Applicant: Ralph N. Highsmith
To permit the establishment of a retail business in an existing
building with no provided parking in lieu of Section 9456(a) of
the Huntington Beach Ordinance Code, located on the east side of
Main Street approximately 50 feet south of Olive Avenue in a C3,
General Business District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. Al Shane and Joseph Collins
were present to represent the application. There being no persons
present to speak for or against the proposed project, the public
hearing was closed.
Secretary Cope reported that discussions have been held regarding
the necessity for this application and the possibility that the
use could be handled under the Certificate of Occupancy by the
Building Department; he suggested continuance for one week to allow
a determination to be made.

ADMINISTRATIVE REVIEW NO. 76-90 (In Conj./CE 76-29)
Applicant: Ralph N. Highsmith
To permit the establishment of small shops and a beauty shop in an
existing building pursuant to Section 9453 of the Huntington Beach
Ordinance Code, located on the east side of Main Street approximately
50 feet south of Olive Avenue in a C3, General Business District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class I, California Environmental Quality Act, 1970.
Al Shane and Joseph Collins were present at the meeting.
Secretary Cope reported that discussions have been held regarding

USE PERMIT NO. 76-37
Applicant: J. I. Hathaway Productions
To permit the establishment of an oil drilling and operation site
pursuant to Section 9685 of the Huntington Beach Ordinance Code,
located 650 feet south of Ellis Avenue and 950 feet west of Golden -
west Street in an RA-01-CD, Residential -Agricultural combined with
Oil Production District.
The Chairman informed that Negative Declaration No. 74-171 was granted
by the City Council for Zone Change No. 74-22 on May 5, 1975, and it
has been determined that this request falls under that negative dec-
laration.
The Chairman opened the public hearing. Emil Plegel was present to
represent the application. He addressed the Board to explain the
proposed timing of the drilling on the site. There being no other
persons to speak for or against the proposed project, the public
hearing was closed.
The Board discussed screening of the operations, type of pumping equip-
ment to be installed, and phasing of the project. In light of the
exploratory nature of the initial drilling, Mr. Plegel requested that

installation of certain improvements not be required until
after successful drilling of the first well site.
ON MOTION BY COPE AND SECOND BY CROSBY USE PERMIT NO. 76-37
WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY
THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use will
not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of Land
Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO APPLICATION FOR DRILLING PERMITS:
1. The site plan for the northerly 300 feet of the subject
property, received and dated June 18, 1976, shall be the
approved layout.
2. The applicant shall comply with all provisions of the
Huntington Beach Ordinance Code applicable to said use.
B. GENERAL CONDITIONS:
1. Within seven (7) months of the issuance of drilling permits,
a decorative masonry wall shall be installed around the
perimeter of the oil operation site. Said wall shall be
six (6) feet high and six (6) inches wide and shall be offset
five (5) feet .from the property lines on the north, east,
and west of subject site.
Failure to install said wall shall result in review and re-
evaluation of this approval by the Board of Zoning Adjustments.
2. At the time of construction of the block wall the five-foot
setback areas shall be landscaped according to a landscaping
plan to be submitted to the Planning Depa.-tment for approval.
Intent of the wall and planting areas shall be to screen the
oil operations and the general site from adjacent streets and
properties.

3. Prior to installation of the block wall, a grading plan
shall be submitted to the Department of Public Works for
approval.
4. At the time of construction of the block wall, any temporary
chain link perimeter fencing which has been constructed on
the subject site shall be removed.

CONDITIONAL EXCEPTION NO. 76-30
Applicant: Barregar Guest & Strasmann
To permit overhead electrical hookup to a new structure in lieu of
Section 9730.8 of the Huntington Beach Ordinance Code, located on
the east side of Ross Lane, approximately 170 feet north of Warner
Avenue in an Rl, Low Density Residential District.
The Chairman informed the Board this request is a Categorical Exemp-
tion, Class V, California Environmental Qualitv Act, 1970.
The Chairman opened the public hearing. Joe Guest was present at
the meeting. There being no persons to speak for or against the
proposed project, the public hearing was closed.
Board discussion revealed that the service would require no new
utility poles to be set, and code provisions allow the application
to be approved administratively under such conditions.

76-30 WAS WITHDRAWN AND REFUND OF FILING FEE AUTHORIZED, BY THE FOL-

OIL WELL ACTIVATION PERMIT NO. 76-5
Applicant: John M. Rohtig
To permit an oil well activation pursuant to Section 15.40.050 of
the Huntington Beach Ordinance Code, located on the east side of
7th Street approximately 125 feet north of Olive Avenue in the
Townlot Specific Plan Area One, Section A.
The Chairman informed the Board that Negative Declaration No. 76-17
was granted for this request by the Environmental Review Board on
March 30, 1976.

