HomeMy WebLinkAbout1976-01-28MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, JANUARY 28, 1976 - 1:15 PM BOARD MEMBERS PRESENT: PALIN, CROSBY, LIPPS CITY STAFF PRESENT: MEL OTT, FIRE DEPARTMENT REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 75-172 (Cont. from 1-7-76) Applicant: Anthony Bartoli To permit the construction of an 1800 square foot professional office, pursuant to Section 9471.4 of the Huntington Beach Ordinance Code, located on the east side of "A" Street approximately 50 feet south of Warner Avenue in a C4, Highway Commercial Business District, The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Secretary Palin noted that the revised plot plan has been submitted as required. The Board discussed landscaping and screening for the proposed use and the need for an encroachment permit to enable the applicant to install and maintain landscaping on the City -owned strip between the use and the presently existing curb line of Warner Avenue. Bruce Crosby reported that a bond could be posted in lieu of street improvements on Warner at this time because of the proposed widening of that street in the future. ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINSTRATIVE REVIEW NO. 75-172 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITrON OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plot plan and elevations received January 16, 1975, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area; Minutes, H.B. Board of Zoning Adjustments January 28, 1976 Page 2 . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 3. In accordance with the City's standards and requirements, an additional dedication of five (5) feet on "A" Street, thirty- five (35) foot radius at the intersection of Warner Avenue and "A" Street, and two and one-half (2-1/2) feet of right- of-way on the alley shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the De- partment of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assess- ment district. 7. The developer shall participate in the Orange County Sanita- tion District #3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of build- ing permits. B. GENERAL CONDITIONS: 1. The developer shall obtain a parkway maintenance agreement from the Department of Public Works to provide for the en- croachment into the City -owned right-of-way between the north property line of subject property and the presently existing curb line of Warner Avenue and to provide for maintenance of landscaping to be installed within that publicly owned right- of-way. A thirty-two (32) inch high masonry screening wall shall be installed both on "A" Street and on the Warner Avenue frontage. Said wall shall be installed approximately in the center of the landscaping strip, with landscaping on the parking area as well as on the street sides. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-3 Applicant: Brent Enterprises To permit the construction of a coin -operated car wash and fast tune-up center, pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the south side of Talbert Avenue approxi- mately 160 feet east of Beach Boulevard in a C4, Highway Commercial District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. George Lightner, Ben Sorrelles, Frank Brent, and Ralph Beam were present to represent the application. The Chairman opened the public hearing. There being no one present to speak on the proposed project, the public hearing was closed. Secretary Palin pointed out that there is no record on any prior division of land on this property, and that the submitted layout calls for two curb cuts on Talbert Avenue, which is more than can be permitted on a single parcel. The Board discussed the above with the applicants. Mr. Brent explained that the two drives were needed to make the businesses economically feasible; he also noted that one business might later be sold separately and would then require a separate drive. Bruce Crosby reported that the recommendations of the Traffic Engineer would be to delete the easterly drive and widen the westerly drive to forty (40) feet, or to install a reciprocal drive between the two separate business uses. He also advised the appli- cants of the future raised median in Talbert Avenue. The use which had been intended for the unimproved strip of prop- erty left when Der Weinerschnitzel was approved was discussed. (The present applicant has been required by lease to improve that strip as well as additional footage for a total of 28 feet.) Mr. Palin indicated that he will ascertain what use had been intended, suggesting that it might have been for a landscaping buffer strip. The possibility of filing for a Tentative Parcel Map on the sub- ject property was discussed, and the timing for such filing explained to the applicants. BZA 1-28-76 Page 3 Minutes, n.B. It was the consensus of the Board that this request should be con- tinued to permit applicant time to reassess the project and consider filing of the necessary application to proceed with the project. ON MOTION BY PALIN AND SECOND BY LIPPS, USE PERMIT NO. 76-3 WAS CON- TIUNED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING OF FEBRUARY 11, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-1 Applicant: Cager Properties, Inc. To permit the construction of an apartment building that extends more