Mapes To permit an addition of a dwelling unit to a site which has a non- conforming yard because of an existing dwelling, pursuant to Section 9719 of the Huntington Beach Ordinance Code, located on the south side of Geneva Avenue approximately 85 feet east of Alabama Street in an R2, Medium High Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman reopened the public hearing. Steve Mapes was present to represent the applicant, and submitted revised drawings as required at the previous hearing. There being no other persons present to speak for or against the proposed project, the public hearing was closed. The Board reviewed the revised plan, noting that the dimensions are now correct and the plan reflects the two -car garage to serve the two units on the site. ON MOTION BY CROSBY AND SECOND BY PALIN, USE PERMIT NO. 76-11 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments March 24, 1976 Page 2 FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received March 24, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. In accordance with the City's standards and requirements, an additional two and one-half feet (2-1/21) of right-of- way on the alley shall be dedicated. 3. The developer shall participate in the local drainage assessment district. 4. The developer shall participate in the Orange County Sani- tation District No. 3 Sewer Annex District. 5. At the time the plan is submitted to the Department of Building and Community Development for building permits said plan shall comply with the required twenty-five (25) foot turning radius from the proposed garage to the right- of-way line on the opposite side of the alley. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE OIL WELL ACTIVATION PERMIT NO. 76-1 Applicant: Standard Oil Company of California To permit the activation of seven (7) oil wells pursuant to Section 15.40.020 of the Huntington Beach Ordinance Code, located north of Mansion Avenue, west of Goldenwest Street, west of the Pacific Electric railroad tracks, and south of Clay Avenue, on property presently zoned C2-0 , C2-O-CD, R1-0, and R1-0-CD, Community Business District and Low Density Residential District, both combined with oil production. The Chairman informed the Board that Negative Declaration No. 76-13 was granted for this request by the Environmental Review Board on March 23, 1976. The Chairman opened the public hearing. Ed Scott and Alex Henderson were present to represent Standard Oil. There being no other persons present to speak for or against the proposed project, the public hearing was closed. Board discussion ensued, covering fencing and landscaping for the project, distance of the wells from the ultimate right-of-way of Mansion Avenue, and proximity to the Seacliff shopping center. ON MOTION BY PALIN AND SECOND BY CROSBY, THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-13 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY OIL WELL ACTIVATION PERMIT NO. 76-1 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: BZA 3-24-76 Page 3 Minutes, H.B. The well at site "B"147 shall be screened from the view of the shopping center parking lot by installation of block walls or box trees. 2. All unused tie -downs and other debris shall be removed from all sites. 3. The sites at "B"70, "B"4, "B" 13, "B" 5, and "B"22 shall be properly fenced, painted, and cleaned up. 4. The reactivation of these seven wells shall comply with all provisions of the Huntington Beach Oil Code. Faas To permit the construction of a single-family dwelling pursuant to :-section 9384.16 of the Huntington Beach Ordinance Code, located on the east side of 18th Street approximately 125 feet south of Palm Avenue in the Townlot Specific Plan Area One, Section A. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. No one was present to represent the application. The application was reviewed by the Board. Bruce Crosby noted that the alley dimension shown on the plan is incorrect, and therefore the required turning radius is not provided. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-31 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A, TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. In accordance with the City's standards and requirements, an additional two and one-half feet (2-1/2') of right-of- way on the alley shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or sys- tems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assess- ment district. 7. