Jackson To permit the construction of an additional single-family resi- dence on a site which contains an existing non -conforming dwelling pursuant to Section 9719 of the Huntington Beach Ordinance Code, located on the northeast corner of Memphis Avenue and Alabama Street. Secretary Palin informed the Board that a letter requesting with- drawal of this request has been filed by the applicant. ON MOTION BY PALIN AND SECOND BY SPENCER USE PERMIT NO. 76-48 WAS WITHDRAWN, AT THE REQUEST OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-129 Applicant: H. J. White To permit the establishment of a non-commercial horse stable pur- suant to Section 9631 of the Huntington Beach Ordinance Code, located on the south side of Warner Avenue approximately 120 feet west of Green Street in an R3, Medium High Density Residential District. Board of Zoning Adjustments September 15, 1976 Page 2 Chairman Crosby informed the Board that this request is a Categorical Exemption, Class I, California Environmental Quality Act, 1970. Secretary Palin reported that a letter has been received from the office of the City Attorney indicating that the administrative review appli- cation for this use is not necessary; it does, however, indicate that there are numerous violations on the site which will be handled by the Department of Building and Community Development. ON MOTION BY PALIN AND SECOND BY SPENCER ADMINISTRATIVE REVIEW NO. 76-129 WAS WITHDRAWN, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 76-50 Applicant: Faye B. Reid To permit the establishment of an industrial catering business in zan existing building pursuant to Section 9511.1(b) of the Huntington Beach Ordinance Code, located at the southwest corner of Graham Street and McFadden Avenue in a 100-M1-A-20,000, Restricted Manufacturing District. Chairman Crosby informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. The Chairman opened the public hearing. Faye Reid was present at the meeting and explained the proposed use to the Board. There being no other persons to speak on the project, the public hearing was closed. The Board reviewed the project, taking into consideration whether or not the use falls within the intent of the Ml-A District, the parking provided, restrictions on seating within the facility, and trash disposal on the site. ON MOTION BY SPENCER AND SECOND BY PALIN USE PERMIT NO. 76-50 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of oersons residing or working in the vicinity; b. CONDITIONS OF THE BOARD: 1. The conceptual plan received and dated September 1, 1976, shall be the approved layout. 2. This approval shall be for a take-out facility only, and no food shall be served on the premises. 3. No seating for the serving or consumption of food shall be provided within the facility. 'sterling Buck & Associates To permit the construction of a six (6) unit apartment building pursuant to Section 9162.3.2 of the Huntington Beach Ordinance Code, located on the west side of Torrey Lane approximately 500 feet north of Heil Avenue in an R2, Medium Density Residential District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-14, adopted by the Planning Com- mission on July 2, 1974. The Chairman opened the public hearing. Paul Lapoint was present to represent the application. The public hearing was closed. Bruce Crosby reported that the application is premature, as the map has not been recorded (Tract 8698), street sections shown are non-existent, and the map has not come back for its second plan check. It was the consensus of the Board that no action can be taken on this request until the parcel has been legally created by the map recordation. ON MOTION BY CROSBY AND SECOND BY PALIN USE PERMIT NO. 76-51 WAS CONTINUED INDEFINITELY, WITH THE CONCURRENCE OF THE APPLICANT, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE BZA 9-15-76 Page 3 Minutes, H.B. Board of Zoning Adjustments September 15, 1976 Page 4 USE PERMIT NO. 76-52 (In Conj./TPM 76-38) Applicant: Glenn Busby To permit the construction of a 180,000 square foot commercial center pursuant to Section 9472 of the Huntington Beach Ordinance Code, located on the southeast corner of Edinger Avenue and Goldenwest Street in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-84. The Chairman opened the public hearing. Glenn Busby, Donald Lynch, and George Ritzau were present at the meeting. Mr. Lynch explained the project and presented sketches of elevations and treatment of the major tenant for the center, Gemco department store. Mr. Lynch and Mr. Ritzau discussed various aspects of the proposal with residents of the adjacent area who were present in the audience; said aspects included heights and setbacks of the proposed structures, landscaping and screening for the site, heights of fencing, treatment of the trash enclosures, locations for loading zones, lighting for the area, grading and drain- age, and traffic generation and controls. The public hearing was closed. Board discussion ensued, centering on the traffic aspects at