The Chairman informed the Board that Negative Declaration No. 75-85 had been granted for this request by the Environmental Review Board on January 20, 1976. Richard Rule was present to represent the application. The Chairman opened the public hearing. There being no one present to speak for or against the proposed project, the public hearing was closed. Board discussion followed. Bruce Crosby reported that the Director of Public Works has checked the plan in relation to the dimension of the proposed knuckle and sees no problem in leaving it as shown on the submitted plans. The Board also discussed the abutting park site to the south and the height of carports proposed to be built at zero property line. ON MOTION BY PALIN AND SECOND BY LIPPS, THE BOARD ADOPTED NEGATIVE DECLARATION NO. 75-85, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments January 21, 1976 Page 2 AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 75-69 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received January 7, 1976, shall be the approved layout, subject to the modifications described herein: a. The plan submitted to the Department of Building and Com- munity Development in conjunction with application for building permits shall be amended to show the width of the entry drive and the radius curve data on the intersec- tion of Prairie and Lynn Streets. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; • Parking layout; . Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detec- tion devices or systems shall comply with the specifica- tions of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Depart- ment and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. 6. The developer shall participate in the Orange County Sani- tation District #11 Sewer Annex District. 7. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Dedication on Prairie Street shall be to the requirements and approval of the Director of the Department of Public Works. 2. A six-inch (6") wide masonry wall shall be constructed on the south property line of subject property as separation between this project and the abutting permanent open space. Said wall shall be six feet (61) high measured from the higher side, and the design and materials of said wall shall be to the approval of the Planning Department. 3. A six inch (6") wide by six foot (61) high masonry wall shall be constructed along the north and east property lines of subject property as a separation wall between this project and the abutting dairy, to Planning Department approval. 4. The height of the carports proposed to be constructed at zero setback shall not exceed nine (9) feet as measured from existing grade on the abutting property. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, BZA 1-21-76 Page 3 Minutes, H.B. Board of Zoning Adjustments January 21, 1976 Page 4 the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air con- ditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 4. An engineering geologist shall be engaged to submit a report indicating the ground surface acceleration from earth move- ment for the project property. 5. All structures proposed for construction within this sub- division shall be constructed in compliance with the g-factors as indicated by the geologist's report. 6. Calculations for footings and structural members to with- stand anticipated g-factors shall be submitted to the City for review. 7. Crime prevention techniques shall be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). Lindborg To permit the construction of a 5000 square foot office -professional building pursuant to Section 9456(b) of the Huntington Beach Ordin- ance Code, located on the north side of Pacific Coast Highway approx- imately 50 feet east of 12th Street in a C3, General Business District. Rex Hoover was present at the meeting. The Chairman informed the Board that Exemption npclaration No. 74-i21 had been granted by the Environmental Review Board for this request pn August 27, 1974. ON MOTION BY CROSBY AND SECOND BY LIPPS, THE BOARD ADOPTED EXEMP- TION DECLARATION NO. 74-121 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received January 9, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. Jones To permit the division of four (4) parcels of land into eight (8) parcels, pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, located at the southeast intersection of the Pacific Electric Railroad and Talbert Avenue in an Ml-A, Restricted Manufacturing District. The Chairman informed the Board that Exemption Declaration No. 74-169 was granted by the Environmental Review Board for this request on January 14, 1975. The Board reviewed the plot plans, discussing the access points to be allowed on Talbert Avenue, the status of the non -conforming Lot 6 and means of handling said lot, and the relocation of the main access point on Redondo to a more centrally located point on the subject property. There being no one present to represent the application and explain the concerns of the Board, it was the consensus to continue this request and require applicant to be present at its next hearing. Board of Zoning Adjustments January 21, 1976 Page 7 ON MOTION BY LIPPS AND SECOND BY PALIN, TENTATIVE PARCEL MAP NO. 76-1 WAS CONTINUED TO THE MEETING OF JANUARY 28, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Later in the meeting, Mr. Jones arrived and requested that the project be reconsidered. ON MOTION BY PALIN AND SECOND BY LIPPS, THE BOARD VOTED TO RECON- SIDER TENTATIVE PARCEL MAP NO. 76-1, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Mr. Jones addressed the Board and explained that the non -conforming Parcel 6 is to be sold to I.C.R. Company, which is already using that parcel as a parking area. He discussed with the Board the possibility of later reconsolidation of Parcels 10 and 11, contin- gent upon a pending sale. The Board discussed methods of handling the above and reviewed possible conditions of approval. ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 76-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Planning Department on January 12, 1976, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed (if such systems exist within 200 feet of said parcels). