Conditional Use Permit No. 75-09 is a request to relocate an
existing commercial horse stable located approximately 900 ft.
south of Ellis and 180 ft. west of Gothard Street.
Conditional Exception No. 75-27 was filed to request reduction
in setbacks.
John Cope addressed the Commission and stated that the applicant
had proposed a new location which would 'liminate the need for
filing the Conditional Exception, and hA requested that this
application be withdrawn.
There was a discussion on access to the site via Gothard Street.
A vugraph was shown.
The Chairman opened the public hearing.
Mr. Bill Williams, the applicant, addressed the Commission and
stated that he was agreeable to the proposed conditions of
approval. He further stated that he would be relocating his temporary
facility within a 6 month period.

ment standards of Article 939 "Temporary Commercial Horse Standards."
2. The- proposed use is compatible with existing land uses of the area.,
CONDITIONS OF APPROVAL:
1. -The site plan dated March 29, 1976 shall be the approved layout as
amended, which requires that the access to the site be via Gothard
Street, the location of which shall be subject^to the'LDepartment
of Public Works' approval.
2. The maximum horse•density shall'not exceed 256 horses.
3. A detailed and comprehensive grading plan shall be submitted to
the Director of Building and Community Development for review
and approval prior to the issuance of building -permits.
4. Dedication for street purposes on the subject parcel shall be
subject to.local ordinance.
5. The lounge and/or office areas shall not be used for residential
purposes.
6. No structures other than those shown on the approved plot plan
shall be constructed.
7. No building or portion of a building shall be constructed more
than 150 ft. from a roadway which is surfaced to support fire
apparatus.
8. Fire protection systems shall comply with the plans and specifi-
cations on file with the Fire Department.
9. The developer shall participate in the local drainage assess-
' ment district as required by local ordinance.
10. A landscape plan and method of irrigation shall be submitted
to the Director of Building and Community Development for approval
prior to the issuance of building permits.
11. An annual review of the use shall be conducted on the anniversary
approval date of the conditional use permit.

APPLICANT: Fox Meadow, Inc.
Conditional Use Permit No. 76-3 is a request for the establishment
of a temporary commercial horse stable located on the south side
of Ellis, approximately 1000 ft. west of Goldenwest Street.
John Cope presented an aerial slide of the property and discussed
the proposed conditions of approval.
The Chairman opened the public hearing.
A representative of Fox Meadow, Inc., was present and stated that
she had read the conditions of approval which were proposed and
felt they could comply with them.
The public hearing was closed.
Commission discussion ensued.

NO. 76-3 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE
FOLLOWING VOTE:
FINDINGS:

This is a request for a change of zone from C4 to R2.. The
subject property is located on the east side of Beach Boulevard
extending approximately 575 ft. to the east, between Constantine
Lane and Garfield Avenue. The property is presently vacant with
property to the south zoned C4 and M1 developed with commercial
uses, older non -conforming residential uses, and the Edison
Maintenance Yard. To the west are C4 properties developed
with commercial uses. To the north are properties zoned C4 and R2
developed with commercial and multi -family residential units.
Property to the east is zoned R3 and developed with multi -family
residential units.
The public hearing was opened. One man spoke in opposition to
the proposed zone change. The public hearing was then closed.
Chairman Slates gave a brief history of this property, stating
that it was previously designated as Highway 39 and later
deleted.

FINDINGS: —
The Planning Commission of the City of Huntington Beach does hereby
find that the proposed subdivision, along with its design and .
improvements, is consistent with general and specific plans for
the area in that:
1. The proposed subdivision of this 10+ acre parcel of land
zoned R1 (which allows 7 units per gross acre) is proposed
to be constructed having only 5 units per gross acre.
2. The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for implementation
for this type of housing.
3. The property was previously studied for this intensity of land
use at the time the land use designation for low density
residential was placed on said property.
4. The lot size, depth, frontage, street widths, and all other
design and improvements features of the proposed subdivision

13. A landscape planter shall be provided along Heil Avenue. Such
planter shall conform to the plans and specifications on file
in the Department of Public Works and the requirements of the
Planning Commission. It is the developer's responsibility to
landscape such planter and to provide irrigation facilities in
conformance with the Department of Public Works specifications
and requirements.
14. 20 inch box trees shall be planted along the easterly parkway
area of "A" Street at 45 ft. on center. Selection of the species
of such trees shall meet and exceed Department of Public Works
horticultural standards.
15. In order to increase visual amenities within the subdivision, a
landscaping plan for the parkway portion of "A" Street shall be
submitted to the Planning Department for approval. The plans
shall meet horticultural standards of the Department of Public
Works.
16. A decorative masonry wall shall be constructed along the easterly
boundary of the subdivision. Said wall shall be six inches wide
and six feet high. The height of said wall shall be measured
from whichever side is higher at finished grade. The architectural
design and material used in said wall shall be the same as the
wall constructed along Heil Avenue. Said wall shall be included
on the street improvement plans.
17. Fire alarm system, conduit, and appurtenances shall be installed
by the developer at locations and to specifications provided by
the Fire Department.
18. Exterior elevations of the structure to be constructed on Lot No. 1
shall be subject to approval by the Planning Department.
19. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If no air conditioning is to

It was noted that the Board of Zoning Adjustments had reconsidered
and approved Administrative Review No. 76-30. In view of this
the Staff recommended that the Commission withdraw the Appeal.

John Cope stated that the City Council at its meeting of April 5,
1976 did authorize the City to sell the above property and requested
that the Planning Commission determine if it is in conformance
with the General Plan.
ON MOTION BY PARKINSON AND SECOND BY KERINS THE PLANNING COMMISSION
FOUND THE PROPOSED SALE OF THE SURPLUS PROPERTY'LOCATED ON THE SOUTH
SIDE OF EDINGER STREET WEST OF GOTHARD TO BE CONSISTENT WITH THE
CITY'S LAND USE DESIGNATION OF COMMERCIAL IN THE GENERAL PLAN BY
THE FOLLOWING VOTE:

Chairman Slates stated that he had been advised by the City Attorney
to abstain on voting since he had been involved in the sale of
the property. Chairman Slates stated that he had not received a
commission on this sale.
PURCHASE OF DOWNTOWN PROPERTY
The Staff indicated that the City Council at its meeting of
April 5, 1976 reaffirmed its intent to acquire downtown properties
for public parking purposes. Staff and Commission discussion
ensued with Commission requesting Staff to provide additional
information pertaining to precise location of property. Staff
agreed to have this information available at the meeting of
April 20, 1976.
