Applicant: Jerry Toland
To permit the establishment of a drive -through film and photo ser-
vice, pursuant to Section 9430.2 of the Huntington Beach Ordinance
Code, located on the south side of Edinger Avenue approximately
350 feet east of Sher Lane in a C2, Community Business District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Mr. Toland was present at the meeting.
The applicant reported that he has been unable to locate the deed
restriction discussed on this property. The Board again reviewed
the ingress -egress for the proposed use and the parking and land-
scaping provisions.
ON MOTION BY PALIN AND SECOND BY ELLSTROM ADMINISTRATIVE REVIEW
NO. 75-173 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received December 31, 1975, shall
be the approved layout, subject to the following:
a. Landscaping shall be provided at both ends of the build-
ing to the ultimate drive widths.
b. The six (6) parking spaces deleted by the proposal shall
be arranged for on abutting properties, and agreements
to such additional parking spaces shall be submitted to

the Department of Building and Community Development
concurrently with application for building permits.
2. The proponent shall comply with all existing restrictions
and/or agreements between property owners which may exist on
the property.
In its approval action, the Board of Zoning Adjustments considered

. Parking layout;
. Lot area;
. Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.

CONDITIONAL EXCEPTION NO. 75-46
Professional Investors
To allow 25 percent of the total parking spaces (418 of 1672 spaces)
for a commercial and residential development to be served by compact
spaces measuring 7'6" x 15'6" in lieu of the 9' x 19' as required by
the Huntington Beach Ordinance Code, located on property at the.east
side of the Southern Pacific Railroad and south of McFadden Avenue
in the north of the Huntington Center Specific Plan area.
The Chairman informed the Board that Negative Declaration No. 75-68
was approved by the Environmental Review Board for this project on
October 23, 1975.
The Chairman opened the public hearing.
Gunnard Johnson addressed the Board, voicing his approval of the re-
quest and suggesting the possibility that it might be applied to
other commercial developments within the City.
Mrs. M.P. Browning of 15461 Shasta Lane, Huntington Beach, addressed
the Board, questioning the impact upon the environment of a parking
lot of the proposed magnitude.
There being no other persons present to speak for or against the pro-
posed project, the public hearing was closed.
Secretary Palin informed the Board that this request is to be referred
up to the Planning Commission, but should be reviewed by the Board

in order that Staff concerns may be included in the staff report.
In its discussion, the Board agreed on the following points: 1) the
map should show the complete parking layout with all dimensions;
2) the location and distribution throughout the complex of the com-
pact parking stalls should be shown, with percentage of assigned
vs. unassigned shown and consideration given to assignment of some
of the parking stalls to remote areas of the lot for use of employees;
and 3) dimensions given by applicant should be substantiated by
separate investigation. It was emphasized that the Board did not
review this exception and its implications on a prepared site plan,
but only reviewed the merits of compact vs. standard sizes, and that
the Board is not prepared to make a recommendation on the merits of
the specific site plan submitted in conjunction with this request.
It was also felt that Staff should recommend that the Planning
Commission consider whether this type of exception would lend it-
self to this size development, or if it might be possible that more
would be gained by smaller developments where the parking problem
is more critical.

TENTATIVE PARCEL MAP NO. 75-15
Applicant: Jerwel Enterprises
To permit a four (4) lot division of land pursuant to Section 9930.1
of the Huntington Beach Ordinance Code, located on the north side
of Center Drive, east of the Southern Pacific Railroad, and south of
the San Diego Freeway, in the north of Huntington Center Specific
Plan.
The Chairman informed the Board that Negative Declaration No. 75-68
was approved by the Environmental Review Board for this request
on October 23, 1975.
Secretary Palin reviewed the Subdivision Committee's concerns on
this project for the Board's information, and noted that this request
also will be referred up to the Planning Commission for action.
The Board reviewed the application and concurred on the following
recommendations to the Planning Commission:

