Carter .,This is a request to permit the construction of a 193 unit.apartment complex on a 7.769 acre parcel of land located on the south side of the San Diego Freeway at the east end of San Angelo Drive, on the southeast side of Edinger Avenue and Beach Boulevard. Jim Palin distributed copies of the traffic report which had been furnished by the applicant. He also referred to the revised plans which had been submitted. An architectural rendering was also on display. He noted that'a petition is on file which has been signed by residents protesting the development. Commission discussion ensued. The public hearing was opened. James"Carter, applicant, -addressed the Commission and discussed the traffic report which indicated less traffic count than a previous report. Mr.-Dottridge, a Westminster resident, was concerned about fire .hazard that the lack of access would createin this area.' - Commissioner Boyle arrived at 7:15 p.m. 0 Minutes: H.B. Georgia Eliopardos•, a Westminster resident, requested information' on access to the project. A resident of Huntington,Villa Apartments opposed the high density and.felt that the traffic report was invalid since it was taken on a - weekend with many tenants out of town. The public hearing was closed. The Planning Commission expressed a desire to further evaluate the traffic report that had been submitted'on the project. ON MOTION BY ]?ARKINSON AND SECOND BY BAZIL USE PERMIT NO. 76-12 WAS CONTINUED TO MAY 4, 1976 AT 7:00 P.M. BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None ZONE CASE NO. 76-5 Applicant: Kae A. Ewing and B.G. Williams This is a request for a change of zone from R2-PD-10 to R-2 located on the east side of Delaware, approximately 460 feet south of Adams. I'" I. John Cope addressed the -Commission and gave some background, information on this•request. A vugraph was presented. He noted that the existing suffix zoning had been requested by the present property owner in Order to allow the continuation of the Planned Residential Development that exists to the south. This existing condominium development was ap- proved by the Planning Commission in October," 19-74. At the time of its'-apprbval, the Commission expressed its desire to maintain the uniformity of the planned development concept throughout the general area between Adams Avenue and Memphis Street and Delaware Avenue and Beach Boulevard. B.'G,. Williams, applicant and purchaser of the property, discussed the proposed project. He did not feel it was economically feasible to develop it as a planned development due to the size of the parcel. Mike Jagger, developer of the property to the south and east, spoke in opposition to the request for a change from the PD-10 suffix. The President of Hampton Oil Company addressed the Commission and spoke in -favor of the zone change since the applicant's plans called for an'alleyway as a buffer zone between the oil operation and.the units. -2- 4/20/76 - PC ' . �'= 1 Minutes: H.B. Planning Commission Tuesday,•April 20, 1976 Page 3 ,,Fred Emery, of La Cuesta Racquet Club, recommended that the. Planning Commission deny this request. He stated that he did not feel that apartment dwellers normally showed the pride of ownership that property owners would show. Dale Smith, of La Cuesta Racquet Club, stated that he had not received a notice that the property was up for rezoning. Chair- man Slates explained that the Assessor's Parcel books are updated annually only and are not always up to date. He stated that he had been assured when he bought in the La Cuesta development that the property in back would be developed as a planned development also. Anthony J. Decero, property owner at La Cuesta Racquet Club, stated that he was very much opposed to apartments. Grace Fick, a -resident of the Racquet Club, was opposed to apart- ment development. Ross Ivy, La Cuesta Racquet Club, objected to multi -unit dwellings, citing the reason that the property adjoining apartment units tended to decrease in value. The public hearing was closed. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY KERINS ZONE CASE NO. 76-5 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The request is inconsistent with the development concept previously approved by the Planning Commissiop. 2. The request is inconsistent with stated policies of the General Plan relating to encouragement of planned residential develop- ments on larger unsubdivided land. 3!. The request will not provide for the best use of the property as it relates to existing residential development to the south. 4.• The planned•development suffix will provide the necessary development reviews in order to insure the proper design and layout of the site as it relates to the oil operations to:the north. Tuesday, April 20,.1976 Page 4 ZONE CASE NO. 76-7 Applicant: Martin F. Kordick Zone Case No. 76-07 is a request to rezone an existing industrial storage yard use from RA-0 to Ml�(Light Industrial). The subject parcel is fully improved and utilized in conjunction with the three industrially zoned and used parcels to the south.