BOARD MEMBERS PRESENT: PALIN, CROSBY, LIPPS CITY STAFF PRESENT: DON MOORE, FIRE DEPARTMENT MINUTES: ON MOTION BY PALIN AND SECOND BY LIPPS, THE MINUTES OF THE REGULAR MEETING OF APRIL 21, 1976 WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: USE PERMIT NO. 76-14 (Cont. from 3/24/76) Applicant: W. Sterling Buck & Associates To permit the construction of a 240-unit apartment complex pursuant to Section 9162.3.1 of the Huntington Beach Ordinance Code located at the southwest corner of Bolsa Chica Street and Heil Avenue in an R2, Medium Density Residential District. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 76-20 & A22licant: W. Sterling Buck & Associates To permit encroachments into required setbacks for: (1) zero setback for carport along proposed east -west street at south property line in lieu of the required 15 feet per Section 9320.6; (2) as much as zero setback for walls over 42 inches in height along Green Street, Heil Avenue, and Bolsa Chica Street in lieu of the required 15 feet per Section 9320.6; and (3) ten foot setback for carports located along Heil Avenue in lieu of the required 15 feet, per Section 9320.6 of the Huntington Beach Ordinance Code located at the southwest corner of Bolsa Chica Street and Heil Avenue in an R2, Medium Density Resi- dential District. The Chairman informed the Board that the Environmental Review Board granted Negative Declaration No. 76-16 for Use Permit No. 76-14 on March 23, 1976; and further stated that Conditional Exception No. 76-20 is a categorical exemption, class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Secretary Palin noted some of the problems on the revised plan, i.e., reestablishment of ultimate right-of-way line on Bolsa Chica Street, too great a walking distance between units and garages; Fire Department access; etc. Mr. Buck addressed the Board and presented his revised plans. He noted the separation of units for adults only and families with children. Mr. Buck is proposing a security gate to surround the facility. It was noted that Green Street is a public street with slight meandering to control speed and is the second escape route for the project to enter onto Heil. There being no further parties present to speak, the Chairman closed the public hearing. Secretary Palin explained the Conditional Exception request to the Board. It was for. Palin's feeling that Article 932 (apartment standards) when drafted did not take into consideration security of an apartment complex which requires construction of a 6 ft. high fence or wall nor did the article take into consideration provisions requiring a 6 ft. high wall around a conventional subdivision where lots back up to or side on an arterial highway. Board discussion followed. ON MOTION BY PALIN AND SECOND BY LIPPS THE BOARD OF ZONING ADJUSTMENTS ADOPTED NEGATIVE DECLARATION NO. 76-16 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-14 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received May 13, 1976 shall be the approved layout, subject to the modifications described herein: Minutes: H.B. Board of Zoning Adjustments Wednesday, May 19, 1976 Page Three a. Streets shall not be less than two 12 ft. travel lanes, one in each direction. b. Adult section on easterly portion shall be modified with security entry along guest parking off Green Street. C. The plan shall be revised to reflect proper site dimensions and ultimate right of way. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. A. 2. The following plan shall be submitted to the Board of Zoning Adjustments. a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. 3. in accordance with the C.ity's standards and requirements, an additional 35 ft. on Bolsa Chica Street, 20 ft. on Heil, Green Street, and 19.5 ft. on "A" Street shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be subject to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the Orange County Sanitation District #11 Sewer Annex District. 8. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Bolsa Chica, Heil, Green and "A" Street shall be improved to the center line of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. Building No. 20 shall meet the requirements for noise attenuation by proper insulation. 2. The design and configuration of "A" Street shall be approved by the Department of Public Works. 3. No portion of the wall along Heil and Bolsa Chica shall be in City right-of-way. 4. Parkway maintenance agreement for Heil and Bolsa Chica shall be submitted. 5. Developer shall comply with recommendations of Negative Declaration No. 76-16 as follows: a. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. b. All building spoils such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. C. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. d. The structures on subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. The general welfare of persons residing or working in the vicinity. b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS AND FINDINGS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The carport proposed for construction at a "0" zero setback along the south property line at "A" Street as well as those proposed along Iieil Avenue shall be constructed in compliance with the plans submitted and designated as carport study received and dated May 7, 1976. 