BOARD MEMBERS PRESENT: PALIN, CROSBY, LIPPS CITY STAFF PRESENT: MEL OTT, FIRE DEPARTMENT MINUTES: ON MOTION BY PALIN AND SECOND BY LIPPS THE MINUTES OF THE REGULAR MEETINGS OF JUNE 16, 1976 AND JUNE 23, 1976 WERE APPROVED BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE REGULAR AGENDA ITEMS: ADMINISTRATIVE REVIEW NO. 76-101(Cont. from 7/28/76) Applicant: Hedley Beesley To permit the construction of an 11,500 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordinance Code located on the north side of McFadden Avenue approximately 265 feet west of Graham Street in a 100-M1-A-20,000 Restricted Manufacturing District. The Secretary informed the Board that this application is covered by Environmental Impact Report No. 73-16, adopted by the City Council on March 18, 1974. The applicant, Mr. Beesley, was present to represent his application. Jim Palin gave a review of the analysis of the plans and noted that the plan is in full compliance with requirements of the Huntington Beach Ordinance Code. He further noted that landscaping met all requirements and that there was a surplus of parking. There was a discussion on the fencing, storm drain easement, and off - site tree location. ON MOTION BY CROSBY AND SECOND BY PALIN, ADMINISTRATIVE REVIEW NO, 76-101 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: H.B. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Two CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received July 17, 1976 shall be the approved layout subject to the modification described herein: a. Plan shall reflect 10 ft. storm drain easement along easterly property line. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modification outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or system= shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitte to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. -2- BZA 8/4/76 H.B. Street trees shall be installed in full compliance with the City of Huntington Beach standards and requirements. AYES: PALIN, CROSBY,LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-38 Applicant: Michael Janes To permit a two lot division of land pursuant to Section 9930.2 of the Huntington Beach Ordinance Code located at the southeast corner of Stark Street and Parkside Lane in an R3, Medium Density Residential District. The Secretary informed the Board that Negative Declaration No. 76-64 was approved by the Environmental Review Board on August 3, 1976. George Alvarez, was present to represent the application. Board discussed proposed plan with applicant. It was noted that parcels one and two are proposed to be developed concurrently. Secretary Palin noted that off site street improvements on Stark Street and Parkside Lane should be constructed in one phase concurrently with development of the first parcel. Board discussion followed. Conditions of approval were discussed on the two parcels. ON MOTION BY PALIN AND SECOND BY CROSBY NEGATIVE DECLARATION NO. 76-64 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOL- LOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 76-28 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: -3- BZA 8/4/76 H.B. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Four CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on July 14, 1976 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Stark Street and Parkside Lane shall be dedicated to City standards at the time said parcel(s) are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcel(s) are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel(s) are developed. 6. All utilities shall be installed underground at the time said parcci (s) are developed. 7. Compliance with all applicable City Ordinances. 8. Off site street improvements on Stark Street and Parkside Lane should be constructed in one phase concurrently with develop- ment of the first parcel. 9. The property shall participate in the local drainage assessment district at the time said parcel(s) are developed. (Contact the Department of Public Works for additional information.) 10. Hanshaw To permit the establishment of a portable ice house pursuant to Section 9472 of the Huntington Beach Ordinance Code located on the east side of Goldenwest Street, approximately 120 ft. north of Warner Avenue in a C4, Highway Commercial District. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Five The Secretary informed the Board that this application is a categorical exemption, Class III, California Environmental Quality Act, 1970. The applicant was not present at the meeting. The Chairman opened the public hearing. Mr. Ben Kanter, 6937 Warner Avenue addressed the Board and stated his opposition to the proposal. Mr. Kanter stated that a portable type building would not provide a convenience to the public and further Stated that such an establishment would give the applicant an uncompetitive business advantage. Mr. Kanter cited various other businesses in the neighborhood that sell ice; whereby he felt the additional portable in- stallation was unnecessary. There being no further parties present to speak for or against the application, the Chairman closed the public hearing. Board discussion followed. It was the consensus of the Board to continue the application to allow the applicant to be present at the hearing. ON MOTION BY CROSBY AND SECOND BY LIPPS, USE PERMIT NO. 76-43 WAS CONTINUED TO AUGUST 11, 1976 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE Mr. Kanter was informed by the Board that the application had been continued for one week should he decide to be present at the hearing. CONDITIONAL EXCEPTION NO. 76-35 Applicant: Sigma Medical Enterprises, Inc. To permit a sign to encroach 17 feet into the required 20 foot side lot line setback in lieu of Section 9763.3(a) of the Huntington Beach Ordinance Code located on the west side of Beach Boulevard approximately 290 feet south of Cypress Avenue in a C4, Highway Commercial District. The Secretary informed the Board that this application is a cate- gorical exemption, class V, California Environmental Quality Act, 1970. Mr. Michael Chase was present to represent the application. -5- BZA 8/4/76 H.B. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Six The Chairman opened the public hearing. Mr. Chase gave a brief summary of the proposed requests in the conditional exception, emphasizing that he planned to acquire adjoining property and the location of the proposed sign would be in the center of the property should he be able to acquire the property. There being no further parties present to speak for or against the application, the Chairman closed the public hearing. A discussion followed on parking, turning radius and circulation, and the possibility of locating the sign in another area. Mr. Chase stated that the property to the north was an equipment rental establishment which did not have.a sign, and a sign in that area would block the view of a sign for the equipment rental establishment should they wish to ever install one. Secretary Palin stated that the conditional exception does not have proper justification and that he would like to see additional documentation of what now exists on the property, the ultimate location of the driveway. Mr. Palin requested further justification for location of sign along south property line. Chairman Crosby stated that he would like to see a median opening_ in conjunction with the property, and that all power poles are to be shown on revised drawings. It was the consensus of the Board to continue the application to allow applicant to revise his plans depicting additional information requested by Board. Applicant concurred with continuance. ON MOTION BY PALIN AND SECOND BY LIPPS, CONDITIONAL EXCEPTION NO. 76-35 WAS CONTINUED UNTIL AUGUST 11, 1976 BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-97 Applicant: Robert Anderson To permit a 2400 square foot industrial building pursuant to Section 9530 of the Huntington Beach Ordinance Code located on the east side of Crystal Street, approximately 155 feet south of Garfield Avenue in an Ml, Light Industrial District. The Secretary informed the Board that the Environmental Review Board approved Negative Declaration No. 76-65 on August 3, 1976. -6- BZA 8/4/76 H.B. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Seven Mr. Robert Anderson was present to represent the application. The Board informed Mr. Anderson that five feet of dedication along the north property line of lot 13 was required. It was noted that the proponent must comply with Ordinance Code requirements on the installation of a block wall along the north and east property line of Lot 13. Mr. Anderson stated that the proposed use for the structure is a meter repair shop. Conditions of approval were discussed. ON MOTION BY PALIN AND SECOND BY CROSBY NEGATIVE DECLARATION NO. 76-65 WAS ADOPTED BY THE BOARD OF ZONING ADJUSTMENTS BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY, ADMINISTRATIVE RRVIRW NO. 76-97 WAS l,PPROVED WITH THE FOLLOING'CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received and dated July 14, 1976, shall be the approved layout, subject to the modifications described herein: a. Applicant shall dedicate five (5) feet along north property line of lot 13. A plan delineating said modification shall be submitted to the Secretary of the Board. If such plan complies with the modifi- cations outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. -7- BZA 8/4/76 H.B. In accordance with the City's street standards and require- ments, an additional five (5) feet of right-of-way on the north side of -Lot 13 shall be dedicated for alley right- of-way. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifi- cations of the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Depart- ment and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the local drainage assessment district for Lot 13. 6. The developer shall participate in the Orange County Sanitatio District "3 Sewer Annex District. 7. All applicable fees shall be paid prior to issuance of building permits. C. GENERAL CONDITIONS: 1. A block wall shall be constructed along the north and east property line of Lot 13 in full compliance with the Huntington Beach Ordinance Code. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-104 Applicant: Rexco Chemical Company To permit the construction of a 13,500 square foot industrial building pursuant to Section 9530 of the Huntington Beach Ordinance Code located on the east side of Gothard Street, approximately 1000 feet south of Talbert Avenue in an Ml, Light Industrial District. -8- BZA 8/4/76 1 H.B. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Nine The Secretary informed the Board that Negative Declaration No. 74-150 was adopted by the Planning Commission on November 19, 1974. Mr. Gordon Mountjoy was present to represent the application. It was noted that the 5 ft. easement was not shown on the plan. Fire Department requirements were discussed and it was noted that the applicant had proposed future expansion of the structure. The Board noted that the applicant should consider parking for any future expansion proposed. Conditions of approval were discussed. ON MOTION BY PALIN AND SECOND BY LIPPS, ADMINISTRATIVE REVIEW NO. 76-104 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received July 26, 1976, shall be the approved layout, subject to the modification described herein: a. Applicant shall comply with a 15 ft. setback from the curb. A plan delineating said modification shall be submitted to -the Secretary of the Board. If such plan complies with the modifications outlined by the Board, said plan shall be ap- proved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. -9- BZA 8/4/76 H.B. AYES: PALIN, CROSBY, LIPPS NOES: NONE ABSENT: NONE MISCELLANEOUS: CONDITIONAL EXCEPTION NO. 76-31 - CLARIFICATION OF CONDITION OF APPROVAL The Board clarified a condition of approval to Mr. Truempler and Mrs. Harry Hirao, adjoing property owners of proposed Conditional Exception No. 76-31. The Board noted that the applicant would have to ccmply with conditions of approval as set forth by the Board of Zoning Adjustments. -10- BZA 8/4/76 1 H.B. Board of Zoning Adjustments Wednesday, August 4, 1976 Page Eleven TENTATIVE TRACT 8011 (ALTERATION OF CONDITION OF APPROVAL) Applicant: Classic Development A communication has been directed to the Department of Building and Community Development stating that the Board of Zoning Adjustments concurred with the developer to utilize turf block treatment in their development in lieu of raised planter with trees as had been previously conditioned. SIGNS: Sign Request No. 7835 Applicant: Magnolia Shopping Center Request for approval of sign theme for shopping center. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD APPROVED THE SIGN THEME FOR THE MAGNOLIA SHOPPING CENTER WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: 1. The pedestal base shall carry a similar color and stucco material as that used on the main buildings. 2. The tenant panels on the pylon sign shall be of an opaque blank material until such time as identification panels are establishes for each use.
