COMMISSIONERS PRESENT: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins COMMISSIONERS ABSENT: None CONSENT CALENDAR: ON MOTION BY PARKINSON AND SECOND BY SHEA THE MINUTES OF APRIL 20, APRIL 27, AND MAY 4, 1976 WERE APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: None ORAL COMMUNICATIONS: None SCHEDULED ITEMS: PRECISE PLAN OF STREET ALIGNMENT NO. 76-2 "McFadden Avenue Modification: This proposed Precise Plan of Street Alignment would replace Precise Plan of Street Alignment No. 75-6, which designates adjacent cul-de-sacs at the subject location to effect a closure to through traffic. Secretary Harlow stated that the City Council on April 19, 1976 directed the Planning Commission to initiate a Precise Plan of Street Alignment depicting Alternative No. 3 of the report. Dave Eadie addressed the Commission and stated that at its April 27, 1976 study session, the Planning Commission reviewed information related to the issue of the subject street alignment and directed the staff to set the street alignment depicted in Figure 1 (Alterna- tive 3) for a public hearing. Vugraphs were shown. Chairman Slates opened the public hearing. Wallace Rodecker, representing Robinwood Homeowners, addressed the Commission and spoke against closure of McFadden Avenue. He addressed traffic control problems with relation to truck traffic and speed enforcement. Minutes: H.B. Planning Commission Tuesday, May 18, 1976 Page 2 Ed Martin, representing residents on McFadden Avenue, spoke in favor of the closure of McFadden as originally proposed in the Environmental Impact Report which was prepared in 1974. Ms. Glen Davison, a resident of Pelican Lane, addressed the Commission and stated that no care has been taken of the tract by the City. She stated that a cul-de-sac would collect debris due to the prevailing winds in that area. She felt that it was the responsibility of the City to landscape this area. Lee Baker spoke against closure of McFadden_ Avenue, stating that it would create bottleneck in the tract. Rudy Gregory discussed painted lines on the street as a means of traffic enforcement. The Chairman closed the public hearing. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY-FINLEY PRECISE PLAN OF STREET ALIGNMENT 76-2 (ALTERNATE NO. 3) WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley, Shea, Boyle, Kerins NOES: Slates ABSENT: I None ON MOTION BY SHEA AND SECOND BY FINLEY RESOLUTION NO. 1165 RECOMMENDING APPROVAL OF SAID.PRECISE PLAN WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Bazil, Finley,'Shea, Boyle, Kerins NOES: Slates ABSENT: None By minute action the Planning Commission requested the Department of Public Works to provide an addendum report to accompany the Planning Commission's transmittal to the City Council which cites recommendations on traffic control devices to be utilized in conjunction with the Precise Plan of Street Alignment. Chairman Slates called a two minute recess at 8:06 p.m. CONDITIONAL USE PERMIT NO. 76-9 APPLICANT: Melvin C. Amerman Conditional Use Permit'No. 76-9 is a request for the development of a private raquetball/handball facility. It will consist of ten �(10) courts;'men and women jacuzzis and saunas, lobby area, etc. The property is located south of Hamilton west of Brookhurst. -2- 5/18/76 - PC Minutes: H.B. Planning Commission Tuesday, May 18, 1976 Page 3 John Cope addressed the Commission and stated that the applicant had requested permission to remain open until midnight since all activity would be in an enclosed building and hence not constitute a nuisance. He stated that the staff concurred with this request. Chairman Slates opened the public hearing. *There being no one to speak on this application, the public hearing was closed. Commission discussion ensued. ON MOTION BY KERINS AND SECOND BY BAZIL CONDITIONAL USE PERMIT NO. 76-9 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOW- ING VOTE: FINDINGS: - - -- --- -- -- ------ --_- 1. The proposed plan substantially complies with the applicable ordinance code requirements. 2. The proposed layout and design has been integrated with planning efforts of adjacent properties and therefore will provide for a more efficient and compatible use. CONDITIONS OF APPROVAL: 1. The conceptual plot plan dated April 29, 1976 shall be the approved layout subject to the following revisions. a. The driveway approach from Hamilton Street shall be subject to the design criteria of Standard Plan 212 "A & B". b. The isolated parking stall adjacent to Hamilton Street shall be deleted and this area incorporated into the adjacent land- scaping. c. A minimum twenty (20) foot intertying accessway shall be pro- vided between the 90 degree parking stall aisles. A revised plan reflecting these changes shall be submitted to the Planning Department for review and approval. 2. Prior to the issuance of building permits, a landscape plan shall be submitted'to the Department of Building and Community Develop- ment for review and approval. 3. The property shall participate in the local drainage assessment district. 4. Soil reports as required by Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 5. Subject property is located on the northwest corner of Clay Avenue and Florida .Street.. Jim Palin addressed the Commission and discussed the stubbing in of a street to penetrate, -property,to ,.the.north. i John Mandrell, representing RMG Engineering, Inc., stated that he had reviewed the staff recommendations and was in accord with them. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY SHEA TENTATIVE TRACT NO. 9259 WAS APPROVED WITH THE,FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: FINDINGS 1. The ro osed ` siibdivitsion � of " this 3.4+ acre p p _ parcel of land zoned R-2, which allows 15 units per gross acre,is proposed to be' constructed having only 15':38-number'of units,per gross,acre. 2. The General Plan'set forth provision for this type of land use as well'as setting forth objectives for implementation of this type of housing. „ 3. The property was previously,- studied for this intensity of land use at the time the land u'se delsignai:ion for medium density residential was placed upon,said property. 4. CONDITIONS OF APPROVAL: 1. The tentative map received and dated May 13, 1976 shall be the approved layout. 2. The sewer, water, and 'fire' hydra system shall be designed to City standards. 3. The sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The property shall be subject to local drainage assessment dist- rict requirements and fees. 6. Drainage for the subdivision shall be approved by the Depart- ment of Public Works prior to the recordation of a final map. This system shall be designed to provide for siltation and erosion control both during and after construction of the pro- ject. 7. All utilities shall be installed underground. 8. A masonry wall shall be constructed along the northerly property lines of lot 1, 14, and 15 and along the easterly property line of lot 15 and along the east right-of-way line of A Street. Said wall shall be six feet high and shall be measured from whichever side is higher at finished grade and match the color of material within the wall to be constructed along the easterly right-of-way line of A Street. That portion of this wall along A Street shall be constructed to City specifications. Said wall shall be six inches wide and six feet high. The height of said wall shall be measured from whichever side is higher at finished grade. The architectural design of said wall shall be approved by the Plan- ning Department. Structural design shall be approved by the Department of Public Works and shall be included as part of the street improvement plans if constructed by the developer. 9. Fire safety systems shall be installed by the developer as re- quired by the Fire Department. 10. Exterior elevations of the units that side onto Clay Street shall be subject to review and approval by the Planning Department. 11. If the developer proposes to provide air conditioning, the insu- lation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a.minimum of R-13 and R-7, respectively. 12. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. , 13. This map was continued to allow time to resolve the'design and right-of-way width necessary for the bike . lane along the east side of Lake.Street. Chairman Slates stated that he would have to abstain on this appli- cation. He then turned the meeting over to Vice -Chairman Finley. im Palin addressed the Commission and referred to Daryl Smith's report concerning the inspection of;tree,s•on Lake Street. ;He further discussed with the Commission'the,widening of Lake Street to 106 feet. ' J Mike Zambory, Public'Works Department, spoke,in favor^of widening Lake Street to 106 feet. Commission discussion ensued. _, ON MOTION BY BOYLE AND SECOND BY BAZIL TENTATIVE TRACT 9234 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY,THE FOLLOWING VOTE:. FINDINGS: , ; 1. The proposed -subdivision of"this 1.8 + acre parcel'of land zoned R3-0 (which -allows 24:89 units per gross acre) is proposed to be constructed having only 20 units per gross acre. 2. The General Plan has'set'forth provisions'for this type of land use as well as setting'forth objectives for implementation for this type of housing. e 3. The property was previously studied for this intensity of land use at the time the land use designation for low density, residential was placed on said property. 4. The lot size, depth, frontage, street widths, and all other design and improvements features of the proposed subdivision are proposed to be constructed'in.compliance with standard plans and specifications on file with the City, as well as in com- pliance with the State Map Act and supplementary City Subdivision Ordinance. The tentative map received and dated March 31, 1976 shall be the approved layout subject to the amendment for a 106' street section. 2. The sewer, water and fire hydrant system shall be designed to City standards. 3.' The water.system shall be through the City of Huntington Beach's water system. 4. The sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The property shall be subject to local drainage assessment district requirements and fees. 6. Vehicular access rights along Lake Street except at street inter- section shall be dedicated to the City of Huntington Beach. 9. All utilities shall be installed underground. 10. All buildings on"lots abutting a City easement shall set back five (5) feet from the edge of such easement. 