It was the consensus of the Commission that this matter be taken up at a later time when Commissioners Finley and Shea would be able to participate. The amendment also,provides for miscellaneous revisions to such provisions as site coverage, open spaoe`,'and flour area." Chairman Pro,Tem Slates stated that.while he had an,interest in the area, the area under discussion did not affect his holdings and he would there fore,participate in the voting. i Minutes: H.B. Nancy Aldrich, representing Leonard Wright, addressed the Commission and read a letter written by Mr. Wright which stated that he strongly supported the Ordinance and felt it would upgrade the area by bringing in more resident owners. He complimented the Staff on their diligent efforts in the preparation of the Code Amendment. The public hearing was closed. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY PARKINSON CODE AMENDMENT NO. 76-10 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Parkinson,'Boyle, Slates, Gibson, Newman NOES: None ABSENT: Finley, Shea CODE AMENDMENT NO. 76-9 "Provisions for the regulation of oversized vehicles and on -site parking of such vehicles." Bryan Austin gave a summary of the contents of Code Amendment No.-76-9. He also gave a brief summary of proposed.amendments of Section 10:44:060 of the Municipal Code. . The public hearing was opened.. T.B. Smith addressed the Commission and complimented the Staff on their in-depth study of this issue. He also complimented the Staff on the on -site provisions. He expressed opposition to the 90 inch width and 14 foot length criteria, citing that he felt' it was too harsh and would impose hardships -on a number of recreational vehicle owners. Commissioner Gibson inquired if the Staff had determined the number of commercial vehicles in the City and facilities for storing. Bryan Austin stated that there was no data source for determining the,number of such vehicles. David Miller addressed the Commission and gave a background history of the citizens committee and discussed'•the problems and need for keeping vehicles overnight. He discussed the police problems connected with keeping -the vehicles in storage yards. -2- 7/27/76 - PC I Minutes: H.B. Planning Commission Tuesday, July 27,- 1976 Page 3 Earl Gabriele addressed the Commission and expressed concern over restrictions in parking on street while loading and unloading his recreational vehicle, citing that much preparation is necessary prior to leaving on a trip in an -RV. Bob Board addressed the Commission and stated that original intent of the City was to try to solve the problem of heavy tractors parked overnight. Sergio Martinez, a member of the Planning Department Staff, addressed the Commission, stating that he was not addressing them as a member of the Staff but as a concerned citizen. He expressed opposition to provisions of Code Amendment 76-9 that would allow oversize'. vehicles to be parked in driveways, citing safety hazards resulting from obscured vision. The public hearing was closed. Commission discussed the need for additional study on certain portions of this Code Amendment. There was further discussion on that portion of Code Amendment No. 76-9 entitled "Interior Side Yard Setback Requirement" Subsection (c). ,ON MOTION BY GIBSON AND SECOND BY NEWMAN THE PORTION OF CODE AMEND- MENT NO. The public hearing was.opened. Ms. Edith -Moffett addressed the Commission and discussed the need for this ---type of -home occupation which would allow swimming lessons to be given in the home. Ms. Wells addressed the -Commission and -also discussed the need for this type of --use in the home. The public hearing -was closed. The Commission -discussed the Code Amendment and the possible processing of it through'an Administrative_Review. There 'was a discussion on the conditions which, should be imposed,'namely'a requirement for -the owner to carry certain -liability insurance,, -and level -of training require'd,of an instructor. Planning Commission Tuesday, July 27, 1976 Page 5 RESOLUTION NO. 1171 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA RECOMMENDING APPROVAL OF PRECISE PLAN OF STREET ALIGNMENT NO. 76-3 TO PROVIDE EAST -WEST ACCESS BETWEEN BOLSA CHICA AND WARNER AVENUE ON MOTION BY SLATES AND SECOND BY BOYLE RESOLUTION NO. 1171 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: Parkinson, Boyle, Slates, Gibson, Newman NOES: None ABSENT: Finley, Shea CONDITIONAL USE PERMIT NO. 76-18 Applicant: Walt Babcock This is a request to establish a handball/racquetball club on an R3 site located on the southeast corner of Warner Avenue and Sims Street. The facilities will include 8 courts, a small office area (250 square feet), saunas, and locker facilities. Jim Palin stated that he had no information to add to that con- tained in the