1. That the two -parcel des" nation on the northwest portion of the
area be deleted.
2. That the north -south public street shall be dedicated to a width
as determined by the Director of Public Works.
3. That all improvements on this street shall be subject to review
and approval action by the Department of Public Works.
4. That the easterly portion of Center Drive be dedicated for pub-
lic street purposes.
5. That the existing easements and right-of-way, pursuant to Orange
County Record 6918-593, be abandoned and that new easements be
provided for surface drainage and flood control, to the require-
ments of the Director of Public Works.
6. That the design of Center Drive shall reflect that alignment
necessary for an arterial intertie between Gothard Avenue and
Beach Boulevard.
7. That, should the City of Huntington Beach declare surplus the
property along the north property line of this project and this
developer is successful in acquiring said property, the blue
border of the map shall be amended to reflect this additional
acreage.
8. That, should any building permits be pulled on any portion of
this map within four years from the date of recordation, the dev-
eloper shall be subject to the Park and Recreation fees in effect
at the time of approval of this map.

ADMINISTRATIVE REVIEW NO. 75-175
Applicant: George Hammond
To permit the construction of a three (3) unit apartment pursuant
to Section 9201.2 of the Huntington Beach Ordinance Code, located on
the southeast corner of 19th Street and Orange Avenue in an R3,
Medium -High Density Residential District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.

The Board reviewed the request, noting that required dedication
would result in insufficient turning radius and building separa-
tion. Since there was no one present to represent the application
it was the consensus that the request should be continued to
permit the plan to be amended to show the proper dimensions as
noted above.

75-175 WAS CONTINUED TO THE MEETING OF JANUARY 28, 1976, BY THE

Later in the meeting, Hugh Seeds arrived to represent the appli-
cation, and requested a reconsideration.

RECONSIDER ADMINISTRATIVE REVIEW NO. 75-175 BY THE FOLLOWING VOTE:

The situation in regard to dedication and plot plan dimensions
was explained to the applicant's representative. Mr. Seeds indi-
cated that the project is scheduled to go before the Coastal
Commission, and agreed to the imposition of conditions on the pro-
ject which would guarantee that the turning radius, setbacks,
and unit separation would comply with code.
ON MOTION BY LIPPS AND SECOND BY ELLSTROM ADMINISTRATIVE REVIEW
NO. 75-175 WAS APPROVED IN CONCEPT WITH THE FOLLOWING CONDITIONS,
BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received December 31, 1975, shall
be approved in concept, subject to the modifications
described herein:
a. The proper turning radius of 25 feet shall be shown
on a revised plan.
b. The revised plan shall indicate the required separa-
tion between units.
A plan delineating said modifications shall be submitted
to the Secretary of the Board. If such plan complies

with the modifications outlined by the Board, said plan
shall be approved and made a permanent part of the admin-
istrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. In accordance with the City's standards and requirements,
an additional two and one-half feet (2-1/2') of right-of-way
on the alley shall be dedicated.
3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and.Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the Hunt-
ington Beach Fire Code. Plans for such systems and devices
shall be submitted to the Fire Department and shall be subject
to approval by the Departments of Fire and Public Works.
5. The developer shall participate in the local drainage assess-
ment district.
6. The developer shall participate in the Orange County Sanita-
tion District #3 Sewer Annex District.
7. All applicable fees shall be paid prior to issuance of
building permits.

