Secretary Palin reported that a request has been received for the continuance of this item. ON MOTION BY PALIN AND SECOND BY LIPPS; USE PERMIT NO. 76-14 WAS TABLED AT THE REQUEST OF THE APPLICANT TO PERMIT REVISED PLANS TO BE SUBMITTED IN COMPLIANCE WITH ARTICLE 932, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-36 Applicant: The 8uccola Company To permit the construction of a 90,000 square foot shopping center pursuant to Section 9430,.2 of the Huntington Beach Ordinance Code, located at the southwest corner of Garfield Avenue and Beach Boulevard ina C2, Community Business District. The Chairman informed the Board that Negative Declaration No. 76-24 has been granted this request by the Environmental Review Board on April 20, 1976. Minutes, H.B. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-36 WAS CONTINUED TO THE MEETING OF MAY 26, 1976, BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-17 Applicant: Huntington Beach Industrial Park To permit an approximate 12-foot reduction in the required land- scaping of a side yard setback in lieu of Section 9513.1 of the Huntington Beach Ordinance Code, located at the northwest corner of Graham Street and Commercial Drive in an M1-A, Restricted Manufacturing District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Dave Ariss was present to represent the applicant and addressed the Board, explaining that land -to -building ratio on this particular lot and the difficulty of building placement because of the restriction of no access from Graham Street were the reasons for the reduced setback request. There being no other persons present to speak on the proposed pro- ject, the public hearing was closed. Board discussion ensued, and it was noted that the adjoining build- ing also had restraints in location because of an existing storm drain down the entire westerly edge of the property. It was also noted that the Planning Commission has approved reinsertion of the provisions for reduced landscaping where a building is not constructed at setback. ON MOTION BY PALIN AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 76-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. Granting of this conditional exception does not constitute a privilege but only grants a use consistent with other parcels in the area. 2. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-44 (Reconsideration) Applicant: Huntington Beach Industrial Park To consider a revised plot plan for a previously approved permit for two single -story, tilt -up industrial buildings pursuant to Section 9511 of the Huntington Beach Ordinance Code, located at the northwest corner of McFadden Avenue and Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. This project is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Dave Ariss was present at the meeting. Mr. Ariss explained that the change in setback as approved in Conditional Exception No. 76-17 has required revision in the plot plan to reflect said change. ON MOTION BY PALIN AND SECOND BY LIPPS, THE REVISED PLOT PLAN FOR ADMINISTRATIVE REVIEW NO. 76-44 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: BZA 4-28-76 Page 3 Minutes, H.B. Jones To permit the construction of an 18,000 square foot commercial shopping center pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the west side of Beach Boulevard approximately 250 feet north of Warner Avenue in a C4, Highway Commercial District. The Chairman informed the Board that Negative Declaration No. 76-29 was approved for this project by the Environmental Review Board on April 27, 1976. The Chairman opened the public hearing. George McCracken and Donald Jones were present at the meeting. The applicant addressed the Board explaining reasons for layout of the project. There being no other persons present to speak for or against the proposed project, the public hearing was closed. The ensuing Board discussion considered possible redesigning of drives to eliminate single -stacking of parking, ownership of adjacent property, and existence of easements on the subject site. Bruce Crosby advised the applicants of -the new driveway standards which will be imposed upon their project. Tho granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 7, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. .b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm sys- tems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. 6. The developer shall participate in the Orange County Sani- tation District No. 3 Sewer Annex District. 7. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Beach Boulevard shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The driveway treatment for this project shall be to the approval of the City Traffic Engineer. 2. If the developer proposes to provide air conditioninq, the insulation in ceilings and exterior walls shall be a minimum Of R-19 and R-11 respectively. If no air condi- tioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, re- spectively. 3. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. i BZA 4-28-76 Page 6 Minutes, H.B. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 5. Use of energy -saving lighting, such as high-pressure sodium vapor lamps, should be considered in parking lots and recreation areas. AYES: PALIN, CROSBY. LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-20 (In Conjunction w/CE 76-15 Applicant: McCulloch Architects To permit the remodeling of an existing structure and establishment of a restaurant pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway in a C4, Highway Commercial District. The Chairman informed the Baord that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Bill McCulloch and Bob Lannon were present to represent the application. The applicants indicated to the Board that they are negotiating to purchase the property to the south of subject property to provide additional parking for the use. There being no other persons to speak in re- gard to this project, the public hearing was closed. Bruce Crosby reported that the dimensions on the assessor's map and the submitted plot plan show a difference of five feet, due to conflicting surveys on the centerline of Pacific Coast Highway, and that research will be required to determine correct centerline. He also noted that there exists a five-foot sidewalk easement on the property. The Board discussed whether or not this would affect the layout and parking for the project. Applicants were given a copy of a 1963 survey map, and in turn submitted to the Board a copy of their title report with the legal description upon which they had based their plot plan. Staff will complete research to establish centerline. Further discussion by the Board included landscaping, parking yield, and turning radius. ON MOTION BY CROSBY AND SECOND BY LIPPS, USE PERMIT NO. 76-20 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 4-28-76 Page 7 Minutes, H.B. The plan shall incorporate the proper property dimen- sions to the centerline of Pacific Coast Highway, and the proper location and dimension of sidewalks and setback areas. A plan delineating said modifications shall be submitted to the Board of Zoning Adjustments for review and approval action. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area; . Should at any future date this valet parking be terminated, the compact parking spaces shall be replaced with a like number of spaces of standard size and dimension with the required turning radius, to be provided upon the subject property or upon property immediately adjacent - thereto in compliance with the requirements for on -site parking contained in Article 979 of the Huntington Beach Ordinance Code. Board of Zoning Adjustments April 28, 1976 Page 10 AYES: PALIN, CROSBY, LIPPS NOES: -NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-15 (In Conjunction w/UP 76-20) Applicant: Mc Culloch Architects To permit a reduction in required parking space size for 25 percent of the -parking. Required is 9' x 19' per Section 9791(d); provided -- 716" x 151. Property is located on the north side of Pacific Coast High- way approximately 1200 feet west of Anderson Street in a C4, High- way Commercial District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Bill McCulloch and Bob Lannon were present at the meeting. The applicants addressed the Board, citing the configuration and size of the parcel as justifi- cation for the request for the exception. They also explained their intention to use valet parking for the project. There being no other persons to speak for or against the proposed project, the public hearing was closed. The Board reviewed the proposal in light of the Planning Commission's recently expressed policy of not allowing reduced parking for com- mercial establishments. It was noted, however, that such policy had not taken use of valet parking into consideration. The Board also considered the size and configuration of the parcel, the location of the proposed reduced spaces in the front of the use (where they would be most likely to be used by standard -size automobiles), and any possible effects failure of the proponents to obtain the adjacent property to the south would have on this project. ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-15 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The,size and shape of the subject property make it impossible to provide standard size automobile parking spaces on both sides of the driveways because of the extreme narrow depth and triangular shape of the property. 2. Requirement to provide standard parking spaces only would reduce the -number of parking spaces far below that which is required; by,utilizing 18 compact parking spaces on the site, the applicant is able to comply with parking requirements of the.Ordinance Code. The landscaping provisions within the parking area far exceed the minimum requirement of 6 percent and is considered by the City as an acceptable trade-off to blacktopped area for the use of compact parking. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. Oil and Gas Company To permit modification of an existing natural gas processing fac- ility pursuant to Section 9552(N) of the Huntington Beach Ordinance Code, located on the south side of Garfield Avenue, approximately 2500 feet west of Edwards Street in an M2-0, Industrial District combined with Oil. The Chairman informed the Board that Negative Declaration 76-28 was granted to this request by the Environmental Review Board on - April,20, 1976. The Chairman opened the public hearing. Bill Woods and John Iskin were present to represent the application. The applicants explained the proposed modernization of the existing plant; installation of the new stratified unit will occur within City limits - removal of structures will occur in County territory. The Board reviewed types of equipment to be used and the noise levels from the operation. Fire access was also discussed, and the appli- cants stated there is access both from the north and south with another direct access through the lease from Pacific Coast Highway. Maguire To permit establishment of a commercial/retail center of approxi- mately 55,000 square feet on property that is zoned C4 (Highway Commercial) located north of Pacific Coast Highway, approximately 1100 feet west of Admiralty Drive. The Chairman informed the Board that this use is covered by Envir- onmental Impact Report No. 75-1 (Huntington Harbour Capacity Study) approved by the City Council January 5, 1976. The public hearing on this project was opened and closed, with no one present to comment on the proposal. Secretary Palin stated that, since there are presently a Tentative Tract, a Conditional Exception, and a Conditional Use Permit pending before the Planning Commission on the total project of which this request is a part, it is deemed advisable to refer this request to that body in order that they may have a comprehensive package for review. ON MOTION BY PALIN AND SECOND BY LIPPS, USE PERMIT NO. 76-23 WAS REFERRED TO THE PLANNING MEETING OF MAY 4, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-11 Applicant: Foxx Development Corporation To permit a four (4) lot division of land pursuant to Section 9930.1 of the Huntington Beach Ordinance Code, located on the east side of Huntington Street, approximately 260 feet south of Yorktown Avenue in an R2, Medium Density Residential District. The Chairman informed the Board that Negative Declaration No. 76-30 was approved by the Environmental Review Board on April 27, 1976, for this project. Bob Jarrard was present to represent the application. The Board reviewed the request with the applicant, discussing align- ment of streets and alternative methods of taking access to Parcels 1 and 2; effects on the drainage basin were also reviewed. The applicant was instructed by Bruce Crosby that his final map should eliminate the lot lines presently indicated on Parcel No. 4. C BZA 4-28-76 Page 14 Minutes, H.B. The Chairman informed the Board that Negative Declaration No. 75-22 has previously been adopted by the Board for the original project. The Chairman opened the public hearing. John Absmeier of Barker and Ott was present to represent the application. Mr. Absmeier addressed the Board, expressing the opinion that closing the exit on Heil Avenue,and redesigning and reducing the parking for the use BZA 4-28-76 Page 16 Minutes, H.B. There being no other persons to speak on the proposal, the public hearing was closed. Secretary Palin reviewed the layout as originally approved for this project and noted that the proposed parking revisions seem inefficient, in that the required turning radius is not shown and parking is provided in single bank on the drive when double - banked parking would almost offset the parking which has been deleted from the original plan. The Board discussed whether or not the change could be considered substantial, and concluded that the applicant's assurance that the drive on Bradbury will remain permanently (even after construction of the future convent on the site) would improve traffic movements at the inter- section of Heil and Bradbury and compensate for the deletion of the Heil Avenue exit. Bruce Crosby informed the applicant of the new standards which will be applied to the Bradbury Drive exit.
