CONSENT CALENDAR:
ON MOTION BY PARKINSON AND SECOND BY FINLEY THE MINUTES OF

APPLICANT: Four Seasons Farms
This is a request to permit the operation of an equestrian center
on a permanent permit located on Ellis Avenue 630 feet west of
Goldenwest Street on the south side of Ellis.
Chairman Slates noted that the Staff had requested a continuance
to allow for the final processing of the proposed "Horse Facilities
Ordinances" before the City Council. The applicant concurred
with the necessary continuance.
The public hearing was opened. There was no one present to speak
on this application.

CONDITIONAL EXCEPTION NO. 75-27
APPLICANT: Bill C. Williams
This is a request to permit exceptions to Article 949 for the
operation of a commercial horse stable on property located on
the north side of Ernest Avenue approximately 320 feet east of
Goldenwest Street in an Ml-0, Light Industrial Oil District.
IN CONJUNCTION WITH:
CONDITIONAL USE PERMIT NO. 75-09
APPLICANT: Bill C. Williams
This is a request to continue to operate existing boarding stable
for 215 horses located on the north side of Ernest at Stewart.
Chairman Slates noted that the Staff had requested a continuance
to allow for the final processing of the proposed "Horse Facilities
Ordinance" before the City Council. The applicant concurred with
the necessary continuance.
The public hearing was opened. There was no one present to speak
on this application.

CONDITIONAL USE PERMIT NO. 75-25
APPLICANT: Argosy Tennis Association
This is a request to permit a family tennis and racquet ball club
located on the north side of Argosy Drive approximately 950 feet
west of Graham, within the Huntington Beach Industrial Park.
A vugraph was shown.
Chairman Slates opened the public hearing.
David Kirchner, representing the applicant, addressed the Commission,
and discussed the revised plot plans which had been submitted and
noted that they conformed with the standards established in that area.
John Hile submitted a letter from Lou Ryave, Club Manager of the
Warner Center Racquet Club. This letter addressed the advantages of
building a recreational tennis club in an industrial area. He also
submitted a letter from David W. Ariss, Vice President of the

Huntington Beach Industrial Park, in which Mr. Arris stated that he
felt the development of such recreational facilities would tend to
aid in further developing the remaining acreage.
The public hearing was closed.
Commissioner Bazil stated that he was opposed to locating this type
of facility in prime industrial area.
Commissioner Parkinson concurred with Commissioner Bazil and further
stated that he did not feel this use represented the highest and
best use as far as the City is concerned.
Commissioner Kerins felt that this was not the best use for the
industrial property, particularly since this is the best industrial
property in the City.
Commissioner Finley stated that while this property is not "prime
property" such as the Orange County Airport industrial area, it is
' the prime property in Huntington Beach. She expressed concern
over the location of the tennis court within the area as opposed
to the perimeter of the industrial park.
Further discussion ensued.
Commissioner Slates stated that if the developers as well as the
owners of the industrial area felt the development of a tennis
club would tend to aid in further developing the remaining acreage
that the use should be approved.
ON MOTION BY PARKINSON AND SECOND BY BAZIL CONDITIONAL USE PERMIT
NO. 75-25 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING
VOTE:
1. The use is inconsistent with the intended uses of the zoning.
2. The use is proposed to be located in the middle of the industrial
development which provides for land use incompatibilities.
3. The subject site is the most prime industrial property in the
City and should be used as such.
4. The City would garner a greater rate of revenue from an industrial
use in this area.

