ON MOTION BY CROSBY AND SECOND BY LIPPS, THE MINUTES OF THE REGULAR
MEETING OF JANUARY 7, 1976, WERE APPROVED AS TRANSCRIBED, AND THE
MINUTES OF THE REGULAR MEETING OF JANUARY 14, 1976, WERE APPROVED

Applicant: Cager Properties, Inc. (Cont. from 1-28-76)
To permit the construction of an apartment building that extends more
than 150 feet from a public street, pursuant to Section 9730.20 of
the Huntington Beach Ordinance Code, located on the north side of
Stark Street approximately 150 feet east of Parkside Lane in an R3,
Medium -High Density Residential District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
Jan Aiken was present to represent the applicant.
Secretary Palin reported that the revised plan has provided the
reduction in over-all dimensions of the units and garages to 25 feet
from original 26, and provides a 19 foot clear -to -the -sky. The ap-
plicant explained the reduction in bedroom count by the deletion of
one bedroom in each of two units and replacement with a den. After
discussion, it was the consensus of the Board that it could not con-
cur in designation of the dens, which could be easily converted.
The applicant was requested to address the parking problem in some
other fashion, and it was suggested that relocation of the drive,
with a reciprocal easement with the adjoining property, would solve
the parking problem and provide more open space for both develop-
ments.

USE PERMIT NO. 76-5
Applicant: Andrew Stupin
To permit an addition to a site having a non -conforming yard pursu-
ant to Section 9719 of the Huntington Beach Ordinance Code, located
on the north side of Yorktown Avenue approximately 100 feet east of
Florida Street in an R2, Medium High Density Residential District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
Andrew Stupin was present at the meeting.
The Chairman opened the public hearing. There being no one present
to speak for or against the proposed project, the public hearing was
closed.
Board discussion ensued. The applicant was informed of the necessary
dedication to comply with the ultimate width of Yorktown of 100 feet
at that location. This dedication would mean that the existing
structure on the property would encroach six feet into the right-of-
way. Various solutions were considered, including relocation or
demolition of the structure, a parcel map (which would create sub-
standard lot frontage), or some type of temporary improvements with
bonding for the remainder to be worked out with Public Works.
It was the consensus of the Board that the request should be contin-
ued to give the applicant an opportunity to revise his plan in
compliance with the Ordinance Code and to work out some arrangement
with the Department of Public Works on the street dedication and
improvements.

USE PERMIT NO. 76-4 (In Conjunction/CE 76-1)
Applicant: Roger DeYoung
To permit the construction of a fifteen (15) unit apartment build-
ing pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance
Code, located on the east side of Green Street approximately 525
feet south of Pearce Avenue in an R3, Medium Density Residential
District.
The Chairman informed the Board that the Environmental Review Board
had granted Negative Declaration No. 76-3 for this project on
February 3, 1976.
Roger DeYoung was present at the meeting.
The Chairman opened the public hearing.
Mr. and Mrs. James Wilson addressed the Board and presented a petition
from neighboring residents objecting to certain aspects of the project
Mrs. Wilson pointed out the present lack of recreational facilities
in the neighborhood and the lack of places for children to play. She
also suggested that a change in the setback from 15 feet to 10 feet
would allow more open space to be provided within the development
itself. Parking difficulties in the area were also noted.
Mr. DeYoung cited the special problems which the extreme depth of
this property raises, and expressed his willingness to work with ad-
joining residents to modify his plan.
There being no one else present to speak on the proposed project,
the public hearing was closed.
Board discussion ensued. Jim Palin expressed the opinion that the
intensity of development is too great and the requested reduction
in open space too extreme. After review of parking, open space,
turning radius, the proposed 10 foot setback and possible deletion
of one or two units, it was the consensus that the applicant
should revise his plan according to the comments made at this
meeting.

CONDITIONAL EXCEPTION NO. 76-1 (In Conjunction/UP 76-4)
Applicant: Roger DeYoung
To permit the front yard setback to average 15 feet in lieu of the
required 20 feet and to permit a reduction in the required recrea-
tion and leisure area by approximately 65 percent and to allow
private patio areas to satisfy a portion of this requirement. These
requests are in lieu of Section 9320.6 and 9320.14 respectively
of the Huntington Beach Ordinance Code, on property located on the
east side of Green Street approximately 525 feet south of Pearce
Avenue in an R3, Medium Density Residential District.
Roger DeYoung was present at the meeting.
In view of the continuance of Use Permit No. 76-4, it was the con-
sensus of the Board that the Conditional Exception should also be
continued to permit applicant to revise his plan.