staff report. A vugraph was presented. The public hearing was opened. Ms. Margaret Wilkins expressed concerns about the property being buildable. Jim Palin explained that any approval of development would be contingent upon filing a tentative map to establish legal building rights. Ralph Clark stated that he was not in favor of the project due to traffic problems it might cause. He further stated that he was in favor'of residential.use for that property. He cited further reasons for his opposition as the night lighting, night sweepers, and the possibility that the use might eventually fail which would create a problem for the City. Mr. Geraci, owner of property across the street from the proposed project, stated that he felt if this use was permitted at that location both sides of the street should be commercially zoned. Art Jacobs, Gibbs Architects, stated that this would be a small scale facility and would not attract large groups of people. Mola This is a request to construct a general-public'membership racquet- ball club to -serve the -Huntington Beach area. The -project will consist of four (4) indoor handball/racquetball courts, an exercise room, locker area, and bathing facilities. It is anticipated that 5400 square feet -of -rentable office space11will complement the athletic endeavor.- The -site area 'is approximately_.9 acres and is located at the northwest corner of Warner -and -Roosevelt. Peter Von-Elten,-attorney-for Mr. Molar -questioned -Condition No. 5 which would require that prior, -.to issuance -of -building permits, the applicant would. -have to _submit -,:to the. - FAA_ -and- the' State Division of Aeronautics the proposed plan for review and approval. Mr. Von Elten was advised that the Airport Land Use Commission for Orange County had advised the City that the Commission had moved to recommend approval of the"building so long as it complies with FAA criteria. -6- 7/27/76 -',PC Minutes: H.B. Planning,Commission Tuesday, July 27, 1976 Page 7 Mr. Nerio, of Meadowlark Airport, expressed his opposition to the use. He felt it would be hazardous, that the proposed building is right under the take -off pattern. He presented to the Staff for filing a petition which he stated contained 341 signatures of citizens in opposition to this use. Jim Caruthers, a pilot, spoke against the location of the project. He felt it was an encroachment on the rights of the airport. The operator ofa restaurant at the airport spoke in opposition to it. George Sandy was opposed to any move to develop the property due to the safety aspect. L. Hofsteder spoke in opposition to the use. Gordon Young, realtor and agent for the seller, addressed the Commission and stated that if the land could not be built upon the owner should be reimbursed. The public hearing was closed. ON MOTION BY BOYLE AND SECOND BY PARKINSON CONDITIONAL USE PERMIT NO. 76-14 WAS CONTINUED TO AUGUST 17, 1976 FOR DECISION ONLY BY THE FOLLOWING VOTE: AYES: Parkinson, Boyle, Slates, Gibson, Newman NOES: None ABSENT: Finley,. Shea CONDITIONAL USE PERMIT NO. 76-19 Applicant: Keller-Mi.l•ler Corporation This is a request to permit the development of a private handball/ racquetball club on an industrial site that is located in the Kaiser Aetna Industrial Park. The facilities will include ten (10) courts, exercise rooms, sauna, jacuzzi, lounge area, and off-street parking facilities. The property is located east of Bolsa Chica, one-half mile south of Bolsa. A vugraph was shown. Jim Palin addressed the Commission and stated that he had not information to add to that contained in the Staff 'Report. The proposed -plan -is in substantial conformance with applicable provisions of the Huntington Beach Ordinance Code. 2. The proposed -use ;is'_ ;compatible with existing land uses of the area and can be anticipated to be compatible with the long term industrial land uses that will -result from -the present zoning. _.. Planning Commission Tuesday, July 27, 1.976 Page 9 CONDITIONAL EXCEPTION 76-25 - APPEAL TO DENIAL Applicant and Appellant: QRS Corporation This is an Appeal to denial by the Board of Zoning Adjustments of a request to permit an additional free-standing sign to be located on an existing shopping center in lieu of Section 9764.3.1.2(a), and to allow such sign to have.an excess area of 81 square feet over the permitted 185 square feet in lieu of Section 9764.3.1.2 of the Huntington Beach Ordinance Code. The property is located on the east side of Gothard Street approximately 260 feet north of Edinger Avenue. Jim Palin stated that he had no information to add to that con- tained in the Staff Report. The public hearing was opened. Bob Van Gerpen, representing QRS'Corporation, addressed the Com- mission and stated that their appeal was based on the need for the sign in a