John Rohrig was present at the meeting.
A communication from the Oil Field Superintendent indicates
the the proposal is in compliance with ordinance codes. The
Board reviewed the type of equipment to be used and the
aesthetics of the project.

pursuant to Section 9162.3.1 of the Huntington Beach Ordinance
Code, located at the northeast corner of Delaware Street and
Utica Avenue in an R2, Medium Density Residential nistrict.

Frank Mola, Bob Ringstrom, and Vince Moretti were present at the
meeting. Mr. Mola indicated that the present plan now complies
with the provision of off-street guest parking spaces. John Cope
noted that the proponent has met with the Department of Public Works
and has appraently worked out the proposed drainage of the site to
that Department's satisfaction. Also discussed were the proposed
treatment of the tennis facility and the lighting which would be
installed if such use were to become a night-time facility.
ON MOTION BY CROSBY AND SECOND BY LIPPS THE REVISED PLAN FOR USE
PERMIT NO. 76-32 WAS APPROVED WITH THE FOLLOWING REVISED CONDITIONS
OF APPROVAL, BY THE FOLLOWING VOTE:
REVISED CONDITIONS OF APPROVAL:
The previously imposed Conditions of Approval shall be revised as
follows:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received July 1, 1976, shall be the approved
layout.
The requirements (a) and (b) previously listed under this
section shall be deleted.
2. The landscape and irrigation plan to be submitted per the
requirements of this section of the conditions shall include
fifteen (15) fifteen -gallon trees (or .5 tree per unit) in
addition to the normal requirements for the development.
C. GENERAL CONDITIONS: Add the following:
9. Prior to use or occupancy of any unit of this development
for residential purposes, the proposed tennis court shall be
completed and ready for recreational use.
10. All other previously imposed conditions of approval shall
continue to apply.

The Board reviewed the plan as submitted and found it to be in
compliance with the original condition of approval.
ON MOTION BY CROSBY AND SECOND BY LIPPS THE REVISED PLAN FOR
ADMINISTRATIVE REVIEW NO. 76-54 WAS APPROVED WITH THE FOLLOWING
CONDITIONS, BY THE FOLLOWING VOTE:

A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan received and dated June 28, 1976, shall be
the approved layout.
2. Applicant shall comply with all Ordinance Code require-
ments applicable to the temporary parking lot use
(Section 9730.28).
3. A landscape and irrigation plan shall be submitted to the
Board of Zoning Adjustments for review and approval
action. Said plan shall incorporate all screening and
irrigation systems as required by Section 9730.28 of the
Huntington Beach Ordinance Code.

To permit installation of two monument signs at an existing

The Board reviewed the proposed signs and the criteria for
approval which the Board is authorized to apply.
ON MOTION BY LIPPS AND SECOND BY CROSBY THE SIGN REQUEST FOR
THE CORNER OF SAYBROOK AND BOARD WALK WAS DENIED FOR THE FOLLOW-
ING REASON, BY THE FOLLOWING VOTE:
REASON FOR DENIAL:
1. The sign does not meet the criteria set forth in Section
9761.9.1 of the Huntington Beach Ordinance Code.

ALGONQUIN WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL-
LOWING VOTE:

1. The sign plan received and dated June 23, 1976, shall be the
approved layout.
2. The applicant shall comply with all requirements of Article 976
of the Huntington Beach Ordinance Code.

Mr. Cope noted his reason for voting "no" on the proposed was that
the existing freestanding sign with the same copy is sufficient for
this location.
SIGN REQUEST
Applicant: Electra Ads
To permit the installation of two wall signs and one pole sign
for a liquor/deli use located at 17035 Newland Street.
The Board reviewed the sign plan submitted.
ON MOTION BY COPE AND SECOND BY CROSBY, SIGN NO. 1 WAS APPROVED
WITH THE FOLLOWING CONDITIONS AND SIGNS NOS. 2 AND 3 WERE DENIED
FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE:
CONDITIONS OF APPROVAL:
1. The sign plan dated July 7, 1976, shall be the approved layout,
subject to the following restrictions:
Sign No. 1 (the 48 square foot wall sign) is approved.
Sign No. 2 (the 16 square foot wall sign) is denied.
Sign No. 3 (the 42 square foot pole sign) is denied.
2. For the Sign No. 1, the applicant shall comply with all require-
ments of Article 976 of the Huntington Beach Ordinance Code.
REASONS FOR DENIAL OF SIGNS 2 AND 3:
1. Sign No. 2 fails to meet requirements of the Ordiancne Code
because it does not face the parking lot or the street.
