Applicant: ^he Buccola Company
To permit the construction of a 90,000 square foot shopping center
pursuant to Section 9430.2 of the Huntington Beach Ordinance Code,
located at the southwest corner of Garfield Avenue and Beach Boule-
vard in a C2, Community Business District.
John Praisler was present at the meeting.
Bruce Crosby presented recommendations from the Traffic Engineer,
which were discussed at length by the developer's representative
and the staff. Mr. Praisler indicated that a primary concern of
his major prospective tenants would be at least one access point
on 17th Street, in order to prevent conflicts between customer
circulation and vehicles servicing the center. The Board discussed
what the effects of implementation of the recommendations would be
on parking, street widths, circulation onsite, and layout. It was
determined that Bruce Crosby should set up a meeting with the
developer, City staff; and the Traffic Department in order to work
out the problems on the project.

Applicant: Forest Olson, Inc.
To permit the creation of one (1) parcel of land from two (2) exist-
ing parcels pursuant to Section 9930.2 of the Huntington Beach Ordin-
ance Code, located on the west side of Brookhurst Street approximately
675 feet south of Garfield Avenue in a C2, Community Business District.
Marvin Olson was present at the meeting.
Mr. Olson indicated that he has received the suggested conditions of
approval for this request; these suggested conditions were discussed
by the Board and the applicant.

CONDITIONAL EXCEPTION NO. 76-24 (Continued from 6-16-76)
Applicant: Thomas Shelton
To permit a reduction in the required side yards from a total of
ten (10) feet to six (6) feet, or three (3) feet on each side, in
lieu of Section 9242.8(c), and to allow a four (4) inch split
face block wall in lieu of the six (6) inch required by the Hunt-
ington Beach Ordinance Code; the request for the reduction in side
yards to be on approximately 20 percent of the lots within the
Mobile Home Park and the request for the masonry wall to be on
the north, east, and south property lines of property located at
the southwest corner of Newland Street and Ellis Avenue in an
MH, Mobile Home District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman uri-ned the public hearing. Tom Shelton was present
at the meeting. He submitted the soils information as requested
at previous hearing and further explained his request for the
four -inch wall. He noted that he is unable to specify exact loca-
tions of lots upon which he will need the reduced setbacks as
applied for, but is requesting latitude in locating units on the
sites as may be necessary.
There being no other persons present to speak for or against the
proposal, the public hearing was closed.
Pat Spencer noted the difficulty the City would encounter in.ad-
ministering the percentage reduction request in setbacks, suggest-
ing that any possible approval should be for corner lots and some
definite number and location for interior lots. It was the con-
sensus of the Board that no justification for hardship could be
found for the blanket percentage reduction, but applicant was ad-
vised that he might be able to apply for a specific site on an
individual basis. Another alternative suggested was for possible
consolidation of lots to accommodate the larger units as they
come in.

2. In accordance with the City's Master Plan of Arterial Streets

curve at the intersection of Pecan Avenue and 17th Street
shall be dedicated.
3. Soil and compaction reports shall be submitted by a certified
soils -engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler
systems, standpipe systems, fire hydrants, fire alarm
systems, and any other required fire protection and detec-
tion devices or systems shall comply with the specifications
of the Huntington Beach Fire Code. Plans .for such systems

The Chairman informed the Board that Negative Declaration No. 76-49
was approved for,this request on June 22, 1976, by the Environmental
Review Board.
The Chairman opened the public hearing: Frank-mola', Vincent Moretti,
and Bob Ringstrom=were present to represent the application.
Secretary,Cope-reviewed'the,action`of.'the.,Planning Commission"on a
proposed precise. plan -of =street alignment" which would .serve land-'
locked parcels to_the-northeast of subject -site: He rioted, -that the
Commission had. voted.,to_table the proposal to' permit _exploration of
alternativesr,and'-therefore_"said proposal would ---have' no: effect.: upon the
application under -consideration. -
Bruce Crosby"presented=.on-going concerns of"the Department of -Public
Works,,noting that.the applicant should be made aware that any'affirma-
tive action on this project today could only be on the conceptual
plan, -and that.all,the..concerns of-.the„Public Works Department would
have to,be resolved.to.the-satisfaction of that -department: -He-in-
formed the applicants that the present holding capacity of"the land -
cannot -be -.changed - any retention basin-proposed-must.be large,enough
to maintain that capacity,at its present'level:- The applicants were
also made-aware_of'.the_"necessity for an easement down the east side
of the property. �.nd the-* required, setba_ cks " from_ that" easement'. These
setbacks would affect the locating,of buildings -,on the site, alter-