- I - An aerial slide of this property was shown. John Cope briefly dis- cussed this request for a zone change with the Planning Commission. The public- hearing was opened. i Martin Kordick; applicant, addressed the Commission. He stated that he would have difficulty in disposing of the property if the zoning was not�in conformance with the use. The public hearing was closed. Commission discussion ensued. ON MOTION BY PARKINSON°AND SECOND BY BOYLE ZONE CHANGE NO. 76-7 WAS APPROVED FOR THE FOLLOWING REASONS AND BY THE FOLLOWING VOTE: 1. An M1 zoning designation will reflect and legitimize the existing land use. 2. ''The present General Plan designation of Planning Reserve permits industrial development and thus the requested change of zone is in conformance with the General Plan. John Cope stated that the applicant/property owner has requested this change in zone in order to be consistent with the medium density residential land use designation. He stated that the staff ! would like to continue to May 4, 1976 to allow time for advertising. of the strip of Caltrans property directly east of the subject site. The public hearing;was opened. None- ABSENT: None CONDITIONAL USE PERMIT NO. 74-22 Applicant: Four Seasons Farms This is a request for approval of revised plans for a previously approved temporary commercial horse stable located on Ellis Avenue, 630 feet west of Goldenwest Street on the south side of Ellis. John Cope addressed the Commission and stated that the Planning Commission at its meeting of March 16, 1976 conditionally approved the above referenced commercial horse stable. Subsequent to that approval, the applicant has presented a revised plan to the staff. These revisions include a reorientation of a majority of the horse stalls and the manner in which they are covered. As a result of this consolidation of the stalls,'the smaller riding. arena has been oriented in an east/west position versus the north/south as originally approved. He further stated that the Fire Department and other appropriate staff have reviewed the revised plan and have indicated that no development deficiencies exist. The public hearing was opened. John Cope stated that there was on file a telegram from Rudolph Zepeda which expressed.opposition to the proposal. There was no one present to speak on this application. The public hearing was closed. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY BAZIL REVISED PLANS FOR CONDITIONAL USE PERMIT NO: 74-22 WERE APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:•, FINDINGS: 1. The proposed plani-is in substantial conformance with the develop- ment standards of Article 939 "Temporary Commercial Horse Standards". 2. The proposed use is compatible with existing land uses of the area. 3. The proposed use is consistent with and carries out the objectives of'stated City Policy relating to the encouragement of active private recreational uses within close proximity to Huntington Central Park. -5- _ 4/20/76 - PC Minutes: H.B. A detailed and -comprehensive grading plan shall be submitted to..the Director of Building and Community Development for review and -approval prior to the issuance of building permits. ' 3. Ellis Avenue shall be dedicated for street purposes as required- a by- the- local, ordinances. 4. The lounge and office areas shall not be used for residential purposes. S. No structures other than those shown on the approved plot plan shall be constructed. 6. No building or portion of -a building shall be constructed more than 150 ft. from a'roadway which is surfaced to support fire apparatus. • 7. Fire protection systems shall comply with the plans and speci- fications on file with the:Fire Department. 8. The developer'shall'participate in the local drainage assess- ment district as required by local ordinance. 9. A landscape.plan and"method of irrigation shall be submitted to the Director of Building and Community Development for approval prior to the issuance of building permits. t 10. An annual review of the use shall be conducted on the anniversary approval date of the conditional use permit. This map was originally before the Planning Commission for approval in 1973 and subsequently reapproved through the Ifiling of a new conditional use permit appli- cation mid year 1975 because of the delays experienced before the Coastal Commission in not commencing construction within the one year period as stipulated for approval of the conditional use permit appli- cation. -6- 4/20/76 - PC Minute: H.B. Planning Commission Tuesday, April 20, 1976 Page 7 This revised map has been submitted to obtain reapproval of the advisory agency in compliance with the actions and requirements imposed by the South Coast Regional Commission in approval action on this proposal. Bill Duncan, representing the applicant, addressed the Commission and stated that he had reviewed the Staff Report and was in agreement with the suggested conditions of approval. ; Commission discussion ensued. ON.MOTION BY PARKINSON AND SECOND BY SHEA TENTATIVE TRACT NO. 5483 (REVISED) WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: 1. The Site Plan dated April 16, 1976 shall be the approved tract map as amended by the following conditions. 