It was the recommendation of the staff that Conditional Use Permit No. 75-09 be continued until such time as the ordinances can be resolved as to the standards desired by the City. Mr. Williams concurred with the continuance. Chairman Slates opened the public hearing. There was no one present to speak on the application and the public hearing was closed. Planning Commission Tuesday, November 4, 1975 Page 2 CONDITIONAL USE PERMIT NO. 74-15 Applicant: Chester C. Smith A.Y.A. In Conjunction With TENTATIVE TRACT NO. 5813 Applicant: Conrad Cornfeldt & W. M. Rogers Conditional Use Permit No. 74-15 is a request to permit the construction of a 56 unit planned residential development on the east side of Pacific Coast Highway and north of Anderson Street. Tentative Tract No. 5813 is a request for a one lot subdivision on the east side of Pacific Coast Highway and north of Anderson Street. Jim Palin noted that the developer had provided a revised site plan which was on display for viewing by Commission. The Chairman opened the public hearing on Conditional Use Permit No. 74-15. Mr. Bill Duncan stated that he had been requested by Mr. Cornfeldt and Mr. Rogers to represent them. He stated that the owner of the 35 acres of property to the south is out of the country and therefore the applicant had been unable to contact him regarding obtaining access off of Anderson Street. An aerial slide of the property was shown. The public hearing was closed. Commission discussion ensued on the possibility of preparing a Precise Plan of Street Alignment for Anderson Street. The tentative map received and dated December 3, 1974, shall shall be the approved layout. Cost for the inspection shall be paid by the Subdivider. 3-1/2 percent of the amount of the improvement bond shall be deposited with the City Engineer for inspection costs. 7. All utilities shall be installed underground. B. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the project. 9. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11 respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 10. All building spoils, such as unusable lumber, wire, pipe, and other surplus and unusable material, shall be disposed of at an off site facility equipped to handle them. 11. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers. Natural gas shall be stubbed in at locations of cooking facilities, water heater, and central heating units. 12. An Engineering Geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 13. All structures proposed for construction within this subdivision shall be constructed in compliance with the g-factors as indicated by the geologist's report. 14. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review prior to the issuance of building permits. 15. A chemical analysis, as well as tests for physical properties of the soil on subject property, shall be submitted to the City for review prior to the issuance of building permits. 16. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State Acoustical Standards set forth for all units that lie within the 60 CNEL contours of the property. - -4- 11/4/75 - PC 1 Minutes: H.B. The exterior elevations of all buildings proposed for construction within said project shall comply with the archi- tectural design of the units submitted to the Planning Commission for approval in conjunction with the site plan and tentative map. 18. The developer shall endeavor to provide access to the develop- ment over an easterly extension of Anderson Street as it is the preferred access because of safety and traffic reasons. 19. If dedication can be accomplished for the easterly extension of Anderson Street, the developer shall be required to improve a minimum of two travel lanes over this easterly extension for access from the development to Pacific Coast Highway. In addition, full improvements of Anderson Street shall be pro- vided along that portion of the subject property abutting Anderson Street. The proposed subdivision of this 2.64 acre parcel of land zoned R4 (which allows 35 units per gross acre) is proposed to be constructed having only 20 units per gross acre. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for high density residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map and supplementary City Subdivision Ordinance. The Plot Plan Amendment filed was for a requested revision to an already approved plot plan for a Planned Residential Development by retention of an existing oil well and the relocation of the pad for such facility, the realignment of two buildings having attached structures, and the deletion of three units from the approved plan. -7- 11/4/75 - PC Minutes: H.B. Planning Commission Tuesday, November 4, 1975 Page 8 This appeal was filed by the Mansion Hall Company to the conditions required by the Board of Zoning Adjustments in their approval of Plot Plan Amendment No. 75-5, which was before the Board at its meeting of October 1, 1975. Jim Palin presented a vugraph. Chairman Slates opened the public hearing. Mr. M. Looain, representing Mansion -Hall Company addressed the Commission and stated that the oil wells ould fall under the jurisdiction of the Huntington Beach Oil Code. He further stated that Mansion -Hall, a subsidiary of the Huntington Beach Company, did not have control over the wells and would be unable to comply with any restrictions placed on the oil wells. Mr. Jerry