Applicant: Rodney B. Lauter
To permit the division of a 110-foot parcel of land into two 55-
foot parcels pursuant to Section 9930 of the Huntington Beach
Ordinance Code, located on the west side of Delaware Street approxi-
mately 190 feet north of Yorktown Avenue, in an R2, Medium Density
Residential District.
The Chairman informed the Board that this request is covered by
Negative Declaration No. 74-14, adopted by the BZA on March 13, 1974.
Secretary Palin informed the Board that this application is in
conjunction with Conditional Exception No. 76-07, pending before
the Planning Commission.

Applicant: William D. Hanshaw
To permit the establishment of a portable ice house pursuant to
Section 9472 of the Huntington Beach Ordinance Code, located on the
east side of Goldenwest Street approximately 120 feet north of
Warner Avenue in a C4, Highway Commercial District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. Mr. Hanshaw and George Casto
were present to represent the application: Mr. Hanshaw addressed the
Board to explain his need for the project.
Mr. Kanter, businessman in the area, addressed the Board in opposition
to the proposed project, citing the unfair business advantage such a
use would give the applicant. There being no other persons present
to speak in regard to the project, the public hearing was closed.
Secretary Palin expressed concerns about the size and location of the
facility, pointing out that it will encroach into the drive widths,
necessitating removal of the parking spaces at the rear of the building.
The Board discussed the parking on the site and whether or not the
rear spaces were required to fulfill the requirements, dimensioning of
the facility, and the means of bringing the total facility up to code
as far as landscaping, parking, and access and circulation are con-
cerned.
ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-43 WAS
CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO PERMIT SUBMITTAL
OF A REVISED PLAN, TO THE MEETING OF AUGUST 25, 1976, BY THE FOLLOW-
ING VOTE:

Applicant: Sigma Medical Enterprises, Inc.
To permit a sign to encroach 17 feet into the required 20 foot side
lot line setback in lieu of Section 9763.3(a) of the Huntington Beach
Ordinance Code, located on the west side of Beach Boulevard approxi-
mately 290 feet south of Cypress Avenue in a C4, Highway Commercial
District.
The Chairman informed the Board that this request is a Categorical
Exemption, Class V. California Environmental Quality Act, 1970.

The Chairman opened the public hearing. Michael Chase was
present to represent the application.
Secretary Palin noted that this request had been continued
to allow applicant to submit a revised plan showing the proper
width on the curb cut and the screening and upgrading of the
site in compliance with prior conditions of approval. Said
revised plan has been received and was reviewed by the Board.
The applicant explained his reasons for not relocating the sign
suggested at the prior hearing.
There being no other persons to speak for or against the pro-
posed exception, the public hearing was closed.
The Board reviewed the access to the property and alternative
placement for the sign. It was the consensus of the Board
that insufficient hardship had been shown to justify the en-
croachment as requested.
ON MOTION BY LIPPS AND SECOND BY CROSBY CONDITIONAL EXCEPTION
NO. 76-35 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING
VOTE:
REASONS FOR DENIAL:
1. The applicant has failed to deomonstrate sufficient hardship
to justify the granting of the request.
2. Granting of the request would constitute granting of special
privilege not generally enjoyed by other properties in the
area.
3. The proposed sign could be relocated to the center of sub-
ject property and conform to the ordinance Code requirements.

Applicant: McDonnell Douglas Astronautics Co.
To permit a 90,000 square foot addition to an existing industrial
structure pursuant to Section 9511 of the Huntington Beach Ordin-
ance Code, located at the northeast corner of Bolsa Avenue and
Bolsa Chica Street in an M1-A, Restricted Manufacturing District.
The Chairman informed the Board that Negative Declaration No.
76-66 was granted by the Environmental Review Board for this
request on August 10, 1976.

Joe Valinsky was present at the meeting and addressed the Board to
explain the project as proposed.
The Board reviewed the request, taking into consideration the parking
ratios as they exist and whether or not the addition will affect
said ratios. At the applicant's request the need for insulation of
the addition was reviewed, as well as the heating and exhaust systems
provided. It was the consensus of the Board that the requirement for
insulation would not in this case be necessary.

Applicant: Donald P. Jones
To permit the construction of a 21,000 square foot shopping center
pursuant to Section 9472 of the Huntington Beach Ordinance Code,
located on the west side of Beach Boulevard approximately 250 feet
north of Warner Avenue in a C4, Highway Commercial District.
The Chairman informed the Board that Negative Declaration No.
76-29 was adopted by the Board of Zoning Adjustments for this pro-
ject on April 28, 1976.
The Chairman opened the public hearing. Donald Jones and George
McCracken were -resent to represent the application. Mr. McCracken
addressed the Board to explain the site plan and layout. There
being no other persons present to speak on the project, the public
hearing was closed.
The Board reviewed the project. Chuck Burney pointed out that
there are problems in providing fire equipment access to the
rear of the property, and Secretary Palin noted that double stacking
of the drives would greatly. increase the efficiency of the project.
ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-44 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE
FOLLOWING VOTE:
FINDINGS OF THE BOARD:
1. The establishment, maintenance, and operation of the use
will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2. The granting of a Use Permit will not adversely affect the
Master Plan of the City of Huntington Beach.

CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS:
1. Use Permit No. 76-19, approved for subject property on
April 28, 1976, shall become null and void.
2. The conceptual plot plan received July 22, 1976, shall
be the approved layout, subject to the following:
A revised plan shall be submitted to the Fire Department
to assure for proper circulation and access to the rear
of the property. Said plan shall afford a 17.5 foot inside
and a 45 foot outside turning radius and shall be subject
to approval of the Fire Department.
In its approval action, the Board of Zoning Adjustments considered
the following issues relating to the conceptual plan:
. Traffic circulation and drives;
. Parking layout;
. Lot area;
. Lot width and lot depth;
. Type of use and its relation to property and improvements in the
immediate vicinity;
Past administrative action regarding this property.
3. The following plans shall be submitted to the Secretary
of the Board:
a. Landscape and irrigation plan complying with Article
979 of the Huntington Beach Ordinance Code and land-
scaping specifications on file in the Department of
Public Works.
b. Rooftop mechanical equipment screening plan. Said plan
shall indicate screening of all rooftop mechanical
equipment and shall delineate the type of material pro-
posed to screen said equipment.
4. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the
Department of Building and Community Development and shall
be subject to approval by that Department.
5. Fire protection systems, including automatic sprinkler
systems, fire hydrants, standpipe systems, fire alarm sys-
tems, and any other required fire protection and detection

devices or systems shall comply with the specifications of
the Huntington Beach Fire Code. Plans for such systems and
devices shall be submitted to the Fire Department and shall
be subject to approval by the Departments of Fire and Public
Works.
6. The developer shall participate in the local drainage
assessment district.
7. The developer shall participate in the Orange County Sanita-
tion District #3 Sewer Annex District.
8. All applicable fees shall be paid prior to issuance of
building permits.
B. GENERAL CONDITIONS:
1. The driveway treatment for this project shall be to the
approval of the City Traffic Engineer.
2. If the developer proposes to provide air conditioning, the
insulation in ceilings and exterior walls shall be a
minimum of R-19 and R-11 respectively. If no air condi-
tioning is to be provided, the insulation in ceilings and
exterior walls shall be a minimum of R-13 and R-7,
respectively.
In commercial and industrial projects, the "U" value of the
structures shall offer the equivalent thermal insulation
characteristics and may be calculated using ASHRAE methods.
3. All building spoils, such as unusable lumber, wire, pipe,
and other surplus or unusable material, shall be disposed
of at an offsite facility equipped to handle them.
4. Natural gas and 220V electrical shall be stubbed in at the
location of clothes dryers, and natural gas shall be
stubbed in at the locations of cooking facilities, water
heaters, and central heating units.
5. Use of energy -saving lighting, such as high-pressure sodium
vapor lamps, should be considered in parking lots.

USE PERMIT NO. 76-45
Applicant: Lawrence D. Schley
To permit the construction of a new dwelling on a parcel having an
existing building with a nonconforming side yard setback pursuant
to Section 9719 of the Huntington Beach'Ordinance Code, located on
the southeast corner of 8th Street and Orange Avenue in the Townlot
Specific Plan Area One, Section A.
The Chairman informed the Board that this request is a Categorical
Exemption, Class III, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. Lawrence Schley was present
at the meeting; he explained to the Board the phasing program he
intends to pursue on this project. There being no other persons to
speak for or against the proposed project, the public hearing was
closed.
Board discussion ensued, taking note that the garage setback does not
comply with code requirements. The phasing was discussed and the
representative from the Department of Public Works agreed that the
a lley dedication could be allowed to take place in conjunction with
the Phase II portion of the project.
ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-45 WAS
APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING

• Type of use and its relation to property and improvements in the
immediate vicinity;
. Past administrative action regarding this property.
2. In accordance with the City's standards and requirements a
twenty (20) foot radius at the intersection of 8th Street
and Orange Avenue shall be dedicated.
3. Soil and compaction reports shall be submitted by a certified
soils engineer. Said reports shall be submitted to the De-
partment of Building and Community Development and shall be
subject to approval by that Department.
4. Fire protection systems, including automatic sprinkler systems,
standpipe systems, fire hydrants, fire alarm systerls, and any
other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be sub-
mitted to the Fire Department and shall be subject to approval
by the Departments of Fire and Public Works.

