Applicant: Jerry J. Galich
To permit the establishment of a light auto service and tune-up
facility in an existing building, pursuant to Section 9451 of the
Huntington Beach Ordinance Code, located at the northeast corner
of Pacific Coast Highway and Second Street in a C3, General Busi-
ness District.
The Chairman informed the Board that this project is a Categorical
Exemption, Class I, California Environmental Quality Act, 1970.
Jerry Galich was present at the meeting.
It was determined that the previous use on this building had been
abated; therefore, it will be necessary for any future use to comply
fully with all requirements of the code. This property is in a
commercial zone with required 30-foot alley width and will necessi-
tate a seven and one-half foot dedication on the alley; this re-
quirement would place the existing building in a position of encroach-
ing over the City's ultimate right-of-way. Parking provisions and
size of parking stalls were also discussed.

1. A revised plot plan shall be submitted to the Board of Zoning
Adjustments for review and approval action. Said plan shall
indicate the following:

a. The location of the building shall be delineated upon
the site plan affording the necessary required dedi-
cation on the alley to bring that alley into compliance
with standard plans and specifications for alleys of
this nature.

ing required for the use and screening in compliance
with Article 979.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
. Parking layout;
Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
2. The following plan shall be submitted to the Secretary of
the Board:
Landscape and irrigation plan complying with Article 979 of
the Huntington Beach Ordinance Code and landscaping specifi-
cations on file in the Department of Public Works.
3. In accordance with the City's standards and requirements,
an additional seven and one-half feet (7-1/2') of right-of-
way on the abutting alley shall be dedicated.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and dev-
ices shall be submitted to the Fire Department and shall be
subject to approval by the Departments of Fire and Public
Works.
5. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Second Street and the alley shall be improved to City stand-
ards. Improvements on Second Street shall facilitate
deletion of one of the curb cuts now existing, with new
curbs, gutters, and sidewalks installed at that location.

USE PERMIT NO. 75-64
Applicant: Leonard 0. Lindborg
To permit the construction of a 17-unit apartment building pursuant
to Section 9202.3.1.3 of the Huntington Beach Ordinance Code,
located on the west side of Holly Street, approximately 235 feet south
of Garfield Avenue in the R3 Medium High Density Residential District.
The Chairman informed the Board that Exemption Declaration No. 73-42
was granted by the Environmental Review Board for this project on
May 1, 1973.
Rex Hoover was present to represent the application.
Secretary Palin reported that the applicant has requested further
continuance of this request to permit time to analyze and resolve
problems on the revised plot plan.
ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 75-64 WAS

2. S. 9492(b): Reduction of the interior side yard setback from the
required 25 feet to as little as 0;
3. S. 9492(d): Reduction of the rear yard from the required 25
feet to as little as 0;
4. S. 9493(e)(1): A waiver of the required 5-foot planter area
along portions of the front property line;

JECT, SCHEDULED TO BE HEARD BEFORE THE COMMISSION AT ITS DECEMBER

CONDITIONAL EXCEPTION NO. 75-44
Applicant: Willis H.,Chapman
To permit the construction of a room addition at zero setback along
a 10-foot drainage easement in lieu'of the required 5-foot setback,
in lieu of Section 9960.2(c) of the Huntington Beach Ordinance Code,
located on the south side of Rio Vista Drive approximately 125 feet
west of Goldenwest Street in an Rl, Low Density Residential District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class I(e), California Environmental Quality Act; 1970.
Willis and Clara Chapman were present at the meeting.
The Chairman opened the public hearing.
Mrs. Chapman addressed the'Board, stating their reasons for request-
ing the exception and explaining the use to�which the addition will
be put.
There being no'other persons to speak -on the project, the public
hearing was closed.
The Board discussed the location and depth of the drain conduit within
the easement, and the possible slumping which might occur (with re-
sultant damage to an adjacent structure) in the event it became nec-
essary to do maintenance work on the pipe.
On motion by Palin and second by Lipps, the Board voted unanimously
to table temporarily while the applicants attempted to obtain from
Public Works information on the depth and exact location of the pipe.
The applicants returned to the meeting with the information that the
bottom of the pipe is at a depth of 10.5 feet. It was the consensus
that this depth would preclude construction of footings to an equal
depth; and Secretary Palin expressed reluctance to approve the request
unless a "hold harmless" letter could be submitted from the applicant

