CONDITIONAL USE PERMIT NO. 76-10
Applicant: T. Nakase
This is a request to permit the continued operation of an existing
wholesale nursery operation located within the Edison right-of-way
east and west of Bushard, north of Yorktown.
John Cope stated that he had no additional information to add to
that contained in the staff report. He advised the Commission
that no letters of opposition to the use had been received.
Mr. Cope further stated that a letter had been received by the
Planning Department which contained the names of seven adjacent
homeowners who stated they favored continuing the operation of the
nursery.

There was a discussion on reducing the width of the bike lane.
Mr. Lloyd Budwig stated that he would not want the bike lane shortened.
He discussed the parking problem in front of his home which would
occur.
Mr. Gellardo spoke in favor of continuing the use as a nursery.
The public hearing was closed.
Commission discussion ensued.
ON MOTION BY PARKINSON AND SECOND BY BAZIL CONDITIONAL USE PERMIT
NO. 76-10 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOW-
ING VOTE:
1. The site plan dated May 6, 1976 shall be the approved layout.
2. All vehicles operating within the nursery shall not exceed a
speed of 10 miles per hour.
3. The taller and larger plant material shall only be stored away
from the residential properties to the south. Lower growing
trees and shrubs shall only be permitted adjacent to these resi-
dential properties, and this plant material shall be no higher
than one foot lower than the top portion of the wall which they abut.
4. All soil amendments or planting mix materials shall be kept damp
to minimize the possibility of such material blowing onto adjacent
properties.
5. Spraying of plant materials shall be done from the property
line onto the premises of the site or inwardly away from the
residential properties.
FINDINGS:
1. The proposed site is adequate to serve the proposed use.
2. The proposed use has resulted in positive environmental effects,
including weed and rodent control and an improvement in the
visual aesthetics of the site.
3. The proposed use is compatible with the surrounding uses.

CONDITIONAL USE PERMIT NO. 76-12
Applicant: George Brown
Conditional Use Permit No. 76-12 is a request to permit the establish-
ment of a recreational athletic club consisting of 28 racquetball/
handball courts, sauna and steam baths, Jacuzzi, a complete gym and
health spa, and a pro shop. The facilities will be open to the
general public. The property is located on the northwest corner
of Garfield Avenue and Delaware Street.
A vugraph was shown. John Cope stated that he had no information
to add to that contained in the staff report.
The public hearing was opened.
Mr. Ray Johnson, architect, addressed the Commission and stated that
he had read the conditions of approval and felt that the applicant
could comply with them. He displayed an architectural rendering
of the project.
A resident of 8212 Bryant Drive spoke in opposition to the use,
citing traffic problems as a major reason.
Commissioner Kerins arrived at 7:15 P.M.
The public hearing was closed.
Commission discussion ensued on the many past problems the City
had experienced with this building.
It was the consensus of the Commission that the proposed use
and upgrading of the building would improve the area.
ON MOTION BY BAZIL AND SECOND BY FINLEY CONDITIONAL USE PERMIT
NO. 76-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING
VOTE:
1. The site plan dated May 20, 1976 shall be the approved layout.
2. Prior to the issuance of building permits, building elevations
indicating colors and materials shall be submitted to the Planning
Department for review and approval.
3. Prior to the issuance of building permits, a landscape plan shall
be submitted to the Department of Building and Community Develop-
ment for review and approval.
4. The hours of operation shall be limited from 6:00 a.m. to midnight.

FINDINGS:
1. The proposed plan substantially complies with the applicable
ordinance code requirements.
2. The proposed design and layout will provide for a compatible land
use with existing commercial uses and adjacent residential uses.

Applicant: Kaiser -Aetna
This is a request for 19 lots on 82.4 acres of land located on the
southeast corner of Bolsa and Bolsa Chica. The application was
continued from the June 1, 1976 meeting to allow the staff time to
resolve vehicular access to the parcels abutting the arterial highways.
A vugraph was shown.
Commission discussion ensued on the suggested conditions of approval.
ON MOTION BY PARKINSON AND SECOND BY BAZIL TENTATIVE TRACT NO. 8688X
WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:
1. The map received and dated June 14, 1976, shall be the approved
layout.
2. The sewer, water and fire hydrant system shall be designed to City
standards.
3. The water system shall be,through the City of Huntington Beach's
water system.
4. The sewage disposal shall be through the City of Huntington Beach's
sewage system.
5. The property shall be subject to a local drainage assessment district
requirements and fees.
6. Drainage for the subdivision shall be approved by the department
of Public Works prior to recordation of a parcel or parcel maps.
This system shall be designed to provide for siltation and erosion
control both during and after construction of the project.