than 150 feet from a public street, pursuant to Section 9730.20 of the Huntington Beach Ordinance Code, located on the north side of Stark Street approximately 150 feet east of Parkside Lane in an R3, Medium -High Density Residential District. Craig Etchegoyen and Brian M. Ambrozich were present to represent the application. Secretary Palin reported that a revised plan has been submitted, show- ing the projection of the second story and indicating a width clear - to -the -sky for emergency access of 19'6". Mel Ott noted that the code requires a width of 25 feet but that, considering the problems on the lot, twenty feet could be acceptable. The possibility of reciprocal easements with the abutting property was discussed, to facilitate pro- vision for Fire Department requirements and to help in getting ade- quate parking, which is presently one space short. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-1 WAS CONTINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING OF FEBRUARY 4, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE MISCELLANEOUS ITEMS: TENTATIVE PARCEL MAP NO. 76-1 (Reconsideration Applicant: Gerald A. Jones Reconsideration of prior approval of the division of four (4) parcels of land into eight (8) parcels, pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, located at the southeast intersection BZA 1-28-76 Page 4 1 Minutes, H.B. Board of Zoning Adjustments January 28, 1976 Page 5 of the Pacific Electric Railroad and Talbert Avenue in an M1-A, Restricted Manufacturing District. Secretary Palin reported to the Board that there are misunder- standings on the treatment of easements and setbacks on the forty-five foot street sections, and recommended reconsideration of this project which was previously approved on January 21, 1976, in order to clarify the terminology on dedications and the ease- ment lines for Redondo Drive , and to determine the location and orientation of buildings in relation to the ultimate easement line. ON MOTION BY PALIN AND SECOND BY LIPPS, THE BOARD DETERMINED TO RECONSIDER TENTATIVE PARCEL MAP NO. 76-1 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS, THE CONDITIONS OF APPROVAL FOR TENTATIVE PARCEL MAP NO. 76-1 WERE AMENDED AS FOLLOWS, BY THE FOLLOWING VOTE: AMENDED CONDITIONS OF APPROVAL: 1. The tentative parcel map received by the Planning Department on January 12, 1976, shall be the approved layout,except as pro- vided in conditions 12 and 13 below. 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed (if such systems exist within 200 feet of said parcels). 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed (if such systems exist within 200 feet of said parcels). 5. All utilities shall be installed underground at the time said parcels are developed. 6. Compliance with all applicable City Ordinances shall be required. 7. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. (Contact the Department of Public Works for additional information.) 8. Vehicular access rights shall be dedicated except at locations between Parcels 1 and 2 and between Parcels 10 and 11. 10. Upon the creation of Parcel 6 and upon the transfer of title to said parcel, Parcel 6 shall be made a part of the property to the south and a subsequent filing of a parcel map shall be re- quired to eliminate the southerly property line of Parcel 6. 11. Should the proponent wish in the future to consolidate Parcels 10 and 11 as one parcel prior to recordation, such revision may be made without further subsequent action by this Board. 12. The five (5) foot easement required to be dedicated on either side of the forty-five (45) foot street section shall be for utilities and future walkway purposes, should the City deem such walks to be necessary at any given future date. 13. The ultimate easement line shall be interpreted for benefit of the front and exterior side yard setbacks as "ultimate right-of- way line," and the building setbacks shall be measured from this easement line. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE SPECIAL EVENT NO. 76-2 Applicant: Lisbon de Medici Galleries, Limited To permit a promotional art exhibition on January 30 and 31, and Feb- ruary 1, 1976, from the hours of 10:00 a.m, to 6:00 p.m., located outside the Thriftimart Supermarket, Warner Avenue and Springdale Street. The Board reviewed the proposed project. ON MOTION BY PALIN AND SECOND BY LIPPS, SPECIAL EVENT NO. 76-2 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plan received January 28, 1976, shall be the approved plan. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance De- partment five (5) days prior to the event. The Board reviewed the landscaping plan submitted. ON MOTION BY PALIN AND SECOND BY LIPPS, THE LANDSCAPING PLANS SUBMITTED FOR TRACT NO. 5642 WERE APPROVED BY THE FOLLOWING VOTE WITH THE FOLLOWING CONDITION: CONDITIONS OF APPROVAL: The landscaping plan received and dated January 27, 1976, identi- fied as Job No. 137423, shall be the approved layout. Walt Lipps reported that the proposed signs meet the Ordinance Code for size, shape, and setback requirements; staff recommends approval. ON MOTION BY LIPPS AND SECOND BY CROSBY, SIGN REQUEST NO. 6959 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan dated January 19, 1976, shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code.