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed (if such systems exist within 200 feet of said parcels). 5. All utilities shall be installed underground at the time said parcels are developed. 6. Compliance with all applicable City ordinances shall be required. BZA 1-21-76 Page 7 Minutes, H.B. (Contact the Department of Public Works for additional information.) 8. A copy of the recorded parcel map shall.be filed with the Plan- ning Department. 9. Vehicular access rights shall be dedicated except at locations between Parcels 1 and 2 and between Parcels 10 and 11. 10. Upon the creation of Parcel 6 and upon the transfer of title to said parcel, Parcel 6 shall be made a part of the property to the south and a subsequent filing of a parcel map shall be re- quired to eliminate the southerly property line of Parcel 6. 11. Should the proponent wish in the future to consolidate Parcels 10 and 11 as one parcel prior to recordation, such revision may be made without further subsequent action by this Board. Stagliano To permit the construction of a 24,000 square foot industrial building pursuant to Section 9510 of the Huntington Beach Ordinance Code, located on the southwest corner of McFadden Avenue and Container Lane in a 100-Ml-A-20,000, Restricted Manufacturing District. The Chairman informed the Board that this project is covered by EIR No. 73-16, approved by the City Council on March 18, 1974. Mr. Stagliano was present at the meeting. Secretary Palin noted that staff has discussed with the proponent for this project the vehicular access rights as they currently are vested with the City on McFadden Avenue and that said proponent is aware of the either/or conditions to be applied, depending on the City Council's decision on the vacation of McFadden. In addition, the Board dis- cussion covered landscaping areas to be required, drive widths, and possible necessity of refiling at some later date to consolidate Lots 40 and 41 into a single parcel to accommodate an integrated devel- opment. Mr. Stagliano discussed with the Board his intention to pro- vide security fencing on -site. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 1-21-76 Page 8 Minutes, H.B. Board of Zoning Adjustments January 21, 1976 Page 9 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan and elevations received January 9, 1976, shall be the approved layout, subject to the fol- lowing: a. Should the City concur in the vacation of the vehic- ular access rights to McFadden Avenue, the buildings as designed to facilitate truck wells in Buildings A and B shall be allowed as designed. b. Should the City not concur in the vacation of the ve- hicular access rights to McFadden Avenue, the plans as submitted for Buildings A and B shall be revised to reflect compliance with restrictions on access from that street. Said revision shall apply to all three (3) curb cuts as shown on the conceptual plan, the two for the truck wells as well as the central drive access. In the latter event, a plan delineating said modifications shall be submitted to the Board for review and approval action. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . A Tentative Parcel Map shall be filed prior to final in- spection on any one of the three buildings, to eliminate the lot line between Lots 40 and 41. 2. Additional landscaping shall be provided within the off- street parking area, with 15-gallon trees as required by Ordinance Code planted at locations along the rear of the now -existing Lot 40 and at the southerly ends of Buildings A and B. 3. If security fencing is to be constructed within the devel- opment in the future, said fencing should not project beyond the building setback line of Buildings B and C, and the landscaping area on each side of the parking between Buildings A and B should be designed to accommodate fencing and gating, if necessary at those locations. Said fencing and gating should not project beyond the front setback of Buildings A and B. Stagliano To permit truck well and loading facilities of an industrial build- ing to face a public street, pursuant to Section 9518 of the Hunting- ton Beach Ordinance Code, located at the southwest corner of McFadden Avenue and Container Lane in an M1-A, Restricted Manufactur- ing District. Mr. Stagliano was present at the meeting. The Chairman informed the Board that this request is covered by EIR No. 73-16, approved by the City Council on March 18, 1974. The Chairman opened the public hearing. The Applicant addressed the Board, stating that relocation of the requested wells would be infeasible, because of blockage of access to the back of the property and the need for ground -level loading i BZA 1-21-76 Page 10 1 Minutes, H.B. Board of Zoning Adjustments January 21, 1976 Page 11 facilities at the rear of the buildings. There being no other persons to speak for or against the proposed project, the public hearing was closed. Board discussion ensued. It was noted that there have been no prior approvals for any truck wells facing on McFadden within this industrial subdivision; it was also noted that adjoining properties to the south and east have received approval for similar truck wells. The Board discussed the width of the doors , the distance which would separate them, and the architectural features breaking up the bulk of the buildings between the two truck well doors. ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 76-1 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. Stagliano To permit the construction of an 11,000 square foot industrial build- ing pursuant to Section 9510 of the Huntington Beach Ordinance Code, located on the east side of Chemical Lane approximately 130 feet north of Research Drive in a 100-M1-A-20,000, Restricted Manufactur- ing District. The Chairman informed the Board that this request is covered by EIR No. 73-16, approved by the City Council on March 18, 1974. Mr. Stagliano was present at the meeting. The Board discussed the setback on the interior property line, con- sidering the possibility of 15-foot reciprocal easements with the abutting property. The applicant informed the Board that he has al- ready attempted to pursue that possibility, but the adjoining owners have already worked out reciprocal easements down the center between their property and the next adjoining lot.