7. All utilities shall be installed underground.
B. Fire safety system shall be installed by the developer as required
by the Fire Department.
9. Bolsa Avenue, Bolsa Chica and Graham Streets shall be dedicated
to the City prior to recordation of a parcel map or maps.
10. Full street improvement shall be constructed on each of the streets
prior to the recordation of a parcel map or maps on the property
that abuts that street.
11. Graham Street shall be constructed at the existing 84 ft.
right-of-way, having no sidewalk on the west side of the street
section..
12. Bolsa Avenue shall be constructed having a standard street
section of 120 ft. The street section on Bolsa between Graham
° Street and Bolsa Chica Street shall be constructed having no
sidewalk at the time of initial construction.
13. At the time of initial construction, Bolsa Chica Street shall
be constructed having standard 120 ft. street section with no
sidewalks on the east side of such right-of-way.
14. All areas within the standard street section which have been
reserved for future walkway purposes shall be flat and planted
with a turf grass to accommodate pedestrian circulation.
15. On -street parking shall be prohibited and all streets within the
industrial park shall be posted with "No Parking" signs.
16. Signs identifying the industrial park shall be subject to the
approval of the Planning Department.
17. The irrigation system and plant material for the raised median
within Bolsa Avenue, between Bolsa Chica Street and Graham
Street shall be provided by the developer prior to recordation
of a parcel map or maps.
18. A conceptual landscaping plan shall be submitted to the Planning
Department for approval prior to issuance of any building per-
mits on any parcel within the industrial park.
19. Vehicular access rights to any parcel from arterial highways
shall be as follows:
A. One common driveway to be located on the common property
line between lots 13 and 14.
B. One driveway access point on the southerly half of lot 1
for vehicular access from Bolsa Chica Street.

C. One common driveway to be located upon the common property
line of each lot fronting onto Bolsa Avenue for vehicular
access.
D. Future driveways to be reviewed and approved by the Depart-
ment of Public Works and Planning Department at the time
an application has been filed for development on each of
the parcels.
20. Soils and compaction reports shall be submitted to the Depart-
ment of Building and Community Development and Department of
Public Works prior to the issuance of building permits. Such
reports shall be submitted by a qualified soils engineer.

TENTATIVE TRACT NO. 9388
Subdivider: Leonard 0. Lindborg
Tentative Tract Map 9388 filed on May 6, 1976 is a request to subdivide
approximately 1.8 acres of land into 7 medium density residential lots.
Subject property is located on the east side of Lake Street, west of
the railroad tracks and between Acacia and Palm Avenues.
A vugraph was shown.
Secretary Harlow discussed the planting and removal of trees.
The Commission discussed the type of trees and it was noted that this
would be coordinated between appropriate departments and Planning
Staff.
ON MOTION BY FINLEY AND SECOND BY PARKINSON TENTATIVE TRACT NO. 9388
WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed subdivision of this 1.8+ acre parcel of land zoned
R2, which allows 15 units per gross acre, is proposed to be
constructed having only 12.7 units per gross acre.
2. The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for implementation
for this type of housing.
3. The property was previously studied for this intensity of land
use at the time the land use designation for medium density
residential was placed on subject property.

4. The lot size, depth, frontage, street widths, and all other
design improvements features of the proposed subdivision are
proposed to be constructed in compliance with standard plans
and specifications on file with the City, as well as in compliance
with the State Map Act and supplementary City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
1. The tentative map received and dated June 8, 1976, shall be the
approved layout.
2. The sewer, water, and fire hydrant system shall be designed to
City standards.
3. The water system shall be through the City of Huntington Beach's
water system.
4. The sewage disposal shall be through the City of Huntington
Beach's sewage system.
5. The property shall be subject to local drainage assessment
requirements and fees.
6. Drainage for the subdivision shall be approved by the Depart-
ment of Public Works prior to the recordation of a final map.
This system shall be designed to provide for siltation and
erosion control both during and after construction of the
project.
7. An additional 16 feet of right-of-way on Lake Street shall be
dedicated to the City of Huntington Beach. (Total R/W 106')
8. Vehicular access rights along Lake Street except at street
intersections shall be dedicated to the City of Huntington
Beach.
9. All utilities shall be installed underground.
10. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If no air conditioning is to
be provided, the insulation in ceilings and exterior walls
shall be a minimum of R-13 and R-7, respectively.
11. All building spoils, such as unusable lumber, wire, pipe, and
other surplus and unusable materials, shall be disposed of at
an offsite facility equipped to handle them.
12. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers. Natural gas shall be stubbed in
• at the location of surface units for cooking facilities and
water heaters and central heating units.

13. The structures on subject property whether attached or detached
shall be constructed in compliance with the State Acoustical
Standards set forth for all units that lie within the 60 CNEL
contours of the property.
14. In addition to those trees required by the Huntington Beach
Ordinance Code, the developer shall be required to plant a
minimum of two on -site trees per lot. The size of such on -site
trees shall be a minimum of 24 inch box specimens, and shall
be subject to approval by the Planning Department and Department
of Public Works.
15. The developer shall deposit a cash bond in the form and
amount as required by the Department of Public Works to
insure improvement of the Lake Street right-of-way. These
improvements shall include curbs, gutters, sidewalks, street
lights, tree removal, and reconstruction of the existing
half street section as required by the Department of Public
Works.

