COMMISSIONERS PRESENT: Parkinson, Gibson,- Finley, Slates, Shea, Newman, Boyle COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE. ELECTION OF OFFICERS: Acting Chairman Selich called^the meeting to order and announced that an election of officers would be conducted by secret ballot. A MOTION WAS MADE BY GIBSON AND SECONDED BY NEWMAN TO NOMINATE COMMISSIONER SLATES`, FOR CHAIRMAN. A MOTION WAS MADE BY PARKINSON AND SECONDED BY FINLEY TO NOMINATE COMMISSIONER BOYLE FOR CHAIRMAN. The nominations were closed. The vote was taken and it was announced that Commissioner Slates was elected Chairman. The Acting Chairman cast a unanimous ballot for Commissioner Slates for Chairman. Chairman Slates called for nominations for Vice Chairman. A MOTION WAS MADE BY PARKINSON AND SECONDED BY FINLEY TO NOMINATE COMMISSIONER BOYLE FOR -.VICE CHAIRMAN. A MOTION WAS MADE BY NEWMAN AND SECONDED BY SHEa_TO NOMINATE. COMMISSIONER GIBSON FOR VICE CHAIRMAN. Councilman Shenkman, recently appointed as Council Liaison Represent- ative to the Planning Commission, addressed the Commission and stated that he -would be attending as many meetings as possible. He further encouraged each member of the Commission to communicate with him as the Liaison Representative by telephone'or in person. Planning Commission Tuesday, August 17, 1976 Page 3 ZONE CASE NO.'76-20 Applicant: City of Huntington Beach Planning Department This is a request for a prezone on 1603.12 acres of land to RA-02, ROS-01, and ROS. This property is bounded by Pacific Coast Highway on the west, Warner Avenue on the north, and City boundary on the east and south. Acting Secretary Selich stated that another public hearing would be held necessitated by the revised zoning proposal. Tom Moseley presented vugraphs and gave an overview of the project. The public hearing was opened. Gretchen goad, representing Amigos of Bolsa Chica, addressed the. Commission and stated that she felt the Solsa Chica should.be , prezoned RO5 in order to avoid being annexed as R1. ` v Councilman Shenkman, speaking as'an individual and not in_behalf _ __ of the Council, stated that he felt the 'area should'be completely master planned prior to any_cevelopment. Margaret Carlberg, representing the Huntington -Beach Environmental Council',,read their position to -the Commission. The Environmental Council was in favor of increasing the ROS zoning. They felt that the potential on high schools and sewer capacity should be assessed, and that.the existing plans for an ecological preserve should be referenced in the Negative Declaration,. Carol Clark spoke in behalf of the League _of__Women Voters in_ -both --V__ - Seal Beach and Huntington Beach and stated that they would support ROS zoning, and'that'they favored preservation of Bolsa chica as an ecological preserve. Herb Chatterton, President of Amigos of Bolsa_ Chica, stated that they preferrecl lower'de'nsity, and hoped that ROS could be appropriate. George'Stringer, representing Signal Oil, stated that the reason the open space zoning wasn't appropriate was that the major land owner was opposed" and therefore there could be no annexation. Dan Kemp spoke against;annexation'prior to master planning. The public hearing was closed. Chairman,Slates advised the Commission and audience that the -item will be readvertised-and it will be heard at 7.:00 P.M. on August 31, 1976 in the Huntington Beach Council Chambers at the Civic Center. Planning Commission z Tuesday, August 17, 1976 Page 4 ZONE CASE NO. 76-19 Applicant: American -Hawaiian Steamship Company This -zone change is a request for a change of zone from R5, R3, and C3 to R2. ,.However,'the Staff recommends approval of --this zone change with a modification of adding a Pb, Plan Development Suffix, to the requested R2. The property is located on the north side of Atlanta Avenue, between Beach Boulevard and alley east of Huntington Street and west side of existing and future Delaware Street•between Detroit and Atlanta Avenue. John Cope gave a brief overview of this request and presented a vugraph. The public hearing was opened. Ned Merritt spoke in favor'of the zone change and stated he••had no - objections to the PD suffix being added to the original request. The public hearing was closed. Commission discussion ensued. ON MOTION BY BOYLE AND SECOND BY PARKINSON ZONE -CASE Nb.;76-19 WAS,, APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The requested change of,zone implements the•previously•ado'pted_ land use desia_nation and therefore is in conformance'with.the General Plan. 2. The staff recommendation of a PD Suffix will encourage a variety in housing types while unifying development of the subject property and insuring the preservation of natural physical features of this property. 