TENTATIVE TRACT 8788"X" REVISED
APPLICANT: Gordon Mountjoy
Tentative Tract Map No. 8788"X" filed on December 15, 1975, is a
request to permit the subdivision of land into 24 individual parcels
for industrial development. The property is located on the east side
of Gothard approximately 630 feet south of Talbert Avenue.
Jim Palin addressed the Commission and discussed the revised,map which
was on display. He discussed the amended conditions.of approval.
A vugraph was shown.
Gordon Mountjoy addressed the Commission and stated that he felt he
could comply with the suggested conditions of approval.
ON MOTION BY BOYLE AND SECOND BY KERINS TENTATIVE TRACT 8788"X".REVISED
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE:
1. The tentative map received and dated February 18, 1976 shall be the
approved layout. ,
2. A detailed hydrology study shall be completed and submitted to the
Director of Public Works for approval action prior to installation
of the street as shown upon the tentative map. This study shall
include the method and systems proposed to properly handle surface
drainage for -this proposed development. The drainage system shall
also include a design to provide for siltation and erosion control
both during and after construction of the project.
3. All proposed new streets within this development shall be designed
and improved in compliance with standard plans and specifications
on file in the Department of Public Works. The 45 ft. street
section shall be dedicated to the City of Huntington Beach for
public street purposes, back of curb to back of curb. The ultimate
street width shall be 55 ft. which shall provide for 5 ft. easements
on each side of the paved section for utilities and future walk-
way purposes. Setbacks of all structures shall be measured from
the ultimate right-of-way width which should be 55 ft. for the
purpose of this condition.
4. All vehicular access rights along Gothard Street shall be dedicated
to the City of Huntington Beach except at street intersections and
one driveway for lot number 12, one common access point for lots 7
and 11, and one common access point for lot 17 and 18, and one
driveway within 150 ft. of the northerly boundary to lot 24. This
would prohibit driveways onto Gothard from lots 1, 6 and 23.
5. Soils and compaction reports shall be submitted to the Department
of Building and Community Development and Department of Public
Works prior to the issuance of building permits. Such permits
shall be submitted by a qualified soils engineer. All structures
constructed within this project shall comply with the report
recommendations.

6. The proposed CC&R's shall be submitted to the City for review by
the Attorney's Office and the Planning Department to assure that
the documents are prepared as to legal form and that they do not
contain provisions that would be violations of any existing City
ordinance.
7. The sewer, water, fire hydrant system shall be designed to City
standards.
8. The water system shall be through the City of Huntington Beach
water system.
9. The sewage disposal shall be through the City's sewage system.
10. The property shall be subject to the local drainage assessment
district requirements and fees.
11. All required improvements shall be constructed under the super-
vision of and to the approval of the City Engineer. Costs of
the inspection shall be paid by the subdivider. 3-1/2 percent
of the amount of the improvement bond shall be posted with the
City Engineer for inspection costs.
12. Parcel maps shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
13. The property shall participate in the local drainage assess-
ment district at the time each parcel is developed.
14. A copy of the recorded parcel map shall be filed with the
Planning Department.
15. All structures existing upon the property within the right-of-way
as delineated on the tentative map as public street right-of-way
shall be relocated and/or demolished prior to commencement of
the street improvements for such street.

APPLICANT: Anthony DeLeonardis
This is a request to permit a reduction of minimum 60 foot frontage
in lieu of S. 9162.2 of the Huntington Beach Ordinance Code, located
at the northeast corner of Utica and Huntington Streets.

This is a request to permit the subdivision of 2.5 acres of.land into
9 lots located on the northeast corner of Huntington and Utica.
Jim Palin stated that the applicant had discussed alternative layouts
with the staff and the revised map is in compliance with provisions
of the subdivision ordinance and does not require the•approval:of
Conditional Exception No. 76-01.
There was a discussion concerning the withdrawal of Conditional
Exception No. 76-01. ,
Chairman Slates opened the public hearing on Conditional Exception
No. 76-01.
Mr. DeLeonardis addressed the Commission and requested withdrawal
of Conditional Exception No. 76-01.
The public hearing was closed.
ON MOTION BY KERINS AND SECOND BY FINLEY APPROVAL FOR -WITHDRAWAL
OF CONDITIONAL EXCEPTION NO. 76-01 REQUESTED BY THE APPLICANT WAS
GRANTED BY THE FOLLOWING VOTE:

ABSENT: Shea
Mr. DeLeonardis addressed the Commission and complimented the Staff
on their cooperation and efforts in arriving at a better plan.
Gordon Offstein addressed the Commission and also complimented -the
Staff and .the developer for coming up with a better plan, particularly
in reference to the prevention of a drainage problem.
ON MOTION BY KERINS AND SECOND BY BOYLE TENTATIVE TRACT NO. 9175
WAS APPROVED WITH THE FOLLOWING CONDITIONS AND BY THE FOLLOWING VOTE:
FINDINGS:
1. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation for
this type of housing.
2. The property was previously studied for this intensity of land
use at the time the land use designation for medium density
residential was placed on said property.
3. The lot size, depth, frontage, street widths, and all other design
and improvements features of the proposed subdivision are pro-
posed to be constructed in compliance with standard plans and
specifications on file with the City, as well as in compliance
with the State Map and supplementary City Subdivision Ordinance.

