The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Secretary reported that the applicant has requested a continuance to the meeting of February 25, 1976. ON MOTION BY LIPPS AND SECOND BY PALIN, USE PERMIT NO. 76-3 WAS CONTINUED TO THE MEETING OF FEBRUARY 25, 1976, AT THE REQUEST OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-12 (In Conjunction/CE 76-3) Applicant: Borg-Warner Corporation To permit the construction of a 24,000 square foot industrial build- ing pursuant to Section 9510 of the Huntington Beach Ordinance Code, located on the north side of Argosy Drive approximately 340 feet west of Graham Street in an M1-A, Restricted Manufacturing District. The Chairman informed the Board that this project is covered by EIR 73-16, approved by the City Council on March 18, 1974. Minutes, H.B. Included in the discus- sion were the width of driveways, the parapet screening planned for rooftop mechanical equipment, and the storage areas to be provided onsite. ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINISTRATIVE REVIEW NO. 76-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received January 26, 1976, shall be the approved layout, subject to the modifi- cations described herein: a. A minimum driveway width of 35 feet shall be provided for the drive which will carry truck traffic. b. The plot plan shall show the locations of the buildings and the proposed location of the storage area and the cir- culation around that storage area. A plan delineating said modifications shall be submitted to the Department of Building and Community Development at the time of submittal for plan check. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; . Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detec- tion devices or systems shall comply with the specifica- tions of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Depart- ments of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. A Tentative Parcel Map shall be filed. Said parcel map shall record prior to issuance of a Certificate of Occupancy. 2. Access rights shall be dedicated on said Tentative Parcel Map. AYES: PALIN, C:cOSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-3 (In Conjunction/AR 76-12 Applicant: Borg-Warner Corporation To permit the construction of a 44-foot high test tower which ex- ceeds the 40 foot permitted height limitation by 4 feet. This request is in lieu of Section 9514.3 of the Huntington Beach Ordinance Code, located on the north side of Argosy Drive approxi- mately 340 feet west of Graham Street in an M1-A, Restricted Manufacturing District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, Environmental Quality Act, 1970. The Chairman opened the public hearing. BZA 2-11-76 Page 3 Minutes, H.B. Board of Zoning Adjustments February 11, 1976 Page 4 Byron Jackson, Ben Rentzel, and Henry Thompson were present to represent the application. Mr. Rentzel explained that the tower will be used for the purpose of testing submersible deep well pumps, and that the 44-foot tower is the minimum height which will fit these units. There being no one else present to speak on the proposed project, the public hearing was closed. Board discussion ensued, and it was determined that this project would be included in the exceptions on height limitations set forth in Section 9730 of the Ordinance Code; therefore, the 45-foot tower as originally requested would be allowed and the Conditional Excep- tion request for this use can be withdrawn. ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 76-3 WAS WITHDRAWN AND AUTHORIZATION GIVEN FOR A REFUND OF THE APPLICATION FEE PAID, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 75-169 Applicant: Foxx Development Corporation To permit the construction of a single-family residence pursuant to Section 9384.16 of the Huntington Beach Ordinance Code, located on the west side of 16th Street approximately 100 feet north of Pecan Avenue in the Townlot Specific Plan Area One. Bob Jarrard was present at the meeting. The Board reviewed the request. Mr. Jarrard explained that he has planned the layout in order to slide the unit forward and afford the necessary dedication if it is necessary to provide the proper turning radius into the garages. If the Specific Plan ordinance is in effect at the time of issuance of building permits, the plan received and dated February 10, 1976, shall be the approved layout. If at the time of issuance of building permits this requirement makes it necessary to amend the plan to afford the additional two foot (2') setback to achieve this turning radius, the plan shall be so amended. To permit the construction of an apartment building that extends more than 150 feet from a public street, pursuant to Section 9730.20 of the Huntington Beach Ordinance Code, located on the north side of Stark Street approximately 150 feet east of Parkside Lane in an R3, Medium High Density Residential District. Jan Aiken was present to represent the applicant. The applicant submitted updated plans to the Board. Secretary Palin noted that the developer had indicated that it was not his intention to provide reciprocal drives between this property and the adjacent one, as previously suggested. The Board reviewed the revised plans, taking into consideration the width of the clear -to -the -sky access, the parking space number and dimensions, and the provision of some sort of pedestrian walkway for access from the rear of the units. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received February 11, 1976, shall be the approved layout, subject to the modification described herein: The plan shall be revised to provide for a twelve foot (121) parking space dimension for the parking space at the rear of Units 4 and 5. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modifi- cation outlined by the Board, said plan shall be approved and be made a permanent part of the administrative file. Harry Tancredi was present to represent the application. The Board reviewed the plot plan, finding that the dimensions in- dicated thereon were in error. The applicant was informed that the Board would require a different elevation treatment for the garage on the corner lot, Lot No. 1, to present a more pleasing appearance from the street. Harry Tancredi was present to represent the application. Secretary Palin noted that changes have been made on the site plan and initialed by the applicant, Mr. Tancredi; these changes involved alteration in setback from the alley and change in separation be- tween units to comply with the required turning radius. The Board discussed the reasons for these changes with Mr. Tancredi; the appli- cant was also advised that an over-all conceptual landscaping plan which would work for all of his current applications (AR 76-5, 76-6, and 76-7) would be acceptable to the Board. ON MOTION BY LIPPS AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 76-6 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. The applicant was informed that street improvements in the Townlot would be required only on developments encompassing a whole- or half -block area; he was also advised that the 25 foot turning radius shown on one of the garages must be increased to the required 27 feet, and that unique treatment of the garage elevations on the exterior corner lot would be required. Also discussed were landscaping plans and the alley setback line of the garage units. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Gary Whitaker was present at the meeting. The Board reviewed past action on the subject property. The huild- inq on said property was converted from residential to commercial use in 1963; the use has been determined to have been abated for at least one year. With the abatement, the site must now conform to the required setback of fifty feet from Beach Boulevard and other applicable requirements of the Ordinance Code.