Applicant: Gerald Jones
To permit the construction of a 12,000 square foot industrial build-
ing pursuant to Section 9510 of the Huntington Beach Ordinance
Code, on property located on the north side of Redondo Circle approxi-
mately 400 feet south of Talbert Avenue in an M1-A, Restricted
Manufacturing District.
The Chairman informed the Board that Negative Declaration No. 74-169
had been granted this project by the Environmental Review Board.
Gerald Jones was present at the meeting.
The Board reviewed the project with the applicant, discussing the
five-foot easement and the setback required from that easement which
will require that the building'be relocated. Mr. Jones submitted a
revised plan showing the proper setback. Also reviewed were the
grading and west -to -east drainage on the property, width of the access
drive to the rear of the building, turning radius, possible fencing,
and the fifteen -foot (15') interior setback required. In regard to
the rear drive, Mel Ott noted that the Fire Department would not re-
quire a drive -through access at that location; a walk-through access

would serve the needs of the Fire Department and thus allow the
developer to install security fencing at the rear of the building
if he so desires.

76-13 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The conceptual plot plan received and dated February 4,
1976, shall be the approved layout.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. The following plans shall be -submitted to the Secretary of
the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping plans on file in the Department of Public Works.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material pro-
posed to screen said equipment.
3. In accordance with the City's standards and requirements
a five-foot (5') easement for utilities and future walk-
ways shall be dedicated on Redondo Lane.
4. Soil and compaction reports shall be submitted by a certi-
fied soils engineer. Said reports shall be submitted to

the Department of Building and Community Development and
shall be subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
-and any other required fire protection and detection dev-
ices or systems shall comply with the specifications of the
Huntington Beach Fire Code. Plans for such systems and
devices shall be submitted to the Fire Department and shall
be subject to approval by the Departments of Fire and Public
Works.
6. The developer shall participate in the local drainage assess-
ment district.
7. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Redondo Lane shall be improved. Said improvements shall
include future sidewalks, street trees, street lights, and
sewer and water main extensions, in full compliance with the
City of Huntington Beach street standards and requirements.

MISCELLANEOUS AGENDA ITEMS:
SPECIAL EVENT NO. 76-1
Applicant: Huntington Beach High School Associated Student Body
To permit a swap meet to be held in the west parking lot of Hunting-
ton Beach High School on March 13, 1976, from the hour of 6:00 a.m.
to 5:00 p.m.
Doug Bradley was present to represent the application.
The Board reviewed the recommendations from the Police Department
and the Fire Department in regard to this special event.
ON MOTION BY PALIN AND SECOND BY CROSBY, SPECIAL EVENT NO. 76-1 WAS
APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The plot plan received and dated January 21, 1976, shall be the
approved layout.

2. The applicant shall obtain all necessary electrical permits.
3. An on -site inspection by the Fire Department shall be re-
quired prior to the event.
4. Access to fire hydrants on the site shall be maintained
free and clear to a minimum distance of fifteen (15) feet on
both sides.
5. A certificate of insurance form shall be filed in the Finance
Department of the City five (5) days prior to the event.
6. A vendor information sheet (copy attached) shall be submitted
by each vendor to the Huntington Beach Police Department.
7. Time of operation shall be limited to those hours designated
on the application received January 21, 1976.

ADMINISTRATIVE REVIEW NO. 73-130 (Rev. Plans & Elevations)
Applicant: Robert Zinngrabe
Consideration of revised plans for a previously approved 158-room,
200 bed retirement care facility located on the east side of
Florida Street.
Secretary Palin noted that this plan has been revised in accord-
ance with the Fire Department's request for a 16-foot wide access
down the easterly property line and an increased turnaround. The
Board reviewed the plan with the applicant.
ON MOTION BY PALIN AND SECOND BY LIPPS, THE REVISED PLANS AND
ELEVATIONS FOR ADMINISTRATIVE REVIEW NO. 73-130 WERE APPROVED WITH
THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The revised plans and elevations dated January 28, 1976, shall
be the approved layout in compliance with the prior conditions
of approval originally imposed upon this application.