CONDITIONS OF APPROVAL:
1. The tentative tract map received and'dated February 17, 1976,
shall be the approved layout.
2. Reciprocal drives shall be provided on common property lines
between abutting lots to facilitate a maximum of two (2)
driveways on Huntington Street and two (2) driveways on pro-
posed "A" Street.
3. The sewer, water, and fire hydrant system shall be designed to
City standards.
4. The water system shall be through the City of Huntington Beach
water system.
5. The sewage disposal shall be through the City sewage system.
6. The property shall be subject to the local drainage assessment
district requirements and fees.
7. Drainage for the subdivision shall be approved by the Department
of Public Works prior to the recordation of a final map. This
system shall be designed to provide for siltation and erosion
control both during and after construction of the project.
8. All required improvements shall be constructed under the super-
vision of and to the approval of the City Engineer. Cost for
the inspection shall be paid by the Subdivider. Three and one-
half percent (3.5%) of the amount of the improvement bond shall
be posted with the City Engineer for inspection costs.
9. A twenty-six foot (261) half street section shall be provided
along the easterly boundary of the subdivision. Such street
shall be dedicated and fully improved at the time of initial
construction.
10. If the developer proposes to provide air conditioning, the in-
sulation in ceilings and exterior walls shall be a minimum of
R-19 and R-11, respectively. If no air conditioning is to be
provided, the insulation in ceilings and exterior walls shall
be a minimum of R-13 and R-7, respectively.
11. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material,' shall be disposed of at an
offsite facility equipped to handle them.
12. Natural gas and 220V electrical shall be stubbed in at the location
of clothes dryers, and natural gas shall be stubbed in at the
locations of cooking facilities, water heaters, and central
heating units.
13. An engineering geologist shall be engaged to submit a report
indicating the ground surface acceleration from earth movement
for the project property.

14. All structures proposed for construction within this project shall
be constructed in compliance with the g-factors as indicated by
the geologist's report.
15. Calculations for footings and structural members to withstand
anticipated g-factors shall be submitted to the City for review.
16. A chemical analysis, as well as tests for physical properties of
the soil on subject property, shall be submitted to the City for
review prior to the issuance of building permits.
MISCELLANEOUS:
Memo from Director of Public Works requesting a finding of conformance
with the General Plan on two proposed street vacations within the City.

Gordon Offstein stated that he had been unable to find documents in the
library which were to have been issued from the Planning Department
Staff. Secretary Harlow advised him that the Planning Department had
furnished the library with these documents and would continue to furnish
the library with documents originating from the Planning Department
WRITTEN COMMUNICATIONS:

COMMISSIONERS' COMMENTS:
Chairman Slates stated that with the Commission's approval he would
like to represent the Planning Commission at the AIP/ASPO Conference
in Washington D.C. the week of March 21. The Planning Commission
concurred.

Commissioner Bazil expressed concerns over property being held in
Planning Reserve, thus denying the owners the possibility of
disposing of their property. Secretary Harlow stated that this
will be reviewed at the General Plan hearing in June, 1976.
There was considerable discussion among Commissioners of the
Joint Study Session with City Council and PAC to be held on
March 3, 1976.
Secretary Harlow stated that he would meet with the City Attorney's
office and discuss the procedures for the March 3 meeting.
Chairman Slates asked that a copy of Section 65402 of the Government
Code be furnished him. John O'Connor stated that he would do so.
STAFF'S COMMENTS:
Secretary Harlow discussed the action at the City Council meeting
of February 17, 1976.
