The Chairman informed the Board that this request is covered by a previous Negative Declaration, No. 74-102, granted by the Envir- onmental Review Board on July 17, 1974. Marvin Olson was present at the meeting. Secretary Palin informed the Board that a revised plan has been submitted which locates the addition on the southerly portion of the existing building, retaining the drive on the north and pro- posing a one-way drive to the south. The Fire Department has reviewed,and these drive widths are satisfactory for access for emergency equipment. The plot plan and elevations received on June 11, 1976, shall be the approved layout, subject to the following: This approval is contingent upon favorable Board of Zoning Adjustments' action on Tentative Parcel Map No. 76-24, filed to implement construction of the above addition. This application is covered by previous Negative Declaration No. 74-102, granted by the Environmental Review Board on July 17, 1974. Marvin Olson was present at the meeting. The applicant indicated that he had not received the suggested condi- tions of approval as required by State law; it was therefore necessary to continue this item to permit time to submit said conditions to the developer. Board of Zoning Adjustments June 16, 1976 Page 3 ON MOTION BY CROSBY AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 76-24 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE MEETING OF JUNE 23, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-70 Applicant: Huntington Beach Industrial Park To permit the construction of a 48,100 square foot industrial building on a 3.35+ acre parcel of industrial property pursuant to provisions of the Huntington Beach Ordinance Code, located on the northwest corner of Springdale Street and McFadden Avenue in the M1-A Industrial District. This application was covered by Environmental Impact Report No. 73-16, previously adopted by the City Council on March 18, 1974. Dave Ariss was present at the meeting and submitted a revised layout of the project. This revised layout reflects the 52 foot radius at the intersection of McFadden and Springdale, as well as revised access to the parking from Springdale Street. The Board also discussed parkway layouts and the installation of the meandering bike lane, a portion of which will be within the 18-foot setback on private property. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-70 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received June 16, 1976, shall be the approved layout. The following plans shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devi shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district. 6. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Street improvements shall be installed from back of curb, to include sidewalks, street trees, street signs, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The required bicycle lane along Springdale Street shall be subject to approval of the Department of Public Works for placement and width. This application was covered by Environmental Impact Report No. 73-16, previously adopted by the City Council on March 18, 1974. Dave Ariss was present at the meeting. The Board reviewed the parcel map, which has been amended to reflect the revised radius at the intersection of McFadden and Springdale. ON MOTION BY PALIN AND SECOND BY SPENCER -REVISED TENTATIVE PARCEL MAP NO. 76-12 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The revised Tentative Parcel Map received and dated June 16, 1976, (reflecting the 52 foot radius) shall be the approved layout. 2. All other Amended Conditions of Approval imposed on this parcel map on -April 28,-1976, shall --apply. McGaffey -To-permit--the-construction--of an enclosed patio encroaching five (5) feet into the required rear yard and one foot six inches (1'6") into the required exterior side yard, in lieu of Sections 9103.2 and 9103.3 of the Huntington Beach Ordinance Code, located at the southeast corner of Sunridge Drive and Crestview Lane in an R-1, Low Density Residential District. Board of Zoning Adjustments June 16, 1976 Page 6 The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Stanley McGaffey was -present at the meeting and addressed the Board to explain his reasons for requesting the conditional exception. There being no other persons to speak for or against the proposed project, the public hearing was closed. The Board reviewed the location of the presently existing patio on the site, considering the degree of encroachment, the history of the construction, and alternatives that might bring the structure into closer compliance with code. It was determined that the Department of Building and Community shall analyze the proposed structure and recommend modifications to that end. ON MOTION BY PALIN AND SECOND BY SPENCER CONDITIONAL EXCEPTION 11O. 76-23 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE REGULAR MEETING OF JUNE 30, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-24 Applicant: Thomas Shelton To permit a reduction in the required side yards from a total of ten (10) feet to six (6) feet, -or three (3)-feet on each side, in lieu of Section 9242.8(c), and to allow a four (4) inch split face block wall in lieu of the six (6) inch required by the Huntington Beach Ordinance Code; the request for the reduction in side yards to be on approximately 20 percent -of the lots within the Mobile Home Park and the request for the masonry wall to be on the north, east, and south property lines of subject property located at the southwest corner of Newland Street and Ellis Avenue in an MH, Mobile Home District. The Chairman informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Tom Shelton, Ted Kato, and Saro Kato were present at.the meeting. The proponents addressed the Board, noting that the reduction in setbacks would permit them more flexibility in siting units within the park, particularly on corner lots. Ted Kato also indicated that installation of awnings and carport covers was a problem on some of the lots due to the required setback. Mr. Shelton addressed the question of the 4-inch wall, citing differ- ences in cost and maintenance factors as justification. There being no other persons Present to speak for or against the proposed exceptions, the public hearing was closed. The Board reviewed the request, discussing the reduced setbacks and questioning the applicants in regard to any soil problems on the site which could justify installation of the lighter wall. It was the consensus that the applicants should provide the Board with data on settlement in the area, compaction and fills, and soil boring records to delineate any concentrations of peat on subject site. ON MOTION BY PALIN AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-24 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE REGULAR MEETING OF JUNE 23, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 