None SCHEDULED ITEMS: ADMINISTRATIVE REVIEW 76-34 - APPEAL Applicant: M. Catherine Martin This is an Appeal to'a denial by the Board of Zoning Adjustments for a request to establish 24 hour care for non -related persons, in a residence located on the,east side of Tranquil Lane approxi- mately 350 feet south of Adams Avenue. Chairman Slates advised the Commission and members of the audience that he had a petition from residents in.the area expressing their objections to this use and requesting denial of the appeal. Planning Commission Tuesday, June 1, 1976 Page 2 Ms. Catherine Martin, applicant, addressed the Commission concerning the need of this type of facility in the community. She requested that if the appeal was denied that the Commission would allow her time to relocate the facility in another area in the City of Huntington Beach. Mr. Robert Green, Executive Director of Mental Health Association of Orange County, read a letter he had addressed to the City Council requesting that this use be allowed. Ms. Kathleen Phillips_, member of Mental Health Department of Orange County, spoke on the need for this type of 'facility. Linda Martin, a licensed evaluator, stated that Ms. Martin had met all requirements for a license. Mr. George Lang addressed the Commission concerning the need for a home environment for persons suffering emotional problems. John Villaneuva, Mike Woods, and Bob Machado, residents of the ar6a,,'" spoke in opposition to the care of the six girls'in the neighborhood. They expressed concern for the safety of their children and the general welfare of the nieghborhood. They cited lack of proper supervision as being evident with the owner not residing on the premises. Commission discussion ensued with the Commission agreeing that there is a need for a home environment for such persons. They also discussed the strong opposition expressed by those residing in the area. ON MOTION BY SHEA,AND SECOND BY PARKINSON APPEAL TO ADMINISTRATIVE REVIEW NO. 76-34 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1. The subject application does not fall within the intent of the provisions drafted by the City Council to provide a "home -living environment" for the care of non -related persons, pursuant to Section 9730.27 of the Huntington Beach Ordinance Code. 2. If there is a non-resident supervisor it would be more appropriately classified as a boarding home and should therefore come under the criteria for processing requirements for an unclassified use. Planning Commission Tuesday, June 1, 1976 Page 3 ON MOTION BY KERINS AND SECOND BY FINLEY THE STAFF WAS DIRECTED TO CONTACT THE TASK FORCE THAT IS WORKING WITH THE LEAGUE OF CALIFORNIA CITIES TO INSURE THAT THE CITY OF HUNTINGTON BEACH IS INVOLVED WITH WORKING OUT THE BEST METHOD OF HANDLING THE MENTAL CARE NEEDS FOR THE COMMUNITY BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Shea, Boyle, Kerins NOES: Slates ABSENT: Bazil SIGN PERMIT NO. 6727 - APPEAL TO DENIAL Applicant: Richard Lie, Treat Time Donuts This is an appeal to denial of a request to permit the placement of a 48 sq. ft. pole sign within a shopping center located on the west side of Goldenwest, approximately 380 feet south of Warner Avenue. Jim Palin stated that he had no information to add to that con- tained in the staff report. He presented a vugraph. The public hearing was opened. Richard Lies, Appellant, addressed the Commission. He stated that his business lacked proper exposure. He advised the Commission that a nearly competitor did have adequate signing and this jeopardized the business at the Treat Time Donut stand. He pre- sented pho4.ographs to the Commission which showed the existing sign. The public hearing was closed. Commission discussion ensued concerning the proposed sign: A MOTION WAS MADE BY KERINS AND SECONDED BY BOYLE TO SUSTAIN THE BOARD OF ZONING ADJUSTMENTS IN ITS DENIAL OF SIGN PERMIT NO. 6727 AND DENY THE APPEAL. VOTE: AYES: Finley, NOES: Slates, ABSENT: Bazil THE MOTION FAILED Boyle, Kerins Shea, Parkinson Further discussion ensued on a different sign plan which would accommodate other signs if required in the future. ON MOTION BY SLATES AND SECOND BY SHEA APPEAL TO DENIAL OF SIGN PERMIT NO. 6727 WAS APPROVED ON THE CONDITION THAT THE APPELLANT SUBMIT