REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 76-92 (Cont. from 7-14-76) Applicant: Parking Company of America To permit the establishment of a 200-space seasonal parking lot pursuant to Section 9730.28.1 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway east of Newland Street in an M2-0 Industrial District. The Chairman informed the Board that this request is a Categorical Exemption, Class IV (e), California Environmental Quality Act, 1970. Theresa Gilcrest was present to represent the application. Ms. Gilcrest submitted a revised plan for the parking lot, which was reviewed by the Board. Secretary Palin noted that a communication has been received from the Circulation Committee in regard to this project, and provided a copy to the applicant. Jerry Ellstrom presented objections to the project from the Department of Public Works, citing the substandard width of Newland Street for storage capacity of vehicles attempting to enter the lot, the dangerous conditions which would result on Pacific Coast Highway from pedestrians crossing at this location, and the inadvisability of the City's condoning, by the formal approval of this application, the continuing hazardous use of this lot. Secretary Palin noted that the parking currently taking place on the property creates more of a hazard that would a controlled situation with restrictions on traffic ingress -egress to the lot. It was his feeling that the flexibility the Board possesses in conditioning the use as to exiting and entering only on Newland, eliminating the parking immediately adjacent to Pacific Coast Highway, and controlling pedestrian traffic through the recently installed signal at Newland would serve to eliminate many of the objections to the project. He further stated that the denial Minutes, H.B. Board of Zoning Adjustments July 21, 1976 Page 2 of the request would be contrary to the intent of the City when the standards for seasonal parking lots within 1000 feet of the beach were enacted. Further Board discussion ensued. ON MOTION BY LIPPS AND SECOND BY ELLSTROM ADMINISTRATIVE REVIEW NO. 76-92 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE: REASONS FOR DENIAL: 1. The intersection and signaling at Newland Street and Pacific Coast Highway are not adequate to handle the traffic flow. 2. Newland Street is not of sufficient width to provide adequate storage space for vehicles attempting to enter the parking lot, resulting in excessive traffic congestion. 3. The entrance and exit for the site is not of sufficient distance from the intersection of Newland and Pacific Coast Highway. 4. Pedestrian crossing on Pacific Coast Highway at that location would create a hazardous situation. AYES: LIPPS, ELLSTROM NOES: PALIN ABSENT: NONE For the record, Mr. Palin stated that his "no" vote was based upon the reasons set forth in his discussion above. USE PERMIT NO. 76-41 (In Conj./AR 76-95) Applicant: A.W. Chapman To permit a truck and loading facility to face a public street pursu- ant to Section 9518(a) of the Huntington Beach Ordinance Code, located on the north side of Commercial Drive approximately 280 feet east of Chemical Lane in a 100-M1-A-20,000, Restricted Manufacturing District. The Chairman informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Mr. Chapman was present at the meeting, and explained that the proposed use would not involve a truck well or a loading dock - he also noted that the overhead door is essential to the operation of the facility. There being no other persons present to speak on the project, the public hearing was closed. The Board discussed the relationship of the project to the total usable floor space in the building, the possible traffic hazard of trucks projecting into the traffic lanes, and the method of control to assure that the loading area is used for no other purposes. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plan received and dated July 6, 1976, shall be the approved layout, subject to the following: The overhead door screening the loading zone shall be of similar color to other architectural features of the proposed building. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. The area delineated on the plan as a 12 x 45 foot area shall be striped and painted to restrict the area to loading only. Chapman To permit the construction of a 10,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ord- inance Code, located on the north side of Commercial Drive ap- proximately 280 feet east of Chemical Lane in a 100-M1-A-20,000, Restricted Manufacturing District. Mr. Chapman was present at the meeting. - The Board reviewed the proposed plan and found it to be in conform- ande with the ordinance code. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-95 WAS APPROVED WITH -THE --FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received July 6, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; Parking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property immediate vicinity; Past administrative action regarding this and improvements in the property. 2. The following plans shall be submitted to the Secretary of the Board: Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equip- ment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certi- fied soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. GENERAL CONDITIONS: 1. All Conditions of Approval imposed on Use Permit No. 76-41 shall apply to this Administrative Review application also. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE PLOT PLAN AMENDMENT NO. 76-5 Applicant: Leonard 0. Lindborg To permit five (5) revisions to a previously approved tennis and racquetball club pursuant to Section 9811.4 of the Huntington Beach Ordinance Code. The revisions are as follows: 1) Increase the clubhouse by approximately 700 square feet; 2) Reduce the front yard setback from 23 feet to 10 feet; 3) Increase the off- street parking by six (6) spaces; 4) Increase the center court seating; and 5) Revise the court layout. The subject property is located on the east side of Gothard Street approximately 650 feet south of Talbert Avenue in an M1-CD, Light Industrial District. The Chairman informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Chairman opened the public hearing. Rex Hoover was present to represent the application. Secretary Palin reviewed the history of this application and the provisions of the Ordinance Code for approvals of plot plan amend- ments. Mr. Hoover explained the scope of the changes. There being no other persons to speak on the proposed amendment, the public hearing was closed. Board discussion ensued. Secretary Palin stated that the Board's options have been restricted by prior administrative actions on this project; and, since much of the construction requested has already taken place, the flexibility of being able to work with the proponent on the revisions has been precluded. TENTATIVE PARCEL MAP NO. 76-26 Applicant: Vincent J. Stagliano To permit the creation of one (1) parcel of land by the consolidation of two parcels pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located at the southwest corner of McFadden Avenue and Container Lane in a 100-M1-A-20,000, Restricted Manufacturing District. The Chairman informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Secretary Palin informed the Board that the suggested conditions of approval have been forwarded to the applicant in accordance with the State Map Act. The parcel map is to satisfy a previously imposed condition of approval. ON MOTION BY PALIN AND SECOND BY LIPPS TENTATIVE PARCEL MAP NO. 76-26 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on July 7, 1976, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the De- partment of Public Works and recorded with the Orange County Recorder. 3. Board of Zoning Adjustments July 21, 1976 Page 7 ADMINISTRATIVE REVIEW NO. 76-96 Applicant: Robco Welding To permit construction of a 6000 square foot industrial building pursuant to Section 9530.3 of the Huntington Beach Ordinance Code, located on the east side of Gothard Street approximately 850 feet north of Ellis Avenue in an M1-A, Restricted Manufactur- ing District. The Chairman informed the Board that Negative Declaration No. 74-150, adopted by the Planning Commission for the subject property on November 19, 1974, covers this request. The submitted request was reviewed by the Board. The accessibility of the site for emergency vehicles and truck deliveries was dis- cussed, with possible rearrangement of parking spaces and landscap- ing to improve access. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-96 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received July 14, 1976, shall be the approved layout,' subject to the modifications described herein: a. The driveway shall be a minimum width of thirty-five (35) feet with an eight (8) foot radius curb return. b. The parking layout shall be revised along the northerly property line to reflect a north -south orientation. A plan delineating said modifications shall be submitted to the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; . Richard Rule was present at the meeting. Secretary Palin informed the Board that, in order to comply with sight angle encroachment, it had been necessary to flip the plan over; the project has been checked in the field and found to be now'in conformance as far as sight angle is concerned and no conflicts have been created with other drives in the area. ON MOTION BY PALIN AND SECOND BY ELLSTROM THE REVISED PLAN FOR ADMINISTRATIVE REVIEW NO. 76-58 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The revised plot plan submitted July 20, 1976, shall be the approved layout. 2. All other applicable Conditions of Approval previously imposed upon this application on June 3, 1976, shall apply. 3. The reapproval of this plan shall not affect the effective date of the overall approval on the application. The Board reviewed the request, noting that no flags have been pro- posed for the complex. Signs will be requested under separate application. Parking and phasing of the construction project were also reviewed. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-98 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The conceptual plan received July 15, 1976, shall be the approved layout. 2. The applicant shall comply with all applicable conditions for model complexes contained in the Huntington Beach Ordinance Code. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE SPECIAL EVENT NO. 76-20 Applicant: Michael G. Page To permit operation of a "Fest-Awe-Fair" from August 25 through September 6, 1976, located at the southwest corner of Beach Boulevard and Atlanta Avenue. Mr. Page was present at the meeting and addressed the Board to explain his project. Three residents of the abutting mobilehome park addressed the Board, expressing their concerns on the impact this project would have on their homes in regard to noise, security, and traffic problems. Extensive review by the Board included dimensions of the area involved, fencing and security provisions, hours of operation, provisions for overnight camping of carnival personnel and exhibitors, methods of dust control, sanitary facilities, Fire Department requirements, sound equipment and means of control of noise emission, and provisions for parking and means of control at egress -ingress points. Food service facilities on the project will comply with the requirements of the Orange County Health Department. ON MOTION BY PALIN AND SECOND BY ELLSTROM SPECIAL EVENT NO. 76-20 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 7-21-76 Page 10 Minutes, H.B. Board of Zoning Adjustments July 21, 1976 Page 11 CONDITIONS OF APPROVAL: 1. The plan received July 21, 1976, shall be the approved layout, as amended to reflect the correct property line dimensions. 2. Beach Boulevard and Atlanta Avenue shall be posted "no parking." Posting and enforcement of the parking restrictions shall be at the expense of the operatpr. 3. Entrance and exiting for public parking shall be from Atlanta Avenue, within the general area as indicated on the July 21 plan; with physical barriers along Atlanta to restrict ingress -egress to a central point through the use of posts and cables and/or telephone poles. 4. The parking area shall be provided with sufficient trash containers to accommodate trash disposal. 5. Parking bays shall be clearly delineated through the use of poles, logs, or ties in conformance with the minimum standards for stall dimensions and turning radius contained in Article 979 of the Huntington Beach Ordinance Code. 6'. The driveways within the parking area shall be oiled or chemically treated for dust control, in a manner satisfactory to the Department of Building and Community Development. 