2. The project shall be subject to the Park and Recreation fees in effect at the time of approval. 3. All required improvements shall be constructed under the inspection of and to the approval of the City Engineer. Cost for the'in- spection shall be paid by the Subdivider. 3-1/2 percent of the amount of the improvement bond shall be deposited with the City Engineer for inspection costs. 4. a. Residences which are air conditioned or which are to be _ advertised as prepared for air conditioning will comply with local, state, or federal (FHA) thermal insulation requirements (i.e., the minimum R values of the insulation in the ceilings and exterior walls are R-19 and R-11, respectively). _ b. Residential structures not air conditioned shall have in- sulation with a minimum rating of R-13 in the ceilings and R-7 in exterior walls. 5. If a lagoon Iis incorporated as a part of this project, the �1 water returned from the lagoon to the new channel shall be 1i constructed to the requirements of the Department of Public Works and Department of Harbors and Beaches. 6. In addition to the requirements imposed by the California Water Quality Control Board, the developer shall be responsible for management and maintenance of the lagoon for a period of five years, -or until the City is satisfied that the water purification system is satisfactory for swimming and other water contact sports and that the Homeowner's Association is capable of maintaining such system. -7- 4 /20 /76 - ':3r' Minutes: H.B. The water quality monitoring station shall be.located,-at the bridge to be constructed on Trinidad (crossing the new channel to be constructed along the southerly border of Maps 7,850 and 5483) or at;;the intersection of the existing channel with the new channel constructed along the southerly boundary of Map 7850. 8. The developer;shall!comply,with all orders that may be issued by the Regional Water Quality Control Board. Algae blooms, if any; =shall not be , controlled by ,the use of , algicj des. They shall be� removed :by raking or; other mechanical- method. , 9., Natural gas shall be provided at the locations of clothes dryers,iwater heaters,'cooking_units.,,•and.central heating units to eliminate the, possible burden ;on .any one ,energy, source.•; 10: The dwellings, shall be ;set 'back a ,minimum of. 50 feet; from, the travel lane of,Edinger to mitigate the possible noise impact upon the, living, quarters ,of ithe .units. 11. fihe developer shall install -individual pumpout,facilities: for each,boat,slip.,and,dock within Tentative Tract 5483... 12. Steam,cleaning,and washing of.conztruction equipment shall be restricted to a location on site which is properly equipped to control land and.water pollution. Such site as well as the equipment maintenance areas shall be inspected'by the City to assure proper -disposal of.maintenance and cleaning , waste. All wastes from these cleaning.and maintenance operations shall be periodically removed and deposited at a landfill site designated -to receive-;such.wastes. e - 13. The grading of the lots shall be such as to minimize all possible storm runoff•into the channel and lagoon. To alleviate possible erosion of the sandy beach, a rain trough shall be designed and constructed at locations of the lagoon, where sand beaches are proposed so as to -catch all runoff. Also, catch basins shall be constructed to eliminate the possibility of solids entering into the channels. 14. Buil'ding spoils, such as unusable lumber, wire, pipe, and other surplus or,unusable.material shall be dumped at -an off -site facility equipped to handle them. 15. Sewers shall be -privately owned and maintained. No sewer manifolds or laterals shall be installed under any unit. 17.' The developer shall enter into a maintenance agreement with the City agreeing to maintain the parkway area on Edinger Avenue. Such agreement shall be finalized prior to use and ' occupancy of any building. 18. The channel shown as lot C on the tentative map shall be extended to its intersection with the main State channel and constructed in conjunction with Tract 5483. Construction of the channel is subject to the requirements or limitations of the appropriate jurisdiction agencies. 19. Plan and profile drawings are required on all private streets and are to be shown on Department of Public Works standard size linens. 20. Final fencing plan along Edinger shall be approved by the Planning and Public Works Departments prior to building permits being issued. 