A REVISED PLAN TO PLANNING DEPARTMENT FOR APPROVAL BY THE FOLLOWING VOTE: -3- 6/1/76 - PC Minutes: H.B. Planning Commission Tuesday, June 1, 1976 Page 4 AYES: Parkinson, Finley, Slates, Shea, Boyle,,Kerins NOES: None ABSENT: Bazil CONDITIONAL USE PERMIT NO. 76-11 Applicant: Edwin C. Ross Conditional Use Permit No.' 76-11 is a request to permit an 1800 square foot addition to an existing office building and the con- struction of a two story classroom structure, all to be part of an existing church complex. The request also proposes to provide 139 additional parking spaces in order to accommodate the proposed changes. The property is located on the west side of Main Street, south of Adams, at 1207 Main Street. John Cope addressed the Commission and advised them that the Environmental Review Board had approved -Negative Declaration 76-43. The Chairman opened the public hearing. Ed Ross addressed the Commission and discussed the proposed addition. There was a discussion on curb cuts, location of trash cans, and setbacks. Commissioner Kerins stated that he would like to see an architectural rendering. ON MOTION BY SHEA AND SECOND BY BOYLE CONDITIONAL USE PERMIT NO. 76-11 WAS CONTINUED TO JUNE 15, 1976, BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Slates, Shea, Boyle, Kerins NOES.: None ABSENT: Bazil PRECISE PLAN OF STREET ALIGNMENT NO. 76-1A AND B Precise Plan 76-1"A" is a proposal to abandon that portion of Seventeenth Street between Clay Avenue and Delaware Street. Precise Plan 76-1"B" is a'proposal to close to through traffic that portion of Seventeenth Street at the intersection of Mansion Avenue. Al Mantes presented vugraphs and'discussed the proposed precise plan of street alignments. Gordon Offstein suggested that a temporary barrier be installed at 17th & Mansion rather than permanent closure. Sandra Oldfield addressed the Commission and stated that she felt a serious study should be made of traffic flow coming up 17th from the ocean area. -4- 6/1/76 - PC Minutes: H.B. It was the consensus of the Com- mission to table the Precise Plan of Street Alignment and further discuss it concurrently with other proposed street changes con- sistent with the General Plan. ON MOTION BY BOYLE AND SECOND BY PARKINSON PRECISE PLAN OF STREET ALIGNMENT 76-1 A AND B WERE TABLE INDEFINITELY BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: Bazil PRECISE PLAN OF STREET ALIGNMENT NO. 75-8 This is a request to provide for a local public street south of Yorktown Avenue midway between Huntington and Delaware Streets for a distance of approximately 500 feet south therefrom and then for said alignment to be at a right angle for access out to Huntington Street a distance of approximately 330 feet. John Cope addressed the Commission and stated that this plan was tabled a year ago pending the Commission's concerns on how it would relate to the terrain and existing residential areas. The public hearing was opened. Gordon Offstein addressed the Commission in opposition to the Precise Plan, citing the water which stands year around in the area. The public hearing was closed. Commission discussion ensued. ON MOTION BY SHEA AND SECOND BY PARKINSON PRECISE PLAN OF STREET ALIGNMENT NO. 75-8 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Slates, Shea, Boyle NOES: Kerins ABSENT: Bazil ON MOTION BY BOYLE AND SECOND BY PARKINSON A RESOLUTION OF THE . CITY PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, RECOMMENDING APPROVAL OF PRECISE PLAN ALIGNMENT NO. 75-8 TO PROVIDE FOR A LOCAL STREET SOUTH OF YORKTOWN AVENUE MIDWAY BETWEEN HUNTINGTON AND DELAWARE STREETS FOR ACCESS FROM YORKTOWN TO HUNTINGTON STREET WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson, Finley, Slates, Shea, Boyle NOES: Kerins ABSENT: Bazil -5- 6/1/76 - PC Minutes: H.B. Planning Commission Tuesday, June 1, 1976 Page 6 TENTATIVE TRACT NO. 8694 Applicant: Huntington Beach Industrial Park Tentative Tract Map No. 8694 filed on April 15, 1976, is a request to allow approximately 60 acres of property to be subdivided into a six lot industrial subdivision. This revised map now reflects the re- maining portion of the property bounded by McFadden Avenue, Graham Street, Bolsa Avenue, and Springdale Street which has not been re- corded by the parcel map process. Jim Palin addressed the Commission and discussed the conditions of approval. Commission discussion ensued. ON MOTION BY PARKINSON AND SECOND BY SHEA TENTATIVE TRACT NO. 8694 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. The map received and dated May 25, 1976 shall be the approved layout: 2. The sewer, water and fire hydrant system shall be designed to City standards. 