HomeMy WebLinkAbout1976-09-22MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Room B-8 - Civic Center 2000 Main Street Huntington Beach, California WEDNESDAY, SEPTEMBER 22, 1976 - 1:15 PM BOARD MEMBERS PRESENT: COPE, CROSBY, SPENCER CITY STAFF PRESENT: CHUCK BURNEY, FIRE DEPARTMENT REGULAR AGENDA ITEMS: CONDITIONAL EXCEPTION NO. 76-46 (In Conj./AR 76-135) Applicant: La Cuesta (Tract 7596) To permit the construction of four single-family dwellings having a three (3) foot overhang projecting six (6) inches into the required 30 inch setback along the side property line; to permit the construction of one single-family dwelling with a reduced front yard setback from 15 feet to 12 feet in lieu of Section 9103.1 of the Huntington Beach Ordinance Code, located on the northeast corner of Bolsa Chica Street and Pearce Street in an R1, Low Density Residential District. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The Chairman opened the public hearing. A representative of the developer was present at the meeting and explained the reasons for the requested exceptions. A gentleman in the audience asked for clarification on what was being requested. Upon being assured that the changes were all proposed within the project and would not affect the street or adjoining properties, he indicated that he had no further objection to the request. There being no other persons to speak on the proposed project, the public hearing was closed. The Board reviewed the request. John Cope noted that Lot 35, upon which the front yard setback is requested, is an odd -shaped parcel, that moving the unit back would create an unusable rear yard area, and that the exception would not be detrimental to surrounding properties. However, it was the consensus of the Board that no hardship existed, as the unit could be sited on Minutes, H.B . Board of Zoning Adjustments September 22, 1976 Page 2 the lot and still maintain proper setback; the eave overhang can be set back six inches on this minimal run without adverse effect upon the side elevations of the units. ON MOTION BY SPENCER AND SECOND BY CROSBY CONDITIONAL EXCEPTION NO. 76-46 WAS DENIED FOR THE FOLLOWING REASON, BY THE FOLLOWING VOTE: REASON FOR DENIAL: Applicant has failed to demonstrate sufficient hardship to justify the granting of this conditional exception request. AYES: CROSBY, SPENCER NOES: COPE ABSENT: NONE ADMINISTRATIVE REVIEW NO. 76-135 (In Conj./CE 76-46) Applicant: La Cuesta (Tract 7596) To permit a reduction of the six (6) foot high front yard fence set- back requirement from 15 feet to 6 feet pursuant to Section 9104.5.1 of the Huntington Beach Ordinance Code, located approximately at the northeast corner of Bolsa Chica Street and Pearce Drive in an Rl, Low Density Residential District. Chairman Crosby informed the Board that this request is a Categorical Exemption, Class V, California Environmental Quality Act, 1970. The request was reviewed by the Board. ON MOTION BY SPENCER AND SECOND BY CROSBY ADMINISTRATIVE REVIEW NO. 76-135 WAS APPROVED WITH THE FOLLOWING CONDITIONS BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan received and dated September 10, 1976, shall be the approved layout for the location of the front yard fence. AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE USE PERMIT NO. 76-53 Applicant: Stan Gerber To permit the construction of a six (6) unit apartment building pursuant to Section 9202.3.1.4 of the Huntington Beach Ordinance Code, located BZA 9-22-76 Page 2 Minutes, H.B. Board of Zoning Adjustments September 22, 1976 Page 3 on the east side of Cameron Street approximately 600 feet south of Slater Avenue in an R3, Medium High Density Residential Dis- trict. Chairman Crosby informed the Board that this request is covered by Negative Declaration No. 76-86. The Chairman opened the public hearing. Stan Gerber was present at the meeting. There being no other persons to speak in regard to the proposed project, the public hearing was closed. Board review of the plan with the applicant determined that the application is in compliance with code requirements except for the width of the drive, which Chuck Burney stipulated must be a minimum width of 20 feet. Construction will require the demolition on one small building on the site and the remodeling of an exist- ing single-family dwelling. The Board also reviewed parking and open space provisions. ON MOTION BY COPE AND SECOND BY CROSBY NEGATIVE DECLARATION NO. 76-86 WAS ADOPTED BY THE FOLLOWING VOTE: AYES: COPE, CROSBY, SPENCER NOES: NONE ABSENT: NONE ON MOTION BY COPE AND SECOND BY CROSBY USE PERMIT NO. 76-53 WAS APPROVED WITH THE FOLLOWING FINDINGS AND CONDITIONS, BY THE FOLLOWING VOTE: FINDINGS OF THE BOARD: 1. The establishment, maintenance, and operation of the use will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2. The granting of a Use Permit will not adversely affect the Master Plan of the City of Huntington Beach. 3. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan and elevations received and dated September 10, 1976, shall be the approved layout, subject to the modifications described herein: a. The driveway shall be a minimum width of twenty (20) feet for its total length. b. One open parking space shown at the front of the proposed project shall be moved to the rear of the property. A plan delineating said modifications shall be submitted to the Secretary of the Board. .If such plan complies with the modifications outlined by the Board, said plan shall be approved and made a permanent part of the administrative file. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; . Parking layout; • Lot area; • Lot width and lot depth; • Type of use and its relation to property and improvements in the immediate vicinity; • Past administrative action regarding this property. 2. A landscape and irrigation plan complying with Article 979 of the Huntington Beach Ordinance Code and landscaping specifications on file in the Department of Public Works shall be submitted to the Secretary of the Board. 3. In accordance with the City's standards and requirements an additional ten (10) feet of right-of-way on Cameron Street shall be dedicated. 4. Soil and compaction reports shall be submitted by a certified soils engineer. Said reports shall be submitted to the Department of Building and Community Development and shall be subject to approval by that Department. 5. Fire protection systems, including automatic sprinkler systems, standpipe systems, fire hydrants, fire alarm systems, and any other required fire protection and detection devices or sys- tems shall comply with the specifications of the IiuntinUton Beach Fire Code. TO BE COMPLETED PRIOR TO FINAL INSPECTION: 1. Cameron Street shall be improved to the centerline of such right-of-way. Said improvement shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. C. GENERAL CONDITIONS: 1. If the developer proposes to provide air conditioning, the insulation in ceilings and exterior walls shall be a minimum of R-19 and R-11, respectively. If no air conditioning is to be provided, the insulation in ceilings and exterior walls shall be a minimum of R-13 and R-7, respectively. 2. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an offsite facility equipped to handle them. 3. Natural gas and 220V electrical shall be stubbed in at the locations of clothes dryers, and natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. ON MOTION BY CROSBY AND SECOND BY COPE ADMINISTRATIVE REVIEW NO. 76-112 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOWING VOTE: CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The conceptual plot plan received September 10, 1976, shall be the approved layout. In its approval action, the Board of Zoning Adjustments considered the following issues relating to the conceptual plan: . Traffic circulation and drives; • Parking layout; • Lot area; . Said im- provements shall include curbs, gutters, sidewalks, paving, street trees, street lights, street signs, street drainage, and sewer and water main extensions, in full compliance with the City of Huntington Beach street standards and requirements. Board review found the plot plan to be in conformance with code requirements. John Cope expressed the need for elevations to be submitted for review which would provide some diversity in the street scene for these contiguous dwellings proposed on AR 76-114, 112, and 113. ON MOTION BY CROSBY AND SECOND BY COPE ADMINISTRATIVE REVIEW NO. 76-114 WAS APPROVED WITH THE FOLLOWING CONDITIONS, BY THE FOLLOW- ING VOTE: CONDITIONS OF APPROVAL: A. Jones To permit the construction of an 8,500 square foot industrial building pursuant to Section 9511 of the Huntington Beach Ordinance Code, located on the south side of Talbert Avenue approximately 170 feet west of Redondo Circle in an Ml, Light Industrial District. Chairman Crosby informed the Board that this project is covered by Negative Declaration No. 74-169, adopted by the Board of Zoning Adjustments on January 29, 1975. TO BE COMPLETED PRIOR TO ISSUANCE OF BUILDING PERMITS: 1. The plot plan and elevations received on September 13, 1976, shall be the approved layout.
