the 5,328 sq. ft. area of the building requires 27 parking spaces, so the plans when modified to reflect true dimensions and locations of stalls will comply with the Huntington Beach Ordinance Code requirements on parking. Further discussion by the Board included pedestrian access across landscaped areas, screening walls and alternatives, and turning radius into the parking banks. Andy Vanderlaan questioned the future use of the second -story portion of the building. Mr. Lacono responded that it was intended only for storage and would not be used for any other purpose. ON MOTION BY LIPPS AND SECOND BY CROSBY, THE REVISED PLAN FOR ADMINISTRATIVE REVIEW NO. 75-11 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received and dated September 30, 1975, shall be the approved layout, subject to the amendments made thereon by the Board of Zoning Adjustments to reflect changes to the park- ing locations and dimensions. 2. All parking dimensions and striping shall be established in compliance with Article 979 of the Huntington Beach Ordinance Code, which provides for 12-foot wide stalls where adjacent to any structure over 12 inches in height or adjacent to a property line. Parking along the landscaped area at the front property line shall be striped to facilitate total screening of all portions of the parking area when viewed perpendicularly from the public right-of-way. -9- BZA 10/8/75 Minutes: H.B. The applicant has an option of providing a masonry screening wall for screening of the parking area and/or to install an intensified landscaping scheme to facilitate this screening. 4. The Board of Zoning Adjustments also recommends that the plan provide for a 27 ft. turning radius to all parking spaces, which when accomplished along the front property line, would neces- sitate a reduction in the proposed landscaping to a 7-foot wide landscaped area. This recommendation is to bring the plan into compliance with the existing provisions of the Huntington Beach Ordinance Code as well as to provide sufficient turning area, as many of the automobile operators may not park their automobiles immediately adjacent to the 6" raised curb around such landscaped area. 5. The parking area for the proposed use shall not be striped for more than 27 parking spaces, which is the required number of parking spaces for retail -commercial, pursuant to the Huntington Beach Ordinance Code. The Board discussed access, parking, and lighting provisions for the use. ON MOTION BY CROSBY AND SECOND BY LIPPS, SPECIAL EVENT NO. 75-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received October 3, 1975, shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. Robert Lichter was present to represent the application. The Board reviewed the request, discussing parking and access to the carnival area. ON MOTION BY PALIN AND SECOND BY CROSBY, SPECIAL EVENT NO. 75-21 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received October 8, 1975, shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. This permission covers the time period from October 10 through October 13, 1975, only. Andy Vanderlaan instructed the representative to make sure the carnival operator contacts the Fire Department as soon as possible for a field inspection of generators, gasoline storage, and other safety considerations. ON MOTION BY PALIN AND SECOND BY CROSBY, SPECIAL EVENT NO. 73-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received October 8, 1975, shall be the approved layout. 2. The applicant shall obtain all the necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. A representative from Neon Sign Company and a representative of Santa Barbara Savings were present at the meeting. Board discussed size and location of signs, making suggestions on consolidation and/or deletion of some of the smaller directional signs. ON MOTION BY LIPPS AND SECOND BY PALIN, SIGN REQUEST NO. 6652 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received October 2, 1975, shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. -12- BZA 10/8/75 1 Minutes: H.B. If possible, the entry sign should be incorporated on the lower portion of this ground sign, with a maximum total depth of forty-two (42) inches. AYES: Palin, Crosby, Lipps NOES: None ABSENT: None SIGN REQUEST NO. 6660 Applicant: Federal Signs To permit three wall signs with total square footage of 210 square feet and three ground signs, located at 7830 Edinger Avenue, Huntington Beach at American Savings and Loan office. The Board reviewed the plan, taking into consideration how the height of the signs would affect visibility for inner circulation on the project site. ON MOTION BY PALIN AND SECOND BY CROSBY SIGN REQUEST NO. 6660 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received October 3, 1975, shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. 3. To improve visibility for inner circulation, the heights of Signs f, k, and n shall be reduced by one course of blocks, or by a height of 6 inches.