shopping center which has a high rate of vacancy. He stated that California Federal Savings and Loan, if permitted. the use of the proposed sign, would bring in more tenants with the exposure afforded by the sign and more business to them as well. He further stated that the request is for temporary use not to exceed o,Le year,from May 31, 1976 to May 31, 1977. Mr. Jim Mears, California Federal Savings and Loan, addressed the Commission and stated that they were occupying' temporary headquarters and would be relocating within a year. He further stated that they had only opened 90 new accounts since being at that location which was far under normal for new accounts. The public hearing was closed. ON MOTION BY PARKINSON AND SECOND BY BOYLE APPEAL TO DENIAL OF CONDITIONAL EXCEPTION 76-25 WAS APPROVED WITH THE FOLLOWING CONDITION AND FINDINGS: CONDITION: A bond in the amount to be determined by the'Planning'Department shall be posted to insure removal of such sign by.May 31, 1977.. FINDINGS: 1. An economic hardship would be imposed upon the -shopping center if not permitted the proposed sign. 2. The proposed sign -is -a- monument type sign with -a =height •of tori (10) feet and an actual sign area of eighty-four (84) square feet. It is pro- posed to be located in a landscaped triangular area formed by the southwest intersection of Warner"Avenue"and Algonquin Street. A vugraph was shown. Jim Palin stated that he had no information to add to that contained in the Staff Report. = _ = The public"hearing was opened. - Bruce Young, representing the Huntington Harbour Corporation, stated that he had read the Staff Report and was prepared'to answer any questions. A resident who stated'that-he-resided' in'the Tennis Estates spoke in opposition to the -sign due to the added light it would generate. The public hearing was closed. Commission discussion ensued. ON MOTION BY PARKINSON AND SECOND BY BOYLE CONDITIONAL'EXCEPTION NO. 76-05 WAS APPROVED_ "WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The planning,.design, and locationofthe subject commercial• center was -based on --the requirements.=and direction,of the, -- proposed Route 1 Freeway. The-subsequent-'deletion,'of-this•freeway has resulted in -a less desirable -commercial location in -terms of traffic -volumes and --,the necessary orientation to -the -arterial highway.- The -requested off -site -sign would provide additional direction to the center from Warner Ave. 2. The proposed sign does not impact or adversely affect -other signs since there'are no•'other•surrounding signs in -the immediate. vicinity. 3. Ed Selich addressed the Commission and stated that the Staff had ' reevaluated the recommendations .outlined in the Staff Report dated July 20th, 1976, and upon further consideration felt that the PD designation was more appropriate. Williams addressed the Commission and stated that he felt the property should be developed in fourplexes and triplexes and that he did no-- wish to put a planned development on the property. Tuesday, July 27, 1976 Page 13 TENTATIVE TRACT.9328 Applicant: Vincent J. Stagliano Tentative Tract 9328 was originally a request to subdivide 3.94 acres into 17 lots for multi -family dwelling units (4-plexes) and was initially filed by the applicant on April 2, 1976. A revised tentative tract map was submitted to the City on June 23, 1976. The revision was required because of a change in zoning philosophy by City Council with resultant and subsequent modification to the General Plan, whereby the integrity of a 250-foot strip of commercial zoning was maintained along the east side of Beach Boulevard. The revised tentative map is a proposal to divide 2.25 acres of land into 10 multi -family units with a 300' x 250' lot remaining on Beach Boulevard for commercial development. The property is located on the southeast corner of Beach Boulevard and Constantine Drive. Discussion on Tentative Tract 9328 was combined with: TENTATIVE TRACT 9327 Applicant: The Buccola Company Tentative Tract 9327 was originally a request to subdivide 7.5 acres intc 32 lots for multi -family dwelling units (4-plexes) and was filed by the applicant on April'l, 1976. A similar decision by City Council to keep a commercial strip on the east side of Beach Boulevard resulted in a revised tentative map to divide 4.9 acres of land into'20 multi -family lots and leave a 2.6 acre parcel along Beach Boulevard for commercial. development. - This property is located on the Bortleast corner of Beach Boulevard and Garfield Avenue. A discussion ensued on the installation of community antenna television as an added condition of approval. B. G. Williams stated that he had no objections to the condition. W. Muller, representing Stagliano, stated that he had no objections to the conditions of approval.