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Eighteenth Street and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. If dedication has been accomplished on the offside of the alley at the rear of subject property, the plan as submitted on March 11 shall be the approved plan. If no dedication has been accomplished, the plan submitted to the Department of Building and Community Development at the time of applica- tion for building permits shall be revised to reflect the required twenty-seven (27) foot turning radius. Sterling Buck & Associates To permit the construction of a 240-unit apartment complex pursuant to Section 9162.3.1 of the Huntington Beach Ordinance Code, located at the southwest corner of Bolsa Chica Street and Heil Avenue in an R2, Medium Density Residential District. The Chairman informed the Board that Negative Declaration No. 76-16 has been granted for this request by the Environmental Review Board on March 23, 1976. The Chairman opened the public hearing. John Cowles and Will Buck were present at the meeting. Secretary Palin reported the receipt of a petition signed by eighty nearby residents in opposition to the project. The Board reviewed the plan and noted discrepancies in the dimensions of the property and the relation of the property to the ultimate right- of-way of Bolsa Chica Street; also, minor problems on the plan in regard to street sections, circulation, turning radii, setbacks, locations of garages, and pedestrian circulation were discussed. It was the con- sensus of the Board that this request should be continued to permit applicant to meet with staff to resolve the problems on the plan. The Chairman continued the public hearing. ON MOTION BY PALIN AND SECOND BY LIPPS, USE PERMIT NO. 76-14 WAS CON- TINUED, WITH THE CONCURRENCE OF THE APPLICANT, TO THE REGULAR MEETING OF APRIL 7, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE BZA 3-24-76 Page 6 Minutes, H.B. Board of Zoning Adjustments March 23, 1976 Page 7 CONDITIONAL EXCEPTION NO. 76-7 Applicant: Foxx Development Company To permit an eleven foot (11') reduction in the required 22-foot setback for front entry garage in lieu of Section 9166.5 of the Huntington Beach Ordinance Code, located at the northwest corner of Clay Avenue and Delaware Street in an R2, Medium Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Bob Jarrard was present to represent the application. Mr. Jarrard addressed the Board and presented his reasons for requesting the conditional exception, citing the uniqueness of the lot and stating that his only other alternative would result in loss of open space on the plan. There being no other persons to speak on the proposed project, the public hearing was closed. The Board reviewed the plan considering the size and configuration of the lot, the setback of the dwelling portions of the project from Delaware Street, and the open space and parking provisions. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-6 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The size and shape of the subject property makes it impossible to design a 22-foot straight -on approach to the garage. 2. The layout and design affords more usable open space area with physical separation from the street traffic. 3. The design also lends itself to an additional open parking space and/or an area for storage of recreational vehicles. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated March 4, 1976, shall be the approved layout, subject to the following modifications: a. The garage shall be equipped with an automatic door opener. C. A ten by ten foot corner cutoff shall be provided in the fence construction at the intersection of the _ driveway approach and the sidewalk to afford visibility down the sidewalk area. The above modifications shall be delineated upon the plan submitted to the Department of Building and Community Development at the time of application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The driveway approach shall be reduced down to no more than a twenty-six (26) foot approach, subject to approval by the City 8ngineer and the Department of Public Works. AYES: PALIN, CROSBY NOES: LIPPS ABSENT: NONE Mr. Lipps stated his reason for voting no was that the difficulty in developing a desirable project resulting from the configuration of the lot did not justify creating a problem in the driveway approach. CONDITIONAL EXCEPTION NO. 76-8 Applicant: Ruth Elaine Bauer To permit a twenty inch (20") encroachment into the required nine foot (9') minimum garage width in lieu of Section 9106 of the Hunting- ton Beach Ordinance Code, located on the south side of Church Circle approximately 200 feet east of Surfdale Drive in an R1 Low Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mrs. Bauer and Mr. Dusenberry, the purchaser of the subject property, were present at the meeting. Mr. Dusenberry discussed the encroachment, pointing out that he and the applicant have executed a good faith contract based upon her under- standing that all the requirements of the.City had been complied with. The Board reviewed the physical construction of the room, the purpose for which it is presently used and what its intended future use would be, and suggested modifications to reduce the encroachment. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-8 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The encroachment is for less than a depth of seven feet (7') from the rear of the garage, which will allow room for parking and exiting from a normal -sized vehicle. 2. The dwelling structure was originally constructed with a three - car garage, which is one more than required by the Ordinance Code. 3. This modification will not afford a special privilege, in that the applicant will still be provided with two fully enclosed, conveniently accessible parking spaces. CONDITIONS OF APPROVAL: 1. The encroachment shall be reduced by relocation of the wall, not to exceed three feet, three inches (3'3") in depth from a line delineated on the plan received and dated March 17, 1976, at four feet, ten inches (4110") from the rear of the garage facility. 