Chairman Pro Tem Boyle, on behalf of the Commission, congratulated

CODE AMENDMENT 76-11 - "Swimming Instruction Permitted"
This code amendment proposes to permit swimming instructions under
the Home Occupation section of the Code through an Administrative
Review process which would include notification to adjacent property
owners of the public hearing on this application.
Acting Secretary Selich gave a brief review of what had transpired
on the preparation of the Code Amendment. He advised the -Commission', __
that there was no necessity for includingany type of require_m_ents _
for the instructor in the -Code. ----
The public hearing was opened.
John Waltman spoke in opposition to permitting swimming lessons
in an R1 area. He cited noise as a main reason for his objection.
He further stated that he felt it decreased the value of his property.
Edith Moffatt spoke in favor of the Code Amendment.

solidating and thereby eliminating 97'encyclopedia lots in the Sunset
Heights District. Subject property, as well as the surrounding land,
is presently under a building moratorium (Ordinance 2009): The City

3. The applicant is consolidating 97 "encyclopedia" lots in the
Sunset Heights District, and such consolidation is highly
encouraged by the City Council.
CONDITIONS OF APPROVAL:
1. The map received and dated July 29, 1976, shall be the approved
tentative tract map.
2. The developer shall dedicate all vehicular access rights on
Bolsa Chica Street to the City of Huntington Beach, except as
may be temporarily required at Lot No. 1.
3. Any two-story structures backing onto Bolsa Chica Street shall
require architectural review by the Planning Department.
4. Streets A and B shall be fully improved and dedicated to the
City of Huntington Beach as required by the Department of Public
Works.
5. The sewer, water, and fire hydrant systems shallv�be designed
to City standards and shall be through the City of Huntington
Beach's utility systems.
6. The property shall be subject to the local drainage assessment
district rFquirements and fees.
7: Drainage for the subdivision shall be approved by the Department
of Public Works prior to recordation of the final map. The
system shall be designed to provide siltation and erosion con-
trol both during and after construction of the project.
8. If the developer proposes to provide air conditioning, the insu-
lation in ceilings and exterior walls shall be a minimum of
R-19 and R-11, respectively. If no air conditioning is to be
provided, the insulation in ceilings and exterior walls shall
be a minimum of R-13 and R-7, respectively.
9. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.
10. Natural gas and 220V electrical shall be stubbed in at the
locations of clothes dryers. Natural gas shall be stubbed in
at the locations of cooking facilities, water heaters, and
central heating units.
11. The structures on subject property, whether attached or detached,
shall be constructed in compliance with the Stag. Acoustical
Standards set forth for all units that lie within the 60 CNEL

ON MOTION BY SLATES AND SECOND BY SHEA TENTATIVE TRACT 9431X WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL
BY THE FOLLOWING VOTE:
FINDINGS:
1. The proposed subdivision of this 18+ acre parcel of land is zoned
M1 (light industrial) and contains lot sizes in conformance with
the Huntington Beach Ordinance Code.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation for
this type of housing.
3.- The property was previously studied for this intensity of land
use at the time.the land use designation for light industrial
was placed on said property.
4. The lot size, depth, frontage, street widths, and all other
design and improvements features of the proposed subdivision
are proposed to be constructed in compliance with standard
plans and specifications on file with the City, as well as
in compliance with the State Map and supplementary City Sub-
division Ordinance.
CONDITIONS OF APPROVAL:
1. The tentative map received and dated July 28, 1976 shall be the
approved layout.
2. The width of the proposed street shall be 46 feet with the
public right-of-way extending six (6) inches behind the curb
face. A four and one-half (4.5) foot public easement shall
exist on each side of the street right-of-way.
3.
A.cross gutter shall not be installed at the intersection of
Slater and the proposed street. Any means used by the appli-
cant to control drainage across the intersection shall be
approved by the Department of Public Works.
4.
A spreading apron shall be provided at the southerly end of the
proposed street. The design shall meet the requirements of the
Department of Public Works.
5.
An eight (8) inch AC water main shall be constructed in the
proposed street and located 10 feet east of the west curb face.
6:
Care must be taken not to allow excessive cut or fill on the
existing easement on the easterly property line mover the exist-
ing 21" water line. The grading plan shall meet with the approval
of the Department of Public Works and Building DeparLment and no
grading permit may be issued until such approval is obtained.

7. A gate or,other method shall be utilized in order -.not to block

The -250 ft. strip along the northwest boundary of the,tract

11. A force main shall be installed by the applicant from the sewer
lift station on Crabb' Lane to the County sewer main on 'Slater

the issuance of any building permits.

In commercial and industrial buildings, the "U" value of the
structures shall offer the equivalent thermal,insulation
characteristics and may be,calculated using ASHRAE methods.

This is a request for a 27 unit planned residential development
located on the east side of Delaware south of Adams.
Chairman Pro Tem Boyle stated that after a reassessment of the
plans submitted which would be required to comply with new
Article 936, the applicant desired to withdraw the request and
pursue the project under the existing Conditional Use Permit 75-20
and Tentative Tract 8984, approved December 2, 1975.

Applicant: American -Hawaiian Steamship Company
This zone change is a request by the applicant to implement the
General Plan Land Use Designation through the appropriate zoning
designation. The change in the land use designation was recently
approved as a part of the revised General Plan Amendment 76-1,
Part A, by both the Planning Commission and City Council. It is
a request for a change of zone from R5, R3, and C3 to R2 on the
north side of Atlanta Avenue, between Beach Boulevard and alley east
of Huntington Street and west side of existing and future Delaware
Street between Detroit and Atlanta Avenue.
Acting Secretary Selich stated that the staff had a request for
the agent for the applicant requesting a two week continuance.
The public hearing was opened. There was no one present to speak
on this zone case and the public hearing was closed.