Shea', representing Mansion -Hall, addressed the Commission and spoke in favor of the appellant. Mr. W. T. Cudmore, a resident of Beachwalk, addressed the Commission and spoke in favor of the conditions which had been imposed by the Board of Zoning Adjustments. Another resident of Beachwalk addressed the Commission and discussed the noise level and the need for a guaranteed landscaping of the area. The public hearing was closed. The Commission discussed the five conditions which had been imposed. ON MOTION BY PARKINSON AND SECOND BY KERI_NS APPEAL TO PLOT PLAN AMENDMENT NO. 75-5 WAS APPROVED AS MODIFIED WITH THE FOLLOWING CONDITIONS IMPOSED AND BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF PERMITS: 1. The plot plan amendment received September 17, 1975, shall be the approved layout. In its approval action, the Planning Commission considered the following issues relating to the conceptual plan: Traffic circulation and drives; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. -8- 11/4/75 - PC Minutes: H.B. Plans for the wall design and plans for the landscaping and irrigation system for the area immediately surrounding the facility shall be submitted to the Secretary of the Board of Zoning Adjustments for approval action prior to the issuance of a building permit for the area. 2. Upon termination of the oil operation at this facility, the oil site shall be conveyed in fee to the Homeowners' Association and be restored to a landscaped area that can be utilized by the Association as open space. AYES: Parkinson, Bazil, Finley, Slates, Boyle, Kerins NOES: None ABSTAIN: Shea CONDITIONAL USE PERMIT NO. 75-17 Applicant: Huntington Beach Court Club This application is a refiling of previously approved Conditional Use Permit No. 74-13 which expired on September 4, 1975. The request is for a ten court handball/racquetball complex with locker facilities, saunas, and a fully equipped pro shop. John Cope stated that the plan is identical to the original plan with the exception of some minor interior revisions. Chairman Slates opened the public hearing. Mr. G. M. Hofmann, representing the applicant, addressed the Commission and stated that the conditions of approval recommended by the Staff met with his approval. The public hearing was closed. Commission discussion ensued. ON MOTION BY KERINS AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 75-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL BY THE FOLLOWING VOTE: FINDINGS: 1. The proposal will provide a service to the public not readily available in the general area. 2. The proposed layout and design has been integrated with planning efforts of adjacent properties, thus a more efficient and functional complex is likely to occur. 3. The conceptual plot plan received October 16, 1975 shall be the approved layout. In its approval action, the Planning Commission considered the following issues relating to the conceptual plan: . Traffic circulation and drives . Parking layout Lot area . Lot width and lot depth . Type of use and its relation to property and improvements in the immediate vicinity . Past administrative action regarding this property. 2. A landscape and irrigation plan shall be submitted to the Planning Department prior to the issuance of building permits. Said plan shall be subject to approval by the Secretary of the Planning Commission. 3. The property shall participate in the local drainage assessment district. 4. Soil reports as required by Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 5. Reciprocal agreements for ingress and egress and circulation over the subject property and the shopping center to the east shall be submitted to the Planning Department. Form and content shall be subject to approval by the City Attorney. 6. All building spoils such as unusable lumber, wire, pipe, and other surplus or unusable material shall be disposed of at an offsite facility equipped to handle them. 7. Hours of operation shall be limited from 7:00 a.m. to 12:00 p.m. 8. Detached advertising copy shall be incorporated with advertising copy for the future office development in front of the subject property. Planning Commission Tuesday, November 4, 1975 Page 11 ON MOTION BY SLATES AND SECOND BY BOYLE THE VACATION OF PORTIONS OF MC FADDEN AVENUE AND GRAHAM STREET FOR CONFORMANCE WITH THE GENERAL PLAN, PRECISE PLAN OF STREET ALIGNMENT NO. 75-6 AND CONDITIONS OF APPROVAL FOR TRACT 6948 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None Secretary Harlow discussed the City Council meeting of November 3, 1975. He noted that there will be a joint meeting of Planning Commission and City Council on November 24, 1975. Chairman Slates suggested that Commissioners contact Mr. Harlow prior to November 17, 1975 with suggestions for topics to be listed on the Agenda in order that the City Council will know ahead of time the topics to be discussed. ORAL COMMUNICATIONS: None WRITTEN COMMUNICATIONS: None COMMISSIONERS' COMMENTS: Commissioner Finley felt that in some instances the Commission was not apprised of all the facts pertaining to some applications which caused her some concern. It was noted that the Staff is not always aware of facts which come to light at the Council level. Commissioner Shea discussed the new pumping station and inquired if an Environmental study had been made prior to installation. Mr. Palin stated that he would investigate.
