ADMINISTRATIVE REVIEW NO. 76-58
Applicant: Richard R. Rule
To permit the construction of a two (2) phase office complex of
approximately 4070 square feet in the C4, Highway Commercial
District located on the south side of Warner Avenue, approximately
180 feet east of Bolsa Chica Avenue.
Mr. Richard Rule, the applicant was present.
The Secretary informed.the Board that the Environmental Review
Board granted Negative'Declaration No. 74-71 on June 5, 1974.

Secretary Palin stated that the Planning Department had received
a letter from the Airport Land Use Commission. The Commission
expressed their concern as to the height of the proposed building,
and further stated that the Commission does not desire a height
exceeding 25 ft. Mr. Rule stated that he eventually plans to
have two-story buildings, but for the present is proposing single
story buildings only.
A letter from the Department of Public Works was discussed with
the applicant regarding street improvements for the subject property.
These improvements include: City will install, at City's expense,
curb and gutter with a depressed curb for future driveway, pavement,
street light, and prepare all the necessary street improvement plans.
The City will also, at applicant's expense, install the water lateral
and sewer line and lateral.

The agreement further stated that at the time of development
the applicant will be required, at applicant's expense, to
,install sidewalk and driveway approach and pay the necessary
drainage and water fees.
Conditions of approval were discussed.
ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW
NO. 76-58 WAS APPROVED WITH THE FOLLOWING CONDITIONS;- BY THE

In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:

2. The following plans shall be submitted to the Secretary of

3.. Soil'and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall
be subject.to approval by that Department.
4. Fire protection systems, including automatic sprinkler syste
standpipe systems, fire hydrants, fire alarm systems, and any
other -required fire protection and detection devices or systems
shall comply with the specifications of.the Huntington Beach
Fire Code: -Plans for.such systems and devices shall be.sub-
mitted to'the Fire Department'and'shall be subject to approval
'by the'Departments Of Fire and Public Works.

5. The developer shall participate in the local drainage assessment
district.
6. The developer shall participate in the Orange County Sanitation
District #11 Sewer Annex District.
7. All applicable fees shall be paid prior to issuance of building

B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Warner Avenue shall be improved pursuant to agreement
with, and to the approval of the Department of Public -Works.

District.
IN CONJUNCTION WITH:
USE PERMIT NO. 76-27
Applicant: Red Lobster Inns of America, Inc.
To permit the construction of a 7,000 square foot restaurant building
pursuant to Section 9472 of the Huntington Beach Ordinance Code
located at the northwest corner of Damask Drive and Beach Boulevard
in a C4, Highway Commercial District.
Mr. James Brooks, representing Red Lobster Inns of America, Inc. and
Mr. Lem Kneedler, Thompsen Engineering, were present.
Secretary Palin informed the Board that Negative Declaration No.
76-41 was granted by the Environmental Review Board on June 1, 1976.
The Chairman opened the public hearing on Use'Permit No. 76-27.

Mr. Palin noted an inefficiency of parking circulation in the
proposed plan. He stated with a modification to the plan, the
parking and circulation could be greatly improved.
Mr. Brooks stated that the parking layout was alike in all Red
Lobster Inns throughout the Country. Mr. Brooks further stated
that the restaurant layout itself was also similar to other Red
Lobster Inns already in existence.
The possible moving of the proposed structure for better identifi-
cation was discussed. Reciprocal easements were discussed. It
was noted that there has been no proposal submitted for the abutting
vacant property at this time; therefore, it was difficult to determine
whether a reciprocal agreement would be congenial with the future
use of the abutting property.
Mr. Brooks stated that the applicant was under strict time constraints
for the project.
There being no further parties present to speak for or against the
proposal, the Chairman closed the public hearing.
The tentative parcel map was addressed. It was noted that the
applicant had reviewed the suggested conditions of approval prior
to this Board meeting for the proposed tentative parcel map.
Conditions of approval were discussed by the Board.

