Applicant: John F. Pelochino, D.D.S.
To permit the remodeling and conversion of an existing service
station to an office -professional building, pursuant to Section
9471.4.1 of the Huntington Beach Ordinance Code, located on the
northwest corner of Yorktown Avenue and Beach Boulevard in a C4,
Highway Commercial District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class I, California Environmental Quality Act, 1970.
Joe Alfano was present to represent the application.
The Chairman opened the public hearing.
Secretary Palin informed the Board that a revised plan has been
submitted showing relocation of parking in the event that recip-
rocal easements can be obtained with the R and B property to the
north. Mr. Palin also noted that the plan has not taken into
account the ultimate dimension to the centerline of Yorktown. Bruce
Crosby added that the ultimate width of the half street will be
fifty (50) feet, requiring an additional dedication of eight feet
(81) and the moving of the curb and gutter back a distance of ten
(10) feet. This will eliminate the new planter shown on the
plan, eliminate half of the existing planter, and affect the future
addition to the structure as far as setback is concerned. Also,
one parking place will be eliminated.

The Board discussed the request, including landscaping, parking,
and the proposed future addition.
ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 76-7 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW-
ING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
,b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land
Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received March 9, 1976, shall be the approved
layout, subject to the modifications described herein:
a. The plot plan shall reflect the additional eight -foot
(8') dedication required on Yorktown Avenue and the
relocation of landscaping upon the new site to reflect
a minimum of 6 percent.
b. If the applicant is successful in obtaining reciprocal
easements for ingress -egress over the southerly twenty-
seven feet (271) of the R and B Furniture property
abutting subject property to the north (see General Con-
dition No. 1), the six (6) parking spaces along the
northerly property line of subject property shall be
positioned to reflect a minimum twenty-seven foot (27')
turning radius.
c. The plan shall reflect a landscaped strip between the
interior parking perpendicular to Beach Boulevard
and the six (6) parking spaces along the northerly
property line, to protect the side stall from vehicular
damage from the other parking spaces.

d. The design, location, and arrangement of the two (2)
parking spaces along the westerly portion of the
property shall be deleted and/or relocated to comply
with Article 979 for access and proper turning
radius.
e. The plan shall reflect the future addition at the re-
quired ten foot (101) setback from the ultimate
right-of-way of Yorktown Avenue.
A plan delineating said modifications shall be submitted
to the Board of Zoning Adjustments for review and approval
action. If such plan complies with the modifications
outlined by the Board, said plan shall be approved and
made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
• Lot area;
• Lot width and lot depth;
. Type of use and its relation to property and improvements in
the immediate vicinity;
. Past administrative action regarding this property.
2. The following plans shall be submitted to the Secretary
of the Board:
Landscape and irrigation plan complying with Article 979
of the Huntington Beach Ordinance -Code and landscaping
specifications on file in the Department of Public Works.
Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical equip-
ment and shall delineate the type of material proposed
to screen said equipment.
3. In accordance with the City's standards and requirements,
an additional eight feet (81) of right-of-way on Yorktown
Avenue shall be dedicated.
4. Soil and compaction reports shall be submitted by a
certified soils engineer. Said reports shall be sub-
mitted to the Department of Building and Community Devel-
opment and shall be subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm
systems, and any other required fire protection and

detection devices or systems shall comply with the
specifications of the Huntington Beach Fire Code._ Plans
'for such -devices and systems shall be submitted to the
Fire -Department and shall be subject to approval by the
Departments of Fire and Public Works.
6. The developer shall participate in the local drainage
assessment district.
7. All applicable fees shall be paid prior to issuance of build-
ing permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Yorktown Avenue on that portion which is to be reconstructed
shall be improved to the centerline of such right-of-way.
Said improvement shall include curbs, gutters, sidewalks, pav-
ing, street trees, street lights, street drainage, and sewer
and water main extensions, in full compliance with the City
of Huntington Beach street standards and requirements.
C. GENERAL CONDITIONS:
1. The applicant shall pursue negotiations with R and B Furni-
ture store, abutting this property to the north, for a
reciprocal agreement for access to the six (6) parking spaces
shown along the northerly property line, to facilitate proper
access and turning radius. If applicant is unsuccessful in
obtaining such reciprocal agreement, those six (6) parking
spaces shall be deleted from the plot plan.

Applicant: Doris Martinez
To permit the construction of a 33,000 square foot commercial building
pursuant to Section 9472 of the Huntington Beach Ordinance Code, located
on the west side of Magnolia Street approximately 1000 feet south
of Garfield Avenue in a C4, Highway Commercial District.
The Chairman informed the Board that Negative Declaration No. 76-10
had been granted this project by the Environmental Review Board
on March 9, 1976.
Doris Martinez and Milt Polsky were present to represent the appli-
cation.