TENTATIVE TRACT NO. 9378
Subdivider: Foxx Development Corporation
Tentative Tract Map 9378 filed on April 28, 1976 is a request to sub-
divide approximately 2.5 acre parcel of land into'a five lot Medium -
Density Subdivision.
The subject property is located at the northwest corner of Garfield
Avenue and Delaware Street.
Chairman Slates stated that he would have to abstain on this appli-
cation as he represented both the buyer and seller. He then turned
the meeting over to Vice Chairman Finley.
Bob Jarrard, representing the applicant, stated that he had read the
conditions of approval suggested by the staff and had no opposition
to them.
Commission discussion ensued.
ON MOTION BY PARKINSON AND SECOND BY BAZIL TENTATIVE TRACT NO. 9378
WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE:
1. The tentative map received and dated June 9, 1976 shall be the
approved layout for a five lot subdivision only. .

7. The design and configuration of the retention basin on lot no. 5
shall be approved by the Department of Public Works prior to the
recordation of a final map. This retention basin shall remain
unaltered after construction and the capacity of the area shall
be predicated upon a water surface of 51-1/2 ft.
8. The retention basin to be constructed by the developer on lot
no. 5 shall be graded in such a manner that it will retain a
minimum one and one-half (1.5) acre ft. of water and that the
basin shall contain a low point at its southwesterly corner
located in lot 5. In addition, appropriate rip -rap shall be
placed at the low point in order to permit maintenance forces
ingress and egress for pumping water using their portable pumps.
A paved access shall be constructed to permit the pumping unit
ingress and egress to the rip -rap area.
9. The drainage basin covering lot 5 shall be fenced with barbed
wire to a design approved by the Public Works Department.
10. Developer shall be responsible for weed control and maintenance
within the fenced drainage basin area.
11. The offer of dedication of the streets to the west of the west
line of Alley "A" shall be offered in the owner's certificate
but rejected in the City Clerk's certificate to allow the City
to acquire these streets at a future date.
12. Construct 8 inch water main in Delaware Street.
13. Install two (2) fire hydrants (1 on Garfield and 1 on Delaware).
14. The developer shall participate in the Orange County Sanitation
District No. 3 Sewer Annex District.
15. Vehicular access rights along Delaware and Garfield -Avenue shall
be dedicated to the City of Huntington Beach.

16. All utilities shall be installed underground.
17. All buildings on lots abutting City easements shall set back five
(5) feet from the edge of such easement.
18. If the developer proposes to provide air conditioning, the

is to be provided, the insulation in ceilings and exterior walls
shall be a minimum of R-13 and R-7, respectively.

Ordinance Code, the developer shall be required to plant a minimum
of one on -site tree per each tree removed. The size of these on -
site trees shall be a minimum of 24 inch box specimens.
23. A decorative masonry wall shall be constructed to City specifi-
cations along lots 1 and 3 which side onto the arterial highway.
Said wall shall be six inches wide and six feet high. The height
of said wall shall be measured from whichever side is higher at
finished grade. The architectural design of said wall shall be
approved by the Planning Department. The structural design shall
be approved by the Department of Public Works and shall be in-
cluded as a part of the street improvement plans.
24. A landscape planter shall be provided at the intersection of
Garfield Avenue and Delaware Street and at the intersection of
A Street with Delaware Street. Such planter shall conform to
the plans and specifications on file in the Department of Public
Works and to the requirements of the Planning Commission. It
is the developer's responsibility to landscape such planters and
provide irrigation facilities in conformance with the Department
of Public Works specifications and requirements.
25. A fire alarm system, conduit and appurtenances shall be installed
by the developer at locations and to specifications provided by
the Fire Department.
26. The exterior elevations on buildings 1 and 3 shall be subject to
approval by the Planning Department.

The intent of this requirement is to improve the street scene by
having the developer provide architectural features and variation
in building materials on exterior faces of buildings that are
viewed from an arterial highway.
FINDINGS:
The Planning Commission of the City of Huntington Beach does hereby
find that the proposed subdivision, along with its design improve-
ments is consistent with General and Specific Plans for the area
in that:
1. The proposed subdivision of this 2.5+ acre parcel of land
zoned R2, which allows 15 units per gross acre, is proposed
to be constructed having only 12.8 units per gross acre.
2. The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for implementation
for this type of housing.
3. The property was previously studied for this intensity of land
use at the time the land use designation for medium density
residential was placed on subject property.
4. The lot size, depth, frontage, street widths, and all other
design improvements features of the proposed subdivision are
proposed to be constructed in compliance with standard plans
and specifications on file with the City, as well as in compliance
