Sterling Buck & Associates To permit the construction of a 10-unit apartment building pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code, loc- ated on the west side of Main Street approximately 470 feet north of Clay Avenue in an R3, Medium -High Density Residential District. The Chairman informed the Board that Negative Declaration No. 76-20 was granted by the Environmental Review Board for this request on April 13, 1976. The Chairman reopened the public hearing. There being no one present to speak on the project, the public hearing was closed. Secretary Palin reported that after numerous continuations the ap- plicant has still not submitted the required revised plans, and outlined alternative procedures the Board might follow in handling this request. ON MOTION BY LIPPS AND SECOND BY CROSBY THE BOARD VOTED TO RECONSIDER USE PERMIT NO. 76-15, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-15 WAS CON- TINUED TO THE MEETING OF MAY 26, 1976, TO PERMIT SUBMITTAL OF REVISED PLANS, BY THE FOLLOWING VOTE: ` AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-53 (Cont. from 5-5-76) Applicant: Huntington Intercommunity Hospital To permit the construction of an additional parking lot for an existing hospital facility pursuant to Section 9401 of the Huntington Beach Ordinance Code, located on the south side of Newman Avenue approximately 220 feet east of Beach Boulevard in an R5, Office - Professional District. The'Chairman informed the Board that this project is classified as exempt under the "on -going project" designation contained in the California Environmental Quality Act, 1970. Lee Baum was present to represent the application. Secretary Palin informed the Board members that staff has reviewed the plan as submitted and feels that it does not truly reflect con- ditions on the site nor proper efficiency in parking layout and onsite circulation. He cited the addition to one of the hospital wings which has resulted in parking on the south side of the proposed layout encroaching into an already established traffic pattern and the reduction of the area alongside the emergency entrance to a width which will not accommodate parking. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-53 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan shall be revised and submitted to the Department of Building and Community Development. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE•PERMIT NO. 76-17 (In Conj�AR 76-33) Applicant: Paul J. Burnside (Agriscape, Inc.) To permit 25 percent retail sales in conjunction with industrial use, pursuant to Section 9530.1(b) of the Huntington Beach Ordin- ance Code, located at the northwest corner of Gothard Street and Ellis Avenue in the MI -CD, Light Manufacturing District. The Chairman informed the Board that Negative Declaration No. 76-36 was granted by the Environmental Review Board for this request on May 11, 1976. The Chairman opened the public hearing. There being no one present to speak for or against the proposed project, the public hearing was closed. The Board discussed right-of-way widths on the two abutting streets, drive numbers and widths, and the recommendations which have been received from the Design Review Board and the Environmental Review Board. ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-17 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: BZA 5-12-76 Page 3 Minutes, H.B. Board of Zoning Adjustments May 12, 1976 Page 4 a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1: The conceptual plot plan received March 26, 1976, shall be the approved layout, subject to the modifications .described herein: a. The plan shall be revised to reflect the true right-of-way widths for Gothard and Ellis. b. The revised plan shall delineate a minimum thirty (30) foot width for the curb cut on both of the driveways. C. The revised plan shall reflect proper setbacks on any structure or fencing exceeding forty-two (42) inches in height. A plan delineating said modifications shall be submitted to the Department of Building and Community Development at the time of application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code shall be submitted to the Design Review Board. Said"plan shall indicate planting materials and elevations of the proposed sign, and shall conform to landscaping specifications on file in the Department of Public Works. In accordance with the City's standards and requirements, an additional 20 feet of right-of-way on Gothard Street, 10 feet of right-of-way on Ellis Avenue, and a 32 foot radius at the inter- section of Ellis and Gothard shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. The developer shall participate in the Orange County Sanita- tion District #3 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Gothard Street and Ellis Avenue shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The chain link fence located at the immediate corner of Ellis Avenue and Gothard Street in front of the proposed landscaping shall be eliminated and relocated behind landscaping. 