7. Pedestrian walkways through the parking area to the activity areas shall be clearly delineated for protection of pedestrian traffic. 8. A revised plan for circulation, showing the location of all physical structures in relation'to the parking turning radius, shall be submitted to the Circulation Committee prior to the issuance of any permits by the City. 9. Security guards and traffic control officers shall be provided at the operator's expense asrecommended by the Circulation Com- mittee. 10. The entire easterly property line, as well as the carnival and activity area and the area to be used for overnight camping by concessionaires, shall be fully enclosed with a six (6) foot chain link fence. 11. The Police and Fire Departments shall review and approve plans for emergency accessways in, upon, and through the facility prior to the issuance of any permits by the City. 12. Music shall cease to be played or operated at 10 p.m., and the total site shall cease to operate and the general area shall be clear of all vehicles by 11 p.m. BZA 7-21-76 Page 11 Minutes, H.B. Board of Zoning Adjustments July 21, 1976 Page 12 13. All speakers and lighting for the proposed facility shall be directed onsite. Said speakers and lighting shall be reviewed by the Department of Building and Community Development prior to general operation of the facility, to assure compliance. 14. The applicant shall comply with Title 19 and all other applicable conditions as required by the Huntington Beach Fire Department, to assure fire safety for the area. 15. A 200 foot transition distance for the exit road shall be pro- vided to permit storage of exiting vehicles onsite, in the general area located on the plan for the 40-foot entry. The above shall apply provided that there is proper control through the use of a police officer directing traffic at the intersection of such entry road with Atlanta Avenue. In the alternative, the entry shall be moved to within 100 feet of the westerly property line with a right -turn only into the facility. The above requirements (including provision of police officers for directing traffic) shall be at the expense of the operator and shall be subject to review and approval by the Huntington Beach Police Department. 16. The applicant shall obtain all necessary electrical permits. 17_. All structures on the site shall be subject to inspection by the Fire Department and the Department of Building and Community Development prior to opening. 18. All food dispensing operations on the site shall be cleared with the Orange County Health Department. 19. No exiting or entry shall be taken from Beach Boulevard. 20. A minimum of one'(1) member o"f'the 24-hour security guard to be maintained at the facility shall be stationed along the wall adjacent to the trailer park at all times. 21. Board of Zoning Adjustments July 21, 1976 Page 13 SPECIAL EVENT NO. 76-21 Applicant: Huntington Beach Playhouse To permit a fund-raising carnival to be held on September 24, 25, and 26 on property located on the corner of Main and Gothard Streets and Garfield Avenue. The Board reviewed the request, noting that the plan provides for ingress -egress at points on Garfield Avenue and Crystal Street. ON MOTION BY PALIN AND SECOND BY LIPPS SPECIAL EVENT NO. 76-21 YIAS APPROVrD WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plot plan received July 19, 1976, shall be the approved layout. 2. The applicant shall obtain all necessary electrical permits. 3. On on -site inspection by the -Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the Finance Department ten (10) days prior to the event. 5. This approval shall be for the dates as requested and per the terms as outlined in the communication requesting said carnival, received and dated July 12, 1976. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE SPECIAL EVENT NO. 76-22 Applicant: Solid Rock Foundation, Inc. To permit the erection of a 60 x 90 foot tent to house a youth outreach program for a period extending from July 20, 1976, through September 1976 on property located on Pacific Coast Highway between 2nd and 3rd Streets. Don Matison was present to represent the application. Secretary Palin noted that communications in regard to this project have been received from the Police Department and the Circulation Committee setting forth reasons for the recommended denial of the request. Board of Zoning Adjustments July 21, 1976 Page 14 Mr. Matison explained to the Board the purpose of the project, noting that in his opinion the project had not been properly presented to either the Police Department or the Circulation Committee, citing the mention of a "revival tent" in both communications. In view of his experience with other projects of this nature it was his contention that the adverse effects listed as a basis for denial would not materi- alize. The Board discussed the hours of operation, types of activities planned to take place within the tent, and signing to be provided. Of particu- lar concern was how parking could be provided on the site as required by code and the effects said project would have on the traffic on Pacific Coast Highway and the local streets, including the possibility that the signs or murals planned for the sides of the tent would prove to be a distraction for drivers on the highway. It was.also specifically noted that, since the project is proposed to be located on City -owned property, the lease would require action by the City Council. ON MOTION BY PALIN AND SECOND BY ELLSTROM SPECIAL EVENT NO. 76-22 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The plan received July 13, 1976, shall be the approved layout, subject to the following: , The plan shall be revised to provide parking on the site, with relocation of the tent in order to provide the required physical separation of parking from that structure. Parking bays and drive areas shall be delineated through some type of physical barrier. 2. This approval shall be for the time period proposed and for the activities outlined in the communication received July 13, 1976, with the stipulation that if any complaints are filed in regard to noise and activities on the site the use shall be subject to immediate review by the City Council for cease and desist action. 3. The location of the tent and all on -site apparatus shall be reviewed by the Fire Department and the Department of Building and Community Development prior to operation. 4.