Conditional Use Permit No. 76-16 is_a request to reestablish a com-
mercial horse stable at the northwest corner of Goldenwest and Ellis.
Conditional Exception 76-34 is a request for the following exceptions:
1. An encroachment of 13 feet into the required 20 foot interior
side yard setback by the mobile home and four -horse barn.
2. A 20 foot encroachment of the riding arena into the front yard
setback.
3. A 13 foot encroachment of two horse stalls into the front yard
setback.
4. An 8 foot encroachment of two paddock areas into the required
exterior side yaid setback.
Mel Tooker gave a brief history of the operation.
The public hearing was opened.

ditions of approval.
Donna Colbert addressed the Commission and spoke against the granting of
a Conditional Exception.

A lengthy discussion ensued on the conditions of approval and amend-
ments which should be made.
ON MOTION BY SLATES AND SECOND BY SHEA CONDITIONAL EXCEPTION NO. 76-34
WAS APPROVED WITH THE FOLLOWING FINDINGS BY.THE FOLLOWING VOTE:
1. It would not adversely affect the General Plan as the General
Plan has set forth provisions for this type of use at that
location.
2. The use has been in existence with,the buildings at the existing

3. It would not be detrimental to the health, safety and welfare of
the surrounding area as it is developed with similar uses,
with no residential development in the general vicinity.
4. The location of an oil well on the property renders the property
unique in its use as a stable facility, and application of the
existing ordinance provisions imposes a hardship on the applicant.
5. The applicant is willing and able to carry out the purposes for
which the conditional exception is sought and has agreed to
proceed to do so without unnecessary delay. i

the rights -of -way along Ellis Avenue and Goldenwest Street, to
the existing standards established by the Department of Public
Works. Upon -acceptance of the offer to dedicate by the City of
Huntington Beach, the applicant shall be given ninety (90) days
to fully comply with all the setback requirements as excepted.

4. The property shall be subject to local drainage assessment
district requirements and fees. .
5. The applicant shall comply with the requirements of the California
Regional Water Quality Control Board as stated in its letter to
the applicant dated June 25,1976.
6. The landscaping plan shall be reviewed by the Board of Zoning
Adjustments for approval action.
7. The area around the oil operations existing on -site shall be
cleaned of refuse and litter. The berm around the tanks shall be
reshaped and also be .free of trash and debris. All pipelines,
whether gas, oil, or water, shall be placed at least one (1) foot
below ground. Fencing around the pumping unit shall be repaired
or replaced. Fencing shall be placed around the tanks at the
top of the berm.
8. The freestanding sign located on the corner of Goldenwest Street
and Ellis Avenue shall be removed.
9. Temporary placement of waste materials shall not exceed forty-eight
(48) hours in an all -concrete, three -walled open storage bin, with
removal to on- or off -site ranch use or destruction on a schedule
subject to approval of the Orange County Health Department. Size
of storage bin shall depend on projected daily volume of waste
material.
10. Conditional Exception No. 76-34 and Conditional Use Permit No.
76-16 shall be rescheduled for review.by the Planning Commission
on January 18, 1977, to determine compliance with above -stated
conditions and compliance with conditions as set forth in Article
939. Should the Planning Commission find that the applicant has
not complied with the above -stated conditions, the Conditional Use
Permit and Conditional Exception shall become null and void, and
.the applicant shall be required to cease and desist the commercial
stable operation. Should the Planning Commission find that
reasonable effort has been made by the applicant to comply with
the conditions of approval, the Conditional Use Permit and
Conditional Exception shall remain in effect for four and one-half
(4-1/2) years from that review date.

CONDITIONAL USE PERMIT NO. 76-17
Applicant: T. J. Hennes
This is a request to permit the continuance of an existing use
which is a horse stable at property located at the southwest
corner of Goldenwest Street and Ellis Avenue.
The Commission was advised by Mel Tooker that the applicant is
in the process of filing a Conditional Exception for his intended
use and that the staff recommended a continuance to complete
the application so that they could be heard simultaneously.
He stated that the applicant was in agreement to a continuance.
The public hearing was opened and closed. No one was present to
speak on the application.

CONDITIONAL USE PERMIT NO. 76-20
Applicant: Veterans of Foreign Wars - Harold I. Ewell
Conditional Use Permit No. 76-20 is a request to convert a portion
of an existing industrial building into a meeting hall and club
facility for Veterans of Foreign War Post. Two of the five suites
of the existing building, approximately 2400 sq. ft., are pro-
posed to be remodeled by enlarging rest room facilities, adding
a kitchen and finishing interior walls and floors. The existing
building has 22 parking spaces on site with additional spaces which
have been granted for VFW use on an abutting site. The property
is located southwesterly of Crabb Lane and Liberty Avenue.
The public hearing was opened.
Jim Palin stated that he had no information to add to that con-
tained in the staff report.
A vugraph was shown.
Harold Ewell addressed the Commission and stated that he was
in agreement with the conditions with the exception of the require-
ment that on -site parking located in front of the buidling shall
be brought up to the standards of'Article 979.'

and after discussion it was determined that if homeowners in the
area wish to bring the matter back to Planning Commission they could
do so.
