The Chairman informed the Board that Negative Declaration No.
75-40, as adopted by the Board of Zoning Adjustments on July 2,
1975, cover:, this request.
Secretary Cope informed the Board that the original Use Permit for
the shopping center of which this request is a part is still in
effect, as construction was begun on the site within the required
time period. It is therefore the staff recommendation that this
application be withdrawn and authorization for refund of the
filing fee be given.

The Chairman opened the public hearing. Mr. and Mrs. Brady
were present to represent their application. _The proponents
explained the need for the carport and the difficulties imposed
upon them by the illegal addition which had been made to the
home they purchased some years ago. There being no other persons
present to speak in regard to the proposed project, the public
hearing was closed. -
The Board addressed the criteria of hardship on the property,
determining that the property is a conforming lot with no
unusual aspects to justify the exception. The precedent -setting
.nature of an approval on this request was also considered.'
ON MOTION BY COPE AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION
NO. 76-32 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. Subject property is a conforming lot, with no building constraints
or unusual circumstances to justify granting of the Conditional
Exception.
2. The applicant has failed to demonstrate sufficient legal hardship
to justify granting of the exception.
3. Granting of this request would constitute granting of special
privilege not enjoyed by surrounding residential properties.

The Chairman informed the Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. Mr. and Mrs. Brady were
present at the meeting. There being no one to speak on the pro-
posed project, the public hearing was closed.
In light of the denial of the setback requested in Conditional
Exception No. 76-32, it was the consensus of the Board that the

carport would be nonconforming -to code and could not be approved.
ON MOTION BY COPE AND SECOND BY ELLSTROM USE PERMIT NO. 76-36 WAS

1. The plan submitted is not in conformance with the sethack re-
quirements of the district in which it is located.
2. Granting of this request with the encroachment into the required
setbacks would serve to establish an undesirable precedent within

To permit the construction of a six (6) unit apartment building pur-

of Sycamore Avenue in an R2, Medium Density Residential District.
The Chairman informed the Board that this request was granted Nega-
tive Declaration No. 76-61 by the Environmental Review Board on
July 13, 1976.
The Chairman opened the public hearing. Blake Barregar and Joe Guest
were present at the meeting. There being no one present to speak on
the project, the public hearing was closed.
Board review included location of the trash enclosure. The plan was
found to be in conformance to code, but the applicants were cautioned
about the possibility of having to install a long run of water line
in order to provide adequate water flow for fire protection purposes.

vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.
3. The proposal is consistent with the City's General Plan of
Land Use.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. The plot plan and elevations received and dated June 22,1976,
shall be the approved lavout, subject to the following:
The trash facility shall be relocated to the northwesterly
wall of the enclosed garages.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
Traffic circulation and drives;
. Parking layout;
Lot Area;
. Lot width and lot depth;
Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. The following plan shall be submitted to the Secretary of
the Board:
Landscape and irrigation plan complying with Article 979 of
the Huntington Beach Ordinance Code and landscaping specifi-
cations on file in the Department of Public Works.
3. In accordance with the City's standards and requirements,
and additional five (5) feet of right-of-way on Elm Street
shall be dedicated.
4. Soil and compaction reports shall be submil.}ed by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall
be subject to the approval of that Department.

