Pelochino, D.D.S. To permit the remodeling and conversion of an existing service station to an office -professional building, pursuant to Section 9471.4.1 of the Huntington Beach Ordinance Code, located on the northwest corner of Yorktown Avenue and Beach Boulevard in a C4, Highway Commercial District. The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Secretary Palin reported that a request has been received from the applicant asking for a week's continuance on this item. Ron Gold, representing the adjacent R & B Furniture Store, addressed the Board in regard to the extent of the remodeling and landscaping which would take place on the subject site. The Board reviewed with Mr. Gold the architectural features planned for the remodeling, the setbacks and parking which would be required, and the land- scaping percentage necessary for the site. The Chairman continued the public hearing. ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 76-7 WAS CONTINUED AT THE REQUEST OF THE APPLICANT TO THE REGULAR MEETING OF MARCH 3, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-3 Applicant: Brent Enterprises To permit the construction of a coin -operated car wash and fast tune-up center, pursuant to Section 9472 of the Huntington Beach Minutes, H.H. Board of Zoning Adjustments February 25, 1976 Page 2 Ordinance Code, located on the south side of Talbert Avenue approxi- mately 160 feet east of Beach Boulevard in a C4, Highway Commercial District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mr. Brent, George Lightner, and Mr. Beam were present to represent the application. The Chairman reopened the public hearing. Mr. Brent addressed the Board, discussing the parcel map which will have to be filed on the subject property, the driveways, and pro- posed signs for the uses. Mr. Beam presented traffic diagrams showing the traffic flow in and out of the project by the two driveways as requested by the applicant. He noted that the traffic flow in the completed project will be con- trolled by striping and directional arrows. The Chairman closed the public hearing. Secretary Palin expressed continued reservations on the two drive accesses, the resulting traffic flow, and the onsite stacking pattern, noting his opinion that the size and configuration of the property does not lend itself to the proposed facilities. Bruce Crosby noted that the drives do conform to Public Works stand- ards and that the Traffic Engineer has recommended that the two accesses be permitted. Also discussed were the open service bays as they relate to the aesthetic appearance from the street. ON MOTION BY CROSBY AND SECOND BY LIPPS, USE PERMIT NO. 76-3 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received January 12, 1976, shall be the approved layout, with the two driveways as shown on said plan. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe'systems, fire hydrants, fire alarm systems, and any other required fire protection and detec- tion devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. - 5. The developer shall participate in the local drainage assessment district. 6. The developer shall participate in the Orange County Sanitation District #3 Sewer Annex District. 7. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Talbert Avenue shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main ex- tensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A parcel map shall be filed to adjust the westerly lot line of subject property. 2. Exhibit A shall be the approved traffic flow pattern, in- cluding the two thirty-five foot (35') drives and striping, arrows, and traffic directions as shown on said Exhibit A. AYES: CROSBY, LIPPS NOES: PALIN ABSENT: NONE Secretary Palin listed his reasons for his "no" vote as follows: 1. The plan and the traffic control mechanisms proposed are a viola- tion of the ordinance code in that: a. The drive widths alongside a commercial building are inadequate; b. It will require people to circulate down the left hand side of a driveway. 2. The size and configuration of the property does not lend itself to the facilities as proposed, and it would have been more beneficial to both the applicant and the City if the applicant had explored one driveway, with a reorientation of the uses or perhaps establishment of only one use on the subject property. 3. The plan as submitted does not take into consideration the aesthet- ics of the open bays and the drive cuts with no visual break or landscaping to mitigate the harshness of the buildings. 4. The line as dashed on the plan submitted January 12, 1976, would indicate that there may be a future desire to divide the site, which would result in problems in drive widths, signing, and cir- culation for the two separate uses. Board of Zoning Adjustments February 25, 1976 Page 5 ADMINISTRATIVE REVIEW NO. 76-19 Applicant: Tom and Truskier, Architects To permit a 3,000 square foot addition to an existing bank building pursuant to Section 9430 of the Huntington Beach Ordinance Code, located on the northeast corner of Delaware Street and Main Street in a C2, Community Business District. The Secretary informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Secretary Palin reported that a request has been received from Saul Sher, owner of the subject property, for a postponement of consideration of this request. (Mr. Sher has not reviewed the plans as submitted, nor has he submitted a letter of authorization for this project.) ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-19 WAS CONTINUED AT THE REQUEST OF THE PROPERTY OWNER TO THE REGULAR MEETING OF MARCH 3, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-4 Applicant: Cooper -Sherman Engineering Company To permit a two -parcel subdivision pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located at the northwest corner of Argosy Drive and Graham Street in Tentative Tract 8688, an M1-A and C4 Restricted Manufacturing and Highway Commercial District. The Chairman informed the Board that this request is covered by EIR No. 73-16, approved by the City Council on March 18, 1974. Mr. Steinberg (Cooper -Sherman) was present to represent the application. The Board reviewed the request. The suggested conditions of approval were discussed with the applicant, and the effect this subdivision will have on the vehicular access rights on Parcel No. 2 was considered. ON MOTION BY CROSBY AND SECOND BY PALIN, TENTATIVE PARCEL_MAP NO. 76-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: BZA 2-25-76 Page 5 Minutes, H.B. Board of Zoning Adjustments February 25, 1976 Page 6 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Depart- ment on February 13, 1976, shall be the approved layout, except as follows: The February 13 layout shall apply for Parcel No. 1; how- ever, dedications and vehicular access rights on Parcel No. 2 shall be determined by the Board of Zoning Adjustments in conjunction with review and approval action on a specific development proposed for Parcel No. 2. 2. A parcel map shall be filed with, and approved by, the De- partment of Public Works, and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach water system at the time said parcels are developed. 4. Sewage disposal shall be through the City of Huntington Beach sewage system at the time said parcels are developed. 5. All utilities shall be installed underground at the time said parcels are developed. 6. Compliance with all applicable City ordinances. 7. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 8. A copy of the recorded parcel map shall be filed with the Planning Department. 9. All applicable conditions of approval imposed on Tentative Tract 8688 shall be complied with. The Board reviewed the request, discussing access, circulation, and safety aspects of the proposal. ON MOTION BY PALIN AND SECOND BY CROSBY, SPECIAL EVENT NO. 76-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received January 23, 1976, shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. The area shall be roped off to prohibit vehicular circulation within the sale area, but to retain total circulation for vehicular traffic around the periphery of the display area. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE SPECIAL EVENT NO. 76-4 Applicant: Jack in the Box To permit a special promotion on Saturday and Sunday, February 28 and 29, from 12 noon to 4:00 p.m., located at 6042 Edinger Avenue. The Board reviewed the request. ON MOTION BY LIPPS AND SECOND BY PALIN, SPECIAL EVENT NO. 76-4 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received February 24, 1976, shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. Signs used on the site shall be of sufficient height to facil- itate any and all emergency vehicles to come onto the site. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE SIGN REQUESTS: USE PERMIT NO. 76-3 (Sign Request) Applicant: Brent Enterprises To permit installation of two (2) freestanding signs and two (2) wall signs for a car wash and tune-up facility located on the south side of Talbert Avenue approximately 160 feet east of Beach Boulevard. The signs as proposed were reviewed by the Board, taking into con- sideration the location and setback requirements for the freestand- ing signs and the allowed square footage for the wall signs. The ground clearance was found to be inadequate and will be increased for the pole signs. Also considered was the possibility of combining the pole signs into one, with identification for both uses. ON MOTION BY LIPPS AND SECOND BY CROSBY THE SIGNS REQUESTED FOR USE PERMIT NO. 76-3 WERE APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received February 25, 1976, shall be the approved plan, subject to the following: The plan submitted to the Department of Building and Safety at the time of application for permits shall delineate exact loca- tions and dimensions of all signing and the ground clearance for the proposed pole signs. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. AYES: CROSBY, LIPPS NOES: PALIN ABSENT: NONE BZA 2-25-76 Page 8 Minutes, H.B. Board of Zoning Adjustments February 25, 1976 Page 9 Mr. Palin submitted the following reasons for his "no" vote: 1. This "no" vote is predicated upon the original negative vote on the use permit - that the establishment of the two uses constitutes overcrowding of the subject site. 2. One freestanding sign could have been located in the center of the property with identification for both uses, in a manner which would have met the criteria of the ordinance code. SIGN REQUEST NO. 7079 (UP 76-11) Applicant: Heath & Company To permit installation of two (2) wall signs and one monument sign located at 7490 Edinger Avenue (Denny's, Inc.) The height and coloring of the subject signs were reviewed by the Board, as well as the relationship of the proposed signs to the sign theme for the shopping center in which the use is located. ON MOTION BY PALIN AND SECOND BY LIPPS, SIGN REQUEST NO. 7079 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual sign plan received February 16, 1976, shall be the approved layout, subject to the following: Locations, heights, and dimensions of all signs shall comply with the overall conceptual conditions of approval originally imposed upon the complex in which this use is located. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE SIGN REQUEST NO. 7082 (AR 74-209) Applicant: ACS Enterprises, Graphic Sign Division To permit a freestanding sign located at 21012 Brookhurst Street, The Board's review of the sign request indicated that it is in compliance with the ordinance code in all respects except the proposed location of the sign. Board of Zoning Adjustments February 25, 1976 Page 10 sign to conform to code would mean the loss of one parking space from the subject property. ON MOTION BY LIPPS AND SECOND BY CROSBY, SIGN REQUEST NO. 7082 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual sign plan received February 24, 1976, shall be the approved sign. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code.