2. The proposed patio shall be relocated to the north side of the proposed building. 3. Vin-�s shall be planted along all proposed chain link fencing. 4. Applicant shall take precautions to prevent by-products and materials from this operation from being blown by wind into surrounding areas. 6. Gates on this project shall remain open during hours of operation. 7. Applicant shall obtain all necessary permits for the reloca- tion of the building. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-33 (In Conj./UP 76-17) Applicant: Paul J. Burnside (Agriscape, Inc.). To permit the establishment of a soil amendment manufacturing facility pursuant to Section 9530 of the Huntington Beach Ordinance Code, loc- ated at the northwest corner of Gothard Street and Ellis Avenue in the M1-CD, Manufacturing District. The Chairman informed the Board that Negative Declaration No. 76-36 was granted for this use by the Environmental Review Board on May 11, 1976. No one was present to represent the application. The Board reviewed the request. Bruce Crosby indicated that the dimensions shown on the plan are inaccurate in that they do not re- flect the proper centerlines on Ellis and Gothard, which have been set as 40-foot half -street sections. Traffic has also indicated that the drives on Gothard must be increased to a width of thirty feet. The Board reviewed the recommendations forwarded from the Design Review Board for this proposed project. Board of Zoning Adjustments May 12, 1976 Page 9 1370 feet north of Garfield Avenue and 735 feet west of Gothard Street in an M1-O, Light Industrial combined with Oil Production. The Chairman informed the Board that Negative Declaration No. 76-33 was granted for this request by the Environmental Review Board on May 11, 1976. Gunnard Johnson was present to represent the application. The Board reviewed the request, and discussed any possible effects the reactivation might have on the pending application for a stable in the area, such as relocation of stall areas or access for emergency vehicles. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-33 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY LIPPS OIL WELL ACTIVATION PERMIT NO. 76-2 WAS APPROVED WITH TIE FOLLOWING CONDITION, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The applicant shall comply with all provisions of the Huntington Beach Oil Codes. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-24 Applicant: Michael Gesler & Associates To permit the addition of a drive -through facility to an existing restaurant pursuant to Section 9472.1 of the Huntington Beach Ordinance Code, located at the southwest corner of Beach Boulevard and McDonald Street in a C4, Highway Commercial District. The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Mr. Gesler was present at the meeting. Secretary Palin informed the Board that a letter in opposition to this request has been received by the Board.' The applicant addressed the Board and explained his request. There being no other persons to speak on the proposed project, the public hearing was closed. The Board reviewed the history of the subject site and discussed parking, access, compact parking stalls as shown on the plan, and landscaping. ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-24 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOL- LOWING VOTE: FINDINGS OF THE BOARD: 1. The five parking spaces delineated as compact car spaces shall be designated as employee parking only. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The Board review determined that the plan is in compliance with code except for the front yard setback, which should be fifteen (15) feet. ON MOTION BY CROSBY AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 76-55 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 29, 1976, shall be the approved layout, subject to the modifica- tion described herein, for Lot 11 only: BZA 5-12-76 Page 11 Minutes, H.B. Board of Zoning Adjustments May 12, 1976 Page 13 ADMINISTRATIVE REVIEW NO. 76-56 Applicant: Circle T Corporation To permit the construction of four (4) single-family dwellings pursuant to Section 9384.16 of the Huntington Beach Ordinance Code, located on the east side of 20th Street approximately 50 feet north of Acacia Avenue in the Townlot Specific Plan Area One, Section A. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Harry Tancredi was present at the meeting to represent the application. Review by the Board found this request to be in conformance with code requirements. The applicant was informed that he could work out a conceptual landscape plan for all lots, to be submitted to the Building Department. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-56 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received April 29, 1976, shall be the approved layout. Discussion by the Board included the type of equipment to be used and the distance such equipment would set back from the bulkhead. ON MOTION BY PALIN AND SECOND BY CROSBY SPECIAL EVENT NO. 76-14 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 5-12-76 Page 14 1 Minutes, H.B.
