BOARD MEMBERS PRESENT: PALIN, CROSBY, LIPPS CITY STAFF PRESENT: MEL OTT, FIRE DEPARTMENT MINUTES: ON MOTION BY PALIN AND SECOND BY LIPPS, THE MINUTES OF THE REGULAR MEETINGS OF APRIL 28, 1976 AND MAY 5, 1976 WERE APPROVED AS TRANSCRIBED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: USE PERMIT NO. 76-15 (Cont. from 5/13/76) Applicant: W. Sterling Buck & Associates To permit the construction of a 10-unit apartment building pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code located on the west side of Main Street, approximately 470 feet north of Clay Avenue in an R3, Medium -High Density Residential District. The applicant was not present. The Chairman opened the public hearing. There being no parties present to speak for or against the application, the Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board to deny the application without prejudice due to the numerous times the application had been continued to allow the applicant to revise his plans to comply with Ordinance Code requirements. ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-15 WAS DENIED WITHOUT PREJUDICE FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. Application was filed on March 10, 1976 and has been continued numerous times to allow revisions of the plan to comply with requirements of the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-36 (Cont. from 4/28/76) Applicant: The Buccola Company To permit the construction of a 90,000 square foot shopping center pursuant to Section 9430.2 of the Huntington Beach Ordinance Code located on the southwest corner of Garfield Avenue and Beach Boulevard in a C2, Community Business District. The Secretary informed the Board that Negative Declaration No. 76-24 was granted by the Environmental Review Board on April 20, 1976. The Secretary presented a letter to the Board from the applicant requesting a continuance to allow him additional time to resolve the layout of the proposal. Board concurred with continuance. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 76-36 WAS CONTINUED TO JUNE 23, 1976 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-61 Applicant: John King To permit the construction of a three (3) unit apartment building pursuant to Section 9231.6 of the Huntington Beach Ordinance Code located on the west side of 18th Street, approximately 50 ft. south of Olive Avenue in an R4, High Density Residential District. The Secretary informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant was not present. The Board reviewed the proposed layout. Secretary Palin noted that the applicant had resolved the circulation and location of parking as well as the treatment of the door opening from the laundry area. Secretary Palin noted that the laundry door now will open in- wards, thus eliminating encroachment into the parking area. Required turning radius for access to garages was discussed. Board of Zoning Adjustments Wednesday, May 26, 1976 Page Three ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-61 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A; TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received May 26, 1976 shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout, Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Board of Zoning Adjustments. 3. In accordance with City's standards and requirements, an additional 2-1/2 feet of the right-of-way on the Alley shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assessment district. 7. All applicable fees shall be paid prior to issuance of building permits. Minutes: H.B. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. Applicant shall comply with required turning radius for access to garages at the time of issuance of building permits. Williams To permit a two (2) lot division of land pursuant to Section 9930.1 of the Huntington Beach Ordinance Code located on the east side of Delaware Street, approximately 330 feet south of Adams Avenue in an R5, Office -Professional and R2-PD, Medium Density Planned Development Residential District. The Secretary informed the Board that Negative Declaration No. 75-52 was granted by the Environmental Review Board on July 22, 1975. The applicant was not present. Secretary Palin informed the Board that he had contacted the applicant by telephone as to whether the applicant wished to pursue the tentative parcel map application due to the City Council's action on a zone change on this parcel. Mr. Palin then stated that the applicant had requested that his application be acted upon by the Board. Secretary Palin stated that the application was within ordinance code conformance. Board discussion followed. Vehicle access rights onto the property were discussed by the Board. ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 76-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 11 Minutes: H.B. The tentative parcel map received by the Planning Department on May 11, 1976 shall be the approved layout (with amendments as noted thereon). 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Delaware Street shall be dedicated to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed (if such systems exist within 200 feet of said parcels. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. A copy of the recorded parcel map shall be filed with the Planning Department. 10. Vehicle access rights to Delaware shall be approved by the Board of Zoning Adjustments as each site is developed. 11. At the time that a development plan is submitted for develop- ment of Parcel #2, access to the oil operation on Parcel #1 shall take access via reciprocal common access easements over Parcel #2 or a plan shall be submitted for review on access to subject oil operations on Parcel #1 from Delaware subject to approval by the Department of Public Works. To permit the construction of a ten (10) unit apartment building pursuant to Section 9202.3.1.3 of the Huntington Beach Ordinance Code located on the east side of Cameron Street, approximately 450 feet south of Slater Avenue in an R3, Medium -Density Residential District. IN CONJUNCTION WITH: CONDITIONAL EXCEPTION NO. 76-19 Applicant: Jansvu Properties, Inc. To permit a sixteen (16) foot high fence to be constructed along the rear and side property lines around a proposed tennis court in lieu of permitted 6 foot high fence per Section 9204 of the Huntington Beach Ordinance Code. Secretary Palin informed the Board that the environmental assessments of Use Permit No. 76-25 and Conditional Exception No. 76-19 ' (Negative Declaration No. 76-25) have not been completed at this time. Mr. Palin further stated that the Environmental Review Board has continued Negative Declaration No. 76-25 due to drainage problems existing on the proposed project. It was the Board's concurrence to continue the applications indefinitely until such time that environmental assessments have been completed. Simons To permit the elimination of an existing lot line between two (2) existing parcels creating one (1) parcel pursuant to Section 9930.1 of the Huntington Beach Ordinance Code located on the east side of Container Lane, approximately 257 feet north of Research Drive in an M1-A, Restricted Manufacturing District. ON MOTION BY PALIN AND SECOND BY LIPPS, TENTATIVE PARCEL MAP NO. 76-16 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on May 12, 1976 shall be the approved layout (with the amend- ments as noted thereon). 2. Darrell Rowe To permit a minor lot line adjustment pursuant to Section 9930.1 of the Huntington Beach Ordinance Code located on the south side of Ragtime Circle, approximately 55 ft. east of Sundancer Lane in an R-1, Low Density Residential District. The Secretary informed the Board that this application is covered under Environmental Impact Report No. 74-6, previously approved. Darrell Rowe was present to represent the application. Mr. Rowe submitted an information statement to the Board to be added to his application. Mr. Rowe stated that these lots still qualify as waterfront lots due to both lots complying with minimum 6,000 square feet R1 require- ment. Board discussion followed. Minutes: H.B. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on May 12, 1976 shall be the approved layout (with amendments as noted thereon). 2. Rule To permit the construction of a two (2) phase office complex of approxi- mately 4070 square feet in the C4, Highway Commercial District located on the south side of Warner Avenue, approximately 180 feet east of Bolsa Chica Avenue. The Secretary informed the Board that Negative Declaration No. 74-71 was adopted by the Board of Zoning Adjustments for this project on June 5, 1974. The applicant was not present. Secretary Palin stated that this project is in the area of influence of the Meadowlark Airport. Mr. Palin further stated that the City would like the input of the FAA to see whether the proposed project is within the FAA 77 Guidelines. Therefore Mr. Palin proposed a continuance for one week. Board concurred with continuance. ON MOTION BY CROSBY AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-58 WAS CONTINUED TO JUNE 2, 1976 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Minutes: H.B. Board of Zoning Adjustments Wednesday, May 26, 1976 Page Nine ADMINISTRATIVE REVIEW NO. 76-63 Applicant: John King To permit the construction of two (2) single-family dwellings pursuant to Section 9384.16 of the Huntington Beach Ordinance Code located at the northwest corner of 19th Street and Pecan Avenue in the Town - lot Specific Plan, Area One, Section A. The Secretary informed the Board that this application is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. The applicant was not present. The Board reviewed the proposed plan and found same to be within Ordinance Code conformance. A 3 ft. easement to provide better maintenance service on abutting properties for walls constructed at "0" setback was discussed by the Board. Elevations and aesthetics of the project were discussed by the Board. ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE REVIEW NO. 76-63 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. A 3 ft. easement shall be provided for maintenance purposes on abutting properties for walls constructed at "0" setback where not adjacent to the wall of the abutting property. This easement shall remain free and clear of any structures and shall not be planted with any plant material exceeding 3 ft. in height; the purpose of which is to allow free access for maintenance and painting purposes of this "0" construction. 2. No portion of any fireplace shall be constructed across the common property line between lots 1 and 3. 3. Special design on the three sides of the garage siding onto Pecan Avenue shall be constructed with a gable or mansard treatment similar to elevations on the dwelling for aesthetic purposes. To permit the construction of a 5,000 sq. ft. office building pursuant to Section 9401 of the Huntington Beach Ordinance Code located on the north side of Slater Avenue, approximately 400 ft. east of Beach Boulevard in an R-5, Office -Professional District. The Secretary informed the Board that Negative Declaration No. 74-56, covering this project, was granted by the Environmental Review Board on April 24, 1974. Dick Tom was present to represent the application. Board reviewed the proposal and found same to be within Ordinance Code conformance. Mr. Tom addressed the Board and stated that he had provided 69 parking spaces for the project; and that he had provided more landscaping than required by ordinance code. Mr. Tom further stated that he intends to pave the easement. Board discussion followed. Conditions of approval were discussed. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-65 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The revised conceptual plot plan and elevations received May 26, 1976, shall be the approved layout. C. GENERAL CONDITIONS: 1. The 10 ft. pedestrian easement shall be improved to City standards. 2. Simon & Jude Catholic Church To permit a "Fall Festival" to incorporate rides, games, and food booths, located on the church grounds at Indianapolis Avenue and Magnolia Street. Applicant was not present. The Board reviewed the special event permit and found same to be within Ordinance Code conformance. ON MOTION BY PALIN AND SECOND BY CROSBY, SPECIAL EVENT NO. 76-15 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received May 12, 1976 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. It was the consensus of the Board to continue this application for one week to allow for Police Department's evaluation of the request. Board of Zoning Adjustments Wednesday, May 26, 1976 Page Fourteen SPECIAL EVENT NO. 76-17 Applicant: Two Guys Department Store To permit a 5 day parking lot sale commencing May 27,.1976 and continuing through May 31, 1976, inclusive located at Two Guys Department Store, 9882 Adams Avenue, Huntington Beach, Calif. Mr. Douglas Craig was present to represent the application. Mr. Craig explained his plan to the Board stating that he intends to rope off the entire special event area with the exception of the entrance. Mr. Craig further stated that the event permits proper traffic circulation. Board discussion followed. ON MOTION BY PALIN AND SECOND BY LIPPS SPECIAL EVENT NO. 76-17 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received May 24, 1976 shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. An on -site inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department five (5) days prior to the event. 5. The area of the parking lot sale shall be,roped off with the exception of the front entrance. The applicant was not present. The Secretary presented the Oilfield Superintendent's recommendations to the Board. Mr. Palin gave a brief history of -the proposal stating - that a prior application had been filed on this oilwell for activation but was imposed stringent conditions of approval at that time. Mr. Palin further stated that due to several legal litigations, the applicant had filed a new application for the reactivation of oilwell "Hamilton #4." Board discussion ensued. Mr. Palin stated that the Oil Code is currently being rewritten and that the City Council had granted oil operations a one year delay for screening of landscaping and irrigation system to allow finalization of the new Oil Code. ON MOTION BY LIPPS AND SECOND BY CROSBY, OILWELL ACTIVATION PERMIT NO. 76-4 WAS APPROVED WITH THE FOLLOWING CONDITION, BY THE FOLLOWING VOTE: CONDITION OF APPROVAL: 1.
