Sterling Buck & Associates To permit the construction of a 240-unit apartment complex pursuant to Section 9162.3.1 of the Huntington Beach Ordinance Code, located at the southwest corner of Bolsa Chica Street and Heil Avenue in an R2, Medium Density Residential District. The Chairman informed the Board that Negative Declaration No. 76-16 was approved for this project by the Environmental Review Board on March 23, 1976. The Chairman opened the public hearing. No one was present to speak on the proposed project. The public hearing was closed. Secretary Palin reported that the applicant is in the process of revising his plans and approach to the project, and such revision may require further applications to be filed. ON MOTION BY PALIN AND SECOND BY CROSBY, USE PERMIT NO.'76-15 WAS CONTINUED TO MAY 12, 1-976, TO ALLOW APPLICANT TO SUBMIT REVISED PLANS IN COMPLIANCE WITH THE ORDINANCE CODE, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-30 (Revised Plan) Applicant: Richard A. Harp & James R. Morton Revision of a previously approved permit for a duplex building from the original duplex to a triplex, located on the east side of 19th Street approximately 100 feet south of Olive Avenue in an R4, High Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Richard Harp and James Morton were present at the meeting. The Board reviewed the proposed revised plan and found it to be in conformance with the ordinance code. Also, the Board discussed with the applicants the relocation of the power pole in the alley right- of-way. ON MOTION BY PALIN AND SECOND BY LIPPS, THE REVISED PLAN FOR ADMIN- ISTRATIVE REVIEW NO. 76-30 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised plan for the triplex received and dated April 29, 1976, shall be the approved layout. In accordance with the City's standards and requirements, an additional two and one-half feet (2-1/2') of right-of- way on the alley shall be dedicated. 4. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm sys- tems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public works. 6. The developer shall participate in the local drainage assessment district. 7. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Nineteenth Street and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, sewer and water main extensions, and relocation of the existing utility pole in the alley, in full compliance with the City of Hunt- ington Beach street standards and requirements. Board of Zoning Adjustments May 5, 1976 Page 4 ADMINISTRATIVE REVIEW NO. 76-37 Applicant: Allen Garner To permit the care of six (6) non -related persons in a single- family dwelling, pursuant to Section 9730.27 of the Huntington Beach Ordinance Code, located on the south side of Kiner Avenue approximately 210 feet west of Lisa Street in an R1, Low Density Residential District. The Chairman informed the Board that Notice'of Exemption No. 76-14 has been issued by the Environmental Resources Department for this request. The Chairman opened the public hearing. Mr. Garner and Linda Martinez, from the County Department of Social Services, were pre- sent to represent the application. Mr. Garner explained that he will provide 24-hour care to young male patients; he resides in the subject property and there will be an attendant on duty at all times. No modifications have been made to the structure to accom- modate this use. Medication as required will be dispensed. There being no other persons present to speak for or against the proposed project, the public hearing was closed. The Board reviewed the request, considering the size of the rooms, the license on file for the use, and the handling of prescribed medications. ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINISTRATIVE REVIEW NO. 76-37 WAS APPROVED WITH THE FOLLOWING CONDITION, BY THE FOLLOW- ING VOTE: CONDITION OF APPROVAL: The applicant shall comply with all provisions of Section 9730.27.2 of the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-45 (In Conj./CE 76-14) Applicant: McDonald's Corporation To permit the addition of a drive -through at an existing fast food restaurant pursuant to Section 9430 of the Huntington Beach Ordin- ance Code, located on the east side of Beach Boulevard approximately 465 feet north of Indianapolis Avenue in a C2, Community Business District. The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. BZA 5-5-76 Page 4 1 Minutes, H.B. Board of Zoning Adjustments May 5, 1976 Page 5 The Chairman opened the public hearing. Larry.Reyes, Charles Hall, Sr., John Arness, and Bud Walker were present at the meeting. Mr. Reyes addressed the Board to explain the project and outline the reasons the drive -through window is needed. There being no other persons to speak on the proposed project, the public hearing was closed. Board discussion ensued, touching upon problems in circulation imposed by the design of the project. Problems included improperly located parking, non-use of undeveloped property to the rear of the site, the blocking of onsite circulation by the drive -through lane, two parking stalls at the rear which abut directly on the drive -through lane, and the speed bump located immediately upon exiting the drive -through window. The hazardous condition created by the "exit only" designation on the northerly driveway was discussed, with Bruce Crosby noting that a south - bound auto attempting to enter at that location would be caught in the traffic on Beach Boulevard. Possible alternative layouts were discussed with the applicants, and it was the consensus that a meeting should be arranged between staff and applicants to attempt to work out some of the problems on the site. ON MOTION BY CROSBY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-45 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANTS TO THE MEETING OF MAY 19, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-14 (In Conj./AR 76-45) Applicant: McDonald's Corporation To permit an eighteen (18) parking space reduction in the required parking in lieu of Section 9793.1(b) of the Huntington Beach Ordinance Code, located on the east side of Beach Boulevard approxi- mately 465 feet north of Indianapolis Avenue in a C2, Community Business District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Larry Reyes, Charles Hall, Sr., John Arness, and Bud Walker were present at the meeting. Mr. Reyes explained that it is anticipated that forty (40) percent of future business is expected to be handled through the drive - through facility thereby reducing the need for onsite parking spaces. There being no other persons to speak for or against the proposed project, the public hearing was closed. In light of the circulation and access problems uncovered in the review of Administrative Review No. 76-45, it was the consensus BZA 5-5-76 Page 5 Minutes, H.B. Board of Zoning Adjustments May 5, 1976 Page 6 of the Board that consideration of this request be deferred to permit staff and applicants to work out the circulation problems. ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 76-14 WAS CONTINUED TO THE MEETING OF MAY 19, 1976, WITH THE CONCURRENCE OF THE APPLICANTS, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-16 Applicant: C. G. Fowler To permit an 18-inch addition in height to an existing 6 foot high wall in lieu of Section 9104(b) of the Huntington Beach Ordinance Code, located at the northeast corner of Crest Avenue and 14th Street in an R1, Low Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. and Mrs. Fowler were present at the meeting. Also present and speaking in favor of the proposed project were Norm Worthy and Robert Hornbeck, neighboring property owners. Mrs. Cross, owner of the adjacent property to the north, queried the Board on whether or not this application concerned the wall on the applicant's north property line as well; she was informed that the present application covers only the alley side of the wall. Mr. Fowler explained his reasons for requesting the con- ditional exception. There being no other persons to speak on the project, the public hearing was closed. The Board discussion concerned the grade differential between subject property and the alley, the present height of the wall measured both from the alley and the subject property, and the present stage of construction of the wall. It was the determination of the Board that the present height of the wall measured from the subject property already reflects the added eighteen (18) inches requested in the application. The Board also reviewed pictures in support of his request which had been submitted by the applicant. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-16 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The applicant is attempting to separate and screen an alley adjacent to the rear yard of subject property. Said alley does create a hardship upon the livability of the rear yard area. The wing wall protion is a permitted wall at the height as requested except within that portion of the rear yard set- back established for that district. 3. There is a difference in grade along the property line at which the applicant is requesting the additional height which partially justifies the height of the wall at the eleven courses as submitted for review. 4 CONDITIONS OF APPROVAL: 1. The wall shall not be allowed to exceed eleven (11) courses above the retaining portion along the alley right-of-way. 2. The presently existing wall shall be capped off, grouted, and the steel severed at the top of the eleventh course of blocks currently existing in place. 3. The plans and photograph received and dated April 16, 1976, shall be the approved layout. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-18 Applicant: Robert Baumel To permit a four (4) foot encroachment into the required twenty (20) foot minimum dimension open space requirements in lieu of Section 9103.3.1.1.2 of the Huntington Beach Ordinance Code, located on the north side of Tisbury Circle approximately 80 feet west of Mistral Drive in an Rl, Low Density Residential District. Secretary Palin informed the Board that this application had been required of the applicant in error, as the exception as requested has been constructed on the island for a number of years based upon the original approved plans. Applicant will request withdrawal. ON MOTION BY CROSBY AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 76-18 WAS WITHDRAWN BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-41 Applicant: J. A. Stewart Construction Company To permit the construction of two (2) industrial buildings (15,000 and 16,200 square feet), pursuant to Section 9530 of the BZA 5-5-76 Page 7 Minutes, H.B. Board of Zoning Adjustments May 5, 1976 Page 8 Huntington Beach Ordinance Code, located on the south side of Edinger Avenue approximately 450 feet west of Gothard Street in an Ml, Light Industrial District. The Chairman informed the Board that Negative Declaration No. 76-31 was granted for this request by the Environmental Review Board on May 4, 1976. Bill Burke was present to represent the application. Bruce Crosby informed the applicant that the Traffic Department has reviewed the regv-�st and has indicated that the two drives on Edinger Avenue will have to be increased to thirty feet in width, with a radius -type drive rather than standard type. He also noted that there will not be a break in the raised median at the subject location. Board review found the application to be in conformance to code requirements. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-31, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-41 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received April 13, 1976, shall be the approved layout, subject to the modification described herein: The drive along the rear elevation of the southerly building shall be increased to a width of twenty-eight(28) feet. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modifi- cation outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. C. GENERAL CONDITIONS: 1. The drives shown on Edinger Avenue shall be thirty (30) feet in width and shall be constructed as radius type drives according to specifications on file in the Department of Public Works. If the developer proposes to provide air conditioning, the in- sulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 3. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central hea}ing units. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. During the grading operation, special care shall be taken to keep siltation from entering into the flood control channel. 6. Applicant shall be required to clean up any debris deposited in the channel during construction or grading of the subject project, prior to use or occupancy. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-48 Applicant: David and Mia Kory To permit the construction of a 4,000 square foot office building pursuant to Section 9471.4 of the Huntington Beach Ordinance Code, located on the northwest corner of Beach Boulevard and Slater Avenue in a C4, Highway Commercial District. The Chairman informed the Board that Negative Declaration No. 76-32 was granted for this request on May 4, 1976, by the Environmental Review Board. David Kory was present at the meeting. The Board reviewed the request. Bruce Crosby noted that the drive on the westerly side of the property is very close to the property line, and applicant explained that he also owns the abutting parcel and it is his intention to have that drive eventually serve the entire property. The drive width on Beach Boulevard was also dis- cussed in regard to the conflict it will create with required land- scaping - Board consensu was that this 43-foot drive should be reduced in width. ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD ADOPTED NEGA- TIVE DECLARATION NO. 76-32 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-48 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. Driveway width on Beach Boulevard shall be a maximum of thirty- five (35) feet and shall be constructed as a radius type drive according to specifications on file in the Department of Public Works. 2. If the developer proposes to provide air conditioning, the insu- lation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Board review found that the request meets the specific standard requirements for this type development. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-49 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. Richard Grundy, hospital Administrator, was present at the meeting. Secretary Palin reviewed the history of previous applications and development on the site. Mr. Grundy explained the need for addi- tional parking contiguous to the emergency entrance of the hospital and reviewed the proposed layout. After discussion of the design, the relationship of the proposed parking to future development, presently existing parking on the site, and the grade differential on the subject property, it was the consensus of the Board that the layout could be rearranged to produce greater efficiency of use, and suggested that staff be given time to work out an alternative arrangement. Saul Sher was present at the meeting. Mr. Sher addressed the Board and presented an alternate to the originally approved Scheme C, which he feels will create a dangerous and unworkable situation by closing off the first entrance to the site on Main Street. The applicant presented aerial photos of subject site and explained what he is presently proposing as a substitute for Scheme C. The Board reviewed the presently existing parking count and the 63 additional spaces to be provided by the alternate layout in relation to the required parking, taking into consideration the demonstrated overlap in hours of operation of businesses in the shopping center. It was noted that there are only two night-time uses in the center, and the total requirement of the theater - would be 541 spaces out of the existing 851 spaces within the facility. The required landscaping for the site was also dis- cussed. The Chairman informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. David B. Czinger was present to represent the application. The Board reviewed the location and dimensions of the building and the proposed parking; applicant indicated that he can be flexible on the parking but the size and configuration of the structure is fixed by economic considerations. Secretary Palin pointed out that two spaces are too near to the overhead doors, that some spaces project improperly, and that some turning radii do not appear to be adequate. Also discussed were the interconnection between this building and the applicant's existing building, the landscaping to be required, and the need for a parcel map to eliminate the lot lines between parcels. ON MOTION BY PALIN AND SECOND BY CROSBY SIGN REQUEST 6727 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. Individual operations within a shell building are not entitled to have a separate detached sign for each such operation. 2. When the City previously approved a sign program for this shopping center, space was set aside on existing signs to provide sufficient area for proper identification of all uses within the center. 3. The sign as proposed does not take into consideration other opera- tions within the building; therefore, granting of this request would constitute a privilege which is denied to other operations on the site. Applicant therefore has two alternatives: a. Use of a wall sign, or b. A new application for a pole sign large enough to accommodate all satellite shops in the center.
