The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Dick Tom and Saul Sher were present to represent the application. The Board reviewed the proposal. Mr. Sher indicated that it has been determined that parking Scheme C, previously approved for the theater expansion project (AR 76-11 and CE 76-2) will not be im- plemented. Therefore, the subject project will be reviewed as it relates to existing conditions in the shopping center. Parking and restriping for the project were dicussed, in particular as relating to circulation at the drive -through facility and the proposed closure of one driveway. Required landscaping and possible sidewalks were also reviewed. ON MOTION BY PALIN'AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-19 WAS APPROVED WITH THE FOLLOWING CONDITIONS,'BY THE FOLLOWING VOTE: Minutes, H.B. Board of Zoning Adjustments March 31, 1976 Page 2 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received February 13, 1976, shall be the approved layout, subject to the following modifications: a. Plan shall reflect revised parking and landscaping in compliance with Article 979, to facilitate the six-foot (61) landscaping strip around the area as well as to show the design on the parking adjacent to the drive - through. b. Plan shall reflect the landscaping strip along Main and Delaware Streets, and restriping of the parking lot in compliance with Article 979. C. Plan shall reflect the parking immediately adjacent to the landscaping along the northerly portion of the new addition. The above revisions shall be contained in -the plan submitted to the Department of Building and Community Development at the time of application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment'and shall delineate the type of material proposed to screen said equipment. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, fire hydrants, standpipe systems, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. 6. All applicable fees shall be paid prior to issuance of build- ing permits. B. GENERAL CONDITION: 1. The existing driveways which are proposed to be deleted shall be reconstructed with new curbs, gutters, and sidewalks. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-6 Applicant: Anacal Engineering Company To permit the consolidation of eight (8) existing lots into one parcel pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, located on the southeast corner of Gothard Street and Talbert Avenue in an Ml-A, Restricted Manufacturing District. The Chairman informed the Board that this project is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The request was reviewed. Bruce Crosby reported that the vacation of the alley adjacent to this site is in process of completion. - ON MOTION BY PALIN AND SECOND BY LIPPS, TENTATIVE PARCEL MAP NO. 76-6 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 3-31-76 Page 3 Minutes, H.B. Board of Zoning Adjustments March 31, 1976 Page 4 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. 'The tentative parcel map received by the Planning Department on March 18, 1976, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. Such recordation shall not take place until the pending vacation of the alley has been completed and is in effect. . 3. Talbert Avenue;, Gothard Street, and Harriman Avenue shall be dedicated to City standards at the time said parcel is developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 6. All utilities shall be installed underground at the time said parcel is''developed. 7. Compliance with all applicable City'Ordinances. 8. The property shall participate in the local drainage assessment district at the time said•parcel'is developed. 9. Pasqualino To permit the establishment of a pinball arcade pursuant to Section 9451 of the Huntington Beach Ordinance Code, located on the west side of Main Street approximately 150 feet south of Olive Avenue in a C3, General Business District. Board of Zoning Adjustments March 31, 1976 Page 5 The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Richard Pasqualino was present at the meeting. Mr. and Mrs. Albert Boswell addressed the Board, questioning the type of use which would go into the building and whether or not those uses and the clientele of the project would have an undesirable effect on surrounding business establishments. Mr. Pasqualino responded, informing the Board that the use would consist of 15 pinball machines only, with no pool tables or other amusements which might be found in such an operation. Hours of operation will be from 10:00 a:m. to curfew, approximately 9:30 or 10:00 p.m. Michael Holtzman, tenant of the Boswells and operator of the Plant Boutique, addressed the Board, saying that he has no objections to the proposed use as long as it does not attract undesirable patrons or encourage loitering in the area. There being no other persons present to speak for or against the proposed project, the public hearing was closed. Board discussion ensued. Parking requirements of the Townlot Area were discussed, as well as hours of operation and the possible future ice cream sales on the premises. Mr. Pasqualino indicated such sales were not presently planned, but might be requested under another application. ON MOTION BY CROSBY AND SECOND BY PALIN, USE PERMIT NO. 76-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING -PERMITS: 1. The conceptual plot plan and elevations received March 19, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives;. . Parking layout; • Lot area; • Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection,and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices,shall be submitt to the,' Fire'Department and"shall be subject to approval by the Departments of Fire and Public Works. 3. All applicable fees shall be paid prior to issuance of building permits. B. GENERAL CONDITIONS: 1. There shall be two (2) parking spaces provided at the rear of the building,'and the proposed bicycle rack at that location shall be located in such a manner that it will not interfere with the opening of doors of automobiles using said parking spaces. 2. Closing hour shall be 9:30 p.m. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE. ADMINISTRATIVE REVIEW NO. 76-30 Applicant: Richard A. Harp & James R. Morton To permit the construction of a duplex building pursuant to Section 9231 of the Huntington Beach Ordinance Code, located on the east side of 19th Street approximately 100 feet south of Olive Avenue is an R4, Higli Density Residential District. Board of Zoning Adjustments March 31, 1976 Page 7 The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Richard Harp was present at the meeting. Secretary Palin reviewed the status of the pending appeal on this previously denied application, and discussed with the appli- cant alternatives to the proposed plan in regard to the two doors on the garage and the location of the outside stairway access. Mr. Harp concurred with the modifications proposed by Mr. Palin. ON MOTION BY PALIN AND SECOND BY LIPPS, THE ORIGINAL MOTION TO DENY ADMINISTRATIVE REVIEW NO. 76-30 WAS WITHDRAWN, BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-30 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received March 15, 1976, shall be the approved layout, subject to the modifi- cations described herein: a. The two -car garage shall be equipped with a single door only. b. The second access point to the second floor within the rear portion of the dwelling shall be relocated to facilitate exiting to the open space area directly ad- jacent to the kitchen and dining room area. Said modifications shall be delineated upon the plan sub- mitted to the Department of Building and Community Develop- ment at the time of application for building permits and shall be subject to approval by that Department. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . The following plan shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department'of Public Works. 3. In accordance with the City's standards and requirements, an additional two and one-half feet'(2-1/2') of right-of- way on the alley shall be dedicated. 4. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm sys- tems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. All applicable fees shall be paid prior to issuance of building permits. B. TO BE'COMPLETED PRIOR TO FINAL INSPECTION: 1. Nineteenth Street and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements: C. GENERAL CONDITION: 1. A Tentative'Parcel Map shall be filed and recorded to elimin- ate the lot line between Lots 18 and 20. BZA 3-31-76 Page 8 Minutes, H.B. The Board reviewed the request, noting that the applicant has requested use of the banners for a 30-day period. ON MOTION BY PALIN AND SECOND BY LIPPS, THE ABOVE SIGN REQUEST WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The sign request reviewed March 31, 1976, shall be the approved layout. 2. The applicant shall comply with all requirements of Article 976 of the Huntington Beach Ordinance Code.