to absolve the City of responsibility for damage to the structure
from necessary work within the easement. The applicants agreed
with this proposal, with reasonable prudence to be taken by the
City.
Further discussion by the Board touched upon the size and config-
uration of other lots within the same subdivision, possible
alternative locations for the addition, and whether or not denial
would constitute a hardship to the applicants.
ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION
NO. 75-44 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. Because the subject property is the only lot in this sub-
division which has the 10-foot storm drain easement existing
upon it, denial of this request would deprive the applicant of
privileges available to owners of other lots of the same size
and same floor plans within the subdivision.
2. The proposed project will not be detrimental to the health,
safety, and welfare of adjacent property owners.
3. Granting of this request will not establish a precedent or
constitute granting of special privilege, due to the exceptional
circumstances existing on the property.
4. Approval of this conditional exception request allows the pre-
servation and enjoyment of substantial property rights.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received November 11, 1975, shall
be the approved layout, subject to the modifications des-
cribed herein:
a. Revised plans shall be submitted reflecting the depth
and location of the existing pipe in the storm drain
easement.
A plan delineating said modification shall be submitted to
the Secretary of the Board. If such plan complies with the
modification outlined by the Board, said plan shall be
approved and made a permanent part of the administrative file.
2. The applicants shall submit a letter to the Secretary of the
Board containing a hold -harmless clause which shall absolve
the City of responsibility for damage to the structure which

might result from future necessary maintenance operations
in the storm drain easement and/or repair of the pipeline.
3. The depth of the footings which shall be required for the
subject structure shall be a determination of the Structural

ment, City of Huntington Beach.

Applicant: Terry Aggers III
To permit an encroachment of 10 feet into the required 20-foot rear
yard and a 4.5 foot encroachment into the required 5-foot interior
side yard. The encroachments involve the necessary fencing for tennis
courts which are part of a proposed private recreational complex;
located on the southeast corner of Ellis Avenue and Edwards Street, in
the RA -CD (Residential-Agricultural/Civic District).
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. There being no one present to
speak for or against the proposed use, the public hearing was closed.
ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO.

USE PERMIT NO. 75-63
Applicant: B & B Developers
To permit the construction of a 20-unit apartment building pursuant
to Section 9202.3.1.3 of the Huntington Beach Ordinance Code, located
on the east side of Florida Street, approximately 450 feet north of
Garfield Avenue in an R3, Medium -High Density Residential District.
The Chairman informed the Board that Negative Declaration No. 75-71
was granted for this request by the Environmental Review Board on
October 21, 1975.
The Chairman opened the public hearing. There being no one present
to speak for or against the proposed project, the public hearing was
closed.

Secretary Palin reported that this project is scheduled to be heard
before the Planning Commission on a Conditional Use Permit and a
Tentative Tract Map application. The facility exceeds all minimum
requirements of the apartment standards and is in full compliance
with Article 931.
ON MOTION BY PALIN AND SECOND BY LIPPS, USE PERMIT NO. 75-63 WAS
APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan and elevations received November 6,
1975, shall be the approved layout.

systems, standpipe systems, fire hydrants, fire alarm sys-
tems, and any other required fire protection and detection
devices or systems shall comply with the specifications
of the Huntington Beach Fire Code. Plans for such systems
shall be submitted to the Fire Department and shall be sub-
ject to approval by the Departments of Fire and Public Works.

5. The developer shall participate in the local drainage assess-
ment district.
6. The developer shall participate in the Orange County Sanita-
tion District #3 Sewer Annex District.
7. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Florida Street shall be improved to the center line of such
right-of-way. Said improvement shall include curbs, gutters,
sidewalks, paving, street trees, street lights, street signs,
street drainage, and sewer and water main extensions, in full
compliance with the City of Huntington Beach street standards
and requirements.
C. GENERAL CONDITIONS:
1. The applicant shall comply with all conditions of approval
which may be imposed by the Planning Commission upon its
review of the planned residential development, Tentative Tract
No. 9081.
2. If the developer proposes to provide air conditioning,.the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If_ no air conditioning is
to be provided, the insulation in ceilings and exterior walls
shall be a minimum of R-13 and R-7, respectively.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
4. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be stubbed
in at the locations of cooking facilities, water heaters,
and central heating units.
5. An engineering geologist shall be engaged to submit a report
indicating the ground surface acceleration from earth move-
ment for the project property.
6. All structures proposed for construction within this subdivi-
sion shall be constructed in compliance with the g-factors
as indicated by the geologist's report.
7. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for
review.

