The Chairman informed the Board that this project is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. No one was present to represent the application. The Board noted that the revised plans as requested at the previous hearing for this project have not yet been received. Board of Zoning Adjustments February 18, 1976 Page 2 USE PERMIT NO. 76-4 (Cont. from 2-4-76) Applicant: Roger DeYoung To permit the construction of a fourteen unit apartment building pur- suant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code, located on the east side of Green Street approximately 525 feet south of Pearce Avenue in an R3, Medium Density Residential District. The Chairman informed the Board that Negative Declaration No. 76-3 has been granted by the Environmental Review Board on February 3, 1976, for this project. Roger DeYoung was present at the meeting. The Chairman opened the public hearing. Mrs. James Wilson addressed the Board, asking that the parking in front be separated from the sidewalk by planting, and also noted that there is a street light which will be required to be installed in front of the proposed project. Mr. DeYoung reviewed the revisions he has made to his plan in attempting _ to conform to the desires of the Board as expressed at the previous hearing. The Chairman closed the public hearing. The Board reviewed the revised plans, noting that the alterations have reduced the number of units from the previously requested 15 to 14. Board consideration included the type of recreational amenities to be provided in the complex, the setbacks and separation of parking areas from buildings and property lines, landscaping, and dimensions of parking spaces and turnarounds. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-3 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 76-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; BZA 2-18-76 Page 2 Minutes, H.B. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received February 9, 1976, shall be the approved layout, subject to the modifi- cation described herein: a. The plan shall be revised to reflect a modified turn- around at the easterly end of the driveway to conform to an over-all width of thirty-six (36) feet and an east -west leg of twenty feet (20'). b. The revised plan shall comply with a minimum of ten feet (10') of landscaped area between the parking and the front property line. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. In accordance with the City's standards and requirements, all necessary dedications of right-of-way shall be made. BZA 2-18-76 Page 3 Minutes, H.B. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection dev- ices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assess- ment district. 7. The developer shall participate in the Orange County Sanita- tion District No. 11 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Street lights shall be installed in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A plan shall be submitted back to the Board of Zoning Adjust- ments for review and approval action on the recreational amenities proposed for -the project, the facilities to be pro- posed in the recreation room, and for the area immediately between such facility and the rear property line. This plan shall be submitted at the time of issuance of building permits. 2. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 5. Crime prevention techniques shall be applied to the design aspects of the project (e.g., single -cylinder locks, etc.). AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE' CONDITIONAL EXCEPTION NO. 76-1 (Cont. from 2-4-76) Applicant: Roger DeYoung To permit a front yard setback of ten (10) feet in lieu of the required twenty (20) feet and a reduction in the required recrea- tion and leisure area by approximately sixteen percent (16%). These requests are in lieu of Sections 9320.6 and 9320.14, re- spectively, of the Huntington Beach Ordinance Code. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. Mr. DeYoung was present at the meeting. The Chairman opened the public hearing. There being no one present to comment further, on the project,'the public hearing was closed. The Board reviewed the alterations in the plan resulting from the setback of ten instead of the original fifteen feet on the front property line. Walter Lipps expressed reservations concerning the granting.of the reduced open space and the 10 foot setback. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-1 WAS APPROVED WITH THE FOLLOWING'FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The ratio of the width to the depth of the subject property creates an extreme hardship in location of the units. 2. When the apartment standards'were drafted, the size and con- figuration of lots of this nature were not taken into consideration. 3. An abundance of private open space is provided through the use of ground floor patios and/or decks for each unit to offset the sixteen percent reduction of common -open space. The proponent has modified his plan according to the desires of some of the residents in the adjacent area by providing the ten foot front yard setback and deleting one unit from the proposed project. These modifications have served to bring the plan into greater conformity with the provisions of the ordinance code. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received February 9, 1976, shall be the approved layout, subject to the modifications de- scribed herein: a. Board of Zoning Adjustments February 18, 1976 Page 7 Walt Lipps submitted the following reasons for his "no" vote: 1. The granting of this conditional exception would establish an undesirable precedent. 2. The project layout could have been redesigned to meet the stand- ard setbacks and percentage of open space required by ordinance codes. ADMINISTRATIVE REVIEW NO. 76-15 (Cont. from 2-11-76) Applicant: Gary G. Whitaker To permit the establishment of an auto sales lot pursuant to Section 9430.2 of the Huntington Beach Ordinance Code, located at the south- west corner of Beach Boulevard and Clay Street in a C2, Community Business District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Gary Whitaker and Mr. and Mrs. Marvin McElroy (property owners) were present at the meeting. Walt Lipps reported that his research of the files has not cleared up the question of prior approval on the subject building, which is non -conforming because of yard setbacks. It was his conclusion that, at the time the mobile home sales operation formerly .at this site was approved, any use prior to that had not been abated and the approval for the mobile home sales was predicated on a non- conforming building with a still -effective use. Since the use has now been abated, the location of the building cannot be approved. The Board discussed procedural alternatives with the applicants and explained the code requirements for setbacks on Beach Boulevard. Included in the alternatives were application for a conditional exception, appeal to the Planning Commission of a Board condition for moving the building, or a temporary certificate of occupancy subject to bonding for moving the building. Also considered was the possibility of a temporary office structure (such as a trailer) with a limited period of occupancy until the building is either re- located or modified to comply with the proper setback. The Board reviewed conditions which would allow encroachment into the required fifty foot (50') setback, considering sight angle and necessary landscaping and pedestrian walkways. It was the consen- sus that the rear portion of the existing building could be used temporarily, with bonding to guarantee that the building would be brought into total conformance with ordinance code requirements .within a snecifiPd period of time. Board of Zoning Adjustments February 18, 1976 Page 8 ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 76-15 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received February 2, 1976, shall be the approved layout, subject to the modifications de- scribed herein: a. The location of the building shall be modified within a period of six (6) months to conform to Article 9432 of the Huntington Beach Ordinance Code. Such plan shall be submitted back to the Board of Zoning Adjustments for review and approval action during the six- month period. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; • Parking layout; . Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. GENERAL CONDITION: 1. Temporary occupancy shall be granted for that portion of the structure conforming to the proper setback for a six- month period of time, during which period the applicant shall file plans for modification of the structure to con- form to the Ordinance Code. The Board of Zoning Adjustments shall review these plans at the termination of the six-month period (to be calcu- lated from the time of establishment of the use). The Board shall evaluate the progress made on the modification of the building and, if adequate progress is being made, the Board shall consider a possible extension of six months' additional time for the proponent to bring the building into total conformance with Ordinance Code re- quirements. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-4 Applicant: William D. Vaughn To permit the construction of a twelve (12) foot high fence along the property line which is 6 feet over the 6 foot permitted height, in lieu of Section 9204 of the Huntington Beach Ordinance Code, located on the east side of Florida Street, approximately 450 feet north of Garfield Avenue in an R3, Medium High Density Resi- dential District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. William Vaughn and Claude Clemens were present at the meeting. The Chairman opened the public hearing. Mr. Vaughn addressed the Board, explaining his reasons for request- ing the height exception. There being no other persons to speak on the proposed project, the public hearing was closed. BZA 2-18-76 Page 9 Minutes, H.B. Board of Zoning Adjustments February 18, 1976 Page 10 The Board reviewed the request, considering the distance of the ball courts from the side property lines, the materials of the fencing, and the effect such a fence would have on adjoining residential units to the north. It was determined that moving the fence in to the setback lines would be a problem because of the necessity of maintain- ing a portion of the open space for the purpose of oil well operations on the property. The applicant was informed that the Planning Commission has been discussing revision to the code to allow height variations in fencing around recreational areas and was advised to postpone his request until some parameters have been established. In the meantime, it was the consensus of the Board that the Building Department could issue a permit for the twelve -foot fence along the easterly property line. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-4 WAS CONTINUED TO THE MEETING OF APRIL 7, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-2 Applicant: Patricia G. Jackson To permit a five (5) lot division of land pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, located on the northeast corner of Utica Avenue and Florida Street in an R2, Medium Density Residential District. The Chairman informed the Board that this request was granted Negative Declaration No. 76-6 by the Environmental Review Board on February 3, 1976. Secretary Palin reported that the proponent for subject application has also filed a Conditional Exception to the Planning Commission to allow reduced lot widths. ON MOTION BY PALIN AND SECOND BY CROSBY, TENTATIVE PARCEL MAP NO. 76-2 WAS REFERRED TO THE PLANNING COMMISSION TO BE HEARD AT ITS MARCH 2, 1976, MEETING IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 76-02, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-16 Applicant: Harold O'Laughlin To permit the establishment of a fast food pizza parlor pursuant to BZA 2-18-76 Page 10 Minutes, H.B. Board of Zoning Adjustments February 18, 1976 Page 11 Section 9453 of the Huntington Beach Ordinance Code, located on the east side of Main Street approximately 200 feet north of Pacific Coast Highway in a C3, General Business District. The Chairman informed the Board that this request is a Categorical Exemption, Class I(a), California Environmental Quality Act, 1970. Mr. O'Laughlin was present at the meeting. The Board reviewed the request. Walt Lipps noted that there should be access provided for Fire and Building Department inspection of the premises. Mel Ott explained to the applicant that the project is within a proposed redevelopment area and the building might have to be demolished in the future. The onsite parking was discussed, as well as offsite parking applicant proposes to provide on an ad- jacent property. Walt Lipps questioned the legality of providing offsite parking on property not under the ownership of the appli- cant, and requested that a legal opinion be obtained from the office of the City Attorney prior to action on this request. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 76-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. A lease shall be filed with the City (prior to any additional inspections and/or issuance of building permits for further modifications to the structure) providing for eight (8) off - site parking spaces upon the property known as 115 3rd Street. The authorization for the use of subject property for a fast food facility shall run concurrently with said lease and shall terminate upon termination of said lease. 2. A pedestrian gate if not already in existence shall be pro- vided in the rear of the offsite parking facility to allow pedestrian access to the subject facility. Scott To permit the construction of a 1700 square foot industrial storage building pursuant to Section 9530 of the Huntington Beach Ordinance Code, located on the east side of Crystal Street approximately 355 feet south of Garfield Avenue in an Ml, Light Industrial District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. William J. Scott was present at the meeting. The Board reviewed and discussed the application. The subject property consists of Lots 15 and 16, split off from a previous stor- age yard approved for Lots 14, 15, and 16. Among the problems considered were the questions of whether the project could be con- sidered non -conforming because of inadequate front yard setback under the new M-1 provisions; whether or not the use constitutes estab- lishment of a new use or can be considered a continuation of the already established use; the parking provisions; and the possible need for additional landscaping on the site. Walt Lipps expressed the opinion that insufficient information is available in this appli- cation to permit the Board to make a determination at this time. Also considered was the suitability of the administrative review application for a project of this nature. BZA 2-18-76 Page 12 Minutes, H.B. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received February 6, 1976, shall be the approved layout. The applicant shall comply with all applicable provisions of the conditions imposed for the original storage facility on subject property by Administrative Review No. 72-67. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Jeff Holm was present to represent the applicant. Landscaping, separation between units, and the location and number of directional signs planned for the project were dis- cussed. Mel Ott notified applicant of the requirement for an operative water system before start of construction, and discussed the provision of gate access for emergency vehicles.