Mr. Williams was present at the meeting.
The Chairman informed the Board that Negative Declaration No. 75-86
has been granted for this request by the Environmental Review Board
on January 13, 1976.
The applicant informed the Board that he is planning to build only
on Lots 1 through 3 and not improve the 175 feet fronting on
Florida Street at the present time. Because of this, he indicated
that he would like not to be required to put in the street improve-
ments along that portion of the property until such time as it is
developed.
The Board reviewed the request, discussing drainage and access
problems to the parcels and the question of public vs. private
alley when the property is developed.
ON MOTION BY LIPPS AND SECOND BY ELLSTROM, TENTATIVE PARCEL MAP
NO. 75-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-
ING VOTE:
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS
FOR ANY PURPOSE:
1. The tentative parcel map received by the Planning Depart-
ment on December 23, 1975, shall be the approved layout.
2. A parcel map shall be filed with, and approved by, the
Department of Public Works, and recorded with the Orange
County Recorder.
3. Water supply shall be through the City of Huntington Beach's
water system at the time said parcels are developed.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time said parcels are devel-
oped.
5. All utilities shall be installed underground at the time
said parcels are developed.
6. Compliance with all applicable City Ordinances.
7. The property shall participate in the local drainage
assessment at the time said parcels are developed (contact
the Department of Public Works for additional information).
8. A copy of the recorded parcel map shall be filed with the
Planning Department.

9• A system shall be provided for siltation and erosion control
both during and after construction, as these parcels are
developed.
10. At the time each parcel is developed, full street improve-
ments shall be installed on Clay Avenue and Florida Street.
Said improvement shall include curbs, gutters, sidewalks,
paving, street trees, street lights, street signs, street
drainage, and sewer and water main extensions, in full com-
pliance with the City of Huntington Beach street standards
and requirements.
11. At the time said parcels are developed, an 18-inch stub -out
facility shall be carried through on the exterior side of
Parcel 3 of the approved tentative parcel map.
12. No improvements shall take place on Lot 4 of this project
until implementation of Assessment District No. 73-02.
13. The retention basin on subject property shall be fenced.
14. The retention basin shall be designed to the specifications
and approval of the Department of Public Works.
B. GENERAL CONDITIONS:
At the time said parcels are developed, the following shall apply:
1. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If no air conditioning is
to be provided, the insulation in ceilings and exterior walls
shall be a minimum of R-13 and R-7, respectively.
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
3. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be stubbed
in at the locations of cooking facilities, water heaters,
and central heating units.
4. An engineering geologist shall be engaged to submit a report
indicating the ground surface acceleration from earth move-
ment for the project property.
5. All structures proposed for construction within this sub-
division shall be constructed in compliance with the
g-factors as indicated by the geologist's report.

6. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for re-
view.

To permit the construction of a 13-unit apartment building pur-
suant to Section 9162.3.1 of the Huntington Beach Ordinance Code,
located at the northeast corner of Prairie Street and Lynn Street
in an R2, Medium Density Residential District.
Secretary Palin informed the Board that the Environmental Review
Board has not yet finalized action on Negative Declaration 75-85
for this project.
ON MOTION BY LIPPS AND SECOND BY ELLSTROM, USE PERMIT NO. 75-69
WAS CONTINUED TO THE REGULAR MEETING OF JANUARY 21, 1976, BY THE
FOLLOWING VOTE:

MISCELLANEOUS:
USE PERMIT NO. 73-32 (Revision to fencing)
Applicant: M. David Kelly (formerly Shelter Industries)
To permit revision to fencing on previously approved 296-unit
apartment complex located at the southwest corner of Edinger Avenue
and Newland Street.
The Board reviewed the revised fencing plan as submitted by the
applicant, discussing material to be used in fencing, relocation
of landscaping necessary, safety aspects of the channel, and
aesthetic considerations in relation to the total project.
ON MOTION BY LIPPS AND SECOND BY PALIN, THE REVISED FENCING PLAN FOR
USE PERMIT NO. 73-32 WAS APPROVED WITH THE FOLLOWING CONDITIONS,
BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The site plan received and dated January 9, 1976, shall be the
approved layout for location of periphery fencing and materials,_,

subject to the accomplishment of the following modifications on
the approved landscaping plans:
a. Plan shall be revised to reflect relocation of the irriga-
tion system.
b. Plan shall be amended to reflect the open channel constructed
along Edinger Avenue and Newland Street.
C. Plan shall be revised reflecting relocation of the plant
material proposed to be installed within the development.
The above changes in the approved plan shall be accomplished by the
applicant in the presence of and to the approval of City staff mem-
bers.