CONDITIONAL EXCEPTION NO. 76-36
Applicant: Edward Allan Kohler
To permit an existing accessory building to remain as presently loc-
ated with the following deficiencies: 1) encroachment of 10 feet
into the required 10 foot exterior side yard setback per Section
9103.2.2; 2) encroachment of 6 feet into the required 10 foot main
and accessory building separation per Section 9105.1; 3) encroachment
of 15 feet into the required 50 foot front yard setback for accessory
buildings per Section 9105.3(z); and 4) projection of 1 foot over the
permitted 15 foot height limitations for accessory buildings per
Section 9105.4 of the Huntington Beach Ordinance Code, located at
the southeast corner of Glenwood Drive and Shinkle Circle in an R1,
Low Density Residential District.
The Chairman informed the'Board that this request is a Categorical
Exemption, Class V, California Environmental Quality Act, 1970.
The Chairman opened the public hearing. Mr. Kohler was present and
explained to the Board how the construction had taken place in
violation to codes. There being no other persons to speak for or
against the project, the public hearing was closed.
Board review ensued, taking into consideration the magnitude of the
encroachments, alternative locations on the site, and the mandatory
finding of hardship necessary for granting of the request. .
ON MOTION BY PALIN AND SECOND BY LIPPS CONDITIONAL EXCEPTION NO.
76-36 WAS DENIED FOR THE FOLLOWING REASONS, BY THE FOLLOWING VOTE:
REASONS FOR DENIAL:
1. The applicant has failed to demonstrate sufficient legal hard-
ship to justify granting of this request.
2. Favorable action on this request would set a dangerous precedent;
due to the magnitude of the encroachments requested.
3. There is sufficient space available on the subject property to
accommodate relocation of at least a portion of the encroaching
facility.

Manufacturing District.
The Chairman informed the Board that this request is covered
by EIR No. 73-16, adopted by the City Council on March 18, 1974.
Gary Lamb was present to represent the application.
The Board reviewed the request and found it to be in compliance
with applicable provisions of the code. Secretary Palin in-
formed the applicant that the up -coming change in the turning
radius for industrial projects from 27 to 25 feet would allow him
an additional two feet on the building if he would desire to
add it.

To permit the construction of a 9400 square foot industrial building
pursuant to Section 9511 of the Huntington Beach Ordinance Code,
located on the west side of Chemical Lane approximately 280 feet
south of McFadden Avenue in a 100-M1-A-20,000, Restricted Manufactur-
ing District.
The Chairman informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
Donald Penkoff and Dave Ariss were present at the meeting.
Secretary Palin noted that the submitted plan is not in compliance
with code requirements in the areas of drive width and encroach-
ment of supporting columns into the front setback. Discussion took
place regarding alternatives to the canopy structure supported by
the encroaching columns and alternative location of the building on -
site to provide adequate drive access to the rear and additional
parking spaces. It was the consensus that provision of a reciprocal
drive with the property to the north side of subject project would
solve the developmental problems.

Applicant: Nick Becker
To permit the construction of a 24,000 square foot industrial
building pursuant to Section 9511 of the Huntington Beach
Ordinance Code, located at the southeast corner of McFadden
Avenue and Graham Street in a 100-M1-A-20,000, Restricted
Manufacturing District.
The Chairman informed the Board that this request is covered
by EIR 73-16, adopted by the City Council on March 18, 1974.
Fred Mayer and Dave Krohn were present to represent the application.
Bruce Crosby reported to the Board that all vehicular access
rights on McFadden were dedicated to the City on the approval
of T7090 except for reciprocals between Lots 1 and 2 and 3 and
4. This plan indicated a drive on McFadden and two drives on
Graham, when according to the recorded map only drive allowed
would be a common drive at applicant's southerly lot. Approval
of this plan cannot be granted unless the City Council should
concur upon application to a vacation of the access require-
ments. The applicant was also informed that there is no longer
a raised median planned in McFadden Street at this location.
After review it was the consensus to continue this item to
allow the developer time to determine how he would proceed with
the project.

other required fire protection and detection devices or systems
shall comply with the specifications of the Huntington Beach
Fire Code. Plans for such systems and devices shall be sub-
mitted to the Fire Department and shall be subject to approval
by the Departments of Fire and Public Works.
6. The developer shall participate in the local drainage assess-
ment district.
7. All applicable fees shall be paid prior to issuance of build-

B. GENERAL CONDITIONS:
1. If the applicant proposes to provide air conditioning the
insulation in ceilings and exterior walls shall be a minimum of
R=19 and R-11, respectively. If no air conditioning is to
be provided, the insulation in ceilings and exterior walls shall
be a minimum of R-13 and R-7, respectively.
In commercial and industrial projects, the "U" value of the
structures shall offer the equivalent thermal insulation
characteristics and may be calculated using ASHRAE methods.
2. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at
an offsite facility equipped to handle them.

Applicant: Jesse T. Jones
To permit the construction of a 10,000 square foot industrial build-
ing pursuant to Section 9511 of the Huntington Beach Ordinance Code,
located on the west side of Industry Lane approximately 240 feet north
of Research Drive in a 100-M1-A-20,000, Restricted Manufacturing
District.
The Chairman informed the Board that this request is covered by
EIR 73-16, adopted by the City Council on March 18, 1974.
Mrs. Jesse Jones was present at the meeting.
Board review revealed deficiencies in the submitted plan in parking
spaces provided, drive width, and landscaping. The applicant indi-
cated that the use proposed would serve the abutting use (also owned
and operated by the applicant) as a warehousing facility; it was
noted that the eradication of the lot line between the two buildings
would then be required. Further review covered ingress -egress and
parking ratios for this special use building.
