USE PERMIT NO. 75-56
Applicant: Signal Landmark, Inc.
To permit the construction of a 70,000 square foot shopping
center pursuant to Section 9472 of the Huntington Beach Ordi-
nance Code, located at the northwest corner of Atlanta Avenue
and Magnolia Street in a C4, Highway Commercial District.
The Chairman informed the Board that this request was granted
Exemption Declaration No. 74-135 by the Environmental Review
Board on September 10, 1974.
Bill Walkup, Roland Wedemeyer, and R. J. Marvick were present
to represent the applicant.
The Chairman opened the public hearing.
Linda Enochs addressed the Board, discussing pedestrian access
to the project. She requested that a crosswalk be installed at
Leasure Lane for the protection and safety of children who might
be using such crosswalk. Mrs. Enochs also discussed the bicycle
trail along Atlanta used by students at Gisler Junior High, the
proposed lighting of the project, and the signing which could be
installed in the streets warning of the crosswalk and the bicycle
traffic.
Others in the audience requested information from the applicants
concerning the architectural treatment and landscaping plans for
the project. Mr. Marvick replied that architecture would be
projected to tie in with Signals' adult project adjacent to the
north; landscaping will be according to City standards and re-
quirements.

There being no other persons to speak for or against the project,
the public hearing was closed.
Board discussion ensued. Jim Palin indicated that the revised
map now reflects the required 28-foot drive at the rear of the
market; areas 8 and 11 at the temporary bank facilities will be
required to conform to the minimum 27-foot drive width for turn-
ing radius. Bruce Crosby informed the applicants of the minimum
150 feet required to the left turn pockets in Magnolia and
Atlanta; he also indicated that the minutes should reflect the
fact that the Board requests installation of a crosswalk at
Leasure Lane into this facility.
Mr. Crosby stated that the City Traffic Engineer had considered
the possibility of a southbound left turn pocket on Magnolia
Street into the shopping center across Magnolia to the east and
determined that such pocket would be too close to the intersection.
ON MOTION BY PALIN AND SECOND BY LIPPS, USE PERMIT NO. 75-56 WAS
APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated October 29, 1975,
shall be the approved layout, subject to the modifications
described herein:
a. A minimum of 28-foot driveway width shall be provided
at the rear of the market.
b. Parking layout and design shall comply with Article 979
of the Huntington Beach Ordinance Code.
A plan delineating said modifications shall be submitted
to the Secretary of the Board. If such plan complies with
the modifications outlined by the Board, said plan shall
be approved and made a permanent part of the administrative
file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
Parking layout;
Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.

A. 2. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan. Said
plan shall indicate screening of all rooftop mechani-
cal equipment and shall delineate the type of material
proposed to screen such equipment.
3. Soil and compaction reports shall be submitted by a
certified soils engineer. Said reports shall be sub-
mitted to the Department of Building and Community Develop-
ment and shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm
systems, and any other required fire protection and de-
tection devices or systems shall comply with the speci-
fications of the Huntington Beach Fire Code. Plans for
such systems and devices shall be submitted to the Fire
Department and shall be subject to approval by the De-
partments of Fire and Public Works.
5. The developer shall participate in the local drainage
assessment district.
6. The developer shall participate in the Orange County
Sanitation District No. 3 Sewer Annex District.
7. All applicable fees shall be paid prior to issuance of
buiding permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Magnolia Street and Atlanta Avenue shall be improved to
the center lines of such rights -of -way. Said improvement
shall include curbs, gutters, sidewalks, paving, street
trees, street lights, street signs, street drainage, and
sewer and water main extensions, in full compliance with
the City of Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. Signs for the development shall be submitted to the Board
of Zoning Adjustments for approval.

C. 2. The left turn north on Magnolia Street shall be a mini-
mum of 150 feet in length.
3. Plans for the above shall be submitted to the Board of
Zoning Adjustments prior to the issuance of building
permits.