3. The resultant land uses are enumerated in the Land Use Element and provide for the highest compatibility with the existing adjacent uses. The.public hearing was opened. Ralph Moran, a property owner on Florida Street, addressed the Commission and stated that he felt Plan "B" as modified would-be the best. Mr. Plunkett addressed the Commission, stating that he preferred the plan that would give access to his property which would be • Plan "B" modified. Louis Hernandez, owner of a lot in the area, spoke in favor of Plan "B" as modified. Mike Major spoke in favor of Plan "B" as modified. The public hearing was closed. ON MOTION BY PARKINSON AND SECOND BY BOYLE PRECISE PLAN 76-4, PLAN "B" MODIFIED, WAS APPROVED WITH THE FOLLOWING FINDINGS BY THE FOLLOWING VOTE: 1. The design of the proposed alignment will not be detrimental to the health and general welfare of area residents. 2. The proposed alignment, in fact, solves a circulation problem that had prevailed in that area for many years. 3. Public safety vehicles are assured adequate and sufficient access in case of emergency. 4. It can be seen with certainty that the proposed project will not result in a substantial adverse effect upon the environment. 5. Various alternative alignments have been assessed and discarded in•favor of that alignment proposed to be.adopted by the Planning Commission. 6. Minimum grading will"result from the proposed alignment. 7. The proposed alignment allows sufficient latitude for future_ developers to take advantage of unique residential designs. Mrs. Brady, Appellant, addressed the Commission and stated -that she and her husband:had,purchased:this home„ten:years.,ago_and at the time they-bought,it the garage,had•,been_•converted into a. family.- room. ...She , further , stated that, she ..did • .not•: ;realize she -was in violation of„the,code-until she received a notice to' -reconvert the garage back to its original use within a fourteen day period. The Commission inquired as to.what brought about the notice of. violation. Walt Lipps, Building Department representative, stated that the. notice of. ,violation _was ,brought to :the - attention of, the Building Department by a group of -Huntington Harbour, residents. ON MOTION BY BOYLE AND SECOND BY PARKINSON APPEAL TO DENIAL OF CONDITIONAL EXCEPTION NO. 76-32 WAS.DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: 1 ;6- 8/17/76 --PC., Minutes: H.B. Planning Commission Tuesday, August 17, 1976 Page 7 , 1. Subject property is a conforming lot, with no building constraints or unusual circumstances to justify granting of the Conditional Exception. f 2. The applicant has failed to demonstrate sufficient legal hardship to justify granting of the exception. 3. Granting of this request would constitute granting of special privilege not enjoyed by surrounding residential properties. 4. The plan submitted is not in conformance with the setback re- quirements of the district in which it is located. 5. Granting of this request with the encroachment into the required setbacks would serve to establish an undesirable precedent within the City. John Cope presented a slide of the area and gave a brief background report on the history of the request. The public hearing was opened. Bob Van Gerpen addressed the Commission and stated that the pro- posed -sign was to be a soft -sell image on the corner of wood construction with no lighting, and that it would be in keeping with the character of the neighborhood. Hans Smith, resident of'the area, spoke in opposition to the construction of the sign, stating that it would be totally un- necessary. The public hearing was closed Commission discussion ensued. ON MOTION BY GIBSON AND SECOND BY SHEA APPEAL TO DENIAL OF SIGN PERMIT NO. 5177 WAS DENIED FOR THE FOLLOWING REASONS BY THE FOLLOWING VOTE: -7- 8/17/76 - PC Minutes: H.B. CONDITIONAL USE PERMIT NO. 76-24- Applicant:'' � Loyal Order' of Moose #1832 ` Conditional Use Permit No. 76-24 is a request to convert a portion of an existing�industria1­building�into a-�meeting hall and club facility for the: Loyal, Order of Moose. ::Two rof . the, five suites of the existing building, approximately 6400 sq. ft.,are proposed to be remodeled by enlarging rest room facilities, adding a kitchen and finishing.,interior walls and floors. The proposed use is compatible with existing and proposed surrounding uses. 2. The proposed use will not have a detrimental effect upon the general health, welfare, -safety or convenience of persons residing or working in the area. CONDITIONS OF APPROVAL: 1. The site plan dated July 26, 1976 shall be the approved layout. 2. Fire protection system shall be subject to review and approval by the Fire Department prior to the issuance of building permits. Planning Commission Tuesday, August 17, 1976 Page 10 UNDERGROUND UTILITIES COMMISSION Chairman Slates appointed Commissioners Parkinson and,Boyle,to serve on the Underground Utilities Commission. The Commission discussed the problems of handling illegal. -garage conversions., The'staff was directed to make a study of , "Truth ,in - Real Estate"'and'report back to the Commission.' Commissioner'Finiey suggested that a tour of the City would'be beneficial to'thb-Commission. Commission concurred and directed - the staff to set up such a tour for the latter part of September,, 1976. There was a�discussion on development of code of ethics.