USE PERMIT NO. 75-66
Applicant: W. Sterling Buck & Associates
To permit the construction of a 14-unit apartment building pursuant
to Section 9202.3.1.3 of the Huntington Beach Ordinance Code,
located on the west side of Holly Street approximately 335 feet
south of Garfield Avenue in an R3, Medium -High Density Residential
District.
The Chairman informed the Board that Negative Declaration No. 75-73
was granted for this request by the Environmental Review Board on
November 18, 1975.
Chris Torrey was present to represent the applicant.
The Chairman opened the public hearing. There being no one present
to speak for or against the proposed project, the public hearing was
closed.
Board discussion ensued, taking into consideration the setbacks from
the easement, spearation between structures, turn -around, open
space, landscaping, timing of the improvements within the reciprocal
easement, and the differences in grade between this development and
the pending development to the north and what effect this grade
differential might have upon drainage of the properties.
ON MOTION BY CROSBY AND SECOND BY LIPPS, USE PERMIT NO. 75-66 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-
ING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity.
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.

C. GENERAL CONDITIONS:
1. Grading plans for this project, as well as the 17-unit
project to the north (U.P. 75-64) shall be submitted to
the City for review and approval action to assure that each
project can properly drain to the reciprocal easement for
ingress -egress for these two properties.
2. The total width of the reciprocal easement accessway shall
be installed in conjunction with the first of these two
projects to be developed (U.P. No. 75-66 or U.P. No. 75-64),
in order to facilitate ingress -egress for the subject pro-
perties and provide the proper turning radius. Should
the complex to the north be constructed first, that devel-
oper would be responsible for installing the turn -around
as well.
3. If the developer proposes to provide air conditioning, the

pursuant to Section 9452 of the Huntington Beach Ordinance Code,
located at the northeast corner of Pacific Coast Highway and 18th
Street, in a C3, General Business District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class I(e), California Environmental Quality Act, 1970.
Rex Hoover was present to represent the application.
The Board reviewed the application, noting changes made to the plot
plan after filing which did not take into account the changes in the
code which require that projects of this nature be in full.compliance
with ordinance provisions as they exist at the time of additions to
the use. With required additional dedication on the alley and the
revision in the plot plan to show the setbacks as they actually exist,
this application was determined to be no longer the proper applica-
tion, and the applicant was advised of the necessity of filing a Use
Permit application.
ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO.
75-156 WAS WITHDRAWN AT THE REQUEST OF THE APPLICANT, FOR THE FOLLOW-

The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
Rex Hoover was present to represent the application.
Andy Vanderlaan noted that plan check had indicated that a problem
would arise due to the location of the gas meters in reference to
garage locations, which would probably cause interference with
vehicular movements. It is the recommendation of the Fire Depart-
ment that these meters be shielded by posts or set in vaults,
with the Department's preference being vaults.

Bruce Crosby discussed the extension of the paved drive indicated
on the plan to a continuous drive east -west through the project
from Palmdale to Gothard; this drive should be a minimum width of

20 feet to intertie with the front and rear access points. Gates
to be installed on this drive were discussed, with the consensus
that 16 feet in width would be adequate. The possibility of reces-
sing the gates was also considered, to prevent stacking of traffic
in the travel lanes of Gothard and Palmdale. Mr. Fryant indicated
that traffic will enter only from Palmdale, and that the entrance
on Gothard will not be used but was included only to comply with
Fire Department standards.
Also discussed for this project were controls over materials and
equipment which might by stored on the property, electrical outlets
and how such service was to be provided, and restroom facilities
for the project.

2. In accordance with the City's standards and requirements,
an additional ten feet (10') of right-of-way on Gothard
Street shall be dedicated.
3. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to
the Department of Building and Community Development and
shall be subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm sys-
tems, and any other required fire protection and detection
devices or systems shall comply with the specifications of
the Huntington Beach Fire Code. Plans for such systems and
devices shall be submitted to the Fire Department and shall
be subject to approval by the Departments of Fire and
Public Works.
5. The developer shall particiapte in the local drainage
assessment district.
6. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Palmdale and Gothard Streets shall be improved to the cen-