Applicant: Kendall Development Co., Inc.
To permit two additional model_ homes to a previously approved
model home and sales office complex, pursuant to Section 9730.18
of the Huntington Beach Ordinance Code, located on the north and
south sides of Woodboro Drive approximately 65 feet from Marber
Lane, in an R1, Low Density -Residential District.
The Chairman informed the Board that this project is a categorical
exemption, Class III, CEQA, 1970.
John Littmann was present at the meeting.
The Board reviewed the conceptual plan submitted.
ON MOTION BY CROSBY AND SECOND BY LIPPS, AR NO. 75-141 WAS
APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:

ADMINISTRATIVE REVIEW NO. 75-143
Applicant: Drafting Services, (J.C. Yates)
To permit the construction of a two -unit development pursuant
to Section 9161.2 of the Huntington Beach Ordinance Code,
located on the east side of 19th Street, approximately 125
feet south of Palm Avenue in an R2, Medium Density Residential
District.
The Chairman informed the Board that this request is a
Categorical Exemption, Class III, CEQA, 1970.
Pete Whitehead was present to represent the applicant.
The Board reviewed the conceptual plan and found the
application to be in conformance with the Ordinance
Code.
ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE
REVIEW NO. 15-143 WAS APPROVED WITH THE FOLLOWING
CONDITIONS, BY THE FOLLOWING VOTE:

The Chairman informed the Board that this request is a
Categorical Exemption, Class III, California Environ-
mental Quality Act, 1970.

Bruce Crosby requested that a notation be made on the
plot plan that the 10-foot setback as indicated is a
7.5-foot setback, and the plan was modified accordingly.

100 feet from Parkside Lane in an R3,.Medium-Density Residential
District.
The Chairman informed the Board that this request is a ministerial
act, exempt from the requirements of the California Environmental
Quality Act, 1970.

The Board reviewed the proposed plans, discussing patio sizes and
access thereto, apparent enclosure of the stairway,,balconies,
parking slot dimensions, and the cantilevering of the second story.

located on the east side of Chemical Lane approximately 235 feet
from Research Drive, in a.100-M1-A-20,000 Restficted Manufactur-
ing District.
This request.is covered by EIR No. 73-16, approved by the City
Council on -March 18, 1974.
Dave Ariss was present at the meeting.
In the Board discussion, Jim Palin noted that the space immedi-
ately adjacent to the -fence separation -would have to be widened
to a minimum of 11!6''_to permit.adequate parking space; this
additional area can be taken from the open space requirement, since
the project is over -the code in -that regard.

Applicant: Andy Lacono
To permit a revised landscape and screening plan for a 5,328 square
foot, one-story commercial retail building, located at the north
side of Warner Avenue approximately 110 feet west of Bolsa Chica
in a C2, Community Busines District.
Mr. Lorbeer, owner of the subject property, was present at the
meeting.
Secretary Palin informed the Board that the applicant has requested
to go with the intensified landscaping provision for screening in
an already -approved planter, as presently permitted by code, in
preference to the wall treatment. The Board reviewed the proposed
plan, noting that the planter is 9 feet instead of the required
10 feet in width. It was also noted that the configuration of the

planter was not the same as that shown on the revised plan
approved by the Board on October 8, 1975, and the applicant was
informed that this second configuration was not permitted.
Mr. Lorbeer addressed the Board, stating that the additional two
parking spaces allowed by the change in configuration were needed
for optimum use of the property; he requested that the Board re-
move the condition previously placed on the project regarding
parking and asked for approval of his intensified landscaping
plan. Mr. Lorbeer was informed that the Board could not amend a
prior plot plan through approval of a landscaping plan.
ON MOTION BY,PALIN AND SECOND BY CROSBY, THE LANDSCAPING AND
SCREENING PLAN FOR ADMINISTRATIVE REVIEW NO. 75-11 WAS APPROVED
WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The landscaping plan as submitted shall be installed
within the confines of the planter area along Warner
Avenue as depicted upon the revised plot plan approved
by the Board of Zoning Adjustments on October 8, 1975.
2. The plot plan received,in the Planning Department on
October 28, 1975, shall be the approved design for the
intensified landscaping, with the modifications as indi-
cated thereon.