2. The relocation of the wall and the modification of the facility shall conform to all applicable building and fire codes. To permit a model home complex, consisting of a sales office, four (4) model homes, temporary parking area, and landscaped areas for a previously approved single-family residential sub- division. Said request is made pursuant to Section 9730.18 of BZA 3-24-76 Page 9 Minutes, H.B. Board of Zoning Adjustments March 24, 1976 Page 10 the Huntington Beach Ordinance Code. Subject property is generally located atthe southeast corner of Talbert Avenue and Springdale Street in an R1, Low Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Jeff Holm was present to represent the application. The Board reviewed the plan submitted. Don Moore informed the appli- cant of the requirement for the water system to be installed before start of construction, improved to finished standards. ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINISTRATIVE REVIEW NO. 76-32 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan and elevations for 18-C, received and dated March 17, 1976, shall be the approved layout. 2. The applicant shall comply with all applicable provisions of Section 9730.18 of the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 75-12 (Revised Plans) Applicant: Leonard 0. Lindborg Revised plans to previously approved application to permit the con- struction of a duplex dwelling unit, pursuant to Section 9161.2 of the Huntington Beach Ordinance Code, located on the east side of 18th Street approximately 50 feet north of Pecan Avenue, in an R2, Medium Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Leonard Lindborg and Rex Hoover were present at the meeting. Secretary Palin explained that the reason for the revision was that the plans had previously been approved prior to enactment of the Specific Plan Area; it will no longer be necessary for the applicant to file a tentative parcel map, and the request is for a modifica- tion to that condition of approval. The applicant was informed that the requirement for a landscaping plan can'be satisfied by submittal of a conceptual plan covering all his applications on the 25-foot lots. Secretary Palin explained that the reason for the revision was that the plans had previously been approved prior to enactment of the Specific Plan Area; it will no longer be necessary for the applicant to file a tentative parcel map, and the request is for modification to that condition of approval. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Leonard Lindborg and Rex Hoover were present to represent the appli- cation. Secretary Patin explained that the reason for the revision was that the plans had previously been approved prior to enactment of the Specific Plan Area; it will no longer be necessary for the applicant to file a tentative parcel map, and the request is for modification to that condition of approval. It was also noted that this project is located on a corner lot, for which the Board has been requiring special treatment on the garage roofs. ON MOTION BY PALIN AND SECOND BY CROSBY, THE REVISED PLANS FOR ADMINISTRATIVE REVIEW NO. 75-125 WERE APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The revised plot plan received March 16, 1976, shall be the approved layout. 2. The condition listed on the original conditions of approval as General Condition No. 1 (requiring the filing of a tentative parcel map) shall be deleted. 3. A mansard -type or other aesthetically pleasing architectural treatment shall be provided for the roof of the garage located at the corner of Walnut Avenue and the alley. Secretary Palin explained that the reason for the revision was that the plans had previously been approved prior to enactment of the Specific Plan Area; it will no longer be necessary for the applicant to file a tentative parcel map, and the request is for modification to that condition of approval. Secretary Palin noted that the trellised areas and the extensive landscaping pro- posed had influenced the Planning Commission's approval of the tract. After discussion, it was the consensus of the Board that conceptual approval for the purpose of issuance of building permits only could be granted, with further revisions to take place on the landscaping before final approval. The Board reviewed the sign plan in relation to its location on the site, the landscaping.proposed, and the materials to be used in construction of the sign. ON MOTION BY PALIN AND SECOND BY LIPPS, SIGN REQUEST NO. 7199 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign plan received and dated March 23, 1976, shall be the approved plan, with the following exception: The base of the sign shall be constructed at ground level and shall be constructed with similar type material to that used on the structure of the medical facility, in order to eliminate a future maintenance problem beneath the sign and to provide a structure compatible with the building. 2.