21. The developer is hereby put on constructive notice that an additional public beach is required within the remaining acreage of vacant land. The developer is encouraged to meet with the Planning, Public Works, Building and Community Develop= ment, and Harbors and Beaches Departments so:that an overall plan for this needed facility can be developed. No additional development in this area will be considered until this matter is resolved. 22. All landscaping plans shall be approved by the Planning Depart- ment prior to issuance of building permits. 23. Access rights along Edinger Avenue, except at the intersection of Trinidad Lane and -at driveway locations as shown on the approved plot plan shall be dedicated to City of Huntington Beach. 24. The water and fire hydrant system shall be approved by the Department'of Public Works and Fire Department. 25. All streets shall conform to City of Huntington Beach Standards. 26. Street trees shall be provided to City standards with 15 gallon trees on Trinidad Lane and 20 inch box trees on Edinger Avenue. The type and placement of such trees shall be approved by the Department of Public Works and Planning Department. (On -site trees shall conform -to the requirements of the Subdivision Ordinance.) 27. Landscaped planters shall be provided along Edinger Avenue. Such planters shall conform to the plans and specifications on file in the Department of Public Works. Planning Commission Tuesday, April 20, 1976 Page 10 provide irrigation"facilities in accordance with the Department of Public Works' specifications and requirements. 28. Street lighting shall be provided to City standards. 29. ,Sub -surface water. rights shall be deeded to'the City of ,,Huntington -Beach,., 30. Drainage of the subdivision shall be approved by the Depart- ment of Public Works prior to final recordation of any part of the'approved tentative subdivision. 31. Said property shall participate in the'local drainage assess- ment district. 32. All buildings on'lots abutting a City easement shall be set back 5 feet from the edge of such easement. 33. Retaining walls may be required by the Building Department where there is a difference in elevation of one (1) foot between adjoining lots or lots abutting City right-of-way. Determination of this requirement shall be made at the time grading plans are approved. 34..Preliminary and final soil reports shall be submitted by an.approved private soils engineer to Department of Public Works prior to issuance of building permits. s 35. Fire alarm system conduit and appurtenances shall be installed by.,the developer at locations and to specifications provided by the Fire Department..— 36. The existing elevations of all -buildings -constructed on lots that side -on or,back-on Edinger Avenue shall be subject to approval by thePlanningDepartment prior to issuance of building permits.' 37. All utilities shall be installed.underground. 38. Pedestrian walkway system on the south side of the southerly drive shall be included on'the landscaping plans to be sub- mitted to the Board of Zoning Adjustments for review and approval action. Planning Commission Tuesday, April 20, 1976 Page 11 TENTATIVE TRACT MAP 8636 (REVISED) Applicant: Harbour Pacific Ltd. This is a request for a single family subdivision located 1,100 feet south of Edinger Avenue. This request was originally for a 349 lot R1 subdivision and was before the Planning Commission on August 20, 1975. Subsequently, the map was submitted to the Coastal Commission for review and acted upon with revisions taking place to the westerly half of the island. Therefore, the developer has resubmitted the plan' -to the Planning Commission for reapproval. Bill Duncan addressed -the Commission and discussed the Coastal Com- mission."s direction that parking offsets be included in the plan. He felt that this condition should not be imposed. Commission discussion ensued. ON MOTION BY SLATES AND SECOND BY SHEA TENTATIVE MAP 8636 REVISED WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: FINDINGS: — 1. The proposed subdivision of this 88.3 acre parcel of land zoned R-1 (which allows 7 units per gross acre) is proposed to be constructed having,approximately 4 units per gross acre. 2.. The,General Plan has set forth provisions for this type of land use,as.well as setting forth objectives for implementation for single-family, detached housing. 3. The property was previously studied for this,intensity of land use'at,the time the -land use designation,for low density residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standard plans and specifications,on file with the City, as well as in compliance with the State. Map Act and supplementary City Sub- division Ordinance. 5. The proposed commercial development across Long Channel will provide for view points that would otherwise not have been provided in this area-. - CONDITIONS OF APPROVAL: 1. Tentative'Tract Map'8636 received and dated April 13, 1976 shall be the approved layout., . 