8. The flood control channel shall be fenced to Flood Control
District standards and City standards at the time said parcels
are developed.

modification described herein:
a. Applicant shall reanalyze parking efficiency. If
applicant desires to increase parking, a revised plot
plan shall be submitted to the Board of Zoning Adjustments
for review and approval action at a•future date.
A'plan delineating said modification shall be submitted to
the Secretary of the Board. If such plan complies with the
modification outlined by the,Board, said plan shall be
approved and made a permanent part of the administrative file.

improved to the center line of such right-of-way. Said
improvement shall include curbs, gutters', sidewalks, paving,
street trees, street lights, street signs, street drainage,
and sewer and water main extensions, in full compliance with
the City of Huntington Beach street"standards and requirements.

1. Driveway on Beach Boulevard shall be revised to reflect
35 ft. driveway radius type pursuant to Department of
Public Works standards.

170 ft. east of Florida Street in an R5 Office Professional District.
IN CONJUNCTION WITH:
USE PERMIT NO. 76-29
Applicant: D'Ambra, Inc.
To permit the establishment of an office -professional use in an
existing building with a non -conforming side yard setback (4 ft. in
lieu of 5 ft.) pursuant to Section 9718 of the Huntington Beach
Ordinance Code located on the south side of Main Street, approximately
170 ft. east of Florida Street in an R5 Office Professional District.
IN CONJUNCTION WITH:
ADMINISTRATIVE REVIEW NO. 76-66
Applicant: D'Ambra, Inc.
To permit the establishment of an Office -Professional business in
an existing single family dwelling pursuant to Section 9401 of the
Huntington Beach Ordinance Code located on the south side of Main
Street, approximately 170 ft. east of Florida Street in an R5,
Office Professional District.
The Secretary informed the Board that Conditional Exception No. 76-22
is a categorical exemption, class 5, California Environmental Quality
Act, 1970; Use Permit No. 76-29 is covered by Negative Declaration
No. 74-52, granted by the Environmental Review Board on July 19, 1974;
and Administrative Review No. 76-66 is a categorical exemption,
class 1, California Environmental Quality Act, 1970.

The Chairman opened the public hearing on Conditional Exception
No. 76-22 and Use Permit No. 76-29.
The applicant explained his proposal as converting an older structure
(approximately 30 years old) into office use.
The Board reviewed the proposed plan and it was a consensus of
the Board that the 12 ft. driveway would not accommodate the
proposal. It was further noted that approval of the proposal
would be setting a trend for small lots in the vicinity and would
therefore have to allow similar type of construction on similar
size parcels. It was further the consensus of the Board that
the design could be modified to present a more desirable layout.
Parking alternatives were discussed with the applicant and his
representative.
There being no further parties present to speak for or against the
applications, the Chairman closed the public hearing.

ON MOTION BY PALIN AND SECOND BY CROSBY, CONDITIONAL EXCEPTION NO.
76-22 WAS DENIED FOR THE FOLLOWING REASON BY THE FOLLOWING VOTE:
REASONS FOR DENIAL:
1. The applicant has not demonstrated sufficient hardship to
allow the use of a 12 ft. driveway along side of an existing
facility for access of parking per the required parking in
the rear of the structure. Approval action would set a
dangerous precedent and through the use of an alternate
design and layout of the lot, a facility could be constructed
to provide the necessary 20 ft. driveway through the use
of a drive-thru or drive -under for access to necessary
parking for a facility of this size.

Mr. Bob Coles was present to represent the application.
The Secretary informed the Board that this application is covered
by Negative Declaration No. 74-102, granted by the Environmental
Review Board on July 17, 1974.
Mr. Palin presented a history of the proposed site, stating that
the division of land filed previously was withdrawn and no
subsequent action was taken to create the 32 ft. parcel which
the applicant now wishes to incorporate into the site plan.
Mr. Coles requested'a continuance on this application to allow
him time to have the proposed property surveyed. Board concurred
with continuance. -

SIGNS:
Applicant: Budget Dynotune

The Board reviewed a sign proposal for Budget Dynotune informally.
The signing is to be located on a portion of the existing service
station (Exxon)at the southwest corner of Garfield and Brookhurst.
Mr. D. L. Woodward of Dynotune and Mr. Roger Knight were present.
Various proposals for location and type of sign were discussed.
It was the consensus of the Board to review the new Sign Code
to allow the Board to make a proper analysis of the proposed
signing.
