BOARD MEMBERS PRESENT: JAMES PALIN, BRUCE CROSBY, PAT SPENCER CITY STAFF PRESENT: ANDY VANDERLAAN, FIRE DEPARTMENT REGULAR AGENDA ITEMS: PLOT PLAN AMENDMENT NO. 75-06 (Cont. from 10-22-75) Applicant: Huntington Continental Townhouse Association #2 To permit the addition of a 13' x 20' storage room to an existing carport structure pursuant to Section 9811.4 of the Huntington Beach Ordinance Code, located at the northeast corner of Bushard Street and Adams Avenue in an R3, Medium -High Density Residential - District. -The Chairman informed the Board that this project is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Cris. C. Cris was present to represent the application. The Chairman reopened the public hearing. Mr. Cris addressed the Board, stating that the Association has studied the Board's recommendations for relocation of the proposed facility and has determined not to amend the application to reflect the different location, as it is their feeling that the out-of-the- way site originally proposed best suits their purposes.; He also noted that the trees which were previously discussed have already been removed. - There being no other persons present to speak for or against the project, the public hearing was closed. Board discussion ensued. Dimensional errors were noted which would require decreasing_ the width of the facility from the proposed 13 feet to 10110" in order to obtain required setback. From the wall of the carport to the sidewalk is 1214" instead of 131; from the walk to the wall is 816" instead of 10 feet. Jim Palin restated his feeling that relocation of the facility would result in less disturbance to existing owners and occupants within the project. Minutes, H.B. Board of Zoning Adjustments November 5, 1975 Page 2 ON MOTION BY SPENCER AND SECOND BY CROSBY, PLOT PLAN AMENDMENT NO. 75-06 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received October 3, 1975, shall be'the approved layout, subject to the modification des- cribed herein: a. The northerly wall of the storage facility shall line up with the northerly wall of the -unit to the east. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and madea permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; • Parking layout; • Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; - . Past administrative action regarding this property. AYES: CROSBY, SPENCER NOES: PALIN ABSENT: NONE Jim Palin submitted a minority report, stating his reasons for a "no" vote as follows: 1. The nature of the facility is such that it is to be used for equipment for the maintenance contractor; therefore, the proper location of the facility should be within the open space areas, to eliminate the interruptions and disruptions to the abutting residents. 2. There is sufficient area which could accommodate this structure within that open space area, not requiring that the main- tenance contractor penetrate the drive at this location. 3. There are sufficient open parking spaces adjacent to the loca- tion within the open space area to accommodate the equipment used by the maintenance contractors. Minutes, H.B. Board of Zoning Adjustments November 5, 1975 Page 3 CONDITIONAL EXCEPTION NO. 75-40 Applicant: La Cuesta To permit a one -foot encroachment of an overhang into the required 30-inch setback in lieu of Section 9103.4.2.2 of the Huntington Beach Ordinance Code, located at the northwest corner of Yacht Lane and Windlark Drive in an Rl, Low Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Mike Jager was present to represent the application. The Chairman opened the public hearing. Mike Jager addressed the Board, pointing out that the non -conforming portion of this overhang is a 14-foot run, and the abutting house will corner onto the property line at the projection. The setback on the other side of the non -conforming house is 15 feet, which would leave ample room for storage of recreational vehicles, etc. There was no one else to speak on the proposed project, and the Chairman closed the public hearing. The Board reviewed the plot plan, considering the distances between units and the setback of the abutting house. ON MOTION BY PALIN AND SECOND BY SPENCER, CONDITIONAL EXCEPTION NO. 75-40 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The proposed encroachment could be made to conform by modifying a 14-foot run with a one foot reduction. 2. The minimum separation between the structure proposed with the 18-inch projection and the abutting structure is eight feet at the closest point. 3. The dwelling constructed on Lot 20 is situated at a diagonal to the proposed projection at the point of such projection. 4. To require modification to comply with the Ordinance Code would create an odd appearance to the eave projection of this unit. CONDITIONS"OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received October 14, 1975, shall be the approved layout. Minutes, H.B. The opposite side yard (which is shown on the plot plan submitted with the conditional exception request as 15-B) shall be retained open and clear for use of future recre- ational vehicle storage. AYES: PALIN, CROSBY, SPENCER NOES:' NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 75-41 Applicant: Grant Campbell and/or Stanley Smith To permit the installation of two doors in a wall that is con- structed on a zero property line in lieu of Section 9513.3(b)(2) of the Huntington Beach Ordinance Code, located on the south side of Research Drive approximately 125-feet,east of Chemical Lane, in a 100-M1-A-20,000 Restricted Manufacturing District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California,Environmental Quality Act, 1970. Stanley Smith was present at the -meeting. The Chairman opened the public hearing. There being no one present to address the Board in regard to the project, the public hearing was closed. The Board discussed a condition previously imposed on this property when Division of Land 74-12 was approved, which required that a parcel map be filed and recorded to consolidate Lots 12 and 13 into a single parcel. Also considered was the necessity to restore the structure to the original requirements for the zero setback if and when the present operator's lease should expire. ON MOTION BY SPENCER AND SECOND BY PALIN, CONDITIONAL EXCEPTION NO. 75-41 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: - FINDINGS OF THE BOARD: 1. Installation of these doors=is'desirable to increase the usability of these two different development sites for the pur- pose of a single user. I Minutes, H.B. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received October 15, 1975, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; • Parking layout; . Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. A bond shall be prepared to the approval of the City Attor- ney's office and filed with the Department of Building and Community Development of the City of Huntington Beach to assure that, should the lease on the two buildings be term- inated, the wall will be reconstructed to its original requirement for zero setback. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. A parcel map shall be recorded in the Orange County Recorder's Office and a copy submitted to the Department of Building and Community Development, pursuant to the original condi- tions of approval imposed on Division of Land No. 74-12. Jones To permit the reduction of: 1) the required number of parking spaces from 6 to 5 in lieu of Section 9493.2(b); 2) required stall size from 8'6" x 19' to 716" x 15' in lieu of Section 9791(d); 3) the required front yard setback from 20 feet to 12 feet in lieu of Section 9513.2(a); 4) required minimum landscaping dimension from 10 feet to 7 feet in lieu of Section 9513.2(f); 5) required turning radius from 27 feet to 25 feet in lieu of Section 9791(d) of the Huntington Beach Ordinance Code; for a 3100 square foot industrial building, located on the south side of Slater Avenue ap- proximately 460 feet east of Gothard in an Ml-A-15,000-CD, Restricted Manufacturing District. rr •n . . - -r - 1. - . - Minutes, H.B. Board of Zoning Adjustments November 5, 1975 Page 6 The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Mr. Jones was present at the meeting. The Chairman opened the public hearing. Mr. Jones addressed the Board and briefly reviewed the history of the subject project, relating the -problems with access and zoning which had resulted in his purchasing two additional pieces of property to accommodate the proposed precise plan of street align- ment in the area. Review by staff and the desires of a prospec- tive tenant have resulted in the plan submitted, with a reduced building size, access.taken from the side street rather than from Slater Avenue, and parking provided on the side of the property. The Chairman closed the public hearing. Jim Palin amplified the applicant's explanation and expressed the Planning Department's endorsement of the submitted plan. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 75-42 WAS -APPROVED WITH_THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD:- 1. Grantinq'of this conditional exception enables the City to achieve effective landscaping at this location, which will enhance the aesthetics of the general area of Central Park. 2. This request -will eliminate a curb cut immediately adjacent to a local street, thus avoiding potential traffic and safety problems at intersection.of Slater -Avenue with the local street. 3. The setback as -now proposed exceeds that which was required at the time a previous plan was approved for the project. 4. The applicant had been penalized by the City's action in plac- ing more restrictive zoning requirements on the subject property after -approved plans had -been processed for develop- ment. 5. Granting of.this request allows implementation of a Precise Plan of Street -Alignment for placement of future street access to the industrial area to the south of subject property. CONDITIONS.OF APPROVAL. - A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received October 16, 1975, shall be the approved layout. Minutes, H.B. GENERAL CONDITIONS: All applicable conditions previously imposed on Administrative Review No. 74-191 when it was conditionally approved on December 11, 1974, shall apply. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 75-58 Applicant: Standard Oil Company of California To permit the construction of a gas treatment plant pursuant to Section 9686 of the Huntington Beach Ordinance Code, located 415 feet south of Garfield Avenue and 495 feet west of Goldenwest Street, in an RA-02-CD, Residential -Agricultural combined with Oil Production District. Negative Declaration No. 75-72 was granted by the Environmental Review Board for this project on November 4, 1975. Mike Waske, Ed Scott, and Walter Dabney were present to represent the applicant. The Chairman opened the public hearing. Mr. Waske addressed the Board, explaining that the intent of the project is to consolidate three existing treatment plants into one more modern and efficient facility. Gil Nixon, resident of Huntington Seacliff, addressed the Board in opposition to the proposed project. He presented a petition signed by approximately 200 other residents of the area, and expressed the opinion that this project would be detrimental to family living and would reduce property values in the vicinity; he also suggested that the plant could be located in a more remote area. Mr. Nixon also objected that no environmental impact report had been received by adjacent property owners. BZA 11-5-75 Page 7 Minutes, H.B. Board of Zoning Adjustments November 5, 1975 Page 8 Tom Welch spoke in opposition to the project, citing the present conditions of tanks existing on the Standard lease, noxious fumes emanating from the present operation, condition of sumps in the area, and the anticipated life span of the oil operations on the site. Mr. Welch also suggested that if adjacent residents knew the total planning concept for the entire 40 acres