The proposed.retention basin was discussed-in,relation_to_screening
and landscaping, -security measures, -means of -_pumping and draining,
and eventual
_"disposition -when the storm drain-district"is- implemented.
Guest parking on -site was.also reviewed,,with applicants proposing -
a reduction in the reauirements of,the code, -and provision of -some of
the required -spaces.-on the street. After"discuss'ibn it"was,'the
consensus of the,Board that.'the requirements -.of --the code"must be met;
if the applicant- desires'" to" pursue,.a. reduction, - .it,will. be- necessary
to file.a conditional exception for that purpose-.
Mr. Mola expressed willingness to work with -the Department of -Public
Works in.resolving the -acknowledged problems -on the site. r

ON MOTION BY CROSBY AND SECOND BY COPE USE PERMIT NO. 76-32 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUA17CE OF BUILDING PERMITS.
1. The conceptual plot plan and elevations received May 27,
1976, shall be the approved layout, subject to the modifi-
cations described herein:
a. Addition of the 15 required guest parking spaces in
conformance with Article 979 of the Huntington Beach
Ordinance Code.
b. Provision for a ten (10) foot easement adjacent to the
easterly property line for a storm drain system as
required by the Department of Public Works. All structures
exceeding forty-two (42) inches in height shall set back
five (5) feet from this easement.
A plan delineating said modifications shall be submitted to the
Secretary of the Board. If such plan complies with the modifica-
tions outlined by the Board, said plan shall be approved and
made a permanent part of the administrative file.
In its approval action, the Board of Zoning Adjustments considered

C. GENERAL CONDITIONS:
1. All oil operations on the site shall be discontinued
and abandoned in full compliance with all State and
City ordinances.
2. A six (6) foot high decorative masonry wall, the design
and materials of which shall be subject to Planning
Department approval, shall be installed on the northerly
and easterly property lines.
3. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a minimum
of R-19 and R-11, respectively. If no air conditioning is
to be provided, the insulation in ceilings and exterior
walls shall be a minimum of R-13 and R-7, respectively.
4. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
5. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be stubbed
in at the locations of cooking facilities, water heaters,
and central heating units.
6. The Structures on subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for all units that lie within
the 60 CNEL contours of the property.
7. If any future street alignments in the area require the plan
for these 30 units to be substantially modified, it shall be
required that the project go back to the Environmental Review
Board for further review.
8. -The applicant shall maintain close contact with the Orange
County Health Department in regard to the retaining basin on
the site.

A plan delineating said modifications shall be submitted
to the Secretary of the Board. If such plan complies with
the.modifications outlined by the Board, said plan shall be
approved and made -a permanent part of the administrative
file.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth-;
. Type of use and 'its relation to propertyy and improvements f. in
the immediate vicinity;
• Past administrative -action regarding this, property.,•
2. The following plans shall be submitted to the Secretary
of the' Board:
a. Landscape and'irrigation plan. complying with Article 979
of the Huntington Beach Ordinance Code and landscaping
specifications on file in the Department of Public Works.
b. Rooftop mechanical equipment screening•plan. Said
plan shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material pro-
posed to screen said equipment.
3. Soil and 'compaction reports shall'b"e-submitted by a certified
soils engineer." Said reports shall be submitted -to the Depart-
ment of ' Building" -arid Community' Development and shall be sub-
ject to approval by that Department.
4. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the
Huntington Beach Fire Code." Plans for such systems and
devices shall be submitted to the Fire Department and shall
be subject to approval by'the Departments of Fire and Public
Works.
5. All appiicable fees•shall"be'paid prior'to issuance of
building permits.

MISCELLANEOUS AGENDA ITEM:
USE PERMIT NO. 74-17
Applicant:, Alpine Civil Engineers
Clarification of conditions of approval on mobile home park
located at Newland and Ellis.
Tom Shelton of Alpine Civil Engineers, Wallace Mitchell, and
Joseph Schmitz were present at the meeting.
The Board reviewed with Mr. Shelton and the others present the
condition of approval originally imposed upon this project which
required specific types of roofing materials for the units and
appurtenant structures in this park.
Mr. Mitchell and Mr. Schmitz indicated that their understanding
of the original conditions had been that the requirement was for
"composition tile." Mr. Shelton noted that the structural mem-
bers of the units would have to be modified drastically in order
to support a roof of that type.
After extensive discussion, it was the consensus of the Board
that the intent of the approvals by the Environmental Review
Board and the Board of Zoning Adjustments had been that the word-
ing should be "roofing materials of shake, cedar, or composition
shingles." It was further determined that such material should
be of ear.then colors, in order to improve the appearance of the
park when viewed from the adjoining hillside properties.