2. The maximum height of carports constructed along the southerly property line, west of Green Street shall not exceed 9 ft. from finished grade on abutting property to the south. REASONS AND FINDINGS: 1. Article 932 (apartment standards) when drafted did not take into consideration security of an apartment complex which requires construction of a 6 ft. high fence or wall nor did the article take into consideration provisions requiring a 6 ft. high wall around a conventional subdivision where lots back up to a side on to an arterial highway. Therefore, to require that the developer comply with the provisions for only a 42 inch high wall and/or structure around the proposed complex would be overrestrictive and would not allow him a privilege granted other conventional subdivisions for security fences or walls for attenuation. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-45 (Cont. from 5/5/76) Applicant: McDonald's Corporation To permit the addition of a drive -through at an existing fast food, restaurant pursuant to Section 9430 of the Huntington Beach Ordinance Code located on the east side of Beach Boulevard, approximately 465 ft. north of Indianapolis Avenue in a C2, Com- munity Business District. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 76-14 (Cont. from 5/5/76) Applicant: McDonald's Corporation To permit an eighteen (18) parking space reduction in the required parking in lieu of Section 9793.1(b) of the Huntington Beach Ordinance Code located on the east side of Beach Boulevard, ap- proximately 465 ft. north of Indianapolis Avenue in a C2, Com- munity Business District. The Chairman informed the Board that Administrative Review No. 76-45 is a class I, categorical exemption, California Environmental Quality Act 1970; and Conditional Exception No. 76-14 is a categorical exemption, class V, California Environmental Quality Act, 1970. Messrs. Larry Reyes (McDonald's Corporation) and Charles Hall (McDonald's Operator) were present to represent the application. The Chairman opened the public hearing. Mr. Reyes presented the revised plot plan to the Board. The conditional exception application was addressed. It was noted that traffic flow would be severely hindered by this proposal. Mr. Reyes stated that by moving the island, sufficient room would be provided for steady traffic flow. He further suggested by moving the entrance on Beach Boulevard -to 40 ft. driveway would allow ease of entrance. He also proposed eliminating two parking stalls. It was Mr. Reyes' intention to increase his business, move the vehicles through the line and encourage customers to take product off the premises. Minutes: H.B. Board discussion followed. Secretary Palin stated that the revised plan did not eliminate concerns expressed by a previous meeting of the Board. He felt that too much congestion would be created by the drive -through facility. He felt that the proposal is too great to be accommodated on this size and configuration of property. It was _Mr. Palin's suggestion that the applicant pursue acquiring additional acreage to accommodate a drive -through proposal of this type. The Board concurred with Mr. Palin's concerns. ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO. 76- 14 WAS DENIED WITHOUT PREJUDICE FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL 1. Reduction of 18 of the required parking spaces for the facility with the desiqn and layout as submitted for the drive-thru onsite would be setting a precedent and allow a special privilege to this facility. 2. There is additional property available on this site that could be incorporated in the overall improvement plan to facilitate much better circulation between the northerly parking area and southerly parking to allow for a better integration of traffic for access of drive-thru window. 3. The proposed location of the drive-thru window has caused a reduction in the greatest number of parking spaces. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Administrative Review No. 76-45 was addressed and it was a consensus of the Board that due to the denial action on Conditional Exception No. 76-14, the Board had no alternative than to deny Administrative Review No. 76-45 without prejudice. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 76-45 WAS DENIED WITHOUT PREJUDICE FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: REASON FOR DENIAL: 1. The conditional exception application has been denied, therefore, the Board of Zoning Adjustments has no recourse but to deny Administrative Review No. 76-45 which would allow the applicant to appeal both applications concurrently. Board of Zoning Adjustments Wednesday, May 19, 1976 Page Eight AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-59 Applicant: Sid Lance Construction To permit the construction of four (4) 12,000 square foot industrial buildings pursuant to Section 9511 of the Huntington Beach Ordinance Code located on the north side of Business Drive, approximately 140 feet west of Graham -Street in a 100-M1-A-20,000, Restricted Manufacturing District. IN