5. Fire protection systems, including automatic sprinkler sys-
tems, standpipe systems, fire hydrants, fire alarm systems,
and any other required fire protection and detection devices
or systems shall comply with the specifications of the Hunt-
ington Beach Fire Code. Plans for such systems and devices
shall be submitted to the Fire Department and shall be subject
to approval by the Departments of Fire and Public Works.
6. The developer shall participate in the local drainage
assessment district.
7. The developer shall participate in the Orange County Sanita-
tion District #3 Sewer Annex District.
B. All applicable fees shall be paid prior to issuance of
building permits.
B. TO BE COMPLETED PRIOR TO FINAL INSPECTION:
1. Elm Street shall be improved to the centerline of such right-
of-way. Said improvement shall include curbs, gutters, side-
walks, paving, street trees, street lights, street signs,
street drainage, and sewer and water main extensions, in full
compliance with the City of Huntington Beach street standards
and requirements.
C. GENERAL CONDITIONS:
1. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a
minimum of R-19 and R-11, respectively. If no air condi-
tioning is to be provided, the insulation in ceilings and
exterior walls shall be a minimum of R-13 and R-7,
respectively.
2. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed of
at an offsite facility equipped to handle them.
3. Natural gas and 220V electrical shall be stubbed in at the
locations of clothes dryers, and natural gas shall be stubbed
in at the locations of cooking facilities, water heaters,
and central heating units.

CONDITIONAL EXCEPTION NO. 76-31
Applicant: Rod Eide
To permit a zero side yard setback for garages in lieu of the
required 4'6" setback per Section 9163.2.1(a) of the Huntington
Beach Ordinance Code, located on the south side of MacDonald
Avenue approximately 450 feet east of Beach Boulevard in an R2,
Medium Density Residential District.
The Chairman informed the Board that this request is a Categori-
cal Exemption, Class V, California Environmental Quality Act,
1970.
The Chairman opened the public hearing. John Cowles and Nan Eide
were present to represent the application.
Mr. and Mrs. Harry Hirao and Mr. Frederick Truempler were pre-
sent at the meeting to speak in opposition to the proposed
exception, citing adverse effects of the wall located at zero
lot fine on the adjacent property. Mr. and Mrs. Hirao live on
the directly abutting property; Mr. Truempler lives next to
another lot which the applicant owns and objected to the approval
of this request as a precedent -setting action which would probably
affect his pror3rty when applicant develops the next lot.
There being no other persons to speak on the project, the public
hearing was closed.
The Board reviewed the proposed plan, taking into consideration
the configuration of the subject property, the height and materials
of the garage walls which would be constructed at zero lot line,
and the length of the run of eight foot wall, which was determined
to be forty (40) feet. Also considered was the orientation of
Mr. and Mrs. Hirao's house on the lot and the drive width which
would separate it from the zero wall on the abutting property.
ON MOTION BY COPE AND SECOND BY ELLSTROM CONDITIONAL EXCEPTION
NO. 76-31 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS,
BY THE FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The configuration of the subject site, with a 45-foot frontage
and 145.7-foot depth, does present certain development
constraints for improvements on the site.
2. The garages as proposed at zero setback result in a better plan,
more covered parking spaces, and better orientation of open
space to the unit. The plan also gives the appearance of a
single-family dwelling in keeping with the character of the ex-
isting neighborhood.

Secretary Cope reported that the proposed addition as well as the struc-
tune to which it is proposed to be added are in compliance with the
ordinance code - the only nonconforming structure on the property is
the unattached garage building at the rear of the property..

Applicant: Parking Company of America
To permit the establishment of a 200-space seasonal parking lot pur-
suant to Section 9730.28.1 of the Huntington Beach Ordinance Code,
located on the north side of Pacific Coast Highway east of Newland
Street in an M2-0 Industrial District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class IV(e), California Environmental Quality Act, 1970.
Mr. Chavez was present at the meeting to represent the application.
The Board reviewed the plan, finding the map as submitted inadequate
to determine what drive access, parking space sizes, and traffic
control measures the applicant is planning to install. It was noted
that if the City were to legitimize such a use at such a dangerous
portion of Coast Highway, more specific details of access, traffic
control, etc., must be spelled out.

SPECIAL EVENT PROCEDURES:
Secretary Cope reported to the Board that the procedures for pro-
cessing special events are under review by the Planning Department
and the City Council, in order to formalize and legitimize the
processing of such requests. All special events submitted for re-
view at this meeting have been postponed to the meeting of July 21,
1976, to permit Council response to Department communications.