2. The water system shall be through the City of Huntington Beach's wat system. 4. The sewage disposal shall be through the City of Huntington Beach's sewage system. S. Each single residential lot abutting upon water shall be pro- vided with plumbing facilities stubbing out through the bulk- head of -'each lot. All other water front lots having community dock and slip areas shall have sewage and pumping facilities sufficient to accommodate the affluent from these areas subject to the Department of Public Works approval. 6. The property shall be subject to the local drainage assessment district requirements and fees. r 7.- All required improvements shall be constructed under the inspection of and to the approval of the City Engineer. The cost of the inspection shall be paid by the subdivider. 3-1/2 percent of the amount of the improvement bond shall be deposited with the City Engineer for inspection costs. 8. All utilities shall be installed underground. 9. Drainage for the subdivision shall be approved by the Depart- ment of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after,.construction of the pro- posed project. 10. If the developer proposes to provide air conditioning, the in- sulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided., the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 11. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 12. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 13. The'structures on subject property, whether attached or de- tached, shall be constructed in compliance with the State acoustical, standards set forth for all units that lie within the 60 CNEL contours,for the project property. 14. An engineering geologist shall be engaged to submit a report w; indicating the ground surface acceleration from earth move- ment for the project property. -12- 4/20/76 -'PC M Minutes: H.B. All structures proposed for construction within this sub- division shall be constructed in compliance with the g-factors as indicated by the geologist's report. 16. Calculations for footings and structural members to withstand anticipated g-factors shall be submitted to the City for review. 17. A chemical analysis, as well as tests for physical properties of the soil on subject property shall be submitted to the City for review prior to the issuance of building permits. 18. The Homeowners Association shall be formed for maintenance of the parksite,lot 341,as shown upon the Tentative Map received and dated April 13, 1976. Subject property is located on the north side of Yorktown Avenue between England and Florida Streets. Chairman Slates requested that it be made a matter of record that while Jim Foxx was a tenant of his he would not abstain from voting on this application. The conditions of approval were discussed. Bob Jarrard, Foxx Development Co., addressed the Commission and discussed the proposed block wall. Commission discussion ensued. The proposed subdivision of this 2.5+ acre parcel of land zoned R2 and R3 (which allows 24.89 units per gross acre): is proposed to be constructed having only 22 units per gross acre. 2. The General Plan has set forth provisions for this type of land use 'as well as' ,setting forth .obje°ctives for implementation for this type of housing. 3. The property was previously studied for this intensity of land use at the time the land use designation for medium density residential was placed on said property. 4_. The'lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be'constructed in compliance with standard plans and specifications on file with the City, as well as in compliance with the State Map Act and supplementary City Subdivision Ordinance. Plan on fencing and landscaping shall be submitted to the Board of Zoning Adjustments for approval action for right-of-way area along Yorktown Avenue. 12. A masonry wall shall be constructed along the northerly property line of lot 5. Said wall shall be six feet high and shall be measured from whichever side is higher at finished grade and match existing wall on the north side of lot 4. 13. Fire safety systems shall be installed by the developer as required by the Fire Department. 14. The exterior elevations of all two story structures which side onto or back onto Yorktown Avenue shall be subject to approval by the Planning Department. 15. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 16. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 17. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the location of surface units of cooking facilities and at water heaters and central heating units. 18. The structures on subject property, whether attached or de- tached, shall be constructed in compliance with the State acoustical standards set forth for.all units that lie within the 60 CNEL contours of the property.
