Penkoff To permit the construction of a 9400 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordin- ance Code, located on the west side of Chemical Lane approxi- mately 280 feet south of McFadden Avenue in a 100-M1-A-20,000, Restricted Manufacturing District. The Chairman informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Donald Penkoff was present at the meeting. The Board reviewed the revised plan noting that the 35 foot com- mon drive and curb cut has been shown as required. The setback of the supporting columns was reviewed and the applicant agreed that it would be possible to move the columns back a foot or so and still maintain adequate support for the heavy beam construc- tion. Jerry Ellstrom suggested proper wording for the recorded easement description. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-109 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: August 18, 1976 Page 2 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received August 18, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; Lot area; Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and land- scaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment plan, if applicable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material pro- posed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and dev- ices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. An easement shall be recorded over the northerly fifteen (15) feet of the subject property and the southerly twenty (20) feet of the northerly lot to facilitate reciprocal ingress - egress for each lot. 2. The above condition shall require modification to the exist- ing curb cut to the north, with a standard drive width of thirty-five (35) feet for both lots. 3. The column supports for the canopy structure proposed over the front entry shall be set back a minimum of fourteen (14) feet from the front property line. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-110 (Cont. from 8-11-76) Applicant: Nick Becker To permit the construction of a 24,000 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordin- ance Code, located at the southeast corner of McFadden Avenue and Graham Street in a 100-M1-A-20,000, Restricted Manufacturing District. The Chairman informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Fred Mayer was present to represent the application. The Board reviewed the revised plan with the applicant. Mr. Mayer informed the Board of the changes he has made to his plan and also of his intention to pursue at the City Council level permission to retain one access point on McFadden Avenue. It was noted that the revised plan now does not provide adequate side yard set- back. ON MOTION BY PALIN AND SECOND BY LIPPS ADMINISTRATIVE REVIEW NO. 76-110 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received on August 18, 1976, shall be the approved layout, subject to the modification described herein: BZA 8-18-76 Page 3 Minutes, H.B. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; • Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A Tentative Parcel Map shall be filed, approved and recorded prior to issuance of building permits to readjust the soutl-erly property line of subject property to the south by an additional five (5) feet. 2. The above Tentative Parcel Map shall reflect the reciprocal easements over and across fifteen (15) feet of the south portion of the subject lot as well as over the northerly fif- teen (15) foot portion of the lot to the south for ingress and egress. 3. Should the applicant not be successful in obtaining deletion of the requirement for dedication of vehicular access rights on McFadden Avenue, the approved plan shall be revised to delete the driveway and curb cut on McFadden and provide for installation of landscaping at that location. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE USE PERMIT NO. 76-46 Applicant: Jansvu Properties, Inc. To permit the construction of a fifteen (15) unit apartment building pursuant to Section 9162.3.1 of the Huntington Beach Ordinance Code, located on the east side of Florida Street approxi- mately 660 feet south of Garfield Avenue in an R2, Medium Density Residential District. The Chairman informed the Board that Negative Declaration No. 76-72 was granted by the Environmental Review Board for this request on August 17, 1976. The Chairman opened the public hearing. Rick Annigoni was present to represent the application. Mr. Annigoni addressed the Board to explain that he has submitted two separate plans, to allow for the possible vacation of Florida Street presently under considera- tion by the City. There being no other persons to speak for or against the project, the public hearing was closed. The Board discussed the project, Secretary Palin noting that review of the revised plan showing the deletion of Florida is premature unless the Board desires to approve it subject to the vacation of that street. The relationship of this project to abutting commercial development was reviewed, as well as parking provided, ingress -egress to the site, on -site trees and landscap- ing. Board of Zoning Adjustments August 18, 1976 Page 6 ON MOTION BY ELLSTROM AND SECOND BY PALIN THE BOARD ADOPTED NEGA- TIVE DECLARATION NO. 76-72 BY THE FOLLOWING VOTE: AYES: PALIN, ELLSTROM, LIPPS NOES: N014E ABSENT: NONE ON MOTION BY PALIN AND SECOND BY LIPPS USE PERMIT NO. 76-46 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOW- ING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. The proposal is consistent with the City's General Plan of Land Use. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received August 12, 1976, shall be the approved layout if the proposed vacation of Florida Street takes place. However, should the City Council not concur in the vacation of Florida, the conceptual plot plan received and dated July 29, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: Traffic circulation and drives; Parking layout; Lot area; . Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. b. Rooftop mechanical equipment screening plan, if applicable. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. 3. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Depart- ment of Building and Community Development and shall be subject to approval by that Department. 4. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Florida Street shall be improved to the centerline of such right-of-way pursuant to the determination on the vacation by the City Council. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. The developer shall arrange for an onsite inspection by the Street Tree Superintendent prior to any grading work on the site, to make a determination on the health and locations of the existing trees and which ones can be retained. The masonry wall proposed along the northerly property line shall be constructed of maintenance -free, decorative masonry material similar in color to the wall proposed along the southerly property line of the commercial development. Said wall shall not exceed nine(9) feet in height from finished grade on the abutting property. 3. The security apparatus proposed shall be approved by the Fire Department and the Police Department prior to its installation within the complex. 4. The plan submitted to the Building Department shall reflect assigned parking. 5. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 6. All building spoils, such as unusable lumber, wire, pipe, apd other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 7. Natural gas and 220V electrical shall be stubbed in at the location of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. The structures on subject property, whether attached or det- ached, shall be constructed in compliance with the State acoustical standards set forth for all units that lie within the 60 CNEL contours of the property. The Chairman opened the public hearing. Rick Annigonni was present to represent the application. There being no persons present to speak on the project, the public hearing was closed. Secretary Palin reported that a request has been received from the applicant for a continuance of this item, to permit time to respond to staff concerns on the layout and access points on the project. ON MOTION BY PALIN AND SECOND BY ELLSTROM USE PERMIT NO. 76-47 WAS CONTINUED AT THE REQUEST OF THE APPLICANT TO THE MEETING OF AUGUST 25, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-29 Applicant: Mola Development Company To permit the creation of four (4) parcels of land from three (3) existing parcels pursuant to Section 9930.2 of the Hunting- ton Beach Ordinance Code, located on the west side of Alabama Street at the west end of Wichita Avenue in an R2-0-CD, Medium Density Residential, Oil, Civic District. The Chairman informed the Board that this project is covered by Notice of Exemption No. 76-12 issued by the Department of Environmental Resources on March 25, 1976. Vince Moretti was present at the meeting. The Board reviewed the suggested conditions of approval with the applicant, explaining the legal necessity for this procedure and the responsibility of the owner of the northerly parcels to install the required utilities for those lots. The applicant concurred with the conditions of approval. ON MOTION BY PALIN AND SECOND BY ELLSTROM TENTATIVE PARCEL MAP NO. 76-29 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 8-18-76 Page 9 Minutes, H.B. Board of Zoning Adjustments August 18, 1976 Page 10 CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on August 6, 1976, shall be the approved layout. 2. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 5. All utilities shall be installed underground at the time said parcels are developed. 6. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 7. A copy of the recorded parcel map shall be filed with the Planning Department. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-30 (In Conj'./AR 76•-105) Applicant: George Bach To permit the creation of a legal parcel per a previously recorded Record of Survey pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. The Chairman informed the Board that this request was granted Negative Declaration No. 76-69 by the Environmental Review Board on August 17, 1976. Noel Hart and George Bach were present to represent the application. Secretary Palin informed the Board and the applicants that no legal documents have been found severing the subject property from the property to the rear; thus, the application under review would create BZA 8-18-76 Page 10 Minutes, H.B. Board of Zoning Adjustments August 18, 1976 Page 11 an illegal forty-one 1,41) foot frontage on the arterial high- way, which would require action on a variance from the Planning Commission for the creation of this sub -standard frontage. The Board discussed prior divisions of land in the area (e.g., the creation of the Texaco location), the prior deeds, records of survey, and assessor's parcel numbers issued for subject site, and the proper procedures for staff and applicant to pur- sue. Secretary Palin requested that the applicant concur with a con- tinuance to permit research into the procedural steps and a review of the Map Act; an opinion will also be obtained from the Attorney's office in regard to the proper future action. ON MOTION BY LIPPS AND SECOND BY ELLSTROM TENTATIVE PARCEL MAP NO. 76-30 WAS CONTINUED WITH THE CONCURRENCE OF THE APPLICANT TO THE MEETING OF AUGUST 25, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-105 (In Conj./TPM 76-30) Applicant: Frank Gonzales & Associates To permit the construction of a 4,000 square foot automobile service center pursuant to Section 9450.5 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. The Chairman informed the Board that Negative Declaration No. 76-69 was granted for this request by the Environmental Re- view Board on August 17, 1976. George Bach and Noel Hart were present to represent the appli- cation. In view of the continuation of the Tentative Parcel Map filed in conjunction with this request, it was the consensus of the Board that review of the application should also be continued. Board of Zoning Adjustments August 18, 1976 Page 12 ADMINISTRATIVE REVIEW NO. 76-107 Applicant: Richard Darling To permit the construction of a 23,500 square foot shopping center pursuant to Section 9450 of the Huntington Beach Ordinance Code, bcated on the northeast corner of Bolsa Chica Street and Heil Avenue in a C2, Community Business District. The Chairman informed the Board that Negative Declaration No. 76--71 was granted for this request by the Environmental