the intersection of Goldan,.aest and Edinger. The possibility was discussed of a joint effort by the City and the developer to install signaliza- tion and medians in the streets, in view of the contribution to the total traffic which this project would make. Mr. Busby indicated that it had been his understanding that City and State funds have already been allocated for this work; it was the consensus of the Board, however, that even if this were so a capital improvement program might be five or six years in the future, and the traffic impacts upon the area would make such a long delay in installing the medians very undesirable. Also, the Board reviewed signing for the center, the treatment of the flood control channel, and specific drainage patterns for the project site. The transmittal and recommendations from the Department of Environmental Resources were reviewed by the Board. ON MOTION BY PALIN AND SECOND BY CROSBY NEGATIVE DECLARATION NO. 76-84 WAS ADOPTED, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY PALIN AND SECOND BY CROSBY USE PERMIT NO. 76-52 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: BZA 9-15-76 Page 4 Minutes, H.B. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received September 1, 1976, shall be the approved layout. if In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: • Traffic circulation and drives; . Parking layout; • Lot area; . Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. The following plans shall be submitted to the Secretary of the Board: a. Landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works. Such plan shall incorporate trees of a minimum 15-gallon size within the three- and ten -foot landscaping strip along the south property line, said trees to be of species that will not be detrimental to the pools located on residential prcnerty adjacent to that property line. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 4. Fire protection systems, including automatic sprinkler sys- tems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or systems shall comply with the specifications of the Huntington Beach Fire Code. Plans for such systems and dev- ices shall be submitted to the Fire Department and shall be subject to approval by the Departments of Fire and Public Works. 5. The developer shall participate in the Orange County Sanita- tion District No. 3 Sewer Annex District. 6. All applicable fees shall be paid prior to issuance of building permits. B. TO BE COMPLETED PRIOR TO FINAL INSPECTION: It 1. Goldenwest Street and Edinger Avenue shall be improved to the centerlines of such rights -of -way. Said improvements shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and require- ments. If the City has not already scheduled the construction of the raised medians in Edinger Avenue and Goldenwest Streets, the developer shall participate in construction of said medians; the ratio of participation shall be as maybe deter- mined by the Director of Public Works. C. GENERAL CONDITIONS: 1. To assure that no direct lighting shall occur on abutting property, a lighting plan for the rear of the commercial project shall be submitted to the Department of Building and Community Development for review and approval prior to the issuance of building permits. 2. The flood control channel on the east property line shall be fenced according to City standards. BZA 9-15-76 Page 6 1 Minutes, H.B. Board of Zoning Adjustments September 15, 1976 Page 7 3. Parking for the facility shall conform with Article 979 of the code in regard to number, size, and turning radius for parking spaces. 4. A sign program for the project shall be submitted to the Board of Zoning Adjustments for approval prior to the issuance of permits for erection of any signs. The signs delineated upon the approved conceptual plot plan shall in no way authorize the issuance of such permits. 5. Drainage for the development shall be subject to the approval of the Department of Public Works, such drainage plan to take into consideration erosion and siltation control both during and after construction of the project. 6. The elevations submitted with the application shall be the approved layout for the Gemco facility. Elevations on the future commercial and office structures shall be submitted to the Board of Zoning Adjustments for approval prior to issuance of building permits for their construction, to assure similar colors and materials throughout the complex. 7. Reciprocal easements for ingress -egress and parking shall be filed with the City, approved as to legal form by the office of the City Attorney, and recorded prior to final occupancy of the first building within the complex. 8. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. In commercial and industrial projects, the "U" value of the structures shall offer the equivalent thermal insulation character istics and may be calculated using ASHRAE methods. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 10. Use of energy -saving lighting, such as high pressure sodium vapor lamps, should be considered in parking lots. 11. An on -site water utility plan shall be submitted to the Water Department for approval, said plan to be a minimum size of 24" x 36" with City of Huntington Beach tit -le block. When utilities are connected to Goldenwest and/or Edinger, the installation shall be timed and regulated to minimize the impact of the resultant traffic disruption. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-38 (In Conj./UP 76-52) Applicant: Glenn Busby To permit the separation of one parcel into six (6) parcels for com- mercial purposes pursuant to Section 9921 of the Huntington Beach Ordinance Code, located on the southeast corner of Goldenwest Street and Edinger Avenue in a C4, Highway Commercial District. Chairman Crosby informed the Board that this request is also covered by Negative Declaration No. 76-84. Glenn Busby, Donald Lynch, and George Ritzau were present to represent the application, and indicated their willingness to readjust the parcel map to eliminate corridors out to the arterials on some of the parcels. After discussion it was the consensus of the Board that designation of commor easements could not be made until the lot lines on the tentative map were adjusted, and the applicant requested a con- tinuance to permit those adjustments to be made. ON MOTION BY CROSBY AND SECOND BY SPENCER TENTATIVE PARCEL MAP NO. 76-38 WAS CONTINUED, AT THE REQUEST OF THE APPLICANT, TO THE REGULAR MEETING OF SEPTEMBER 29, 1976, BY THE FOLLOWING VOTE: AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE PLOT PLAN AMENDMENT NO. 76-7 Applicant: La Cuesta (7596) To permit an amendment to a previously approved plot plan by deleting the swimming pool and relocating the clubhouse pursuant to Section 9811.4 of the Huntington Beach Ordinance Code, located at the north- west corner of Newland Street and Ellis Avenue in an Rl-PD, Low Density, Planned Residential District. Chairman Crosby informed the Board that this request is covered by EIR 73-14, adopted by the Planning Commission on September 11, 1973. The Chairman opened the public hearing. Mike Jaeger was present to represent the application and addressed the Board to explain the reasons for the request. ON MOTION BY SPENCER AND SECOND BY PALIN PLOT PLAN AMENDMENT NO. 76-7 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The proposals as outlined on the above plot plan do not con- stitute an extensive change to the previously approved plot plan. 2. The changes delineated in the plan will reduce the noise impacts of the recreational facility upon the immediately ad- jacent buildings. 3. The changes will result in cost savings to future residents in the project. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated August 31, 1976, shall be the approved layout. AYES: PALIN, CROSBY, SPENCER NOES: NONE ABSENT: NONE TENTATIVE PARCEL MAP NO. 76-40 Applicant: RMG Engineering To permit the elimination of an existing lot line to create one (1) parcel pursuant to Section 9930.2 of the Huntington Beach Ordinance Code, located on the west side of Industry Lane approxi- mately 230 feet north of Research Drive in a 100-M1-A-20,000, Restricted Manufacturing District. Chairman Crosby informed the Board that this request is covered by EIR 73-16, adopted by the City Council on March 18, 1974. Bill Blakeley (RMG) and Mrs. Jesse Jones were present at the meeting, and indicated that they had received and concurred with the suggested conditions of approval. Secretary Palin noted that the parcel map has been filed to comply with conditions of approval on a prior application (AR 76-116). ON MOTION BY PALIN AND SECOND BY SPENCER TENTATIVE DARCEL MAP NO. 76-40 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: BZA 9-15-76 Page 9 Minutes, H.B. A parcel map shall be filed with, and approved by, the Depart- ment of Public Works, and recorded with the Orange County Recorder. 3. Chairman Crosby informed the Board that this request is covered by EIR 74-6. L. Darrell Rowe was present at the meeting. Board review found the request to be in conformance with code require- ments. Parking for the model site was discussed. ON MOTION BY PALIN AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-133 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. Spencer) To permit an annual swap meet to be held September 26, 1976, from the hours of 6:00 a.m. to 4:00 p.m., located on the Goldenwest College parking lot at Goldenwest Street and Edinger Avenue. The Board reviewed the proposed project. ON MOTION BY CROSBY AND SECOND BY PALIN SPECIAL EVENT NO. 76-28 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: 1. The project description and plot plan received September 14, 1976, shall be the approved project and layout. 2. The applicant shall obtain all necessary electrical permits. 3. An onsite inspection by the Fire Department shall be required prior to the event. 4. A certificate of insurance form shall be filed in the License Division of the Finance Department ten (10) days prior to the event.