3. The water system shall be through the City of Huntington Beach's water system. 4. The sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The property shall be subject to local drainage assessment district requirements and fees. 6. Drainage for the subdivision shall be approved by the Department of Public Works prior to the recordation of a parcel or parcel maps. This system shall be designed to provide for siltation and erosion control both during and after construction of the projects. 7. All utilities shall be installed underground. 8. Fire safety system shall be installed by the developer as required by the Fire Department. 9. "A "B", "C", "D", "E", McFadden Avenue and Springdale Street shall be dedicated to the City. -6- 6/1/76 - PC Minutes: H.B. Planning Commission Tuesday, June 1, 1976 Page 7 10. "A", "B", "C", "D", and "E" Streets shall be constructed having a five foot easement on both sides of such street for utilities and future walkways if needed. 11. McFadden Avenue shall be constructed having an 80 ft. street section with no sidewalks on the north side at the time of initial construction. 12. Springdale Street shall be constructed to City standards. 13. All areas within the standard street section of arterial high- ways which have been reserved for future walk purposes shall be flat and planted with a turf grass to accommodate pedestrian circulation. 14. On -street parking shall be prohibited on arterial highways within the park, and they shall be posted with "No Parking" signs. 15. Signs identifying the industrial park shall be subject to approval of the Planning Department. 16. A conceptual landscaping plan shall be submitted to the Planning Department for approval prior to issuance of any building per- mits on any parcel within the industrial park. 17. Vehicular access to any parcel from arterial highways shall be reviewed and approved by the Department of Public Works and Plan- ning Department prior to recordation of any parcel map or maps. This review is to minimize the number of access points through the use of common driveways. 18. Soils and compaction reports shall be submitted to the Depart- ment of Building and Community Development and Department of Public Works prior to the issuance of building permits. :Such report shall be submitted by a qualified soils engineer. AYES: Parkinson, Finley, Slates, Shea, Boyle, Kerins NOES: None ABSENT: Bazil CODE AMENDMENT NO. 76-4 REVISED ENVIRONMENTAL GUIDELINE AND CODE AMENDMENT NO. 76-5 PROVISIONS FOR ARCHAEOLOGICAL SITE PROTECTION Mel Tooker addressed the Commission and discussed the two code amendments. To reduce the turning radius requirement for access into 90 degree parking stall from 27 ft. to 25 ft. within industrial district, and 2. To require a Tlse Permit for all residential developments along arterial street in the R2, R3 and R4 districts to enable review by a discretionary body, and 3. To renumber the Ordinance Code provisions pertaining to the Townlot Specific Plan Area One from 938 to 935 to eliminate conflicting provision, and 4. Delete Section 9514.5 a redundance on the landscaped buffer require- ment and add a provision to Section 9513.1 which will allow the front and exterior side yard setbacks (on major, primary, or secondary highways) to be used for parking and accessways, however, a minimum of 50 percent of the required setback shall be landscaped, and 5. Addition of provisions to regulate the building bulk in the Medium - High Density Planned Residential Development. Commission discussion ensued. A growth management program should not be instituted at this time. 2. The policies of the Revised Growth Policy Phase I Guidelines should be integrated into the Open Space and Conservation' Element and the Land Use Element. 3.' Capital improvements programming should be given consideration for integration into the Land Use Element.