Review Board on August 17, f976. Richard Darling was present at the meeting. Points of access to the subject site were reviewed, as well as the relationship of this project to the Scandia park to the north. The applicant was informed of the thirty-five (35) foot required width on his drives, with radius return. Mr. Darling indicated that the five- foot utility easement across the north of the property would be located within the east -west drive; no access drive is provided immed- iately adjacent to the northerly wall separating this project from the mobilehome park. ON MOTION BY ELLSTROM AND SECOND BY PALIN THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-71 BY THE FOLLOWING VOTE: AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE ON MOTION BY LIPPS AND SECOND BY PALIN,. ADMINISTRATIVE REVIEW NO. 76-107 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received July 29, 1976, shall be the approved layout, as amended thereon and subject to the following: The plot plan submitted to the Department of Building and Commun- ity Development at the time of application for permits shall reflect an increased width for both drives to thirty-five (35) feet with a radius return. C. GENERAL CONDITIONS: 1. No structures or trees shall be placed within five (5) feet of the easement on the north property line; grass, shrubbery, or other landscaping may be placed within this area. The approval of this request shall include approval of the sign theme for the building signs as shown on the approved plot plan. Any future proposal for any freestanding signs shall be submitted to the Board of Zoning Adjustments for review and approval action. 3. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. In commercial and industrial projects, the "U" value of the structures shall offer the equivalent thermal insulation characteristics and may be calculated using ASHRAE methods. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 5. If on -site lighting is to be provided, the developer should consider the use of energy -saving devices, such as high pressure sodium vapor lamps, in the parking lot. AYES: PALIN, ELLSTROM, LIPPS NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-117 Applicant: J. Ward Dawson To permit the construction of four (4) single-family dwellings pur- suant to Section 9384.16 of the Huntington Beach Ordinance Code, located on the west side of 15th Street approximately 50 feet south of Acacia Avenue in the Townlot Specific Plan Area One, Section A. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Mel Hoeffliger and Sally Gipple were present to represent the appli- cation. The applicants submitted a slightly revised plan which provides a patio effect over the garage and increased the open space on the plan. The Board reviewed the revised plan and found it to be in conformance with code requirements. BZA 8-18-76 Page 14 Minutes, H.B. C. GENERAL CONDITION: 1. A maintenance easement shall be provided on adjacent properties where the buildings are constructed at zero common property lines. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. Rex Hoover was present to represent the application. The application was reviewed by the Board. The square footage of the units having ground floor living areas was reviewed, as well as the open area for such units required by code. Heights of stairs for adequate clearance to park cars in the garages will need to be indi- cated on the plans. The ease with which the ground -floor master bed- rooms could be converted to separate rentals was noted by the Board. The Chairman informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Charles Pancheri was present at the meeting. The Board reviewed the application and found it to be in conformance to code requirements. The applicant was informed of the pending code change to permit 25-foot turning radius for industrial develop- ments. Sterling Buck & Associates To permit the construction of a 5,700 square foot professional office building pursuant to Section 9430.2 of the Huntington Beach Ordinance Code, located at the southeast corner of Bolsa Avenue and Springdale Street in a C2, Community Business District. The Chairman informed the Board that this project is covered_ by Negative Declaration No. 75-16, adopted by the Board of Zoning Adjust- ments on April 9, 1976. Will Buck was present to represent the application. Secretary Palin reviewed for the Board's information several prior divisions of land and development proposals for subject property, noting that the present proposal does not conform to the original intent to provide for reciprocal easements across the northerly portion of the property for drive access which would minimize the impacts of this commercial development upon the abutting residential property. Mr. Buck reported that he had been unable to obtain the ease- ment from the neighboring owner; he also stated that his present plan would not require the easement. The Board discussed previous approvals and alternative methods of locating the building on the site. It was determined that the applicant should investigate prior commitments and the possibility of revising the plot plan. Walt Lipps presented two samples of roofing materials, both of which are satisfactory as far as the Building Department is concerned. A representative of the Ace Awning Manufacturing Company spoke in favor of the submitted materials. BZA 8-18-76 Page 20 Minutes, H.B. The materials shall be of a similar color to that which is being used on the coach roofs to assure continuity in design and appearance. b. The Department of Building and Community Development shall assure that the materials carry the same guarantee as the roofing material on the coaches. The request was reviewed by the Board, in particular the arrange- ments made to separate the carnival area from the general traffic pattern within the shopping center. Secretary Palin informed the Baord that a new location has been pro- posed at the intersection of Atlanta Avenue and Lake Street; the Board had originally approved the request to be located on Pacific Coast Highway. Board review found that the activity had not changed, with the exception that a condition providing for removal of the murals on the tent sides would no longer apply at the new site.