CONJUNCTION WITH: USE PERMIT NO. 76-26 Applicant: Sid Lance Construction To permit the construction of truck loading facilities facing a public street pursuant to Section 9518 of the Huntington Beach Ordinance Code located on the north side of Business Drive, approximately 140 feet west of Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. The Chairman informed the Board that Administrative Review No. 76-59 and Use Permit No. 76-26 were covered under Environmental Impact Report No. 73-16, adopted by the City Council on March 18, 1976. Messrs. Sid Lance and Webb Morrow were present to represent the applications. The Chairman opened the public hearing on Use Permit No. 76-26. Mr. Lance presented his proposal to the Board. He stated that with the use of the proposed truckwells, the entire center would be enhanced due to the truckwells being located inside the buildings. There being no further parties present to speak for or against the application, the public hearing was closed. Board discussion followed. Mr. Palin felt that four truckwells in a row on the same side of the street is overconcentration of truck wells. It was a consensus of the Board that by flipping building A on lot 9, side by side truckwell construction could be avoided. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-59 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: Minutes: H.B. The building (Building A) on Lot 9 shall be flipped to avoid side by side truck well construction. A plan delineating said modification shall be submitted to the Secretary of the Board. AYES: CROSBY, LIPPS NOES: PALIN ABSENT: NONE Secretary Palin stated his'reason for voting NO on Administrative Review No. 76-59 and Use Permit No. 76-26 as being: Four truckwells in a row on the same side of street is overconcentration of truck wells and would not carry out the confidence placed on Board by City in avoiding overconcentration of truckwells. He further stated that he voted NO without prejudice. TENTATIVE PARCEL MAP NO. 76-14 Applicant: Brent Enterprises To permit a two (2) lot division of land pursuant to Section 9930.1 of the Huntington Beach Ordinance Code located at the southeast corner of Beach Boulevard and Talbert Avenue in a C4, Highway Commer- cial District. The Chairman informed the Board that this application is a categorical exemption, class V, California_Environmental Quality Act, 1970. Mr. George Lightner was present to represent the application. Board reviewed plans and found plans -to be in conformance with Ordinance Code requirements. ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-14 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(s) FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on May 7, 1976 shall be the approved layout (with the amendments as noted thereon).. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Compliance with all applicable City Ordinances. 4. A copy of the recorded parcel map shall be filed with the Planning Department. Minutes: H.B. Williams To permit a two (2) lot division of land pursuant to Section 9930.1 of the Huntington Beach Ordinance Code located on the east side of Delaware Street, approximately 330 feet south of Adams Avenue in an R5, Office -Professional and R2-PD, Medium Density Planned Development Residential District. The Chairman informed the Board that the Environmental Review Board has granted Negative Declaration No. 75-52 on July 22, 1975. The applicant was not present. The Board reviewed the proposal. Secretary Palin noted that the applicant had a zone change on the subject property before the City Council, and was subsequently denied. Therefore, it was the consensus of the Board to continue this application for one week to allow applicant to be present at the meeting and to get a response from the applicant whether or not he wishes to pursue the Tentative Parcel Map application. ON MOTION BY CROSBY AND SECOND BY LIPPS, TENTATIVE PARCEL MAP NO. 76-17 WAS CONTINUED TO MAY 26, 1976 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-61 Applicant: John King To permit the'construction of a three (3) unit apartment building pursuant to Section 9231.6 of the Huntington Beach Ordinance Code located on the west side of 18th Street, approximately 50 feet south of Olive Avenue in an R4, High Density Residential District. The Chairman informed the Board that this application is a categorical exemption, Class III, California Environmental Quality Act, 1970. The applicant was not present. The Board noted some conflicts in the proposed plan and felt that a one week continuance would be appropriate for this application to allow the applicant to be present at the meeting and to allow staff to contact applicant pointing out discrepancies in his plans. The Chairman informed the Board that this application is covered by.Environmental Impact Report No. 73-16, adopted by the City Council on March 18, 1974. Mrs. Miller was present to represent the applicant. Board discussed application and found same to be within Ordinance Code requirements. ON MOTION BY CROSBY AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-62 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONnTTTONS OF APPROVAL! A.