Bruce Crosby noted that existing easements along the southerly
and westerly property lines will require setbacks at those loca-
tions of fifteen (15) and twenty (20) feet, respectively.
The Chairman closed the public hearing.
The Board discussed the width of the main drive and the possi-
bility of using 901 parking instead of the indicated 600. Pat
Spencer said Building has been requiring a minimum of 24-foot
width for two-way access drives which also provide parking, in
order to maintain proper turning radius and also for Fire Depart-
ment access. The drive at the rear of the property was reviewed,
with Bruce Crosby noting that there are man -hole covers already
installed in the easement at the rear of the subject site, and
their location and grade elevation should be indicated on the
plan, as well as further information on the depth, location, and
size of pipe installed in this easement. Circulation to the
rear in order to provide access for service vehicles was also
discussed.
Mel Ott indicated that the Fire Department will require clear
access to the fire hydrants along the south property line of
the K-Mart property to the north.
It was the consensus of the Board that this request should be
continued to permit applicant to submit a revised plan and to
allow time for staff to investigate existing easements and the
locations of the man -holes in the westerly easement.

Applicant: Alva R. Mapes
To permit an addition of a dwelling unit to a site which has a
non -conforming yard because of an existing dwelling, pursuant to
Section 9719 of the Huntington Beach Ordinance Code, located on
the south side of Geneva Avenue approximately 85 feet east of
Alabama Street in an R2, Medium High Density Residential District.
The Chairman informed the Board that this request is a Categ-
orical Exemption, Class V, California Environmental Quality
Act, 1970.
Alva Mapes was present at the meeting.

The Chairman opened the public hearing. There being no one present
to speak for or against the proposed project, the public hearing
was closed.
Board discussion ensued concerning the legality of the existing
structure when it was originally built and whether or not it might
have been a converted garage. The existing portion of the structure
will be demolished and a new garage constructed at zero setback,
which could require a different application to be filed. The Board
reviewed the parking requirements, and advised the applicant to
submit new drawings for a two -car garage only, with proper dimensions
and setbacks shown. Plan shall also reflect the proper turning
radius.
ON'MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO. 76-11 WAS

Applicant: L.D. Zehnder
To permit the construction of two (2) single-family dwellings pursu-
ant to Section 9384.16 of the Huntington Beach Ordinance Code,,
located on the southeast corner of 18th Street and Acacia Avenue in
the Townlot Specific Plan Area One.
The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
Mr. Zehnder was present at the meeting.
The Board reviewed the plan and found it to be in conformance with
code, with the exception of the required twenty-seven foot (27')
turning radius. The applicant was advised of the Board's requirement
for special treatment of the garage roof for the corner unit.
ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINISTRATIVE REVIEW
NO. 76-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW-

1. The garage facing Acacia Avenue shall be furnished on three
sides with a roof designed to provide an aesthetically
pleasing appearance to the street, such as a mansard treat-
ment or other architectural design.

The Chairman informed the Board that this request is a Categori-
cal Exemption, Class III, California Environmental Quality Act,
1970.
No one was present to represent the application.
Board discussion of the project ensued.

Applicant: Beach Auto Mart
Request for permission for the use of grand opening banners and
string pennants for a thirty -day period on property located at
the southwest corner of Beach Boulevard and Clay Avenue.
No one was present to represent the application.
The Board reviewed the special event request, noting that the
application for the grand opening was in order but that the use
itself is non -conforming with the conditions of approval imposed
at the time of original approval. It was the unanimous opinion
that the request be tabled until the Department of Building and
Community has acted to bring the use into conformity by having
the portion of the building which is in violation vacated.
ON MOTION BY SPENCER AND SECOND BY CROSBY, THE SECRETARY OF THE
BOARD WAS AUTHORIZED TO COMMUNICATE WITH THE APPLICANT TO APPRISE

SIGN REQUEST
Applicant: Treat Time Doughnuts
Request for a 6 x 8 pole sign for a satellite shop in a previously
approved shopping center at 6964 Warner Avenue, at the southwest
corner of Warner and Goldenwest Street.
The Board reviewed the sign request.
ON MOTION BY SPENCER AND SECOND BY PALIN, THE SUBJECT SIGN REQUEST
WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE:
REASONS FOR DENIAL:
1. At the time of the approval of the sign theme for the subject
shopping center, a design for wall signs for the satellite shops
was approved.
2. It was further stipulated in the original approval that any future
request for a pole sign for satellite uses should be large enough
to accommodate all or none of such uses. Applicant therefore has
two alternatives:
a. Use of a wall sign, or
b. A new application for a pole sign large enough to accommodate
all satellite shops in the center.