they might feel more comfortable with the proposed project as it relates to that total plan. Nancy Pinelle questioned whether the conversion or modernization of the existing plants had been considered at all and if any future development has been planned to reflect possible use of the old plant locations. Gayle Palmin also opposed the project on aesthetic grounds, asking that landscaping and maintenance plans be made available. Mr. Waske responded to the questions raised above, explaining the reasons for siting the plant where it has been located, the opera- tions in the field and conditions which make a new plant more feasible than conversion of old plants, and the type of fuel the plant will use. The Chairman closed the public hearing. Board discussion ensued. Mr. Palin explained the environmental review process to the audience, and reassured them that no City approval would be.granted to such projects without ample precautions being taken to make them as aesthetically pleasing as possible and to protect the health, safety, and welfare of adjacent property owners. Andy Vanderlaan,submitted for the record a list of conditions the Fire Department would require to be placed on the project. Mr. Vanderlaan further stated his feeling that the proposed plant would be a beneficial step towards the consolidation of the total opera- tion, but to accomplish this without conditions and modifications to the Entire present field would not really address all the issues which have been presented here. After further discussion among Board members, applicants, and the representatives of the -home owners, it was the consensus that Standard Oil should arrange a meeting with concerned residents in order to'present a detailed and comprehensive view of what they are actually proposing. Jim Palin indicated that a report from Bob Davis, Oil Field Superintendent, should be filed on recommenda- tions for bringing the existing field up to code requirements. Andy Vanderlaan pointed out to the audience that it would be un- realistic to anticipate that the whole area could be improved over- night; but that this process could be utilized to obtain a commitment from the oil operator and establish some kind of time frame in which such improvements could be accomplished. Board of Zoning Adjustments November 5, 1975 Page 9 ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 75-58 WAS CONTINUED TO THE MEETING OF NOVEMBER 12, 1975, TO PERMIT SUBMITTAL OF A REPORT FROM THE OIL FIELD SUPERINTENDENT, WITH THE CONCUR- RENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 75-59 Applicant: Gerald S. Thomas To permit the construction of a single-family residence pursuant to Section 9231.1 of the Huntington Beach ordinance Code, located on the west side of 19th Street approximately 125 feet north of Walnut Avenue in an R4, High Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Gerald Thomas was present at the meeting. The Chairman opened the public hearing. There being no one present to speak for or against the project, the public hearing was closed. Board discussion ensued. The plan was found to be in conformance, but the indicated zoning of R3 was changed to reflect the true R4 zoning. ON MOTION BY CROSBY AND SECOND BY PALIN, USE PERMIT NO. 75-59 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. Negative Declaration No.- 75-44-was granted•for this project by the Environmental Review-Board=on June 17,-1975: Richard Simone and John Gabriel were present to represent the application. - The Board reviewed the plot plan with the applicants. Mr. Simone indicated that required dedication presented no problem, but they would like to postpone improvements on Parcel 2 if possible. Bruce Crosby. explained the traffic hazard•which would result from the unimproved access street; however, he also indicated that the Department of Public Works has discretionary authority for approval of some type of.partial-, temporary improvement which would allevi- ate the traffic -problems.- Also discussed was the sign location as indicated on the plan. ON MOTION BY PALIN AND'SECOND'BY CROSBY, NEGATIVE DECLARATION NO. 75-44,WAS ADOPTED, -BY THE FOLLOWING -VOTE: AYES: PALIN, NOES: NONE ABSENT: NONE CROSBY, SPENCER ON MOTION BY PALIN AND SECOND BY SPENCER, ADMINISTRATIVE REVIEW NO. 75-147 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received October 28, 1975, shall be the -approved layout-, as amended to show landscaping between the total setback area from the building to the right-of-way line. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. In accordance with the City's standards and requirements, an additional twenty feet (20') of right-of-way on Magnolia Street shall be dedicated. 4. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm sys- tems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sani- tation District No. 3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Magnolia Street shall be improved to the center line of such right-of-way. C. GENERAL CONDITIONS: 1. Full dedication shall be required on Garfield Avenue along Parcel No. 2, and this dedication shall be improved to Public Works standards and requirements. 2. The sign location indicated on the plot plan is not a part of this conditional approval. 3. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a mini- mum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 6. All structures proposed for construction at this location shall be constructed in compliance with the g-factors as indicated by the geologist's report. 7. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City for review. Secretary Palin reviewed the conditions originally imposed upon this administrative review application, which required that addi- tional parking be provided in phases as the use expanded. Mrs. Fowler explained the change in occupancy which is proposed to take place. After review of the original plot plan, the Board determined that the proposed plan would satisfy the intent of the conditions imposed.
