Eadie To permit a two -lot division of land pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the southwest corner of Huntington Street and Springfield Avenue in an R2-0, Medium Density Residential District. Robert Eadie and Bill Reed were present at the meeting. Secretary Palin reported that an application is pending before the Planning Commission on this project and this request is to be referred to be heard concurrently with that application (C.E. 76-09). ON MOTION BY CROSBY AND SECOND BY PALIN TENTATIVE PARCEL MAP NO. 76-36 WAS REFERRED TO THE PLANNING COMMISSION MEETING OF SEPTEMBER 8, 1976, TO BE HEARD IN CONJUNCTION WITH CONDITIONAL EXCEPTION NO. 76-09, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE Minutes, H.B. Board of Zoning Adjustments September 1, 1976 Page 2 TENTATIVE PARCEL MAP NO. 76-30 (In Conj./AR 76-105) Applicant: George Bach To permit the creation of a legal parcel per a previously recorded Record of Survey pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the north side of Pacific Coast Highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-69. Secretary Palin reported that he has researched the code, and the applicant's appeal on this project would be directly to the City Council. No further information has been received from the applicant, and no one is present at this meeting to represent the application. He further stated that it appears that the lot split creating the sub -standard forty- one foot frontage was not a legal lot split. Pat Spencer noted the possibility that a lot might have been created of which the City has no record and expressed the need for a title report from the proponent. After further discussion, it was the consensus of the Board that the request should be continued and that the Secretary should contact the applicant in writing to outline the problems on this project. ON MOTION BY PALIN AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 76-30 WAS CONTINUED FOR THIRTY DAYS (TO OCTOBER 6, 1976) BY THE FOLLOW- ING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-105 (In Conj./TPM 76-30) Applicant: Frank Gonzales & Associates To permit the construction of a 4,000 square foot automobile service center pursuant to Section 9450.5 of the Huntington Beach Ordinnace Code, located on the north side of Pacific Coast Highway approximately 180 feet northwest of Anderson Street in a C2, Community Business District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-69. In view of the continuance of TPM 76-30, it was the consensus of the Board that this request also should be continued. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 76-105 WAS CONTINUED FOR THIRTY DAYS (TO OCTOBER 6, 1976) BY THE FOL- LOWING VOTE: BZA 9-1-76 page 2 1 Minutes, H.B. Board of Zoning Adjustments September 1, 1976 Page 3 AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE CONDITIONAL EXCEPTION NO. 76-40 (In Conj./AR 76-122) Applicant: James R. Belt To permit the elimination of the minimum landscaping require- ment per Section 9792.2 and minimum block wall requirement per Section 9534(b,e) of the Huntington Beach Ordinance Code, loc- ated at the northwest intersection of Crabb Lane and Liberty Avenue in an Ml, Light Industrial District. Chairman Crosby informed the Board that this request is a Categ- orical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. James Belt was present at the meeting. He addressed the Board in objection to being required to install landscaping and fencing which might have to be removed at a later date, noting that other developments in the area have minimal or no landscaping. There being no other persons to speak on this project, the public hearing was closed. Board discussion ensued. Pat Spencer reported that he has inves- tigated the court action, and that it was dismissed by the Court because of this present application on the property. The Board reviewed the intent of the prior conditions imposed upon the property, the history of use of said property by various persons, and whether or not said use had been abated in the past. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-40 WAS DENIED FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: REASON FOR DENIAL: Applicant has failed to demonstrate sufficient hardship to justify granting subject exception. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-122 (In Conj./CE 76-40) Applicant: James R. Belt To permit the establishment of an automobile and recreational vehicle storage yard pursuant to Section 9530 of the Huntington Beach Ordinance Code, located at the northwest corner of Crabb Lane and Liberty Street in an Ml, Light Industrial District. Board of Zoning Adjustments September 1, 1976 Page 4 Chairman Crosby informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. The Board reviewed with the applicant the code requirements for the proposed use in regard to setbacks, fencing and screening, and street improvements. Bruce Crosby reported that the Director of Public Works has been waiving the requirements for concrete sidewalks in this area. The applicant requested that the automobile storage be dropped from his application and the request reviewed for storage of recreational vehicles only. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-122 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received and dated July 12, 1976, shall be the approved layout, subject to the modifications described herein: a. The plan shall be revised to reflect the correct property line and the correct setback for the fence. A plan delineating said modification shall be submitted to the Department of Building and Community Development upon application for building permits. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; • Parking layout; . Lot area; . Lot width and lot depth; . Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. This approval shall be for the storage of recreational vehicles only, and shall not include approval of storage of any type of impounds or motorized vehicles. 3. The impound storage currently currently existing upon a portion of the subject property shall cease thirty (30) days from this approval date. BZA 9-1-76 Page 4 Minutes, H.B. Board of Zoning Adjustments September 1, 1976 Page 5 4. The existing fence shall be relocated to set back at the required ten (10) foot front yard setback from the front property line. 4. The area between the existing right-of-way and the fence shall be landscaped. 5. The applicant shall install street improvements in full compliance with ordinance requirements as determined by the Director of Public Works. 6. All applicable fees shall be paid prior to issuance of building permits. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-75. Ali Labib was present at the meeting and has received and con- curred with the suggested conditions of approval which were forwarded to him. ON MOTION BY PALIN AND SECOND BY CROSBY THE BOARD ADOPTED NEGATIVE DECLARATION NO. 76-75, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 76-32 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCELS FOR ANY PURPOSE: 1. The tentative parcel map received by the Planning Department on August 11, 1976, shall be the approved layout. A parcel map shall be filed with, and approved by, the Department of Public Works, and recorded with the Orange County Recorder. 3. Alhambra Street shall be dedicated to City standards at the time said parcels are developed. 4. Water supply shall be through the City of Huntington Beach's water system at the time said parcels are developed. 5. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcels are developed. 6. All utilities shall be installed underground at the time said parcels are developed. 7. Compliance with all applicable City Ordinances. 8. The property shall participate in the local drainage assess- ment district at the time said parcels are developed. 9. A copy of the recorded parcel map shall be filed with the Planning Department. 10. At the time said parcels are developed if the developer pro- poses to proivde air conditioning the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 11. At the time said parcels are developed all building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 12. At the time said parcels are developed natural gas and 220V electrical shall be stubbed in at the locations of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. Levinson To permit the construction of a single-family dwelling pursuant to Section 9384.16 of the Huntington Beach Ordinance Code, loc- ated at the northwest corner of 13th Street and Acacia Avenue in the Townlot Specific Plan Area One, Section A. The Chairman informed the Board that this request is a Categorical Exemption, Class III, California Environmental Quality Act, 1970. No one was present to represent the application. Board review found the request to be in conformance with appli- cable ordinance code requirements with the exception of provision for a twenty foot radius at the intersection of 13th and Acacia. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-127 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOL- LOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceputal plot plan and elevations received August 26, 1976, shall be the approved layout, subject to the modification described herein: The plan shall be revised to reflect a twenty (20)foot radius at the intersection of 13th and ,Acacia. A plan delineating said modification shall be submitted to the Department of Building and Community Development upon application for building permits. In its approval action, the board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; Lot area; . Lot width and lot depth; Type of use and its relation to property and improvements in the immediate vicinity; . Past administrative action regarding this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Department of Building and Community Development. In accordance with the City's standards and requirements, an additional two and one-half (2-1/2) feet of right-of-way on the alley shall be dedicated, and a twenty (20) foot radius at the intersection of Acacia Avenue and 13th Street shall also be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the Huntington Beach Fire Code. Plans for such systems and devices shall be submitted to the Fire Depart- ment and shall be subject to approval by the Departments of Fire and Public Works. 6. The developer shall participate in the local drainage assess- ment district. 7. All applicable fees shall be paid prior to issuance of build- ing permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Acacia Avenue, 13th Street, and the alley shall be improved to the centerlines of such rights -of -way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-35 Applicant: Allan Allbright To permit the creation of one parcel of land from two (2) existing parcels pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the northwest corner of 18th Street and Olive Avenue in an R3, Medium -High Density Residential District. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. No one was present to represent the application. Since State law re- quires that the applicant shall have received the suggested conditions BZA 9-1-76 Page 8 1 Minutes, H.B. Board of Zoning Adjustments September 1, 1976 Page 9 of approval and understood and concurred with said conditions, it was the determination of the Board that no action could be taken on this request at this time. ON MOTION BY SPENCER AND SECOND BY CROSBY TENTATIVE PARCEL MAP NO. 76-35 WAS CONTINUED TO THE MEETING OF SEPTEMBER 8, 1976, TO ALLOW THE APPLICANT TO BE PRESENT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. :df is