11. If the developer proposes to provide air conditioning, the in- sulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 12. The structures on -subject property, whether attached or detached, shall be constructed in compliance with the State Acoustical Standards set forth for all units that lie within the 60 CNEL contours of the property.. 15. In addition to those street trees required by the Huntington Beach,Ordinance;Code, the developer shall be required to plant a minimum -of two.on-site.trees per lot. The size of these on -site trees shall be a minimum of 24 inch box specimens. 16. Should the City vacate the Oswego Street "right-of-way" prior to recordation of,a final map,'that portion vacated should be in- cluded within Lot No. 1. The alley configuration shown along the east side of the subdivision should "T", out to Lake Street. 17. Lake Street will be dedicated and improved to City standards to 106 feet at ultimate width as shown on the recommended Section reviewed and approved by the Planning Commission at its May 18, 1976 meeting. Haas Tentative Parcel Map 76-9 is a request to permit a two lot division of land on the south side of Atlanta Avenue approximately 390 feet east of Miramar Lane in an Rl District. The developer filed -an appeal to the Board of Zoning Adjustments' decision to deny Tentative Parcel Map 76-9 on April 27, 1976. The request is to allow a parcel of land to be divided into two separate parcels to facilitate construction of a single family dwelling on one of�the parcels. -8- 5/18/76 - PC Minutes: H.B. Planning Commission Tuesday, May 11, 1171 Page 9 Tentative Parcel Map 76-9, filed on April 1, 1976 was before the Board of Zoning Adjustments at its April 21, 1976 meeting, at which time the Board of Zoning Adjustments unanimously denied the request to allow the parcel to be divided into two lots to facilitate development of a single family home on parcel 1 fronting on Dorset Drive. At that time, the Board reviewed the history and prior actions by the Planning Commission on Tentative Map 7079 and questioned if the parcel to be retained by the church was proposed for immediate construction. The developer informed the Board that plans had not been prepared for the church nor had any plans been submitted for building permits. Jim Palin stated that he had no information to add to that con- tained in the staff report. The public hearing was opened. David W. Haas, applicant, spoke in favor of the two lot division. He cited traffic problems which currently exist in the area. Several residents in the area spoke in favor of permitting the two lot division. They cited traffic problems and children's safety as reasons. The public hearing was closed. Commissioner Shea stated that she did not feel any more traffic problems should be created just to benefit the future of Parcel 2. Vice -Chairman Finley stated that she had looked at the area and felt the concerns of the residents expressed during the public hearing were quite valid. Commission discussion ensued. ON MOTION BY KERINS AND SECOND BY BOYLE APPEAL TO DENIAL OF TENTATIVE PARCEL MAP 76-9 WAS DENIED FOR THE FOLLOWING REASON BY THE FOLLOWING VOTE: 1. The proposed map is not consistent with applicable general and specific plans for the area, as approval of this map would allow development of proposed Parcel No. 1 with a single-family dwelling prior to development plans being filed for proposed Parcel No. 2. Such construction upon Parcel No. 1 would restrict access being taken from a local public street (Dorset Drive). Planning Commission Tuesday, May 18, 1976 Page 10 CODE AMENDMENT NO. 76-7 "SPECIFIC PLAN AMENDMENT" At its Study Session of April 27, 1976, the Planning Commission directed the staff to prepare a Code Amendment to the North Huntington Center Specific Plan (Article 937) which would allow the Commission,to approve Compact Car Parking Provisions within Site I of the Specific Plan. Site I is that area of the plan in which.a 280 unit apartment complex,is proposed to be built. The apartment complex was approved as part of Conditional Use Permit No. 75-24 (Jerwel Enterprises) on February 3, 1976. Dave Eadie addressed the Commission and discussed the background of this Code Amendment. He presented a vugraph. The public hearing was opened. Gordon Offstein inquired as to what would occur if the property was sold. This -was -in regard to the parking situation. He was advised that the owner would have'the perogative of replacing compact parking with standard parking. The public hearing was closed. ON MOTION BY BOYLE AND SECOND BY KERINS ZONE CASE NO. 76-16 WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The requested change of zone implements the recently adopted land use designation, and therefore is in conformance with the General Plan. 2. The resultant land uses are enumerated in the Land Use Element and provide for the highest compatibility with the existing adjacent uses. 3. The zoning will be consistent with and implement the adopted General Plan Policy of providing for residential development that maximizes open space by encouraging planned residential developments on larger parcels or unsubdivided land. John Cope stated that this zone change request was initiated by the staff to implement the General Plan land use designation through the appropriate district zoning. The public hearing was opened.
