HomeMy WebLinkAbout1975-12-10MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center Huntington Beach, California WEDNESDAY, DECEMBER 10, 1975 - 1:15 PM BOARD MEMBERS PRESENT: PALIN, CROSBY, SPENCER MINUTES: ON MOTION BY PALIN AND SECOND BY SPENCER, MINUTES OF THE REGULAR MEETING OF NOVEMBER 12, 1975, WERE APPROVED AS TRANS - SCRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT% NONE REGULAR AGENDA ITEMS: USE PERMIT NO. 75-65 (Cont. from 12-3-75) Applicant: Frank Clendenen To permit the construction of a 124-unit apartment building complex pursuant to Sections 9162.3.1 and 9202.3.1.3 of the Huntington Beach Ordinance Code, located on the east side of Bolsa Chica Street ap- proximately 1000 feet south of Warner Avenue in both an R2 and R3, Medium and Medium High Density Residential Districts. Frank Clendenen was present at the meeting. The Chairman reopened the public hearing. The applicant informed the Board that his engineer had not yet com- pleted the required sections and profiles, and suggested approval contingent upon receipt of those plans. James La P4orte, neighboring property owner, submitted photographs of nearby apartment buildings visible from the R1 homes in the area, and asked that some sort of architectural treatment be a condition of approval, to assure a more aesthetically pleasing view from homes abutting this project. The Chairman closed the public hearing. Secretary Palin indicated his reluctance to give further considera- tion to this project without the requested information, as well as an indication of the architectural treatment intended for the rear of the apartments. Also, the Board discussed the type of fencing materials which would be used on this rear property line. Minutes, H.B. Board of Zoning Adjustments December 10, 1975 Page 2 ON MOTION BY CROSBY AND SECOND BY PALIN, AND WITH THE CONCURRENCE OF THE APPLICANT, USE PERMIT NO. 75-65 WAS CONTINUED TO THE REGU- LAR MEETING OF DECEMBER 24, 1975, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT:NONE ADMINISTRATIVE REVIEW NO. 75-162 Applicant: Gerald D. Hiland To permit the construction of a 10,500 square foot industrial build- ing pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the west side of Computer Lane approximately 245 feet south of McFadden Avenue in a 100-M1-A-20,000 Restricted Manufactur- ing District. The Chairman informed the Board that this request is covered by EIR No. 73-16, approved by the City Council on March 18, 1974. Bruce Crosby pointed out discrepancies between the dimensions indi- cated on the submitted plans and the true conditions existing upon the property. The Board also discussed width of parking stalls and location of the trash area. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75-162 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received December 2, 1975, shall be the approved layout, subject to the modifications described herein: a. The true condition of the street section of Computer Lane shall be shown, reflecting the true sidewalk width and the half -street section of 28 feet (22 feet to curb with a 6-foot parkway). h. The plan shall reflect the 2-foot easement for public utility purposes. C. Parking stalls Nos. 1, 10, and 11 shall be revised to reflect the 11.5 feet necessary to comply with the Ordin- ance Code requirement for the additional 3 feet in width where such stall abuts a property line or a structure over 12 inches in height. If such plan complies with the modifications outlined by the Board, said plan shall be ap- proved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; • Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 75-111 Applicant: Carl M. Weaver To permit the establishment of a non-commercial horse corral for two (2) equines pursuant to Section 9632 of the Huntington Beach Ordin- ance Code, located between Goldenwest Street and Stewart Street, approximately 388 feet south of Garfield Avenue in an RA-0 and RA-O-CD Residential -Agricultural, Civic District. Herb Day was present to represent the application. The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Mr. Day explained the conditions of the lease on the property, noting that the length of the lease was tied to the production of "paying quantities" of crude oil. The Board discussed development of adjoin- ing property which might take place in the future. ON MOTION BY SPENCER AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 75--163 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO THE ISSUA*ICE OF BUILDING PERMITS: 1. The plot plan received December 4, 1975, shall be the approved layout. This approval shall apply until the termination of applicant's lease or until the adjacent property shall be developed to residential uses. At such time as either of the above shall occur, this approval shall become null and void. Galich To permit the establishment of a light auto service and tune-up in an existing building, pursuant to Section 9451 of the Huntington Beach Ordinance Code, located at the northeast corner of Pacific Coast Highway and Second Street, in a C3, General Business District. ON MOTION BY SPENCER AND SECOND BY PALIN, THE BOARD DETERMINED TO RECONSIDER THE CONDITIONS OF APPROVAL ON THIS REQUEST BY THE FOLLOWING VOTE: AYES: PALIN, SPENCER, CROSBY NOES: NONE ABSENT: NONE Secretary Palin informed the Board that an opinion has been received from the office of the City Attorney indicating that no requirements already provided for in the Ordinance Code may be part of the condi- tions of approval on.a request. Such inclusion would allow those re- quirements to be challenged via the appeal process; therefore, the purpose of this reconsideration is to delete all code requirements from this previously approved Administrative Review. ON MOTION BY SPENCER AND SECOND BY PALIN THE ORIGINAL CONDITIONS FOR THIS REQUEST WERE RESCINDED AND ADMINISTRATIVE REVIEW NO. 75-155 WAS APPROVED WITH THE FOLLOWING AMENDED CONDITIONS, BY THE FOLLOWING VOTE: 1 BZA 12-10-75 Page 4 1 Minutes, H.B. A revised plot plan shall be submitted to the Board of Zoning Adjustments for review and approval action. Said plan shall indicate the following: The revised plan shall incorporate all necessary parking for the use and screening in compliance with Article 979. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection dev- ices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 3. All applicable fees shall be paid prior to issuance of building permits. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 75-64 Applicant: Leonard 0. Lindborg To permit the construction of a 17-unit apartment building pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code, loc- ated on the west side of Holly Street, approximately 235 feet south of Garfield Avenue in the R3 Medium -High Density Residential District. Secretary Palin informed the Board that its previous action had failed to include the Negative Declaration granted for this project by the Environmental Review Board. It was the consensus of the Board that mitigating measures necessary to lessen the cumulative impacts of successive developments of this nature at this general location should be incorporated into this project, as they have been BZA 12-10-75 Page 5 Minutes, H.B. Board of Zoning Adjustments December 10, 1975 Page 6 incorporated in previous Board approval of Use Permit 75-37 (a 17- unit complex abutting subject property cn the north) and Use Permit No. 75-66 (a 14-unit complex abutting subject property on the south). ON MOTION BY PALIN AND SECOND BY SPENCER, THE BOARD ADOPTED NEGATIVE DECLARATION NO. 73-42 AND AMENDED THE CONDITIONS OF APPROVAL FOR USE PERMIT NO. 75-64 AS FOLLOWS, BY THE FOLLOWING VOTE: ADDITIONS TO CONDITIONS OF APPROVAL: C. GENERAL CONDITIONS: (Cont.) 5. If the developer proposes to provide air conditioning, the in- sulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 6. All building spoils such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 7. Natural gas and 220V electrical shall be stubbed in at the loc- ation of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth movement for the project property. 9. All structures proposed for construction within this project shall be constructed in compliance with the g-factors as indicated by the geologist's report. 10. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. 11. The structures on subject property, whether attached or det- ached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. The Board reviewed the submitted plans. ON MOTION BY PALIN AND SECOND BY SPENCER THE SCHEMATIC PRESENTA- TION AND MATERIALS AS SUBMITTED WERE APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received and dated December 3, 1975, shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code.