76-28 Applicant: Gordon F. Powers, Architect To permit the construction of a 40-lane, 42,000 square foot bowling center pursuant to Section 9472.1 of the Huntington Beach Ordinance Code, located on the south side of Edinger Avenue, approximately 360 feet east of Gothard Street in a C4, Highway Commercial District. The Chairman informed the Board that Negative Declaration No. 76-45 was granted for this request by the Environmental Review Board on June 15, 1976. The Chairman opened the public hearing. Gordon Powers and Steve Schumacher were present at the meeting. The applicants indicated that they have not revised the plans in regard to comments made by staff on access for fire vehicles, treatment of the drives, etc., but were prepared to accept conditions to effect such changes. Secretary Palin reviewed for the Board's information the items which had been discussed in the staff's meeting with the developers. The Chairman closed the public hearing. ON MOTION BY PALIN AND SECOND BY SPENCER THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-45 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE BZA 6-16-76 Page 7 Minutes, H.B. Board of Zoning Adjustments June 16, 1976 Page 8 ON MOTION BY PALIN AND SECOND BY SPENCER USE PER14IT NO. 76-28 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Lane Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received and dated May 14, 1976, shall be the approved layout, subject to the modifications described herein: a. The building shall be relocated on the site to facilitate a two-way drive with a minimum width of twenty (20) feet along the easterly property line of subject property. b. Parking between the proposed building and Edinger Avenue shall be redesigned in an east -west flow rather than in a north -south alignment, with proper raised landscaped areas at the end of each parking bay. C. The driveway in front of the proposed facility shall be modified to a width to facilitate loading and unloading zones for both passengers and deliveries to the site. d. The parking immediately west of this loading area shall be redesigned with a raised landscaped island between the bays and the driveway in front of the area. e. A minimum drive width of thirty-five (35) feet shall be provided for the drive on Edinger Avenue. A plan delineating said modifications shall be submitted to the Board of Zoning Adjustments for review and approval action. BZA 6-16-76 Page 8 Minutes, H.B. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 2. Should the proponent be successful in discovering an exist- ing easement from the facility to Got -hard Street and that easement area is used for ingress -egress, the driveway approach shall be reconstructed to a minimum width of thirty- five (35) feet. 3. Signs for the facility shall be submitted to the Board of Zoning Adjustments for review and approval action. 4. No structures other than those shown on the approved plans shall be constructed on the subject site. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 76-30 Applicant: George L. Rogers To permit the enlargement (room addition) of an existing residence with a non -conforming side yard setback pursuant to Section 9719 of the Huntington Beach Ordinance Code, located at the east side of Farnsworth Lane, approximately 400 feet south of Kingfisher Lane in an R-1, Low Density Residential District. The Chairman informed the Board that this request is a Categorical Exemption, Class I(e), California Environmental Quality Act, 1970. The Chairman opened the public hearing. There being no one present to speak on the proposed project, the public hearing was closed. ON MOTION BY SPENCER AND SECOND BY PALIN USE PERMIT NO. 76-30 WAS APPROVED WITH THE FOLLOWING.FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The Chairman informed the Board that Negative Declaration No. 76-48 was approved for this project by the Environmental Review Board on June 15, 1976. Pete Christey was present at the meeting. The suggested conditions of approval were discussed with the appli- cant, as well as the additional condition requested by Public Works that vehicular access rights on Garfield Avenue be dedicated to the City. After review, it was the consensus of the Board that such a condition should also be applicable to the already developed Parcel 1 of this map, in order to eliminate the hazardous drive access from Garfield. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-48, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 76-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: BZA 6-16-76 Page 11 Minutes, H.B. Board of Zoning Adjustments July 16,1976 Page 12 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on May 26, 1976, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Garfield Avenue and Gregory Lane shall be dedicated to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 9. A copy of the recorded parcel map shall be filed with the Planning Department. 10. Vehicular access rights on Garfield Avenue (to Parcel 1) shall be dedicated to the City on the recorded parcel map submitted to the City for acceptance. 11. Concurrently with the development of Parcels 2, 3, and 4, the vehicular access from Garfield Avenue to Parcel 1 shall be eliminated and a new access be provided from Gregory Lane to said Parcel 1. 12. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air condi- tioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 13. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 15. The structures on subject property, whether attached or det- ached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. Bob Jarrard was present at the meeting. Upon review of the application plan as submitted has resulted applicant agreed to redraw the lines. it was determined that the plot in illegal lot splits, and the plans along legally constituted lot ON MOTION BY CROSBY AND SECOND BY PALIN ADMINISTRATIVE REVIEW NO. 76-72 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT, TO THE MEETING OF JUNE 23, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-73 Applicant: Foxx Development Corporation To permit the construction of a duplex apartment pursuant to Section 9161.2 of the Huntington Beach Ordinance Code, located on the west side of 17th Street approximately 50 feet south of Acacia Avenue in an R2, Medium Density Residential District. Bob Jarrard was present at the meeting. Secretary Palin reported that the application meets the require- ments of the Ordinance Code, and noted also that the presently existing standards on 17th Street require that this request be considered as a duplex on a 50-foot lot and the line between the two lots must be eliminated. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-73 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received June 8, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; . Lot area; .
